Abstract

Putusan Mahkamah Konstitusi No. 18/PUU-XVII/2019 tanggal 06 Januari 2020, merupakan sebuah putusan fenomenal yang menghapus kelembagaan parate eksekusi sebagaimana tercantum dalam Pasal 15 Ayat (2) dan (3) Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Terhadap putusan ini diajukan kembali oleh pihak ketiga dan diputus oleh Mahkamah Konstitusi dengan putusan No. 2/PUU-XIX/2021 tanggal 31 Agustus 2021. Kedua putusan tersebut mengeliminasi kedudukan parate eksekusi dalam Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Parate eksekusi merupakan legalitas yang dimiliki lessor dalam upaya melakukan eksekusi bila lessee wanprestasi. Kedudukan parate eksekusi sebagai pranata hukum jaminan pasca putusan Mahkamah Konstitusi merupakan permasalahan hukum dalam penarikan jaminan, yang secara yuridis belum dimiliki oleh lessee. Dari permasalahan diatas, maka tujuan dalam penulisan ini hendak mengkaji kedudukan parate eksekusi pasca putusan Mahkamah Konstitusi No. 18/PUUXVII/2019 dan No. 2/PUU-XIX/2021 terhadap hak eksekutorial lessor berdasarkan pranata parate ekekusi. Metode penelitian yang digunakan dalam penulisan ini adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Hasil penelitian menunjukan bahwa kedudukan parate eksekusi sebagaimana diatur Pasal 15 Ayat (2) dan (3) UndangUndang Nomor 42 Tahun 1999 tentang Jaminan Fidusia telah dieliminasi dan eksekusi jaminan harus berdasarkan kesepakatan dengan debitur yang telah mengakui wanprestasi atau mengajukan permohonan pelaksanaan eksekusi kepada Pengadilan Negeri.

Abstract

Abstract

This research aims to examine the Legal Protection for Cooperative Members in Standard Agreements on Digital Financial Services as well as the Legal Protection provided to Cooperative Members if there are problems with Digital Financial Services. The legal research method used by researchers is normative legal research. Normative legal research uses legal behavioral products, for example reviewing laws. The results of this research show that the legal protection provided to cooperative members regarding standard agreements is preventive legal protection, namely creating regulations in this case standard agreements and repressive legal protection aimed at resolving disputes arising from legal consequences. The legal remedies that can be taken are Litigation and Non-Litigation.

Abstract

Tourism business contracts in the digital era often trigger disputes. This is because the parties involved in the business contract are subject to different legal systems. Apart from that, contracts signed by the parties still contain clauses that contain multiple interpretations. Contracts that should become law for the parties actually become a source of dispute. This research aims to conduct a juridical study of multi-interpretation clauses in tourism agreements in the digital era. This research uses a normative method by examining statutory regulations, books, journals, and articles relating to tourism business contracts and multi-interpretation clauses. The research results show that the existence of multiple interpretation clauses in tourism business contracts can trigger disputes that hinder the development of the tourism industry. Therefore, efforts are needed to draft clear and firm clauses and pay attention to legal harmonization so that tourism business contracts can provide legal certainty and protect the parties involved.

Abstract

Abstract

Rapid advances in information technology have fuelled the emergence of digital currencies such as Bitcoin as an increasingly popular means of transaction in Indonesia. However, behind the convenience and speed offered, the use of Bitcoin also poses a high risk of fraud in online transactions. The main objective of this research is to analyse the nature of legal protection for Bitcoin users in Indonesia. This research applies normative juridical method with statutory approach, conceptual approach, case study analysis, and refers to legal protection theory, online transaction theory, and legal economic theory. One of the case studies studied is the High Court Decision 1240/Pid.Sus/2022/PN Tng which reflects the existence of a vacuum and vagueness of legal norms in the protection of Bitcoin users. The analysis shows that although Bitcoin has been regulated under the legal framework of digital asset trading, there are still inefficiencies in the application of legal protection in a comprehensive and effective manner. This research emphasises the need for more progressive regulatory reforms, as well as strengthening the role of law enforcement agencies and financial technology supervisors to ensure fair, certain and comprehensive protection for Bitcoin users in the territory of Indonesia. It is hoped that the results of this research can strengthen theoretical contributions in enriching the development of digital economy law and become a practical reference for policy makers.

Abstract

The implementation of the Job Creation Law has brought significant changes to the regulation of foreign investment in Indonesia, particularly through the establishment of a minimum capital requirement for a Foreign Investment Limited Liability Company (PT PMA) of IDR 10 billion. This study aims to examine the formal minimum capital requirements for PT PMA in notarial deeds under the Job Creation Law using normative juridical methods with statutory, conceptual, and case study approaches, and referring to the theory of legal certainty, responsibility, and legal protection. The analysis includes the evolution of PT minimum capital regulations, capital classification within the company's legal structure, the phenomenon of fictitious PT PMAs such as the PT BKG case, and the status and limitations of notary responsibilities. The results of the study indicate that although the minimum capital requirement for PT PMAs has been explicitly stipulated in Government Regulation No. 5 of 2021 and Regulation of the Head of the Investment Coordinating Board (BKPM) No. 4 of 2021, there are legal loopholes in the form of unclear capital deposit periods, weak verification and oversight mechanisms, and the prevalence of nominee practices and fictitious PT PMAs that reduce the effectiveness of the policy. The notary's position as a public official plays a strategic role in drafting deeds of establishment, verifying documents, and providing legal counseling, but has limited authority in verifying material truth. The study concluded that regulatory improvements are needed through establishing clear capital deposit periods, strengthening verification and oversight mechanisms, and harmonizing regulations between institutions to ensure the effective implementation of minimum capital requirements for foreign-owned companies (PT PMA) in accordance with the principle of economic sovereignty.

Abstract

Purpose:This study aims to juridically examine the suitability of using deeds under the hand as a legal basis in notarial practice and analyze the form of notary liability in the context of legal certainty.Methodology:The method used is normative legal research with statutory, conceptual, and case approaches. Data was collected through a literature study, interviews with five notaries, and analysis of three concrete cases, including case No. 616 K/PK/Pdt/2023.Findings: The results show that although the use of handwritten documents is still often encountered in practice, notaries are obliged to ensure the validity of the contents and identity of the parties before being stated in the authentic deed. Legal responsibility is attached to the notary both civilly, administratively, and criminally if there is an error or dispute due to the deed made. The unclear norms regarding the limits of the use of underhand documents show the need for legal clarity so that the deed made remains valid, strong, and does not cause legal loopholes.Implication Therefore, there is a need for legal reform to create clarity of norms regarding the limits of the use of underhand documents so that the deed made remains valid, strong, and does not cause legal gaps.

Abstract

This study is based on the increasing cases of socialengineering fraud in the banking sector that threatencustomer security. The urgency of this study lies in theneed to understand how the bank's precautionaryprinciple can be actualized to protect customers fromincreasingly sophisticated crime modes. The purpose ofthis study is to analyze the application of theprecautionary principle in customer protection effortsand to identify steps that can be taken by banks to reducethe risk of such crimes. The research method used is anormative method supported by empirical data. Empiricaldata were collected through in-depth interviews withbank management, namely at PT. Bank BRI DenpasarRenon Branch and PT. Bank BPD Bali Denpasar Branch.The results of the study indicate that although banks haveimplemented several precautionary principles, there arestill gaps in their implementation that can be exploited bycriminals. This study found that customer education andimproving digital security systems are important stepsthat need to be taken to strengthen customer protection.The output of this study is expected to provide practicalrecommendations for banks in optimizing the applicationof the precautionary principle and increasing customerawareness of the potential risks of social engineeringcrimes. In addition, the results of this study can also be areference for better banking policies in protectingcustomers in the digital era

Abstract

Tanah merupakan salah satu kekayaan negara Indonesia yang menjadi modal dasar agar kehidupan masyarakat dapat adil dan makmur, sehingga pemanfaatannya harus berdasarkan prinsip-prinsip yang tumbuh dan berkembang dalam kehidupan masyarakat Indonesia. Penelitian tesis ini menggunakan Penelitian Hukum Normatif yang menganalisis tentang pembatalan Perjanjian Sewa-Sewa Tanah yang dialihkan kepada pihak ketiga. Rumusan masalah dalam penelitian skripsi ini adalah apa akibat hukum yang timbul jika pembatalan dialihkan kepada pihak ketiga? dan bagaimana pembatalan Perjanjian Sewa-Sewa Tanah dialihkan kepada pihak ketiga berdasarkan Putusan Mahkamah Agung Nomor: 1616 K/PDT/2018? Sebagai alat analisis untuk membahas hal tersebut digunakan Teori Perjanjian dan Teori Kepastian Hukum, serta menggunakan Pendekatan Statuta, Pendekatan Analitik dan Konseptual, Pendekatan Kasus dan Pendekatan Komparatif. Kesimpulan dari penelitian ini adalah akibat hukum yang timbul dari pembatalan yang dialihkan kepada pihak ketiga yaitu Perjanjian yang menggunakan warga negara Indonesia sebagai Nominee adalah penyelundupan yang sah karena substansinya bertentangan dengan Undang-Undang Pokok Agraria (UUPA), dimana secara substansi ketentuan dalam Pasal 9, Pasal 21, dan Pasal 26 ayat (2) UUPA tidak dapat menyimpang. Pada hakekatnya perjanjian nominee bertujuan untuk mengalihkan hak milik atas tanah kepada pihak asing, sehingga keberadaan akta otentik perjanjian nominee sebagai alat bukti menjadi batal demi hukum
