Abstract

Fraudulent investment is a form of crime where a certain amount of money is asked to invest in a product or business that does not ictually exist. Business in Indonesia is currently experiencing rapid development following the digital era, namely by utilizing technology to simplify the transaction process. The Indonesian financial services industry has utilized facilities called fintech. Companies and individuals also experience convenience in their business because they are assisted by fintech technology. However, in practice there are still many companies that use technology for illegal business, especially in the field of fraudulent investment with various kinds of schemes. The conditions for imposing criminal responsibility on perpetrators of online fraud are that all elements of the criminal act are fulfilled and the purpose of the act can be proven. This was done deliberately with awarenessm that the act would be condemned by law. To determine criminal responsibility for criminal acts of online buying and selling fraud, you must refer to specific laws, because to avoid misinterpretation if using conventional evidence and avoid the emergence of other interpretations, and there needs to be an understanding from law enforcers regarding the expansion of the evidence. In order to avoid misunderstandings, to have the same thoughts about the value of the evidentiary power of electronic evidence contained in the ITE Law.

Abstract

This research is motivated by the lack of optimal eradication of criminal acts of corruption in Indonesia, which is indicated by data showing that the value of state financial losses in criminal acts of corruption that have been handled cannot be recovered by law enforcement. This issue is a challenge in eradicating criminal acts of corruption, not only imprisoning the perpetrators of corruption but more than that, how to confiscate the assets of the perpetrators of corruption as far as possible and return them to the state. Based on data released by ICW, the handling of criminal acts of corruption has not been followed by optimal asset recovery, including that carried out by the Prosecutor's Office. Using empirical juridical methods, this research concludes that the Prosecutor's Office has a very important role in carrying out Asset Confiscation in eradicating criminal acts of corruption, both as investigators, public prosecutors and as State Attorneys. However, this role cannot be carried out optimally by the Prosecutor's Office, especially in the regional level, in this case the High Prosecutor's Office and the District Attorney's Office, are still experiencing various obstacles. in implementation.

Abstract

This thesis aims to conduct a juridical analysis of the role of notaries in the creation of prenuptial agreements with the objective of ensuring legal certainty within the context of marriage law in Indonesia. This research encompasses a comprehensive examination of the legal regulations governing the role of notaries in the creation of prenuptial agreements, the implementation of notarial practices in the prenuptial agreement process, and the identification of factors that may hinder the attainment of legal certainty. Through a normative legal approach, this thesis analyzes various legal provisions, regulations, and notarial guidelines pertaining to prenuptial agreements. Additionally, this research involves interviews with notaries practicing in this field to gain a deeper understanding of the implementation of the notarial role and the challenges faced in ensuring legal certainty. The findings of this research are expected to provide a more profound insight into the role of notaries in prenuptial agreements and their contribution to legal certainty within the context of marriage law in Indonesia. Furthermore, this study may serve as a foundation for improvements or refinements in legal regulations and notarial practices, aimed at enhancing legal certainty for individuals planning to marry or already married in Indonesia. By combining normative and empirical legal approaches, this thesis seeks to provide a comprehensive picture of the role of notaries in creating legal certainty in marriage agreements.

Abstract

The development of information and communication technology has had a significant impact on various aspects of life, including the business world. One form of this development is the use of a digital platform to hold an online General Meeting of Shareholders (GMS), this is what PT Midi Utama Indonesia Tbk (MIDI) is doing, with a special focus on harmonizing the holding of the online GMS with Article 77 of the Law Limited Liability Company and comparison with Article 16 paragraph (1) of the Law on Notary Positions. This research has three problem formulations, namely regarding legal regulations related to the legality of holding an online General Meeting of Shareholders (GMS) to create legal certainty, implementation of the legality of holding an online General Meeting of Shareholders (GMS) to create legal certainty, and factors that become obstacles. and obstacles and solutions in implementing the validity of holding an online General Meeting of Shareholders (GMS). This research uses normative juridical legal research methods and sociological or empirical legal research. This normative juridical research is carried out by examining library materials or secondary data. The data used in this research are primary data and secondary data. Primary data in this research is in the form of interviews and observations, while secondary data used in this research consists of primary legal materials, secondary legal materials and tertiary legal materials. The results of this research are that the implementation of Online GMS is permitted according to legal regulations based on Article 76 Jo. Article 77 of the Limited Liability Company Law and POJK Number 16/POJK.04/2020. Basically, the implementation of an online GMS does not violate the law and remains legal. In its implementation carried out by a Notary, the preparation of a GMS deed carried out online is still difficult to implement firmly, because there is still uncertainty regarding the Notary's authority. Obstacles that can occur are related to the mechanism for holding an online GMS, because this GMS is carried out online, the main obstacle or obstacle is located in the network or computer equipment.

Abstract

The era of technology has given birth to significant transformation in the financial sector, particularly in the form of Financial Technology Lending (Fintech Lending). Fintech Lending is the result of the fusion of technology and the financial sector, enabling individuals and businesses to access loans quickly, easily, and transparently. Specifically, this journal discusses the validity of Fintech Lending agreements from the perspective of civil law and other legal aspects related to Fintech Lending agreements. Using a normative legal research method and supported by relevant secondary data on the validity of Financial Technology Lending agreements, collected, selected, and processed as the primary data source in this study, as well as the development of descriptive-analytical research based on applicable legal regulations. This is analyzed with legal theories related to issues or problems in Financial Technology Lending. This journal examines the validity of agreements through the Civil Code Book Articles 1313, 1314, and 1320, Financial Services Authority Regulation No. 77 of 2016 Article 1 Number 3, Law No. 11 of 2008 concerning Electronic Information and Transactions Article 1 Number 17 and Article 18. The validity of a Fintech Lending agreement is also correlated with the concept of contracts as proposed by Roscoe Pound through four theories, namely, the Will Theory, the Bargain Theory, the Equivalent Theory, and the Injurious-Reliance Theory. Efforts to establish a Fintech Lending Data Center (Pusdafil) which aims to monitor and manage risks. These steps demonstrate efforts to secure the online loan process and protect the parties involved from possible fraud or default.

Abstract

Pengelolaan sumber daya alam di sektor pertambangan yang dilakukan pemerintah dan badan usaha selama ini menimbulkan dampak negatif, antara lain: kerusakan alam, kerusakan lingkungan, serta masyarakat dan badan usaha yang masih mengabaikan nilai-nilai dari sumber daya alam tersebut. Sebagai mana yang terjadi di Bangka Provinsi Kepulauan Bangka Belitung terdapat banyak daerah pertambangan yang tidak memperhatikan kerusakan lingkungan, diperlukan penegakan hukum yang tegas serta mekanisme penyelesaian terkait kerusakan lingkungan yang di dasari dengan dasar hukum dan rasa keadilanyang berpotensi baik kedepannya.

Abstract

Burung cendrawasih merupakan burung endemic asli Papua yang sekarang memiliki status dilindungi dan berpotensi punah. Banyak hal yang dapat mengakibatkan terjadinya kepunahan terhadap burung cendrawasih seperti perburuan liar, rusaknya lingkungan hidup atau habitat asli burung cendrawasih dan juga terdapat faktor susah untuk berkembang biak. Dengan adanya hal – hal tersebut yang terus menerus terjadi dapat membuat terancamnya populasi burung cendrawasih bahkan dapat membuat jenis burung endemic asli papua ini menjadi terancam punah.

Abstract

Credit agreements are provisions that have legal certainty and apply as law to the parties to the agreement. In accordance with Article 1338 of the Civil Code paragraph (1) states that, "Any agreement made by the parties concerned constitutes a binding law between the two parties." So that in every credit agreement between the creditor and the debtor gives rise to a binding force between the debtor and the creditor, the settlement must be obedient and in accordance with the grace period that has been determined by both parties. Based on the background above, the problems to be studied are: 1) How to resolve the credit agreement in the event that the debtor has died without insurance ownership in PT. Bank Nagari West Sumatra Region? 2) How to carry out the responsibility of the heirs who receive inheritance on the debts of the heirs in PT. Bank Nagari West Sumatra Region? To solve the problem, an empirical juridical approach is used with the main data being primary data in the form of primary, secondary and tertiary legal materials. The results of the study and discussion that the Settlement of credit agreements for debtors has died without ownership of life insurance in Nagari Bank. Based on the results of the study, the following data can be obtained; 1) Guided by the legal provisions of Article 1381 of the Civil Code, steps taken after the event of the deceased debtor's situation, namely: payment, cash payment offer followed by storage or custody (consignation), debt renewal (novation), , debt encounters (compensation), mixing debts (confucion), debt relief, destruction of objects / goods that are the object of the agreement, void terms in each agreement (void / cancel), the enactment of a condition is void, and because of the expiration of time (expiration). This effort is made after the situation of the debtor has died. In addition, ways are taken through banking administration, non-litigation and litigation methods 2) The mechanism for the Implementation of Heir Responsibilities for the Debts of the Deceased Heir is by deliberation between the Credit Rescue Division and the Credit Officer with the Heirs of the debtor concerned. It aims to seek agreement on the payment of the remaining outstanding debtor credit to be settled and to look back at how the debtor's business was abandoned as well as what the condition of the collateral was collateralized to the bank. At that time, the bank assesses the ability to repay as well as the character of the customer itself. Research Methods. In conclusion, Bank Nagari was negotiate with the debtor's heirs who do not have the ability to pay their credit. Bank Nagari proposed the sale of the credit collateral, and found a third party who wanted to buy and sell the collateral to cover the credit.. Advice, maintain communication more intensely to safeguard the rights of both parties.

Abstract

A mandatory will is a will intended for heirs or relatives who do not receive a share of the inheritance from the testator given by the judge, Islamic law has stated that people of different religions cannot inherit from each other, whether Muslims inherit from non-Muslims or non-Muslims inherit from Muslims, but in practice mandatory wills are currently implemented as an alternative to several inheritance problems such as the right to inheritance of assets for heirs of different religions, children and adoptive parents. Judges at the Supreme Court level apply mandatory wills, taking into account the sense of justice and humanity for heirs who are prevented from inheriting as stated in Supreme Court Decision Number. 331/K/AG/2018/MA. This research aims to examine how the mandatory will is implemented for heirs who change beliefs after the death of the testator in the Supreme Court decision Number. 331/K/AG/2018/MA based on the provisions of the Compilation of Islamic Law (KHI), this research is normative legal research which is known as research for academic purposes. namely the process of searching for legal rules, legal doctrines, and legal principles to answer the legal issues being discussed.

Abstract

A country basically needs foreign investment, especially in the form of direct investment. What is often considered a crucial factor is the regulations that intersect with investment in recipient countries. Recently, however, multinational companies are also considering other rules relating to the resources they will use. This research leads to the conclusion that there is a chain effect, from a regional regulation on investment, even though the regulation does not regulate procedures, nor does it directly affect the investment climate in the receiving country.
