Abstract

Abstrak The aims of this research is to find the model of traditional tourism governance format so that it can be used as a benchmark in the development of village tourism or sustainable hamlet tourism by re-arranging regulations based on local wisdom that support traditional tourism. Another objective is to evaluate and refine the implementation of village regulations that have been developed and implemented in the village tourism domain to determine the extent of their implications on improving the economy of people in tourist villages. This paper is authored using a qualitative approach with the orientation of literature study as an employed strategy in this study. The literature study is used in social research methodologies to trace historical data, as is found in this study. The results showed that the development of rural tourism is able to minimize the potential of urbanization from rural to urban society caused by the ability of local people to create economic activities based on tourism activities (tourism economy) in rural areas. The productive power of local potentials, including the potentials of rural areas, can be encouraged to grow and develop by utilizing the resources owned by the village, so that it can be an effective instrument in encouraging the development of socio-cultural and economic fields of rural communities. Furthermore, efforts will be encouraged to conserve and empower the potential of local culture and local wisdom values that tend to be threatened with extinction due to the heavily globalized currents that have entered rural areas. In the development of a tourist village, certain guidelines are needed so that the impact of the development of tourism activities in each rural area can be controlled. Abstract

Standard clauses are made by business actors with the aim of efficiency and effectiveness. However, various problems arise from standard clauses made by business actors both producing goods and providing services. Standard clause is not prohibited if it pays attention to the balanced position of the parties, but conversely if it contains exoneration clause then this is categorized as null and void. Provisions on the prohibited standard clause are regulated in Law No. 8 of 1999 concerning Consumer Protection of Article 18. This study aims to determine the fulfillment of good faith principles in the preparation of standard clauses and identify the consequences of the agreement containing standard clauses that are not in accordance with the principles of good faith. The research method used is normative research using primary legal material from the Civil Code, Law No. 8 of 1999 concerning Consumer Protection and secondary legal materials in the form of reference books and articles in legal journals. The results obtained, the principle of good faith is regulated in Book III of KUHPdt article 1338 thus it must be concretized in the form of an agreement with a standard clause that provides a balanced position for the parties. If there is an exoneration clause, the standard agreement is categorized as null and void.

Abstract

ABSTRAK Perceraian di dalam sebuah perkawinan campuran adalah merupakan sebuah realitas, meskipun tujuan dari perkawinan adalah untuk membentuk rumah tangga yang bahagia dan kekal, namun karena pasangan suami istri masing-masing membawa kebiasaan, budaya dan hukum yang berbeda, sudah tentu sangat rentan akan terjadi persilisihan dan pertengkaran diantara mereka, sehingga dapat berujung pada perceraian. Akibat-akibat hukum dari perceraian ini bisa menyangkut tentang masalah perebutan hak pengasuhan anak, masalah hak-hak mantan istri atau suami, bahkan juga sampai pada masalah perebutan harta bersama. Artikel ini merupakan sebuah kajian hukum normatif dengan menggunakan pendekatan peraturan perundang-undangan dan pendekatan kasus. Permasalahan yang dibahas adalah mengenai : 1) bagaimanakah akibat hukum perceraian terhadap anak dalam perkawinan campuran, 2) bagaimanakah akibat hukum perceraian terhadap bekas suami/istri dalam perkawinan campuran , dan 3) bagaimanakah akibat hukum perceraian terhadap harta bersama dalam perkawinan campuran. Berdasarkan kajian dan analisis yang penulis telah dilakukan, dapat disimpulkan bahwa akibat hukum perceraian di dalam perkawinan campuran terhadap hak pengasuhan anak-anak ada pada si Ibunya /mantan istri dengan membebankan kepada bekas suami untuk memberikan biaya pemeliharaan terhadap anak tersebut sampai mampu untuk mandiri atau sampai berumur 18 (delapan belas) tahun. Disamping itu bekas suami juga diwajibkan untuk memberikan nafkah kepada bekas istri. Mengenai pembagian harta benda bersama yang diperoleh selama perkawinan , jika pasangan suami istri ini tidak memenuhi syarat untuk berkedudukan sebagai subyek pemegang hak milik atas tanah di Indonesia, dalam waktu satu tahun harus melepaskan atau mengalihkan hak milik atas tanahnya kepada pihak lain yang memenuhi syarat. Apabila hal ini tidak dilakukan, maka tanahnya hapus karena hukum dan tanahnya kembali menjadi tanah yang dikuasai langsung oleh Negara . Kata Kunci : Akibat Hukum, Perceraian, perkawinan campuran.

Abstract

This study examines the notaries’ liability in a copy of Identity Card (KTP) legalization according to its original form. This is grounded on the rampant of the Identity Card Fraud cases and that notaries are authorized to approve a letter in compatibility with the original form as stated in the amended Law of the Republic of Indonesia Number 2 Year 2014 on Article 15 letter (d). To examine the phenomenon, the author used normative research method supported by interview as the instrument used to collect the data. The legal theories used are the theory of legal certainty, legal protection, and legal accountability. The results indicate that notary is responsible for parties who are disadvantaged due to the validation of the fake KTP card only in case if the notary endorsed the copy of the KTP without seeing and comparing the original form of it or the Notary has known that the KTP is a fake or not valid yet to endorse. On the contrary, a notary is not liable for having legalized an original KTP, not a photograph/photocopy, looking like original until it is unknown that it is actually a fake.

Abstract

Abstak Artikel ini mengkaji konsekuensi hukum yang dimiliki oleh ahli waris dari pewaris pemegang Personal Guarantee. Konsekwensi tersebut adalah kewajiban melunasi hutang pewaris akibat dari Persoal Guarantee yang dibuatnya. Permasalahan yang dikaji adalah bagaimana tanggung jawab pemegang personal guarantee perseroan yang pailit di Indonesia dan Singapura. Selain itu juga kajian ini membahas bagaimana perlindungan hukum terhadap ahli waris dari pewaris pemegang personal guarantee pada perusahaan yang pailit. Kajian ini menggunakan metode yuridis normatif atau doktrinal, yaitu penelitian hukum dengan menggunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier untuk memperkuat fakta ilmiah. Temuan penelitian adalah bahwa Kondisi di Indonesia terdapat kurangnya perlindungan hukum bagi ahli waris yang diatur di dalam Hukum Perdata Burgerlijk Wetboek voor Indonesie (BW) dan khususnya UU Kepailitan, Di sisi lain aspek keadilan yang diterima oleh ahli waris pada saat pemberesan boedel pailit yang dilakukan oleh kurator, hal ini nampak apabila kurator juga mengeksekusi harta pribadi ahli waris pailit dan tidak dipisahkan dari harta peninggalan pewaris karena menanggung beban tanggung jawab sebagai pelaksanaan Kepailitan dimana ahli waris yang menjadi debitor pailit atas penggantian kedudukan pewaris Personal guarantee. Sesuai Pasal 1826 BW, mewajibkan adanya sitaan umum atas segala harta kekayaan ahli waris. Selanjutnya apabila ternyata harta peninggalan pewaris pemegang Personal Guarantee tersebut tidak mencukupi segala piutang kreditor, yang mengakibatkan harta pribadi ahli waris juga ikut menjadi boedel pailit. Di Singapura, ahli waris berkewajiban membayar hutang pewaris sejumlah harta yang diwariskan saja. Jika harta yang diwariskan tidak mencukupi dalam pembayaran hutang, ahli waris tidak berkewajiban melunasi kekurangan hutang tersebut sepanjang ahli waris tidak mengetahui perjanjian hutang tersebut. Namun jika ahli waris mengetahui perjanjian hutang yang dilakukan pewaris, maka ahli waris berkewajiban melunasi hutang yang ditinggalkan oleh pewaris. Kajian dalam rangka penulisan disertasi ini berekontruksi terhadap peraturan dan perundang-undangan tentang kepailitan di Indonesia khususnya yang berkaitan dengan ahli waris dan personal guarantee serta sebagai bahan referensi terhadap kasus kepailitan yang melibatkan personal guarantee dan ahli waris. Sampai saat ini belum ada penelitian serupa yang mengkaji tentang tanggung jawab ahli waris pemengang personal guarantee pada perusahaan yang pailit di Indonesia.

Abstract

Abstract This study aims to find and analyze legal aspects immovable as a fiduciary guarantee object. This study is a normative law by using four (4) approach: statutory approach, conceptual approach, an analytical approach and case approach. Collection and processing of legal materials both primary and secondary legal materials relating to the fiduciary. Furthermore, identified with the rule of law that is directly related to the formulation of research problems, from identification, systematization conducted research material has been collected. Descriptive analysis was then performed with a coherent explanation. The results of this study explained that with regard to the legal aspects of the object is not moving as fiduciary object can be categorized into 3 (three) period, namely a period before Law 4 of 1996 on Mortgage, the period after the enactment of Law No. 4 of 1996 on Mortgage, and the period after the Law No. 42 of 1999 on Fiduciary. The provisions concerning immovable object here is to accommodate the credit needs for building owners without rights on land where the building has a high economic value in accordance with the principle of horizontal separation. Abstract

This study aims to analyze the implications of the existence of the principle of recognition to the administration of village governance. The method used is normative method with juridical, statute, and doctrinal approaches. The principle of recognition brings the existence of the village to play an independent role in the administration of village governance and the affairs of the village while increasing the participation of the village community in realizing good governance. This principle of recognition is also an alternative in exploring the origin of the village in question, especially for villages that are beginning to forget their origins. Notwithstanding, basically the principle of recognition is recognizable as long as it is still alive and applies in the village concerned.

Abstract

Abstract This research was conducted in Lovina Tourism Area. The problems raised in this thesis are: 1) how is the pattern of the control and use of coastal land for tourism accommodation in Lovina tourism area Buleleng regency? 2) What is the legal protection of coastal land rights used for tourism accommodation in the Lovina tourism area of Buleleng regency? And the finding in the field the acquisition of that the existing land in Lovina tourist area which is located in Kalibukbuk village, dominantly controlled by local community. This study belongs to empirical law study. In the case of the utilization of the lands possessed by the right ownership rights, there is also a leased to a third party. The technique used in collecting data required in this research is interview, observation and document. The result of the research is The development of tourism in the Lovina area of ​​Kalibukbuk Village as the center of the Tourism Area that directly and indirectly affects the economic, social and cultural life of the community, and developments are included in the control and utilization of land in coastal areas and There are two kinds of legal protection, namely preventive and repressive law protection: Protection of repressive law against customary land in Lovina area is a form of legal protection that is done related to the dispute faced by its citizens through the settlement in the judiciary, In the protection of preventive law, to ensure legal certainty of state land and management rights, registration shall be made, as described in the Minister of Home Affairs Regulation No. 1 of 1977, so that the Right to Own, Use and Use Rights may be issued. Abstract

This study aims to determine the legality of credit agreement made with a guarantee of land and building proof of ownership of Letter C without the existence a Power of Attorney Charging Mortgage (SKMHT), Giving Deed Mortgage (APHT), and Mortgage Certificate (SHT). This study used a normative juridical research method with a statutory approach, conceptual and case. The credit agreement that has been made is stated and affects the law with the agreement that among the creditors (PNM) and the debtor (Komsatun) followed by the completion of the investment object, this was only in accordance with the 1320 Civil Servants Court. As for land and building of Letter C which was made as a courtesy agreement credit is displayed nothing happens and canceled as for law becase is not following madate paragraph 10 (3) UUHT, that letter C land to be used as a mortgage then the dependent can still be possible while giving it at same time with the process of applying for a land mortgage. Based on the result of the study, it can be concluded that the Credit agreement which made by the ownership of letter C of land and buildings guarantee without any binding for the notarial deed/PPAT in form of SKMHT, APHT, and SHT is official and binding according to law. Because of the credit agreement which already made according by agreement by the creditor (Bank PNM Ulam) and the debtor (Komsatun) followed by submission of money as an agree-ment project.

Abstract

Perkawinan ialah ikatan lahir bathin antara seorang pria dengan seorang wanita sebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Mahaesa. Salah satu akibat hukum dari perkawinan adalah terciptanya harta benda perkawinan yang terbagi menjadi harta asal atau harta bawaan, yaitu harta yang dipunyai oleh masing-masing suami isteri sebelum perkawinan. Harta bersama adalah harta kekayaan yang diperoleh selama perkawinan, tidak termasuk hadiah atau warisan, maksudnya adalah harta yang didapat atas usaha mereka atau sendiri-sendiri selama masa ikatan perkawinan. Konsep harta bersama merupakan harta kekayaan yang dapat ditinjau dari segi ekonomi dan segi hukum. Tinjauan dari segi ekonomi menitikberatkan pada nilai kegunaan, sebaliknya tinjauan dari segi hukum menitikberatkan pada aturan hukum yang mengatur. Harta bersama adalah harta yang diperoleh selama ikatan perkawinan berlangsung dengan tidak mempermasalahkan terdaftar atas nama suami atau istri
