Abstract

Illustrations generated by artificial intelligence (AI), commonly referred to as Artificial Intelligence Generated Content (AIGC), have raised significant challenges in copyright law, particularly concerning originality, ownership, and enforcement. This study aims to analyze and compare the legal approaches of Indonesia and Sweden regarding the protection and enforcement of copyright for AI-generated illustrations. Employing a normative juridical-comparative method, the findings reveal that AI-generated illustrations do not qualify for copyright protection in either Indonesia or Sweden due to the inability of AI to satisfy the originality principle, which requires human creativity, and its incapacity to be recognized as a legal subject. In Indonesia, the Copyright Law (Law No. 28 of 2014) does not explicitly regulate works produced by AI. In contrast, Sweden has made significant progress by harmonizing its domestic regulations with the European Union’s AI Act, set to be fully implemented by 2026. As part of enforcement efforts, the national research body “AI Sweden” plays a pivotal role in exploring mechanisms for enforcing copyright over AI-generated illustrations. This study recommends revising Indonesia's Copyright Law to ensure relevant legal protection and develop effective enforcement mechanisms for AI-generated illustrations, aligning with technological advancements and the needs of the creative industries.

Abstract

Inheritance of shares in a Limited Liability Company is a form of legal transfer of rights that occurs automatically upon the death of the testator, as regulated in the Civil Code (KUHPer) and specifically in Law Number 40 of 2007 concerning Limited Liability Companies (UUPT). However, in practice, the inheritance of shares does not always run smoothly because it can cause problems, especially if there are objections from other shareholders who refer to the provisions in the Company's Articles of Association. This objection is often based on concerns that it will disrupt the stability and direction of the company's leadership. Therefore, it is important to examine in depth how the mechanism of inheritance of shares can still guarantee the rights of heirs without neglecting the continuity and business interests of the Limited Liability Company itself. This study uses a normative legal research method with a statutory and conceptual approach, and aims to collect and analyze relevant secondary data. The results of the study indicate that the inheritance of shares in a Limited Liability Company must be placed within a legal framework that not only respects the civil rights of heirs, but also takes into account the collective interests of shareholders and the sustainability of the company's operations as a whole. Thus, it is necessary to harmonize positive legal provisions and internal company practices to create justice and legal certainty for all interested parties.

Abstract

According to data from the Corruption Eradication Commission (KPK), Indonesia is currently facing a corruption crisis. Therefore, this study aims to offer a trilogy concept in combating corruption. It explores how transparency, accountability, and ethics are interrelated within the context of anti-corruption efforts. This research employs a normative method, specifically prescriptive-analytical, using a conceptual approach, legislative approach, and case study approach to assess the effectiveness of transparency, accountability, and ethics in eradicating corruption. The findings reveal that the implementation of transparency, accountability, and ethics as a trilogy in combating corruption in Indonesia remains ineffective. The study finds that the trilogy concept can become part of law enforcement if supported by the President as both the Head of State and Head of Government. Limitations: This research is limited to the discussion of transparency, accountability, and ethics in anti-corruption efforts. The author hopes that this study can raise awareness among the public, anti-corruption communities, and the younger generation about the dangers of corruption to Indonesia’s future. Contribution: Finally, this research is expected to contribute to the academic field by providing new insights in the study of corruption, law, politics, and public administration.

Abstract

The objectives of combating corruption as stipulated in UNCAC 2003 are to effectively and efficiently eradicate corruption, recover assets, and build international cooperation. None of the objectives are to punish perpetrators as severely as possible. The concept of deferred prosecution agreements is marked by a shift in the principle of combating corruption from primum remedium to ultimum remedium. Based on the background described above, several issues can be formulated as follows: 1) How are corporate corruption crimes regulated in UNCAC 2003 and Indonesian positive law? 2) How does the concept of deferred prosecution agreements serve as an effort to combat corporate corruption crimes? The type of research used in this study is normative legal research. The technique of legal material analysis applied in this study is legal interpretation. The results of this study show that the regulation of corporate corruption in UNCAC 2003 and Indonesian positive law can be seen in several provisions of UNCAC 2003, namely: Article 12 paragraph (2) letter c; Article 14 paragraph (1); Article 26; Article 46 paragraph (2); Article 51; Article 52 paragraph (2). Specifically regarding the regulation of corporate liability in Article 26 of UNCAC 2003, compared to the provisions in Article 1 number 3, Article 18 and Article 20 of the PTPK Law. The formulative policy of deferred prosecution agreements in criminal acts of corruption committed by corporations in the future (ius constituendum) with the concept of deferred prosecution agreements that can be accommodated for application in Indonesia must refer to the Indonesian legal culture based on the noble values of Pancasila and adhere to the trilogy of judicial principles: simplicity, speed, and low cost.

Abstract

Corporate criminal liability for environmental pollution presents an intriguing subject of analysis, particularly in the context of Indonesia’s small islands, which possess limited ecological carrying capacity and are highly vulnerable to environmental degradation. This paper aims to examine the forms of corporate criminal liability in cases of environmental pollution on small islands and to assess the extent to which legislation can effectively reach and bind corporations as subjects of criminal law. This study employs a normative juridical method, using statutory and conceptual approaches. The findings reveal that although corporations cannot physically commit acts themselves, liability can be traced through the actions of directors or individuals holding authority within the corporate structure (the directing mind). Furthermore, considering Indonesia’s geographic characteristics, it is essential to strengthen a legal framework that is responsive to the socio-ecological conditions of small islands, in order to promote corporate accountability and ensure sustainable environmental protection.

Abstract

Law Number 16 of 2019, concerning Amendments to Law Number 1 of 1974 concerning Marriage, changes the minimum age limit for marriage to 19 years for men and women as an effort to suppress and eliminate the practice of child marriage in Indonesia. In addition to changing the minimum age limit for marriage, the law also opens up the opportunity to apply for a dispensation to marry for those not yet 19. Several data collected show that the number of child marriages and marriage dispensations in Indonesia still tends to be high, and there is still inconsistency among judges in examining applications for marriage dispensations based on the Supreme Court Regulation concerning Guidelines for Adjudicating Applications for Marriage Dispensations. Therefore, this study aims to capture the conditions of child marriage and marriage dispensations in Indonesia, especially after the revision of the minimum age limit for marriage, as well as the effectiveness of law enforcement. The method used in this study is the normative legal research method, which traces primary legal materials and secondary legal materials, such as reports and journals related to child marriage. Based on the research conducted, several recommendations are given, including taking preventive measures against several main factors in the occurrence of child marriage, especially in provinces that are based on data including provinces with the highest percentage of child marriage, one of which is by recommending the local government to form regional regulations to prevent and overcome child marriage.

Abstract

This article examines the enforcement of spatial planning law by the Badung Regency Government in controlling the development of tourism accommodations within the beach border area of Pantai Bingin, Bali. It highlights the issue of illegal buildings that violate the Rencana Tata Ruang Wilayah (RTRW) and Peraturan Daerah, threatening the ecological sustainability of coastal areas and restricting public access to the beach. Using a normative legal research method with a statutory and conceptual approach, this article aims to analyze the effectiveness of existing law enforcement mechanisms and identify the factors hindering their optimal implementation. The focus of the study is directed at the implementation of spatial planning law enforcement by the Badung Regency Government through the application of the RTRW and Peraturan Daerah in the beach border area for the development of tourism accommodations at Pantai Bingin, Bali, as well as the factors influencing the effectiveness of local regulation enforcement officers in efforts to protect coastal areas. The findings of this research are expected to contribute to strengthening spatial planning law enforcement to protect coastal zones as sustainable public spaces.

Abstract

Land registration is a form of state service that aims to provide legal certainty and protection for landowners in Indonesia. This paper analyzes the legal protection granted to landowners through land certificates and evaluates whether such certificates can be classified as authentic deeds (akta otentik) under Indonesian civil law. The study uses a normative legal research method, employing both statute and conceptual approaches. The statute approach examines relevant legal instruments such as the 1945 Constitution, the Basic Agrarian Law (Law No. 5/1960), and Government Regulation No. 24/1997 on Land Registration in conjunction with Government Regulation No. 18/2021. Meanwhile, the conceptual approach explores the theoretical foundation of legal certainty, ownership rights, and the evidentiary power of written documents in civil law. The findings reveal that land registration is a systematic and continuous state obligation, which culminates in the issuance of a land certificate. This certificate functions not only as evidence of ownership but also as a tool of legal protection, especially when disputes arise. Furthermore, based on Article 1868 of the Indonesian Civil Code, land certificates issued by the Land Affairs Office fulfill the criteria of authentic deeds, as they are created by authorized public officials in accordance with statutory procedures. Consequently, land certificates possess the highest evidentiary value in civil legal proceedings. The research contributes to understanding the dual administrative and legal functions of land certificates, reinforcing their status as both proof of ownership and instruments of legal certainty.

Abstract

Danantara dalam perspeltif investasi memiliki kewenangan lebih luas karena tidak hanya mengelola aset tertentu, tetapi juga mengonsolidasikan aset-aset pemerintah yang tersebar di berbagai kementerian agar lebih terintegrasi dan efisien. Danantara sebagai Badan Pengelola Investasi (BPI) Indonesia menandai era baru dalam tata kelola investasi strategis nasional. Berdasarkan Undang-Undang Nomor 1 Tahun 2025 tentang perubahan ketiga atas Undang-Undang Nomor 19 Tahun 2003 tentang Badan Usaha Milik Negara (BUMN) serta diperkuat dengan Peraturan Pemerintah Nomor 10 Tahun 2025, entitas ini diharapkan mampu mengoptimalkan aset negara melalui skema investasi berbasis hukum yang kuat. model pengelolaan Danantara memiliki peran serupa dengan Indonesia Investment Authority (INA), secara kelembagaan yang memiliki fungsi untuk mengelola dan mengembangkan aset negara. Danantara apabila salah pengelolaan akan mengakibatkan Adanya restrukturisasi tenaga kerja yang menjadi bagian dari pembentukan holding dapat membawa potensi tantangan ketenagakerjaan yang kompleks. Penelitian hukum ini menggunakan jenis penelitian hukum normatif, Pembentukan entitas BPI Danantara dapat menimbulkan risiko birokrasi dalam perspektif Hukum Investasi, adanya Potensi praktik monopoli dalam sektor keuangan yang dapat menghambat kompetisi dan inovasi, akibat hukum apabila manajemen yang mengelola aset-aset strategis dalam super holding BPI Danantara tidak ditangani dengan baik Adanya restrukturisasi yang menjadi bagian dari pembentukan holding dapat membawa potensi tantangan ketenagakerjaan yang kompleks.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) have a strategic position as a form of business activities capable of expanding job opportunities, providing broad economic services, playing a role in the process of equitability and increasing community income, encouraging economic growth, and contributing to the realization of national stability. Despite having shown its role in the regional economy, MSMEs in Badung Regency still face various obstacles and challenges, both internal and external, which lead to a weak competitive edge compared to other business players. This research aims to analyze the problems faced by MSMEs and formulate efforts for empowerment and development of MSMEs in Badung Regency. The research results indicate that empowerment efforts to address the problems of MSMEs in Badung Regency include education and training for human resources related to access to financing, product development, and strengthening marketing networks. Development efforts for MSMEs are directed at micro enterprises with the aim of increasing their scale to small enterprises by increasing the percentage of entrepreneurs in Badung Regency.
