Abstract

The type of fintech peer-to-peer lending that has experienced the most growth in Indonesia is a type of financial technology that allows customers to get loans with simple, easy and fast procedures and does not require them to have collateral. But in reality, this fintech presents a very high credit risk. This is due to the efforts of fintech companies. as a coordinator when other financial institutions' standards are not met when evaluating buyers. Consequently, there is a need for preventive legal prescriptions and protection, especially for lenders. This is managed in the Financial Services Authority regulation Number.77.01.2016 regarding the implementation of information technology-based money lending and the Financial Services Authority regulation Number.1.07.2013 regarding Consumer Protection in the Financial Services Sector. Both of these regulations can be found on the official website of the Financial Services Authority (OJK). Lenders have sufficient legal protection thanks to these two POJKs, but additional legal protection is needed, particularly in the area of ​​credit risk reduction.

Abstract

The Makassar City Government has carried out government functions by demonstrating the realization of measurable programs and regulations in handling the Covid-19 pandemic in Makassar City. Several strategic steps have become examples for other local governments, such as procuring isolation places on ships in collaboration with PT—Indonesian National Shipping (Pelni) for Covid patients in the mild category. The level of legal compliance of the people in Makassar City in implementing health protocols as an Effort to Prevent and Control Corona Virus Disease in 2019, the majority are at the Compliance level (fulfillment of wishes) due to fear of being penalized. At the identification level, namely, compliance to maintain good relations with enforcement officials law enforcement, some of them have law enforcement relatives, and very few are at the level of internalization who comply with the rules because they know the purpose of the regulations for implementing health protocols and know the dangers of transmitting the Covid-19 virus. Factors that become obstacles in implementing health protocols in handling the Covid-19 pandemic are a) Community saturation factor. b) The inconvenience factor of using a mask. c) The factor of public knowledge of the dangers of Covid-19 is limited

Abstract

The role of children in narcotics crimes, namely as couriers for narcotics transactions, triggers a social phenomenon that strengthens because children are one of the next generations of the nation and are the foundation of their families and even themselves. Considering that there is a high rate of Narcotics crimes, especially the use of children as Narcotics couriers, this research aims to analyze the legal arrangements for children who become couriers in Narcotics crimes and criminal responsibility for children who become Narcotics police. This research is a normative legal research that relies on library research and uses other secondary legal materials. The data analysis used in this research is descriptive data analysis method. The results of this study indicate that for children who become Narcotics couriers in Narcotics crimes, these children can be referred to as falling into major criminal acts. Criminal responsibility for children who become Narcotics couriers and are caught in Narcotics criminal cases will first be assessed for the age of the child to determine the punishment he will receive because when the child is 12-13 years old, he will only be subject to sanctions while if he is 14-16 years old years shall be sentenced to half the maximum threat of adult punishment

Abstract

UUPA merupakan landasan yuridis bagi pengaturan permasalahan pertanahan di Indonesia. Hak Pengelolaan lahir dan berkembang sesuai perkembangan suatu daerah. Hak Pengelolaan (HPL) tidak diatur secara tegas di UUPA, hanya dalam penjelasan umum UUPA romawi II menjelaskan bahwa “negara dapat memberikan tanah kepada atau memberikannya kepada sesuatu badan penguasa untuk dipergunakan bagi pelaksanaan tugasnya masing-masing.” HPL lahir dan berkembang sesuai perkembangan suatu daerah, HPL merupakan istilah baru dan diterbitkan sebelum diberlakukannya UUPA. HPL pada dasarnya tidak dijelaskan secara tegas dalam UUPA, namun tersirat makna HPL di dalam Pasal 2 ayat (4) UUPA. Mengenai Hak Guna Bangunan (HGB), HGB diatur dalam Penjelasan Umum Angka II Nomor 2 UUPA. HGB merupakan hak yang diberikan kepada pemegangnya untuk membangun/mengusahakan tanahnya sesuai dengan peruntukannya. HGB dapat berdiri di atas tanah HPL dengan izin dari negara yang melimpahkan haknya kepada pihak lain. Dengan adanya pengaturan mengenai HPL dan HGB, HGB di atas tanah HPL dapat dijadikan jaminan utang, dimana HGB tersebut dijaminkan dalam bentuk Hak Tanggungan yang diberikan melalui Akta Pembebanan Hak Tanggungan (APHT). Pemberian hak tanggungan di hadapan PPAT tersebut harus dihadiri oleh debitur selaku pemberi hak tanggungan, dan kreditur selaku penerima hak tanggungan, serta disaksikan oleh 2 (dua) orang saksi.

Abstract

Intellectual property rights are rights that originated and are born from the creation of a creation. One form of intellectual property rights is copyright, and one form of copyrighted work is cinematography. Cinematography itself is protected by the rights contained in the copyright. Then, as the time evolves, technology also has a function that can distribute a work of cinematography, as for the creators, this also has a negative impact. Some problems that arise are related to the piracy of copyrighted works or the distribution of cinematographic works without a license or permission. Therefore, the author of the journal intends to discuss concerning the efforts that have been made through the existing legal provisions in Indonesia to protect cinematographic copyrighted works for unauthorized distributions, one of which is through Tiktok media. This research was conducted with normative juridical methods, namely conducting literature studies and studies through laws and regulations.

Abstract

Ujaran kebencian pula bisa dikaitkan menggunakan minoritas serta masyarakat adat, mempengaruhi satu komunitas tertentu serta mengakibatkan mereka sangat menderita sementara lain mengabaikannya. Hate speech tak sama menggunakan ujaran pada biasanya, meskipun ujaran kebencian mengandung, menyerang, serta mengobarkan kebencian. Perbedaan tadi terletak di maksud suatu tuturan untuk menyebabkan suatu akibat, baik langsung (aktual) juga tak langsung (berhenti pada niat). Terkait menggunakan permasalahan pada penelitianF, bagaimana pertanggungjawaban pidana individu anggota LSM, gerakan warga terhadap pelaku mengancam wartawan Indonesia melalui media sebagai akibatnya mengakibatkan rasa kebencian serta permusuhan terhadap suku, ras, agama serta antar group? (Nomor Keputusan Kajian: 175/Pid .Sus/PN Gdt)? Serta apa pertimbangan hakim pada memutus pelaku oknum anggota LSM, gerakan rakyat, bahwa Indonesia mengancam wartawan melalui media sebagai akibatnya menyebabkan kebencian serta permusuhan terhadap suku, ras, agama serta antargolongan (Studi Putusan No:175/Pid .Sus /PN Gdt)?.Metode penelitian dipergunakan pada disertasi merupakan pendekatan hukum normatif serta pendekatan empiris. Data sekunder merupakan data didapatkan menggunakan penelitian kepustakaan (library research), seperti literatur buku serta karya ilmiah perihal persoalan penelitian. Data sekunder terdiri dari 3 bahan hukum yaitu bahan hukum primer, sekunder serta tersier. Data primer merupakan data didapatkan menggunakan hasil penelitian lapangan langsung terhadap obyek penelitian (field research), dilakukan melalui observasi serta tanyajawab langsung terhadap obyek pada waktu penyusunan skripsi.Sesuai hasil penelitian bisa disimpulkan bahwa oknum anggota Gerakan warga Indonesia menuntut pertanggungjawaban pidana LSM mengancam wartawan melalui media serta mengakibatkan kebencian serta permusuhan terhadap suku, ras, agama serta antar golongan (Studi Keputusan No:175/Pid.Sus/PN Gdt merupakan terdakwa dipidana menggunakan pidana penjara 6 bulan serta denda sebanyak Rp10.000.000 serta pertimbangan hukum Majelis Hakim memutuskan Putusan No:175/Pid.Sus /PN Gdt, terdakwa sudah menandakan res judicata serta meyakinkan bahwa beliau melakukan tindakan pidana dimaksud pada Pasal 28(2) jo 45A(2) UU informasi serta Transaksi elektronika serta perbuatan memberatkan yaitu sebab terdakwa membangkitkan perbuatan menggunakan wartawan pada Kabupaten Pesawaran serta meringankan terdakwa mengakui serta menyesali perbuatannya. Terdakwa tak pernah dihukum, terdakwa serta korban berdamai sebelum persidangan, Terdakwa merupakan tulang punggung keluarga.Saran bisa diberikan pada penelitian merupakan warga sebaiknya lebih mampu menahan diri serta mengontrol untuk tak melakukan ujaran kebencian lagi sebab bisa mengakibatkan malapetaka di perbuatan kita lakukan sebab pula menyinggung suku atau ras tertentu dituding wajib tahu dilakukan, benar atau salah serta ada tidaknya dampak hukum. Serta usulan bagi aparat penegak hukum khususnya lembaga peradilan pada menanggulangi serta menjatuhkan perkara tindak pidana ujaran kebencian sangat perlu melihat kemaslahatan bagi warga serta memastikan putusan bisa diterima baik oleh terdakwa juga korban bisa membawa perdamaian. Serta perdamaian membangun kenyamanan bagi warga, tetapi kepentingan hukum lebih diutamakan.

Abstract

Sesuai dengan putusan MK Nomor 97/PUU-XI/2013, MK tidak lagi berwenang untuk menyelesaikan sengketa hasil Pilkada langsung, karenaPasal 236 C Undang-Undang Nomor 12 Tahun 2008 bertentangan dengan UUD Negara Republik Indonesia Tahun1945. Pasal 157 ayat (1) Undang-Undang Nomor 8 Tahun 2015 menentukan bahwa penyelesaian sengketa hasil Pilkada langsung menjadi kewenangan badan peradilan khusus. Namun sebelum badan peradilan khusus tersebut dibentuk, maka MK masih berwenang untuk menyelesaikan sengketa hasil Pilkada langsung. Kewenangan MK tersebut adalah kewenangan konstiturional yang bersifat sementara untuk mengisi kekosongan hukum (Rechtvakum). Oleh karena itu pembentuk undang-undang haru segera membentuk badan peradilan khusus yang mempunyai kewenangan untuk menyelesaikan sengketa hasil Pilkada langsung.

Abstract

The emergence of the phenomenon of illegal investment which is often associated with Ponzi schemes is an issue that deserves to be studied because it is very close to our surrounding life. The Ponzi scheme that is developing in Indonesia is actually not the same as investment fraud, but is the method used to carry out this crime. In its development, ponzi schemes have evolved into various forms of investment products. However, the ongoing developments in Indonesia have not been followed by the strengthening of regulations governing ponzi schemes. Therefore, there are obstacles in handling cases that use ponzi schemes as well as in ineffective prosecutions due to sectoral regulations used to prosecute ponzi scheme users.

Abstract

The purpose of this study is to analyze the validity of the SPKTNP without the SPTNP which has been regulated in the Customs Law which underlies the decision of the Supreme Court. The research is descriptive-analytical with a normative juridical approach. Collecting data by library or document study conducted by searching and studying and making an inventory of secondary legal documents or materials. As a result, the validity of the issuance of SPKTNP without SPTNP is regulated in Law Number 10 of 1995 Article 16 and its explanation which is closely related to Law Number 17 of 2006 Article 17 which is a re-stipulation. However, Article 16 paragraph (4) concerning the amount of the fine jo. Article 17 paragraph (4) which adds a fine from the construction of state administrative law is a positive fictitious decision considering that the function of government is active. Issuance of SPKTNP without SPTNP is a state administrative decision by Law Number 5 of 1986 concerning Administrative Court Article 1 point 3 jis Law Number 51 of 2009 concerning Amendments to Law Number 5 of 1986 concerning Administrative Court Article 1 point 9. The re-stipulation decision by the Supreme Court requires the issuance of the SPTNP before the issuance of the SPKTNP, then the Supreme Court did not defend the issuance of the SPKTNP without being preceded by the issuance of the SPTNP because it contradicted Article 17 jo. Article 16 of Law Number 17 of 2006 in conjunction with Article 7 of Law Number 12 of 2011 concerning the Establishment of Legislation.

Abstract

Penelitian ini bersifat normatif, dengan pendekatan menggunakan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum yang digunakan adalah primer dan sekunder, dimana Teknik pengumpulan datanya menggunakan studi kepustakaan dan wawancara. Bahan hukum yang telah dikumpulkan, dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa Postingan ujaran kebencian yang dilakukan melalui media sosial oleh FH dan RS sempurna sebagai tindak pidana karena memenuhi unsur Pasal 28 ayat (2) Undang-Undang ITE, sekalipun telah dihapus. Terpenuhinya alasan-alasan pertanggungjawaban pidana berupa sifat melawan hukum, kesalahan, kemampuan bertanggung jawab dan tidak adanya alasan pemaaf, sehingga FH dan RS dapat dikenakan sanksi pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp. 1.000.000.000, - (satu milyar rupiah) sebagai bentuk pertanggungjawaban pidananya.
