Abstract

This research discusses the relationship between green open space (RTH) and good environmental governance (good environmental governance). Good environmental governance is an extension of good government, which refers to the principles of good governance in the context of the environment. The government's role in providing green open space that can be enjoyed by the wider community is closely related to public policy making. This public policy involves a policy-making process that leads to certain goals and involves steps taken by the government. Green open space has various benefits, both ecologically, socio-culturally, and aesthetically. Green open space provides comfort, improves the microclimate, increases oxygen reserves, and serves as a means of recreation, social interaction and regional identity. The existence of green open space is also important in maintaining a balance between the natural environment and the built environment in urban areas. In managing green open space, it is important to apply the concept of good environmental governance by taking into account the sustainability of natural resources. Environmental governance understands environmental management through interactions between the state and its people. Green open space management also involves the process of planning, utilization and control which plays an important role in forming a planned urban spatial layout. This study focuses on Karawang Regency, where there is an imbalance between the amount of green open space with public facilities and private buildings. Even though there is still empty land that can be used as green open space, its utilization has not been optimal. In the Karawang Regency strategic plan, an analysis of land use and green open space needs is carried out based on the area and population. Good green open space management efforts in Karawang Regency can help achieve good environmental governance and improve the quality of the environment and the quality of life of its people.

Abstract

This article will examine the Criminal Law loophole which can still be found in the qualification of the crime of, “having intercourse with a woman out of wedlock”. In Verdict Number 30/Pid.B/2017/PN.bdw the perpetrator of crime and the victim who are both adults and without marital ties have intercourse without coercion, threats of violence and/or violence in different private areas. The Bondowoso District Court judge sentenced the perpetrator to three years in prison with a subsidiary indictment of the Public Prosecutor, namely Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code in Verdict Number 30/Pid.B/2017/PN.Bdw. This article will examine the accuracy of Article in Verdict Number 30/Pid.B/2017/PN.Bdw which uses Article 5 paragraph (3) letter b of the Emergency Law Number 1 of 1951 jo. Article 289 of the Criminal Code regarding the criminal act of obscenity and to examine the application of Article 412 in the new Criminal Code no. 1 of 2023 for perpetrators of criminal acts in Verdict Number 30/Pid.B/PN.Bdw.The research uses normative juridical research with statute approach and a conceptual approach.The temporary conclusion of this article is that the act of two single adults who have intercourse with the promise of marriage is still not punishable by crime. Indonesia's positive law and criminal law reforms still have legal loopholes, so they require government regulations to regulate actions that are considered morally bad. Law enforces need to take a legal sources outside of the appropriate law to convict perpetrator of criminal acts are that unequaled in the Criminal Code to fill the legal vacuum so that it does not become arbitrary space for law enforcers.

Abstract

Penelitian ini bertujuan untuk mengetahui pertimbangan hakim dalam tindak pidana penggelapan dalam jabatan dan untuk mengetahui penerpan sanksi dalam putusan Nomor 90/Pid.B/2021/PN Bkt. Penelitian ini tertuju pada penelitian kepustakaan, mempelajari, mengkaji dan menjelaskan mengenai tindak pidana penggelapan dalam jabatan. Hasil dari penulisan ini menunjukan bahwa 1) pertimbangan hukum bahwa fakta-fakta dipersidangan sekaligus kesesuaian diantara keterangan saksi-saksi akan serta hal-hal yang meringankan dan hal-hal yang memberatkan akan mempengaruhi putusan Hakim. Dalam hal ini terdakwa Eka Sari panggilan Eka memang telah terbukti bersalah sesuai dengan pasal yang didakwakan oleh Jaksa Penuntut Umum. 2) Terkait pertimbangan hukum oleh hakim terhadap pelaku tindak pidana penggelapan dalam hubungan kerja, nomor putusan 90/pid.B/2021/PN Bkt. Ini masih kurang tepat, karena sanksi pidana yang diterima terdakwa belum sebanding dengan jumlah kerugian materil yang diterima oleh cv merapi argo sejati. Dengan kerugian materil yang mencapai Rp. 87.092.000,- (delapan puluh juta Sembilan puluh dua ribu rupiah) dan kerugian non materil seperti nama baik perusahaan yang sudah dinilai menurun sehingga membuat perusahaan tersebut tutup sementara.

Abstract

Drug abuse is a serious problem in society, especially among the younger generation. In law enforcement related to narcotics abuse, it is necessary to increase supervision and control in order to prevent and eradicate this crime. Decision Number 44/PID.SUS/2021/PN BTG is an example of drug abuse against recidivists. The research uses normative juridical research methods and a qualitative approach. The results of the study discuss the application of criminal sanctions for drug abuse recidivists in Decision Number 44/Pid.Sus/2021/PN The judge imposed a prison sentence of 5 years and a fine of Rp. 1,000,000,000. The evidence was confiscated and destroyed except for the returned motorcycle. Juridical, sociological, and philosophical considerations were used in the decision. The purpose of imprisonment is deterrent effect and protection of society. This decision reflects the judges' consideration of juridical, sociological, and philosophical aspects in applying criminal sanctions. Decision Number 44/Pid.Sus/2021/PN Btg against M. Wahyu Wijayanto Alias Anto Bin (Alm.) Kayun Wibowo shows that the defendant was legally proven to have committed the crime of being an intermediary in the sale and purchase of class I narcotics. The defendant admitted to abusing drugs twice in 2022. The judge sentenced the defendant to 5 years imprisonment and a fine of Rp 1,000,000,000, with the provision of 1 month imprisonment if the fine is not paid. The evidence, except for the motorcycle, was destroyed. The defendant is also required to pay court costs of Rp. 5,000.

Abstract

ETLE (Electronic Traffic Law Enforcement) is basically the result of technological developments that keep moving forward, which are then used in the framework of less traffic control. This is the same as digitizing law enforcement against traffic violations. With the existence of ETLE, of course the hope is that it can run effectively in order to create order in traffic for motorized vehicles. Based on this, it is worth exploring the implementation of ETLE implementation as well as the obstacles, to be linked to the effectiveness of the law. This research is an empirical juridical research, with a qualitative approach. The field study was conducted at Polretabes Surabaya. Sources of data are primary and secondary data, in which there are primary, secondary and tertiary legal materials. Collecting data using the method of observation, interviews, and literature study. Data analysis used descriptive analytical method. The results of the study show that the implementation of ETLE as mandated by the Law of the Republic of Indonesia Number 22 of 2009 concerning Road Traffic and Transportation begins with planning and ending with implementation. However, ETLE with CCTV cannot be implemented in the Surabaya area. In its implementation, discrepancies are still found that are contrary to the objectives and benefits of implementing ETLE. In addition, there are still obstacles in its implementation, which shows that the implementation of ETLE is still not effective.

Abstract

This paper aims to examine the potential for disputes in the problem of joint property in marriage. Normatively, both Article 85 KHI and 86 paragraph {1} KHI and Article 171 letter e KHI have the potential for turbulence of law which has implications for social turbulence which leads to legal uncertainty itself. This research is a literature study (library research) with the data analysis method used is content analysis. The results of this study indicate that the legal norms contained in Article 85 KHI and 86 paragraph {1} KHI, as well as Article 171 letter e KHI, basically require an agreement as a form of manifestation of separation, possession of marital assets and legal actions that can be performed each party over their respective assets without neglecting their respective obligations in marriage, so that with an agreement on marital assets, the clustering of assets controlled by each party both on innate assets, gifts, inheritance and assets acquired by each party during the marriage become a stressing point in minimizing the potential for disputes while at the same time providing legal certainty when disputes occur both during the divorce phase and the death phase of one of the parties

Abstract

This research is based on the fact that in Sempan Village there is have potential eco tourism for Bukit 7 Sempan which requires professional institutions. However, there is a void in the legal basis for the Sempan Village Government in creating institutional governance. This research was written using an empirical normative approach that relies on secondary data and primary data. The role of the village is part of the constitutional aspect because the village is an autonomous government unit. Village government is indeed a part that cannot be separated geographically because the village government area is also a regional government area. But uniquely, on the one hand, the village also always has its autonomy, namely in terms of controlling the village household and making village regulations. The village is a self-governing community, a form of autonomy from the Sempan Village Government in managing Sempan 7 Hill is by forming a Tourism Awareness Group (Pokdarwis). Efforts to guarantee legal certainty. By giving Pokdarwis legality, it will enjoy a position like other legal subjects.

Abstract

State institutions that exercise State power, especially in the field of prosecution, are called the Prosecutor's Office of the Republic of Indonesia. The Prosecutor's Office is a body that has authority in law enforcement and justice, the Prosecutor's Office itself is led by the Attorney General, the High Prosecutor's Office and the District Attorney's Office which is an integral and inseparable whole. The indictment for the Public Prosecutor is the basis for proving Juridical Analysis, filing charges and legal remedies by the prosecutor. The type of research used is empirical juridical, which is research oriented to data collection at the location. As for the results of research on the consideration of the public prosecutor in making charges, the first thing that is done is in terms of case files, case files from investigators that have been declared complete by the investigating prosecutor are poured into the form of P-21. In the sense that the case file is declared complete because it has met the formal and material requirements. The public prosecutor uses the alternative indictment i.e. first, second or third, The alternative indictment is made in the form of an indictment that includes two or more several Articles that are placed the word "or" indicating the nature of the alternative, the public prosecutor still doubts what type of crime is actually appropriate to be charged. And give the judge the opportunity to choose one of the charges filed in the indictment

Abstract

Sexual violence has become an urgent issue in Indonesian higher education institutions. The increased freedom and diversity in campus social interactions make students vulnerable to becoming victims. The rising number of reports and cases of sexual violence in universities has serious consequences for the victims and disrupts the academic climate and quality of education. Addressing sexual violence in higher education institutions poses unique challenges due to factors such as the lack of awareness about victims' rights, feelings of shame or fear in reporting incidents, and the potential intimidation from related parties, which often hinder law enforcement efforts. Therefore, enforcing laws against sexual violence in university settings becomes crucial. This research employs a normative juridical method with a qualitative approach. Data is collected through library studies and research on relevant literature and documents. The research aims to describe the symptoms of sexual violence in higher education institutions and identify law enforcement and prevention efforts that have been implemented.As a step to address sexual violence in higher education institutions, on May 9, 2022, the President of the Republic of Indonesia approved Law No. 12 of 2022 on Sexual Violence Criminal Acts. Additionally, the government has issued Minister of Education, Culture, Research, and Technology Regulation No. 30 of 2021 concerning Prevention and Handling of Sexual Violence in Higher Education Institutions.Preventive and handling efforts for sexual violence are conducted by establishing task forces in universities, formulating prevention and handling guidelines, providing training and socialization on gender equality and sexual health education, as well as offering reporting services for sexual violence. With effective implementation of these laws and policies, it is hoped that sexual violence in higher education institutions can be minimized, ensuring a conducive learning environment and providing positive impacts for the entire academic community.

Abstract

Indonesia as a developing country continues to strive to advance its resources, especially technology in the field of communication, becoming one of the rapidly growing and accepted fields in human life. convenience for their lives, especially with the internet media in it. The internet not only has a positive impact but also has a negative impact. One of the negative impacts that is happening and is currently rife among the public is online gambling games. The problem approach used in this study is a normative juridical approach. The approach taken is an approach on matters of a juridical nature which uses legal materials such as laws, books, related journals. The ITE Law in Article 45 paragraph (2) and also Article 27 paragraph (2) will only serve as objects used to ensnare gambling which has been explained by Article 303 of the Criminal Code in electronic media. So that the point of reading the sentence regarding gambling is in Article 303 of the Criminal Code. It is not enough to carry out the activities, but all of them must be supported by the inner attitude of the perpetrators themselves. Where in Article 303 of the Criminal Code it is explained that the inner attitude of the perpetrator must be "deliberately". The doctrine of mens rea is referred to as the basis of criminal law, in practice even added criminal liability may disappear if there are conditions that forgive. This later must be considered when asking for criminal liability for link spreaders that contain gambling content.
