Abstract

The merit system intends to develop employee careers and also to reward the achievements of employees in carrying out their duties. This means that the merit system must be applied to all components or functions in ASN management. In this case the author will examine the Implementation of the Merit System in the Management of the State Civil Apparatus (ASN) and the Neutrality of ASN from Political Elements Based on Law Number 5 of 2014 concerning the State Civil Apparatus in the City of Ternate. In this case the author uses the juridical-normative legal research method. namely studying the law which is conceptualized as a norm or rule that applies in society, and becomes a reference for everyone's behavior.

Abstract

Foreign Direct Investment is an international capital flow where companies from one country establish or expand their companies in other countries. Therefore, there is not only a transfer of resources, but also the exercise of control over companies abroad. In Foreign Direct Investment there are parties who have legal relations. The party is the Multinational Corporation or Multinational Company and the Host State or host country. Foreign Direct Investment has benefits for the Host State, some of which are technology transfer, economic improvement, employment opportunities, foreign exchange reserves, and industrial growth. The purpose of this study is to analyze the implementation of the responsibilities of multinational companies in foreign direct investment and the responsibilities of multinational companies that violate investment agreements against national law. This research is a juridical-normative legal research with statutory and conceptual approaches. The sources of legal entities used are in the form of primary and secondary legal materials which are collected using inventory techniques and then analyzed normatively in order to interpret the law (interpretation). The results of the study found that the Implementation of Multinational Company Responsibilities can be seen in the Indonesian legal system which is regulated in Law Number 25 of 2007 concerning Investment, Law Number 40 of 2007 concerning Limited Liability Companies. According to Indonesian legal provisions, multinational companies that violate investment agreements against national law can be subject to sanctions. Sanctions can be in the form of criminal or administrative sanctions

Abstract

Rumah merupakan salah satu kebutuhan dasar setiap orang disamping kebutuhan akan pangan (makanan), sandang (pakaian). Di tengah lonjakan perekonomian tidak semua masyarakat dapat menempati rumah layak. Pemerintah dengan program sejuta rumah menyediakan fasilitas pembiayaan perumahan melalui metode Kredit Pemilikan Rumah (KPR) Subsidi bagi masyarakat berpenghasilan rendah (MBR). Pihak yang terlibat dalam pengajuan perumahan bersubsidi tidak hanya konsumen dan Bank Pelaksana, melainkan melibatkan perusahaan pembangunan perumahan atau yang dikenal dengan istilah developer. Konsumen akan melakukan akad (agreement) harus memenuhi tahap-tahap melalui permohonan kredit pemilikan rumah (KPR) Subsidi. Tetapi terdapatnya suatu permasalahan di lapangan seperti adanya kerusakan akan fasilitas, sarana dan prasarana hingga mengakibatkan pencemaran lingkungan. Metode penelitian berupa Yuridis Empiris dengan penelitian secara deskriptif melalui analisis data secara kualitatif. Hasil penelitian bahwa, tanggung jawab developer setelah akad (agreement) berupa bertanggungjawab dengan jangka waktu atas ketentuan Bank Pelaksana baik permasalahan pada bangunan, kerusakan sarana dan prasarana hingga utilitas terhadap kelengkapan fisik bangunan. Kendala baik eksternal maupun internal yaitu pasifnya konsumen dalam melakukan pelaporan atas kerusakan dan developer harus melakukan penyediaan dana lebih dan tenaga buruh untuk melakukan perbaikan atas permasalahan dari bangunan perumahan bersubsidi tersebut.

Abstract

The transition process in the process of buying and selling land requires the active participation of land buyers in the JKN-KIS program, so the buying and selling process will take quite a long time and seem complicated. The purpose of this study is to find out the legal consequences and obstacles encountered in implementing Circular Letter Number 5/SE-400.HK.02/II/2022 Ministry of Agrarian Affairs and Spatial Planning/National Land Agency in transferring land rights. This study uses empirical research using two research approaches, namely Sociology of Law and Legislation. The results of this study indicate that the implementation of the implicit law of Circular Number 5/SE-400.HK.02/II/2022 Ministry of Agrarian Affairs and Spatial Planning/National Land Agency in the transfer of land rights is a delay in the completion and ownership of documents. Certificates, lack of legal certainty, emergence of disputes between PPAT and BPN, violation of legal standards regarding the implementation of BPJS requirements and the effect of ineffective service processes and no relevant rights between BPJS ownership and registration of land ownership. . The obstacles faced were complaints from PPAT that not all customers were registered as active BPJS participants and there was an exception for land certificates of 25% because the buyer did not meet the requirements as an active BPJS participant.

Abstract

The phenomenon of gambling is nothing new in people's lives, from the past until now the practice of gambling has existed. In essence, this gambling is contrary to religion and decency, it is very dangerous for the life of society, nation, and state. But in fact, gambling is growing rapidly and is increasingly being carried out, either clandestinely or transparently, in a simple way or in a modern way. So, the role of the police is needed in dealing with this one social problem. This study discusses gambling that is rife in the Tanah Karo area. The increase in gambling that occurs from year to year, why can there be an increase whether it is the lack of education received by the public or the lack of firmness of the police in handling criminal acts of gambling. So, this study aims to discuss how the efforts made by the police in eradicating gambling in Tanah Karo and what obstacles the police have in handling criminal acts of gambling. Based on the objectives to be achieved, this study uses an empirical juridical method which reveals laws and regulations related to legal theories which are the object of research. The results of this study reveal how the efforts made by the Tanah Karo Police in acting against criminal acts of gambling in Tanah Karo, have they been efficient in reducing gambling cases in Tanah Karo.

Abstract

Bandar built village is one of the villages located in the Lubuk Kilangan sub-district, Padang, West Sumatra, Indonesia. Bandar Create Village is also a Village with potential in agriculture, plantations, animal husbandry, and trade in Lubuk Kilangan District, Padang City, West Sumatra Province. Associative causal research methods quantitative techniques. Data collection techniques with questionnaires. The population in this study were all RT, RW in Bandar Create Village, Lubuk Kilangan District, Padang City. With a total of 61 samples that are representative of the existing population. Data analysis used descriptive analysis, classic assumption test, and hypothesis testing. The results showed that the influence on the emotional intelligence variable (X) with Decision Making (Y) was 0.245 or 24.5% while the remaining 20.2% was influenced by other factors not included in this study.

Abstract

Customary land is one of the sources of agrarian conflicts that often occur in Indonesia. The government has attempted to resolve land disputes by involving the judiciary. However, the implementation of court decisions often does not meet the expectations of indigenous peoples, so the conflict continues. This study aims to analyze the implementation of court decisions on customary land claims in Indonesia. The method used is normative legal research with a case approach. This study uses secondary data from court decisions and related documents. The results of the research show that the implementation of court decisions on customary land disputes in Indonesia still faces various obstacles. Some of these obstacles include the ignorance of indigenous peoples about court decisions, the slow execution of decisions, and the lack of support from the government in enforcing court decisions. This study recommends the need for efforts to increase awareness of indigenous peoples regarding court decisions, accelerate the execution of decisions, and increase support from the government in enforcing court decisions. In addition, there is a need to formulate clear and firm regulations regarding the implementation of court decisions on customary land disputes in Indonesia.

Abstract

The problem studied in this final assignment islegal protection for third parties as buyers with good intentions for indicated abandoned land, so that it is known how the procedures for possession of abandoned indicated land are known, what are the legal consequences for land indicated as abandoned if it is sold by the right holder to a third party, and what is the legal protection for third parties as a willing buyer either on land indicated as abandoned. Based on this research, it was found that the government's authority regarding state rights in carrying out control of abandoned land is the duty and function of the Ministry of Agrarian Affairs and Spatial Planning/Head of the National Land Agency. Land becomes an object of abandoned land tenure if it is deliberately not cultivated, used and utilized in accordance with the purpose of granting the rights obtained. The process of controlling abandoned land is carried out in several stages, including: evaluation of abandoned land, notification, warning of abandoned land, proposal for designation of abandoned land if after the expiration of the third warning period the land remains abandoned, and determination of abandoned land which includes abolition of land rights, termination of law between land rights holders and their land, and affirmation that the land is directly controlled by the state. The legal consequences for third parties who acquire land through buying and selling plots of land that are indicated as abandoned are because there is no prohibition in the implementation of land registration, where the prohibition on legal action only applies to objects that have been proposed to be designated as abandoned land.

Abstract

Indonesia has abundant marine and fishery economic potential that can be managed and utilized for the welfare of the people and increase national economic growth, and potentially almost three quarters of the territory of the Republic of Indonesia is the ocean with all the sources of wealth contained therein. Nawacita Program His government said that Indonesia has the potential to become the world's maritime axis and the sea is the future of the nation towards a golden Indonesia 2045, to guard President Jokowi Nawacita world maritime axis, it is translated into 3 (three) missions, namely, first, Sovereignty, namely being independent in managing and utilizing marine resources. and fisheries by strengthening national capacity to enforce law at sea in order to realize economic sovereignty, secondly, Sustainability. Adopting the blue economy concept in managing and protecting marine and fishery resources responsibly with environmentally friendly principles as an effort to increase productivity, which is carried out through marine space management; management of marine biodiversity, three. Welfare namely managing marine and fishery resources is for the greatest prosperity of the people, which is carried out through human resource capacity development and community empowerment; and development of marine and fisheries science and technology innovations. As mentioned above, the independence of fisheries resource management is how the government enforces the law at sea even though the government has previously issued Law Number 31 of 2004 As amended by Law Number 45 of 2009 concerning Amendments to Law Number 31 concerning Fisheries which is a law enforcement regulation in the marine and fisheries sector which over time in 2020, the House of Representatives and the Government have issued and ratified Law Number 11 of 2020 concerning Job Creation which with the issuance of the Job Creation Act, there are several articles in the Law. -Law Number 31 of 2004 As amended by Law Number 45 of 2009 concerning Amendments to Law Number 31 concerning Fisheries, several changes have been made as well as in the Law on Marine and Fisheries Job Creation, ah sector whose management and utilization requires having a Business Licensing Risk Base Approach.

Abstract

This writing is meant to figure out how effective using Sipol is in the registration process for Candidates for the 2024 Election. The method used in this research is the library research method using laws and regulations and Bawaslu decisions as data material for research. The problems to be discussed in this study are (1). What are the obstacles in implementing Sipol in the registration process for Candidates for Election Contestants?, and (2). How effective is using Sipol based on Bawaslu Decision Number: 003/PS?REG/BAWASLU/X/2022? The results of this study are in the form of conclusions, namely (1). Obstacles in the implementation and use of Sipol come from HR factors, both HR from Political Parties as users of Sipol, factors from weak Sipol servers which often experience errors so they cannot be used optimally, as well as elements from the limited time in the process of using Sipol, namely at the stage of the verification process political party data, (2). The maximum effectiveness of the use of Sipol has not been achieved, it can be seen based on the Bawaslu Decision Number: 003/PS.REG/BAWASLU/X/2022, where the Republican Party was declared disqualified as a Candidate for the 2024 Election based on the KPU Decree which was caused by obstacles to the use of the Sipol application , The Bawaslu Adjudication Committee stated that technical problems in using Sipol should not occur because it is contrary to the principles of election administration including the principles of independence, honesty, fairness, legal certainty, orderly, openness, proportionate, professional, accountable, effective and efficient.
