Abstract

Abstrak Tanah adalah aset bangsa Indonesia yang merupakan modal dasar pembangunan menuju masyarakat adil dan makmur. Oleh karena itu, pemanfaatannya harus didasarkan pada prinsip-prinsip yang terkandung dalam pasal 33 (3) UUD 1945 serta Ketetapan MPR No. IX/MPR/2001 dengan prinsip keadilan dalam penguasaan, penggunaan, pemanfaatan dan pemeliharaan sumber daya agraria dan sumber daya alam, melaksanakan fungsi sosial, kelestarian dan fungsi ekologis sesuai dengan kondisi sosial budaya setempat. Penyelesaian sengketa tanah Lar dalam masyarakat sumbawa. Sehingga perlu penyelesaian dan perlindungan hukum terhadap keberadaan tanah Lar guna menjaga budaya dan eksistensi masyarakat Sumbawa, yang mayoritas adalah petani-peternak. Penelitian ini menggunakan pendekatan yuridis-sosio kultural. Masyarakat Sumbawa dengan nilai kearifan lokal yang dijiwai oleh “Adat Barenti ko Syara’, Syara’ beranti ko Kitabollah”. Nilai lokal masyarakt sumbawa belum terakomodir dalam regulasi terkai pengelolaan tanah Lar. Kedepan upaya optimalisasi atas fungsi Lar tersebut dengan mengedepankan pengelolaan atas unsur-unsur sumber daya peternakan secara efektif dan efisien, dapat mempercepat terwujudnya Masyarakat petani-peternak yang sejahtera, Mandiri dan Tangguh serta berdaya saing. Kata kunci: Lar, regulasi, masyarakat sumbawa, sejahtera Abstract The land is an asset of the nation of Indonesia which is the authorized capital of development toward a just and prosperous society. Therefore, its utilization should be based on the principles contained in article 33 (3) 1945 CONSTITUTION and statutes, the MPR No. IX/MPR/2001 with the principle of fairness in mastery, usage, utilization and maintenance of agrarian resources and natural resources, carry out social functions, sustainability and ecological functions in accordance with the social conditions of the local culture. Dispute resolution in the public land Lar sumbawa. So need a settlement and legal protection of the existence of the ground to keep the culture and the Lar of existence of society the majority are Sumbawa, farmer-breeders. This research uses a juridical approach to socio-cultural. Sumbawa community with the local wisdom values imbued by "Customary Barenti ko Syara ', Syara ' beranti ko Kitabollah". Local values celebrated by sumbawa has not terakomodir in the regulation of land management terkai Lar. The fore top optimization efforts by putting forward Lar function management over elements of the farm's resources effectively and efficiently, can accelerate the attainment of the Community farmer-breeders a prosperous, independent and tough as well as competitive power. Abstract

This study aims to analyze the criminal policy in the field of land against customary land conflicts and the criminal policy regarding efforts to overcome conflicts over customary land tenure. The method used is normative legal research with a statutory approach, a library approach, a case approach and a concept approach. The materials used are primary, secondary and tertiary data sources, and then analyzed using legal hermeneutic interpretation techniques. As a result of analysis, it shows that the Criminal Policy in the Field of Land Against Customary Land Conflict is the act of the perpetrators both individually and in groups can result in losses not harmonizing the local indigenous community, there is a criminal nature against the law so that there are perpetrators subject to criminal sanctions in the form of basic penalties namely; as regulated and threatened in Article 10 of the Criminal Code in the form of basic sentences namely the death penalty, imprisonment, confinement and fines and additional penalties for revocation of certain rights, the seizure of certain items and the announcement of a judge's decision. In conclusion, the criminal aspect in every customary conflict is always trailing because usually in customary conflict there are parties who force the will to intersect with customary issues so that they can disturb public order until there is a criminal nature against the law.

Abstract

Laut merupakan sumber daya alam (sda) untuk pengganti sumber kehidupan umat manusia di darat, yang mana sumber kehidupan manusia di darat keberadaannya dewasa ini sudah semakin menipis.Selain itu, laut beserta lingkungannya selain merupakan sumber daya alam, juga bermanfaat sebagai pariwisata khususnya pariwisata berupa wisata bahari.Wisata bahari di Bali utamanya di Desa Lembongan, Kecamatan Nusa Penida sudah mengalami kemajuan pesat yang banyak didatangi oleh wisatawan nasional /domestic maupun internasional. Potensi utama wisata bahari yang dikelola di Desa Lembongan, yakni : snorkeling, diving, surfing, pariwisata baik hotel, layanan wisata bahari dan penyewaan sepeda motor. Nusa Lembongan Bali, memiliki pantai pasir putih, tempat terbaik untuk wisata diving, snorkeling, surfing, fishing dan island trekking. Selain itu, wisata bahari yang dikenal di Nusa Lembongan, ada juga berupa hutan lindung, yang disebut sebagai Hutan Mangrove Nusa Lembongan. Selanjutnya, Perlindungan hukum terhadap lingkungan wisata bahari di Nusa Lembongan, dalam hal ini pemerintah telah menetapkan beberapa peraturan, baik bersifat nasional maupun lokal di Provinsi Bali, sebagai payung hukum atau yuridis dari pelaksanaan atau pengelolaan wisata bahari yang ada di Nusa Lembongan. Peraturan tersebut, antara lain : Undang-undang nomor 10 tahun 2009 tentang kepariwisataan; Undang-Undang No. 32 tahun 2009 tentang perlindungan dan pengelolaan lingkungan hidup; Peraturan Pemerintah (PP) Nomor 50 Tahun 2011 tentang Rencana Induk Pembangunan Kepariwisataan Nasional (RIPPARNAS) Tahun 2010 – 2025; Keputusan Menteri Kelautan dan Perikanan No. 24/KEPMEN-KP/2014 tentang Penetapan Kawasan Konservasi Perairan Nusa Penida Kabupaten Klungkung di Provinsi Bali; Perda Provinsi Bali No. 10 Tahun 2015 tentang Rencana Induk Pembangunan Kepariwisataan Daerah Provinsi Bali 2015 – 2029.

Abstract

Perjanjian nominee akan mempunyai kekuatan hukum bilamana di dalamnya ada unsur itikad baik dan diperjanjikan bahwa warga negara asing hanya dapat menguasai tanah hak milik secara fisik dan untuk jangka waktu yang terbatas misalnya untuk jangka waktu 25 tahun dan dapat diperpanjang untuk jangka waktu 20 tahun serta dapat diperbaharui lagi sehingga tidak untuk selama-lamanya sebagaimana jangka waktu dari tanah hak milik. Struktur perjanjian nominee yang benar adalah yang sesuai dengan sistem hukum pertanahan Indonesia yaitu perjanjian nominee yang di dalamnya tidak terdapat klausul yang menyatakan bahwa warga negara asing dapat menguasai tanah hak milik secara juridis atau tanpa batas karena hanya warga negara Indonesia yang boleh memiliki tanah hak milik, sesuai dengan ketentuan Pasal 26 Angka (2) UUPA. Dalam pembuatan perjanjian nominee yang baik dan benar harus ada itikad baik (good faith) dari para pihak sejak awal pembuatannya sampai penanda-tangan perjanjian nominee tersebut sehingga memenuhi ketentuan KUHPerdata. Perjanjian Nominee juga sebaiknya dibuat dengan transparan dan to the point.

Abstract

The Circular No. 5/SE-100/I/2015 dated January, 29th 2015 issued by the Ministry of Agrarian and Spatial Planning/Head of National Land Agency, gives order to all ranks of working environment of the Land Agency to use the computerized system in the service of land registration, as long as the facilities and infrastructures are adequate. The strategy is aimed at; easing the access to land registration services for society and modernizing the agrarian management and service, Spatial Planning, and Land service. This is due to some reasons, which also affects the Mortgage Right registration system which, according to respondents, more than one registration of deed of imposition of mortgage but still in one credit agreement, cannot be registered at the same time. This study is an empirical research or non-doctrinal legal research. With regard to this the present study examines implementation of Mortgage Right registration at the Land Office of Badung District based on a computerized system after the issuance of the Circular 5/2015, to identify the obstacles faced in registering Mortgage Right in that new system and to seek for solutions to solve it.

Abstract

Abstract This article aims at describing the role of Yayasan Karya Cipta Indonesia (YKCI) in copyright protection in Indonesia and the mechanism of royalty payment on Indonesian songs to the YKCI. Conceptual and statute approaches to legislation are the approach used in designing this study. Data were collected through library documentation. Data were analyzed qualitatively. The results show that YKCI's role as an administrator body in copyright protection is to collect royalties from parties that use songs or music commercially and help dispute resolution between creators, users or record producers of songs or music creations. Furthermore, the mechanism of royalty payments to YKCI shall be initiated by the authorization of YKCI by the creator or the copyright holder of the song, so on the basis of such power of attorney. Law Number 19 of 2002 on Copyright should be accompanied by the willingness and ability of the apparatus in enforcing it so that what to be achieved with the Act can be obtained. It is recommended that the government immediately issue provisions on the roles, duties and functions of the Copyright Council as well as the organic rules that explain the authority of YKCI which may be the appointment of the Director-General of Intellectual Property Rights (IPR) as endorsement of a collective society in order to attract royalties. Abstract

This research aims is to determine the basis for judges' considerations in ratifying the sale and purchase deeds based on the Debt Recognition Letter with Power of Attorney to pay off debts in the Decision of the Supreme Court No. 2290 K / PDT / 2012 which can be justified based on the prevailing laws and regulations and knowing the matters that need attention concerning the legal consequences of the deed of selling right for guarantee of Land Rights. This recent study uses a normative legal research method that examines and analyzes existing legal issues through existing legal sources and applicable laws and regulations. The results of this study found that the Judge's Consideration in the Supreme Court Decree No. 2290 K / PDT / 2012 which stated that Judex Facti was not wrong to apply the law, decided two legal actions of the plaintiff were legally valid and the legal consequences that occurred after the Supreme Court Decision No. 2290 K / PDT / 2012, then the creditor can have a Guarantee for Land Based on a Credit Recognition Letter made imperfectly (Authentic and Unilateral) on the basis of a Deed of Sale and Purchase without a number authorized by the Panel of Judges in the Decision.

Abstract

Abstrak Tujuan dari penelitian ini adalah untuk mengetahui tugas dan fungsi majelis pengawas daerah dalam menyelenggarakan pengawasan, pemeriksaan, dan penjatuhan sanksi terhadap notaris. Permasalahan yang dibahas pada penelitian ini adalah Tugas dan fungsi Notaris sebagai pengabdi masyarakat menjalankan sebagian tugas Negara dan karena itu sangat penting bagi para notaris di dalam memangku jabatannya untuk memberi pelayanan kepada masyarakat dan demi kepentingan masyarakat. Adapun hasil dari penelitian ini menyatakan bahwa Majelis Pengawas Notaris dapat melakukan tugas dan fungsinya secara berjenjang atau tidak berjenjang. Dalam kaitannya dengan penjatuhan sanksi, pemeriksaan dilakukan secara berjenjang, dimulai dari MPD, MPW, dan MPP, namun penjatuhan sanksi berupa peringatan lisan atau tertulis merupakan kewenangan dari MPW yang sifatnya final, dan penjatuhan sanksi berupa pemberhentian merupakan kewenangan dari MPP, dan Menteri Hukum dan HAM RI yang akan mengeluarkan Surat Keputusan pemberhentian. Kata Kunci: Notaris, Majelis pengawasan notaris Abstract The aims of this research is to know duty and function of regional supervisory board in conducting supervision, examination, and imposition of sanction against notary. The problems discussed in this research are the tasks and functions of the Notary as a servant of the community to carry out some of the tasks of the State and therefore it is very important for the notary in holding their positions to provide services to the public and for the benefit of society. The results of this study states that the Supervisory Board of Notaries can perform tasks and functions in stages or not tiered. In relation to the imposition of sanctions, the examination shall be conducted in stages, starting with the MPD, MPW and MPP, but the sanction of oral or written warning shall be the authority of the MPW which is final, and the imposition of sanctions in the form of termination shall be the authority of MPP, Human Rights which will issue a Decision Letter of dismissal. Abstract

ABSTRAK Perjanjian perkawinan yang dibuat sebelum atau pada saat perkawinan berlangsung sudah diatur dalam perundang-undangan, sedangkan perjanjian perkawinan selama dalam ikatan perkawinan belum diatur. Terhadap hal ini tentu diperlukan instrumen hukum agar dapat mengakomodir permasalahan yang terjadi, untuk itu harus direspon dengan ketentuan peraturan perundang-undangan yang mengaturnya agar menjamin adanya kepastian hukum. Mahkamah Konstitusi telah memberikan jalan keluar mengenai permasalahan ini atas gugatan yang disampaikan kepada mahkamah melalui putusan Mahkamah Konstitusi No.69/PUU-III/2015 yang secara eksplisif menyatakan bahwa perjanjian perkawinan dapat dilakukan selama dalam ikatan perkawinan bahkan dapat dilakukan perubahan atau dicabut sepanjang disepakati kedua belah pihak suami istri. Putusan tersebut dilandasi oleh pertimbangan hukum dimana pengaturan Pasal 21 Ayat (1), Ayat (3) dan Ayat (4) Undang-Undang Perkawinan (Undang-Undang Nomor 1 Tahun 1974) dinyatakan bertentangan dengan Pasal 28 H Ayat (4) Undang-Undang Dasar Negara Republik Indonesia Tahun 1645 terutama adanya pembatasan atau bahkan menghilangkan hak-hak konstitusional Warga Negara Indonesia yang melakukan perkawinan campuran dengan tetap mempertahankan kewarganegaraannya dalam hal memiliki Hak Milik / Hak Guna Bangunan atas tanah di Indonesia. Abstract

In Practice Financial Institutions and Financing Institutions operationally require another type of service, namely a guarantee facility. The guarantee itself in economy is divided into two broad lines that differentiate it, namely moving assets guarantee and immovable assets guarantee. The guarantee of immovable assets or land with all the objects attached to it is called mortgage, while for the guarantee of moving assets is regulated in Fiduciary Institutions. In Indonesia Fiduciary Institution already has its legal basis that is Law No.42 Year 1999 on Fiduciary. This research method combines between quantitative and qualitative research method to be used together in a research activity, so that it is obtained data that more comprehensive, valid, reliable and objective. Accordingly, this study will examine what is the rationale of making motorcycle as fiduciary and its implementation in the field. The regulation of Fiduciary Institution in the financing company is strictly regulated in the Laws number 42 Year 1999 on Fiduciary, is the transfer of property rights to the goods as a guarantee on the basis of trust, while the object itself remains in the hands of the owner. The implementation of imposition of motorcycle as a fiduciary at a financing company in PT.Adira Denpasar is an absolute requirement for the purpose of legal certainty that is expressly regulated in the credit agreement. This is because fiduciary security is very important for financing companies to counter the risks that may arise in the future as a result of lending by the company to the customer. Due to credit law without fiduciary in case of default at PT. Adira Denpasar, that credit without fiduciary carries a greater risk so that the legal consequences is apply that all existing and future moveable and immovable customer’s property become guarantee to debt payments. At PT. Adira Denpasar, applying prudential principles in every lending to customers by seeking guarantee or known as credit with guarantee, as one effort to minimize the risk of loss that will be suffered as a result the debtor cannot pay off the credit as agreed in the credit agreement.
