Abstract

The dominus litis principle is a principle that gives authority to the public prosecutor to control criminal cases. This principle confirms that no other body has the right to carry out prosecutions other than the public prosecutor. In the legal system in Indonesia, the principle of dominus litis is confirmed in Article 1 number 25 of Law Number 16 of 2004 concerning the Prosecutor's of the Republic of Indonesia. This article states that a public prosecutor is an official who is authorized by law to act as a public prosecutor in criminal cases, especially corruption cases. Then, legal problems that arise in the field still include the practice of bribery with the aim of mitigating or even acquitting through P3 letters, fatwa issuance scandals, and exceptions to indictments to reduce sentences, so enforcement and supervision are needed to overcome this. The research uses a Normative Juridical research method and uses a Statute Approach and a Case Approach, where this research focuses on legal principles, statutory regulations, legal rules and cases related to this research. With the existence of the dominus litis principle, it is hoped that the criminal law enforcement process in Indonesia can run more effectively and efficiently. Discussion regarding law enforcement and the role of the prosecutor's commission is an urgency considering that prosecutors as pioneers are expected to be in line with practice in the field, so that in the future the prosecutor's office as the holder of the Dominus Litis principle does not happen again which makes a prosecutor get involved in handling a corruption case.

Abstract

This study aims to explore the considerations made by judges of the Banten High Court in resolving Civil Case Number 173/Pdt./2023/PN.BTN. concerning a dispute over the sale and purchase of land, which involves marital property and is linked to the principles of nebis in idem and the fundamental theory of contract formation. The methodology involves inventorying primary and secondary legal materials related to land law, followed by the identification of these materials according to the central issues of the research. Through analysis of these legal materials, the researcher seeks to provide insights and solutions to the questions raised. The findings revealed that the judges of the High Court of Banten affirmed the decision of the Tangerang District Court in Civil Dispute Number 173/Pdt./2023/ PT.BTN. They found that the reasons behind the initial decision were correct, especially regarding the land and building ownership issue involving Mr. Arhan. Hence, it is crucial for judges to thoroughly review all aspects of a case, particularly the subject matter, to ensure a fair and just outcome that benefits all parties involved.

Abstract

Corruption in Timor-Leste has become a chronic issue that harms the country's finances and economy, as well as violates the social and economic rights of the people. Efforts to recover state financial losses due to corrupt practices through civil proceedings have not been optimal, with the focus being more on criminal prosecution, which has proven to be ineffective. This research aims to examine the concept of recovering state financial losses through civil processes in Timor-Leste, identify obstacles in filing civil lawsuits, and formulate an ideal model and specific regulations for civil lawsuits in the context of recovering the proceeds of corruption. The study uses a qualitative approach by examining relevant legal documents and analyzing the judicial process and financial management in Timor-Leste. The focus of this research is on the application of civil lawsuit rules in recovering the proceeds of corruption and the challenges faced. The results show that the use of civil forfeiture can be a solution to expedite the recovery of corrupt assets through civil proceedings. The research also found obstacles in civil lawsuits, such as the ineffectiveness of criminal prosecution in reducing corruption and the need for anti-corruption legal reforms to improve the mechanism for recovering corrupted state assets. The proposed ideal model includes strengthening the role of the administrative tax and accounts court in examining the management and financial responsibility of the state, as well as placing civil lawsuits as the primary legal effort in combating corruption. This research underscores the importance of legal reforms and the implementation of civil lawsuits as the main strategy in fighting corruption in Timor-Leste. The use of civil forfeiture and asset confiscation through administrative channels is necessary to expedite the recovery of corrupt assets and reduce state financial losses.

Abstract

This research analyzes the efforts of child protection agencies in Indonesia to protect victims of sexual abuse. By employing qualitative analysis methods on relevant data, the main conclusion of this study is that child protection agencies face several constraints that limit their effectiveness in providing adequate protection to victims of sexual abuse. These constraints include limited resources, lack of coordination among agencies, low public awareness, limited access to protection services, and inconsistent law enforcement. Close collaboration between the government, civil society organizations, and all elements of society is needed to address these constraints and enhance child protection in Indonesia, particularly in the context of sexual abuse victims.

Abstract

Penerapan hukum adat dalam pengelolaan sumber daya alam telah menjadi subjek penting dalam upaya pembangunan berkelanjutan. Peluang yang kiranya sangat berkaitan dengan penerapan hukum adat mencakup peningkatan pelestarian lingkungan, pemeliharaan keanekaragaman hayati, dan pemberdayaan masyarakat lokal. Hukum adat juga memberikan landasan bagi praktik-praktik pengelolaan yang berkelanjutan, memungkinkan adaptasi terhadap perubahan lingkungan, dan mempromosikan ketahanan lokal. Namun, penerapan hukum adat juga dihadapkan pada sejumlah tantangan. Sehingga penelitian ini bertujuan untuk mengetahui bagaimana seharusnya masyarakat adat mendapatkan perlindungan hak terhadap tantangan utama sulitnya mendapatkan pengakuan dan perlindungan hukum terhadap Hutan Adat sebagai sumber daya alam di Kalimantan Tengah menurut perspektif hukum adat. Menurut hasil penelitian, konflik kepentingan antara masyarakat adat dan pihak-pihak lainnya seperti pemerintah, serta ketidaksesuaian dengan kerangka hukum nasional menjadi pemicu permasalahan antara Masyarakat adat dan pemerintah. Dalam konteks pembangunan berkelanjutan, pemerintah seharusnya memegang kepentingan untuk memperkuat pengakuan dan perlindungan hukum terhadap hukum adat, serta memperkuat keterkaitan antara hukum adat dan hukum formal. Langkah-langkah tersebut dapat menciptakan kerangka kerja yang inklusif dan berkelanjutan bagi pengelolaan sumber daya alam, yang menghargai pengetahuan lokal, mendorong partisipasi masyarakat, dan memperkuat resiliensi ekosistem dalam rangka pengelolaan dan pemanfaatn hutan adat sebagai Upaya Pembangunan Berkelanjutan.

Abstract

In October 2023, there were several white phosphorus explosions fired by Israeli forces in a military operation over the Gaza city port and two rural locations along the Israel-Lebanon border. Abstract

A traditional country of course has a Head of State Government or more often called a King, a King is a child of a Traditional State who is appointed or elected from the Mata Rumah Parentah to lead the State, Ambon City Regional Regulation Number 10 of 2017 concerning Appointment, Election, Inauguration and dismissal of the Head of State Government is the basis of the rules that serve as a reference in the implementation of obtaining a Head of State Government, but often in carrying out customary mechanisms, both appointment, election and inauguration, it is not in accordance with regional regulations, which of course gives rise to legal consequences. Purposes of the Research : This research aims to determine and analyze the legality of the inauguration of the Head of the State Government based on Ambon City Regional Regulation Number 10 of 2017 concerning the Appointment, Election, Inauguration and Dismissal of the Head of the State Government Methods of the Research : This writing uses normative research methods, with the problem approach used being the statutory approach, conceptual approach, historical approach and case approach. Abstract

This study aims to examine how efforts to fulfill the rights of child prisoners and the implementation of child prisoner development in correctional institutions class II B Sorong City. The research used through empirical juridical legal research methods through a qualitative approach with material analysis using qualitative descriptive analysis techniques. The results of this study indicate that (1) Efforts to protect the rights of child prisoners in the Class II B Correctional Institution of Sorong City based on Law Number 22 of 2022 concerning Corrections. Its implementation runs in accordance with existing regulations. However, in granting these rights, it is necessary to pay attention to the development of child prisoners, including the growth and development of children, both physical, mental, and social, so it is not justified if the development and protection of child prisoners are equalized with adult prisoners. According to Lawrence M Friedmann, the success of law enforcement is determined by three elements of the legal system, namely: Legal structure, legal substance, and legal culture. First Legal Substance, in this case there is no new government regulation after Law Number 22 of 2022 concerning Corrections. Second Legal Structure, in this case the overcapacity that occurs in the Correctional Institution class II B Sorong City can affect the performance of the Institution itself so that extra services are needed for prisoners. Third Legal Culture, the existence of prisons that cannot keep up with the number of incoming prisoners, it is necessary to increase awareness of the legal culture of the community so that crime can be minimized and can reduce the number of incoming prisoners. (2) The existence of child prisoners who are still integrated with adult prisoners due to overcapacity needs to be addressed properly because the implementation should be specifically placed in the Child Special Development Institution (LPKA) based on the provisions of Article 47 of Law Number 22 of 2022 concerning Corrections.

Abstract

Rape is an act of sexual violence that forces someone into sexual relations, including those between a husband and wife. According to records from the Federation of Indonesian Teachers' Unions (FSGI), from the beginning of the year until May 2023, 31.08% of sexual violence cases against minors involved teachers. This study, using Normative Juridical research, examines the criminal liability of teachers who rape students and the judicial considerations in Decision Number: 156/Pid.Sus/2020/PN.Pkb. Findings indicate that teachers violating Article 81 paragraphs (1) and (3) are subject to criminal sanctions, including a minimum prison sentence of 5 years and a maximum of 15 years, as well as a fine of IDR 5,000,000,000.00 (five billion rupiah). Additionally, one-third of the principal penalty may be added. In the referenced case, Decision Number: 156/Pid.Sus/2020/PN.Pkb, the defendant received a sentence of 6 years in prison and a fine of IDR 10,000,000.00 (ten million rupiah). Failure to pay the fine would result in an additional 3-month prison term. Given the damage to the reputation of teachers, the panel of judges should have the authority to impose further punitive measures, such as publicizing the perpetrator's identity through print and social media. It is hoped that such measures will create a deterrent effect, discouraging similar offenses in the future.

Abstract

Law Number 1 of 1974, amended by Law Number 16 of 2019 concerning Marriage, regulates mixed marriages in Article 57, affirming that marriage between two individuals in Indonesia subject to different laws due to differences in nationality and one party being an Indonesian citizen. This research aims to analyze the legal consequences of mixed marriages on the establishment of children according to this Law. The study employs a normative juridical method with descriptive data analysis. Findings indicate that according to Article 42 of Law Number 1 of 1974 concerning Marriage, a legitimate child is one born within or as a result of a lawful marriage. Through a case study of judge's decision Number 471/Pdt.P/2019/PN.DPS, the judge approved the establishment of the child because the applicants fulfilled the requirements set forth to obtain authentic evidence of their marriage. The establishment of children in mixed marriages is clearly regulated by Law Number 1 of 1974, amended by Law Number 16 of 2019 concerning Marriage. However, law enforcement regarding the establishment of children in the context of mixed marriages requires compliance with the stipulated conditions in the law to ensure the validity of the child's status.
