Abstract

This paper contains a discussion of predisposition or contradiction in laws and regulations governing the crime of adultery with the implementation of abortion. Adultery and abortion are criminal acts that are victimless in nature or crimes with mutual agreement and without victims. In positive Indonesian law, adultery is only considered a criminal act when one or both of the perpetrators are married people or in our society it is known as an affair or gathering. kebo. This is very contrary to Islamic law and laws that live in society or customary law as stated in the Pancasila. As a result, a pregnancy outside of wedlock or an unwanted pregnancy may result from this adulterous relationship. When a pregnancy outside of marriage occurs, the psychological condition of both parties is disturbed and eventually not a few decide to take the path of abortion, especially teenagers, even though at the risk of losing their life. Even though by law abortion is allowed, but even then it must be subject to rules, conditions and supervision. strictly carried out by competent parties as designated by law. The formulation of the article on adultery in Indonesian legislation is still unclear, especially for the act of adultery committed by two men and women who are neither married to any party. However, sexual behavior is risky or between other pre-marital sexual behavior according to Article 11 of Government Regulation no. 61 of 2014 concerning Reproductive Health to prevent and protect adolescents from these acts because it is clear that they have a bad impact both physically and psychologically. This is where there is a conflict between Indonesia's positive law, namely between Article 284 of the Criminal Code and Article 11 of Government Regulation no. 61 of 2014 concerning Reproductive Health. Meanwhile, the adultery article as mentioned above has been clearly stated in Article 240 of the Draft Criminal Code, but so it has not been ratified for certain reasons. Among the efforts to prevent the crime of adultery and abortion is the enforcement of the substance, structure and culture of law in Indonesia.

Abstract

Perlindungan hukum dalam pelayanan jasa kesehatan bagi dokter dan pasien sebagaipihak dalam perjanjian terapeutik, menimbulkan hak dan kewajiban masing-masingpihak, pasien mempunyai hak dan kewajibannya, demikian juga sebaliknya. Metodeyang digunakan dalam penelitian adalah metode yuridis normatif. Hubungan antaradokter dan pasien di harapkan dalam penerapan hak dan kewajiban diantara keduanyaberjalan secara seimbangan, karena bagaimanapun Dokter tanpa adanya kerjasamayang baik dengan Pasien ,tidak akan membuahkan hasil yang maksimal, olehkarenanya hak dan kewajiban antara Dokter dan Pasien harus seimbang walaupuntidak harus sama. Dalam perjanjian terapeutik antara Dokter dan Pasien sering kali dijumpai adanya kasus- kasus yang seharusnya jika secara Preventif telah mengetahuihak dan kewajiban maka hal tersebut dapat dihindarkan.sebagaimana di atur dalam Undang-Undang Nmor 36 tahun 2009 tentang Kesehatan.

Abstract

It is still found that investigating officers do not have an S1 degree or equivalent in thejurisdiction of the Sambas Resort Police as mandated in PP No. 58 of 2010 concerningAmendments to Government Regulation Number 27 of 1983 concerning theImplementation of KUHAP article 2A paragraph (1) letter a. If the requirements ofinvestigators are not fulfilled, there will automatically be limits of authority, includingthe inability to issue investigation orders, detention warrants and other administrativeletters. This study used a qualitative method with juridical empirical research. Toobtain accurate data, purposive sampling technique was used, and primary datacollection by conducting in-depth interviews. The research results found, among others:first, discretion regarding the administration of investigations in the jurisdiction of theSambas Resort Police for the Sambas District Police who do not have investigatingofficers who meet the requirements, is then taken over by the Head of the CriminalInvestigation Unit as the supervisor of the integrated criminal investigation function.Second, the impact of an integrated investigation administration causes the time tocarry out investigations to be slow due to the long distance between the Sector Policeand the Resort Police.

Abstract

Social transformation, law, development and modernization involve human history. In this context, law in Indonesia is a cultural phenomenon and can be studied with the approach of cultural science, law and methodological tools. With its advantages and disadvantages, studies on social transformation, law, development and modernization towards progress and a better government order towards civil society. As the background of the Paradigm of Social Transformation, Law, Development and Modernization of Society, which is the discussion in this proposal, it is attempted to be able to distance itself from the attitudes Richard C. Martin called as fideistic subjectivism or scientific objectivity. More importantly, the side that portrays the side of the government towards the weak or the poor and becomes an important awareness that is critical of the existence of social transformation, law, development and community modernization.

Abstract

Indonesia is rich in diversity. The socio-cultural diversity in Indonesia is relatively abundant. This can be a strength, but at the same time it can also create friction ad conflict in the society. Recently, the government issued a Joint Decree of 3 Ministers (SKB 3 Menteri) in response to the friction. This decree organize dress procedures in the learning process at schools. As a result of this implementation, various responses emerged from the Indonesian people, either agreement or disagreement. Part of the society that may be relevant to this policy are students. This article will study the perspectives of undergraduate students of Bandung Institute of Technology (ITB), especially of the School of Architecture, Planning and Policy Development’s (SAPPK) on the Joint Decree. This article uses quantitative and qualitative methods by distributing questionnaires and interviews to SAPPK’s students. From the results of this study,  the researchers are able to see the perspectives and the trends of SAPPK ITB Students towards the SKB 3 Ministerial Policy as a solution to social issues related to diversity. It is hoped that these results can be used as a reference for campus policy makers in overcoming the same problem.

Abstract

Accountability in the implementation of local government to the environment in this study emphasizes the control of environmental pollution due to bird nest breeding. Theresults of this study are expected to provide a positive contribution in the developmentof legal science in the environmental sector and can also be a suggestion for structuringregulations in protecting the environment in Pinrang Regency. The form ofaccountability for the Pinrang Regional Government related to environmental pollutioncontrol, explicitly, the regulations regarding the use of swallow nests carried out by thepeople of Pinrang Regency do not have separate rules. This is because there has notbeen any discussion regarding the proposed special arrangements relating to theutilization of the swallow's nest in Pinrang Regency in the form of the Pinrang RegencyRegional Regulation. So that the form of controlling the swallow business follows theform of licensing in terms of trading business licensing. The accountability of localgovernments is hampered, in that it is not implemented in the form of an explicitarrangement regarding the use of swallow's nests, and the entrepreneurs of swallowbirds follow the designation in the area of Pinrang Regency. Thus, the implementationof the swallow bird business must comply with the existing regulations regarding thespatial plan for the Pinrang Regency area

Abstract

Penelitian ini bertujuan untuk mendeskripsikan dan mengeksplanasi realisasi DPRD insiatif DPRD Kabupaten Ponorogo di dalam fungsi legislasi periode Tahun 2014-2019, factor-faktor yang menghambat dan mendukung realisasi PERDA inisiatif DPRD Kabupaten Ponorogo, proyeksi kedepan DPRD Kabupaten Ponorogo dalam menjalankan fungsi legislasi tahun 2019-2024 terkait dengan obesitas peraturan. Penelitian ini mendasarkan pada metode pendekatan yuridis empiris. Oleh karena itu dalam penelitian ini lebih mengutamakan pada data primer yang dikumpulkan dengan wawancara dan observasi serta didukung data sekunder yang dikumpulkan dengan studi kepustakaan. Data dianalisis secara diskriptif kualitatif. Berdasarkan hasil penelitian ditemukan bahwa, realisasi dprd insiatif DPRD kabupaten ponorogo di dalam menjalankan fungsi legislasi periode tahun 2014-2019 tidak berjalan dengan baik. Faktor-faktor yang menghambat yaitu kualitas SDM, aspek partisipasi dan komunikasi, kemampuan dan minimnya tenaga pakar, berbenturan dengan undang-undang, anggaran. sementara itu faktor pendukung realisasi perda inisiatif dprd kabupaten ponorogo yaitu sarana dan prasarana, dukuangan stakeholder, proyeksi kedepan yaitu efisiensi dan efektif, tidak ada obseitas perda, penerapan tatib dprd, memperluas jangkauan fungsi penyerapan aspirasi masyarakat, mencipatakan budaya kerja yang baik dan meningkatkan kualitas sumber daya manusia.

Abstract

Dalam perkembangan ketatanegaraan pasca amandemen terhadap Undang-Undang Dasar NRI 1945, melahirkan lembaga-lembaga yang baru sebagai amanat dari konstitusi. Keberadaan DPD RI dalam pasal 22C UUD NRI 1945 merupakan bagain dari kelembagaan parlemen di Indonesia, tetapi Pasal 22D Ayat (3) UUD NRI Tahun 1945 bahwa hasil pengawasan DPD RI menjadi bahan pertimbangan DPR RI. Hal ini yang menjadi ketidakseimbangan kedudukan lembaga Negara di parlemen Indonesia. selain itu penafsiran terhadap pengawasan yang dimiliki DPD hanya terbatas memberikan pertimbangan. Sehingga pasal 249 ayat (1) huruf j Undang-Undang Nomor 2 Tahun 2018 tentang Perubahan Kedua Atas Undang-Undang Nomor 17 Tahun 2014 tentang Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, Dewan Perwakilan Daerah, dan Dewan Perwakilan Rakyat Daera hdalam rangka pengawasan perda oleh DPD RI hanya sebatas dalam bentuk rekomendasi. Sehingga kewenangan yang di miliki oleh DPD RI menjadi sub kewenangan DPR RI.

Abstract

Dokter merupakan profesi yang berada di garis terdepan yang berhadapan langsung Covid-19. Berjibaku dalam membantu kesembuhan Pasien Covid-19. AdakalanyaDokter harus mengorbankan nyawanya demi melindungi masyarakat dari persebaranCovid-19. Metode penelitian yang digunakan adalah yuridis normatif yuridis normatifyang bersifat deskriptif dengan pendekatan perundang-undangan dan pendekatankasus. Bahan hukum yang digunakan adalah bahan hukum primer dan sekunder, bahanhukum primer meliputi peraturan perundang-undangan dan dokumen medical recordpasien dengan gejala infeksi Covid-19 dan bahan hukum sekunder berupa jurnal-jurnalhukum yang berisi tentang referensi mengenai perlindungan hukum bagi Doktermaupun tentang virus corona. Hasil penelitian menyebutkan bahwa Standar ProsedurOperasional merupakan pedoman bagi Dokter yang harus dipegang dalam rangkamengemban tugas profesinya memenuhi unsur kehati-hatian, harus ditumbuhkan sikapsaling menghargai dan memanusiakan manusia melalui transparansi dalam Anamneseantara Dokter dan Pasien serta Medical Record sebagai media pencatatan riwayatkesehatan pasien Covid-19 merupakan dokumentasi yang penting sebagai obyek risetdan sebagai bahan referensi pengembangan ilmu kedokteran.

Abstract

This study aims to determine the implementation of the supervision of prisoners on parole by the Community Guide. This research used descriptive qualitative method with data collection techniques in the form of observation and supported by literature studies. A prisoner undergoing parole needs to be supervised to ensure that there is no violation of the provisions of the guidance contract agreed upon by the client and the community advisor at the beginning of the mentoring period. Community Advisors as law enforcement officials are tasked with carrying out this supervision. In its implementation, there are several obstacles experienced by community counselors related to the background and competence of officers, high workloads, and coordination between community counselors and law enforcement officials. Community involvement strongly supports the successful achievement of program objectives because parole is implemented in the community. Analysis of the needs of community counselors is also needed to increase the effectiveness and professionalism of officers.
