Abstract

The purpose of this research is to discover the mechanism of mCent Browser application in Islamic law. This research is conducted using library-researched study. The research information is compiled from the library information by reviewing and comprehending the things that are considered important related to the discussion. Furthermore, this researched is analyzed by the deduction method and theory of Ushul Fiqh. The result from this study is that the mCent Browser application is included as a buy and sell application which is not clear. There is a chance of speculation, as well as elements of fraud, that can evoke animosity between two parties that transact, or one party deceiving the other party, and this is forbidden by the Prophet Muhammad SAW.

Abstract

Arisan is a form of contemporary muamalah which basically consists of two functions, namely as a means for savings and accounts receivable debt. The arisan that develops in society today is of various forms and mechanisms so it is not uncommon for people to use arisan as a place for profit. This research was conducted to find out how the practice of arisan today, whether with the development of the current arisan model has the potential of riba in it. The research method used is library research, the discussion in this research uses descriptive qualitative analysis, then the data are analyzed to draw a conclusion. The results of this research indicate that the law of social gathering in Islam is basically mubah, but it is illegal when in practice there is a riba element namely the addition of the acquisition of each member who is not the same and has been determined at the beginning of the agreement. Found many elements of riba in the practice of arisan that developed at this time even with riba being a special attraction in the community

Abstract

The problem of marriage has become an increasingly complex problem. Starting from the many cases of early marriage that require carrying out marriages with mental and financial unpreparedness so as to cause bad consequences in the form of divorce. Until there is a case of delay in marriage carried out by people who are actually mentally and financially ready but consciously reluctant to carry out marriage. In fact, Islam has ordered for someone who has been able to carry out marriage so that it can channel sexual desire properly and avoid adultery. This paper will examine the cases of marriage delays that occur in many youths in Kasreman Village, Kasreman District, Ngawi Regency by using deductive methods. With this method it is known that there are 4 main factors that are the background to the occurrence of marriage delays, namely customs factors, economic factors, trauma factors and factors of lack of religious understanding. Once known the delay factor of marriage it will be easier to find ways in prevention.

Abstract

Agreements that are binding will result in certain laws that there will be prestasi and wanprestasi, dispute resolution of wanprestasi can be differentiated into two namely litigation and nonlitigation lines. The default settlement of Sharia banking products can be done by process with extension of credit term, reconditioning is by changing the requirements, restructuring by increasing the amount of credit, combination by combining the three and last collateral foreclosures. The basic provisions that can be learned from the Islamic law of wanprestasi is a legal event which is a form of offence if done with an element that is intentional or done because of negligence caused by overmacht (force majeure). The importance of adh-dhaman (guarantees) in the agreement, so that in agreements that have been approved by both parties there is no dispute. All losses either occur before or after the contract is then borne by the risk by the indemnified party. However, in terms of fiqh Islamist does not punish people who accidentally and do not want such negligent deeds, as long as the man has made the maximum to fulfill his achievements, and Islam appreciates the person who gives room in debt payments. In order to know how to respond to wanprestasi in Sharia business law, such as what Islamic law views wanprestasi and what needs to be done by Islamic Financial Institutions (LKS) when there is a wanprestasi, the author conducts a study on this to enrich knowledge related to the resolution of business disputes in sharia economy.

Abstract

This study discusses the waqf right of the fetus (janīn) in the context of Islamic law. Islamic law in this regard is the opinion of the most powerful jurists in the four best known sects (mażhab). Being something that is worth mentioning is due to the lack of human attention and the legality that surrounds it to the rights of janīn. This study aims to find out how Islamic law protects the rights of children in the content with the strongest opinions available. This research is a literature study by collecting data in classic jurisprudence (fiqh) books to find out the opinions and opinions of past jurists and other supporting articles, normative jurisprudence that seeks to extract values and norms from the opinions of classical jurists. or any of the arguments contained in the law, and uses a descriptive approach intended to illustrate in general the scope of Islamic law in relation to the rights of the janīn. This study of Islamic law produces the strongest opinions of any internal debate in a sect, and the most salient opiniono f all mażhab on a waqf right of the janīn.

Abstract

The purpose of this research is to determine the effect of emotional and spiritual intelligence on academic achievement of fifth grade students at Gontor, central campus. This research is survey research, where the total population is 720, and the sample is taken based on the table of the sampling requirements with an error rate of 10% n: 700 is 200 people. Based on the results of the analysis mentioned in the ANOVAb, which shows that the value of the 5th column F statistic, namely Fhit = 31.747, and p-value = 0.000 <0.05 or Ho is rejected. In the results of the significance test of the multiple correlation coefficients obtained from the Model Summary table, it can be seen in the first section that the multiple correlation coefficient (R y.12) = 0.494 and Fhit (F change) = 31.747, and p-value = 0.000 <0.05 or H0 rejected. While the coefficient of determination shown by R square = 0.244 indicates that 24.4% of variable variability of academic achievement (Y) can be explained by emotional intelligence (X1) and spiritual intelligence (X2), so it can be concluded that the influence of emotional intelligence and spiritual intelligence is together on student academic achievement of 24.4%.

Abstract

The purpose of this research is to find out how the form of discipline in the Islamic boarding school madrasatul Qur’an and how the strategy in the formation of a culture of discipline in the Islamic boarding school Madrasatul Qur’an. This study used a qualitative research method with research subjects, namely the head of the boarding school as the key informant and the student staff and stakeholders as additional informants. Research data obtained through observation, interview and documentation techniques. The technique of checking the validity of the research data was triangulation. Data analysis used is data collection, data reduction, data presentation and drawing conclusions. The results of the research that the researchers obtained in the formation of a disciplined culture at the Madrasatul Qur’an Islamic Boarding School were. 1) the leadership of the boarding school and internal organizations form discipline, namely by arranging activities in a systematic and directed manner, so that it is easy to control. 2) The strategy used in the formation of a culture of discipline is more effectively used, namely through moral education, exemplary leadership of the boarding school. Then, the intensity of the continuous interaction between the students and the board. There are rules and sanctions for students that are used to establish a disciplinary culture for students. To carry out these two things, the leader has an important role ini carrying out his duties and fuctions. Leaders must make subordinates aware of their duties and responsibilitional goals. In this case the leader must have the abality to manage an educational institution

Abstract

This study aims to optimize the competence of Islamic religious education teachers so that students can master the skills needed in the 21st century, namely critical thinking skills in solving problems,communicating, collaborating and leadership as well as being creative and innovative. In mastering these skills, there must be optimization of PAI teacher competencies, namely pedagogic, social, personality, professional and leadership. Qualitative approaches and types of literature research are used in this study, therefore, the data sources are taken from books, articles, journals and other documents. Research data were collected using documentation techniques, then analyzed by reading, understanding, examining, connecting and concluding. From this research, it can be seen that by optimizing the five competencies of Islamic Education teachers, the student skills needed in the 21st century will be easily achieved.

Abstract

This research aims at determining the process of management of literacy culture development at Early Childhood Education (PAUD) of Islamic Baby School Elmafaza. This research was qualitative conducted at Early Childhood Education of Islamic Baby School Elmafaza. Technique of collecting data applied observation, interview and documentation. Technique of data validity used triangulation. Technique of data analysis applied interactive analysis model encompassing data reduction, data display and conclusion.The results of this research conclude that the management of literacy culture at PAUD of Elmafaza is divided into three stages, starting from the planning stage which includes setting a large vision related to literacy. Then, it is followed by lowering the vision and mission of the institution into the school curriculum. The implementation phase includes: a) parents’ socialization, b) Reading Habits is getting used to 10 minutes for reading at school, c). strengthen the role and the function of the school library and book corner in each class, d). Book corner program at home, e). Home visit. It is the hospitality of Elmafaza teachers to the house to see the book corner at home and the programs that have been implemented, f) Organizing Seminars and Talk Show related to Literacy Culture, g). Literacy for children with special needs: stimulates reading to children with special needs, h). There is a teacher writing program that encourages and facilitates teacher writing i) joining Gernas Baku activities and, j) holding some literacy competitions, i.e., writing and telling stories. The evaluation phase includes supervision conducted by the school and sees the results of this literacy culture for children and the school environment. This literacy culture fosters eagerness or love of reading in students. This love of reading is very important because it becomes the basis for the development of one’s learning motivation.Learning motivation is the key to success in life.

Abstract

This research departs from academic anxiety that Islam has not been able to answer the main problems of Muslims, namely first, the intellectual movement to make the Qur’an as a guide for social ethics, second, affirm and integrate knowledge, intellectuality and spirituality of Muslims,third, provide improvement of the spread of intolerance, extremism, radicalism and terrorism,fourth, placing Islamic teachings and culture in the context of the life of the nation and state. The formulation of the problem in this paper is how to develop a moderate legal paradigm in Islamic boarding schools, especially in PPMI Assalaam, and how the influence of the development of Islamic law on the development of PPMI Assalaam as an educational institution in Indonesia. This research is a qualitative research with content analysis method. The results showed that the development of moderate Islamic law at PPMI Assalaam was based on five main values, namely sourced from the Qur’an and as-Sunnah, wasatiyah life attitude, tasamuh life attitude, love of the study of the yellow book, and fiqh muqaranah insight. Methodically, can use saddudz dzari’ah by prioritizing benefit and avoiding mafsadat. This moderate Islamic law approach is oriented towards the ideals of realizing akhlaqul karimah and rahmatan lil’alamin (spreading love for the entire universe).
