Abstract

The noken or tie system in Papua is the system used in the presidential and vice-presidential election, technically represented by a big man or tribal chief. The validity of the noken system is not in the form of written rules (laws) but only in the form of traditional Papuan beliefs that have been passed down from generation to generation, in other words, unwritten rules. Because noken is believed to be able to bring relations, familiarity, friendship and kinship among Papuans. This research uses a type of normative legal research with the method of approaching laws and legal concepts. In this study it was found that the noken system had implications contrary to a number of legal and theoretical principles in law. As in a constitutional state that adheres to written rules alluding to elections being held on the basis of direct, free, secret and fair principles. Likewise with the theory of democracy in terms of the implementation of elections that want to be held through absolute participation of the people in politics because it is aimed at the common interest. Preservation of culture through the noken tradition is only suitable for use in everyday life as it can be used in solving local customary problems, through deliberations for consensus through intermediaries of big men or tribal chiefs as the noken system was done before.

Abstract

Masalah kewarisan merupakan suatu hal yang sangat penting dalam kehidupan manusia karena berhubungan dengan harta peninggalan dari pewaris kepada ahli warisnya yang masih hidup. Dalam penelitian ini, ahli waris yang masih hidup merupakan orang dalam gangguan jiwa (ODGJ). Tujuan dari dilakukannya penelitian ini untuk mengetahui pembagian harta warisan terhadap orang dalam gangguan jiwa (ODGJ) menurut Hukum Islam dan KUH Perdata. Metode penelitian yang digunakan adalah yuridis normatif. Hasil penelitian menunjukan bahwa orang dalam gangguan jiwa (ODGJ) tetap dapat mewarisi harta peninggalan dari pewaris, namun dalam mewarisi tersebut harus dalam perwalian seperti yang telah dinyatakan dalam Pasal 184 KHI. Selanjutnya dalam KUH Perdata tidak ada larangan bagi orang dalam gangguan jiwa (ODGJ) untuk mewaris, mereka tetap dapat mewaris karena orang dalam gangguan jiwa (ODGJ) tidak serta merta mengilangkan hak-haknya dalam mewarisi harta peninggalan pewarisnya. Tetapi dalam pelaksanaanya, untuk mewarisi harta peninggalan pewarisnya harus dilakukan di bawah pengampuan seperti yang telah dinyatakan dalam Pasal 433 KUH Perdata.

Abstract

Paper ini bertujuan untuk memberikan pemahaman mengenai dasar konseptual dan implementasi restorative justice oleh polri untuk mewujudkan tujuan dan fungsi hukum (kepastian, keadilan dan kemanfaatan) Penegak hukum idealnya dalam menegakkan hukum harus mampu mewujudkan tiga (3) nilai dasar hukum, atau sering disebut sebagai tujuan hukum, yaitu kepastian, keadilan, dan kemanfaatan bagi masyarakat. Adapun dengan ditetapkannya Peraturan Kepolisian Negara Republik Indonesia Nomor 8 tahun 2021 tentang penanganan tindak pidana berdasarkan keadilan restoratif diharapkan mampu memberi keadilan, kemanfaatan dan kepastian hukum bagi masyarakat, terutama bagi mereka yang sedang berperkara hukum.

Abstract

The Kanjuruhan Tragedy Is the second biggest tragedy in the world, this tragedy killed 134 (one hundred and thirty-four) people, and this tragedy occurred because of the shooting of 45 shots of tear gas by the police. Security Regulation as a tool that may not enter the stadium area, while the Republic of Indonesia Police also has its own rules regarding tear gas to control the masses, the difference between these rules will be discussed in this article, regarding the legitimacy of the use of tear gas itself because in the rules there is an opacity of laws and rules that should be used in a football match, the method used in this article is a normative juridical method, namely reviewing legal aspects, principles, rules, doctrines, and others. This research contains a study of law that is conceptualized as a norm or rule that is applied to the social sphere.

Abstract

Indonesia is a legal state which consists of various rules to provide protection, security and welfare for its people. Especially regarding the rights of every person, such as the rights that every person gets when he is in his parents' womb, namely Human Rights, but not throughout a person's life it is guaranteed that his rights will not be disturbed or injured by other people, such as cases of sexual harassment received by children, both boys and girls. This research uses a normative type of research. In Indonesian law there are regulations that regulate the death penalty for perpetrators of abuse or rape of children. There are various pros and cons to this regulation because the imposition of the death penalty sanction is also a violation of a person's right to life which is regulated in Human Rights.

Abstract

The impact of divorce must be very significant for a child, especially if the child is still underage. A child needs the affection, attention and supervision of both parents. This research aims to explore the custody of children to fathers according to the Islamic Law Compilation and the Shariah Maqashid perspective. In this study the author uses a qualitative method of normative jurisprudence. According to the results of research that has been carried out in the Compilation of Islamic Law, the custody of a child who has not been fully mumayyized is the right of the mother. But when the child is self-sufficient and can distinguish between good and bad, then the child can be categorized as already mumayyiz. Then the child has the right to decide to whom he will be raised.

Abstract

Banking plays a vital rolein a country's economy as an institution that collects funds from the public and distributes them through credit to support development.the public and distributes them through credit to support national development.development. Abstract

The ease of access to trademark registration and the special treatment of reduced registration fees given to Micro, Small and Medium Enterprises have not made the employers register their brands as a form of preparedness towards legal protection of brands.The aim of this research is to analyze the readiness that must be met by Micro, Small and Medium Enterprises based on local food ingredients in legal brand protection and their efforts towards leading enterprises in Serang City. The research method used is the empirical normative method. The data sources used are primary and secondary data with data collection techniques in the form of field studies and literature and analyzed descriptively qualitatively. The research results show that the readiness of Micro, Small and Medium Enterprises in legal protection of brands is to prepare for trademark registration, fulfill the requirements and carry out trademark registration to obtain a brand certificate as proof of ownership of brand rights and obtain brand protection. The efforts of Micro, Small and Medium Enterprises towards excellence are by innovating in improving product quality, finding funding sources, using technology in product marketing, taking advantage of programs created by the government, and paying attention to legal aspects.

Abstract

This research aims to determine the obstacles that occur for auction buyers in vacating auction objects due to resistance from debtors or third parties, denying that debtors have been negligent in carrying out their obligations towards creditors, debtors who do not acknowledge the amount of debt from all costs that have been incurred by creditors first for the purposes of encumbrances in mortgage rights. The nature of this research is analytical descriptive. This research is also included in empirical juridical research. The data source used in this research is secondary data sources. This research was carried out at the Batam State Property and Auction Service Office (KPKNL) which was the research location. In collecting data for this research, the techniques used were library research and field research methods. The data collection tools used in this research are document study or literature study and interviews. Meanwhile, the data analysis used in this research is qualitative analysis. The conclusions that will be drawn in this research are carried out deductively. The results that have been obtained from this research are the auction minutes as authentic deeds that have perfect evidentiary power, the efforts made by KPKNL in overcoming obstacles in the auction for the execution of mortgage rights at KPKNL must be completed properly and auction buyers who have good intentions must be protected by law.

Abstract

The development of national law in Indonesia is a complex process involving various issues, interests, and expectations. Islamic law plays a crucial role in shaping the national legal system as one of the acknowledged sources of law. However, challenges in integrating Islamic law with national law encompass the diversity of interpretations, harmonization with constitutional principles, and practical obstacles in implementation. This study employs a literature review method with a normative approach. The literature review method is utilized to explore and analyze various documents and literature concerning the integration of Islamic law into the national legal system, enabling a more profound understanding of Islamic law and national law. The study's conclusion underscores the significant role of Islamic law in the development and formation of national law in Indonesia. Islamic law strongly influences the shaping of legal norms and values within the national legal system. Nevertheless, the integration of Islamic Law with National Law faces challenges and obstacles that must be overcome, including diverse interpretations, consensus among various parties, and a deep understanding of Islamic law within Indonesia's social context.
