Abstract

The Basic Agrarian Law regulates the prohibition on foreigners' ownership of private land. However, it cannot be denied that Indonesian residents can have foreign heirs. This research aims to determine and analyze the legal position of foreigners regarding ownership of land by inheritance using a notarial deed, as well as how the notary is accountable for the deeds they make. So this research is entitled Notary's Responsibility for the Transfer of Land Ownership Rights by Inheritance to Foreigners. This research was conducted using qualitative methods. The approach to this research uses a normative juridical approach. This research shows that the legal position of foreigners regarding ownership of land by inheritance is that a person's civil right to receive an inheritance can never be lost unless due to actions that endanger the heir who has died. For foreigners, they are not allowed to have ownership rights to land. Acquisition by means of sale and purchase, gift, exchange, gift by will, without stipulation by the government is considered null and void by law. Foreigners are required to relinquish the property rights they have acquired within 1 year of obtaining those rights. However, if the 1 year period has passed, the foreigner will lose ownership rights to the land and the ownership will change to state property.

Abstract

Nowadays, people with disabilities still experience various acts of discrimination. For example, mainly constrained by the requirements of "no physically disabled" which has always been one common absolute requirement for every person when registering for certain jobs. Therefore, states should expressly provide legal protection to people with disabilities and provide opportunities for people with disabilities to be able to work like normal people in general and not consider their limitations as something that could hamper their work. Two important and interesting points will be discussed in this paper. First, people with disabilities are discriminated Often against while facing job recruitment, especially for Indonesian Attorney Civil Servants. Second, it is important to know the responsibility of the state in protecting people with disabilities. The type of research used in the present research is doctrinal-comparative legal research. This present research conducts library research to obtain secondary sources of law (authorities). This paper found that various legal instruments on disability rights that there is no correlation with each other, so it does not create an integrated system to protect the rights of disabilities in obtaining jobs. Although there has been affirmative action in the recruitment process prosecutor (civil servant), it is not enough to give the disabilities an equal opportunity to participate in the recruitment process

Abstract

The research method used in this article is normative legal research, with a statutory approach. This research aims to identify legal rules, legal principles, and legal doctrines that are relevant to the legal issues of overcoming extraordinary events and outbreaks, as well as to find the basis and ontological foundation behind the formation of certain laws, including the identification of the ratio legis. Criminal law policies against perpetrators of criminal acts, especially related to the handling of extraordinary events and outbreaks, have significant implications for the implementation of prevention efforts and the achievement of sustainable development goals, especially in the 3rd Sustainable Development Goals (SDG) related to sustainable health. Criminal sanctions must be clear and firm to ensure legal certainty for the community in accordance with the principle of legality. However, in Article 446 of the Health Law, there are deficiencies and vagueness in the formulation of articles that can hinder effective law enforcement, especially in emergency situations such as the Covid-19 pandemic. The ideal concept of punishment comprehensively considers the factors that influence criminal offenders, in line with the principles of justice and takes into account social and economic factors. Flexibility in the application of punishment, such as community service as an alternative to fines, can be more relevant and have a positive impact, especially in public health emergencies. Refinement and adjustment of criminal law policies are essential to support the management of extraordinary events and outbreaks and achieve sustainable development goals in the health sector.

Abstract

This research uses normative legal research methods with a focus on analyzing legal norms. This research aims to reveal the basic aspects of the formation of certain laws, by analyzing related laws using a statute approach. The sentencing system in Law Number 1 Year 2023 on the Criminal Code (National Criminal Code) presents significant changes, especially in special criminal offenses such as narcotics. The sentencing guidelines introduced in the National Criminal Code allow for broader considerations in imposing punishment, taking into account aspects of justice and humanity. The death penalty is regulated with leniency, giving judges a lot of consideration before making a decision. For drug offenders, the National Criminal Code provides rehabilitation sanctions, showing a more humane approach. Drug sentencing under the National Criminal Code reflects an integrative sentencing theory, which combines the principle of retribution with considerations of crime prevention and offender rehabilitation. This marks a change in the Indonesian criminal law system that prioritizes justice and humanity.

Abstract

A Marriage Agreement is an agreement between a husband and wife regarding matters that will arise in marriage. A marriage agreement is usually made by the prospective husband and wife regarding aspects of the marriage and all matters that may arise during the marriage before the marriage takes place or when the marriage takes place. However, with the issuance of Constitutional Court decision no. 69/PUU XIII/2015 determines that a marriage agreement can be made before, during and during the marriage. This article wants to discuss marriage agreements after the Constitutional Court decision above comes into effect and the position of Marriage Agreements made before a Notary after the Constitutional Court Decision comes into force. The method used is a normative juridical approach and descriptive analytical research specifications. Qualitative juridical data analysis. Constitutional Court Decision Number 69/PUU-XIII/2015 determines that marriage agreements can be made before, during and during the marriage, and there are several formats of model marriage agreements which can be a guide for notaries who will make marriage agreement deeds and agreement deeds. Marriages made before a Notary after the enactment of Constitutional Court Decision Number 69/PUU-XIII/2015 are still valid and are authentic deeds and are valid evidence.

Abstract

Criminal Profiling is a method of investigating criminal phenomena. Criminal profiling involves creating a criminal profile to determine the background of the perpetrator. Premeditated murder is a heinous crime because the manner in which the perpetrator commits the murder requires planning. This plan includes what items to use, when, the right opportunity to do so, and how to escape. Therefore, this research discusses the role of criminal profiling of premeditated murder offenders in Indonesia based on the General Theory of Crime. The theory used will discuss 3 important points of the theory, namely implusive, low self-control, and opportunity. This study collects 5 examples of premeditated murder cases to be studied and presents the results of profiling the perpetrators based on the results of press conferences held by the police and summaries of several news articles. The profiles observed include the perpetrators' motives, modus operandi, socio-cultural conditions, and demographics. The method used in this research is a systematic literature review; this method requires researchers to collect and select articles, books and magazines related to this research. In addition to journal articles and books, researchers also collected references to newspaper articles to explore the development of these cases.

Abstract

In practice, there are often disobedient shareholders who do not deposit the full capital that has been issued, even though their names as shareholders have been recorded in the Company's deed of establishment. In this research, the author raises the case of a Deed of Acknowledgement of Indebtedness made by a shareholder at PT This research will discuss the absence of capital deposits by shareholders in the establishment of a limited liability company which can be said to be a debt based on the applicable laws and regulations, as well as reviewing whether a Deed of Acknowledgement of Indebtedness can be used as a substitute for proof of capital deposits in the Company. This research was prepared using normative juridical research methods, utilizing document studies using secondary data, and using analytical descriptive research specifications, and analyzed using qualitative analysis methods. The research results show that the absence of a full deposit made by shareholders in the Company constitutes a debt and/or obligation and is considered fulfilled if the shareholder has made a full deposit into the Company. Apart from that, as reflected in Article 33 paragraph (2) of Law no. 40/2007, shareholders are required to deposit capital in full to the Company as proof of legal ownership of the issued shares. Thus, the Deed of Acknowledgment of Indebtedness made by the shareholder in the case raised serves as evidence of an Authentic Deed which strengthens and justifies the Company's position in postponing the granting of shareholder rights to shareholders who have not paid for the shares that have not been deposited. However, the existence of the Deed of Acknowledgment of Indebtedness cannot replace proof of capital deposit in the Company.

Abstract

Land boundary disputes involve changes in the arrangement of land parcels caused by merging, reducing and separating land parcels that do not correspond to valid data. This problem can be resolved peacefully, but it is not uncommon for certain situations related to land boundaries to cause prolonged tension between the parties. This research aims to explain how the implementation of land boundary dispute resolution through mediation at the Bandung City Land Office and what are the obstacles faced Bandung City Land Office as a mediator for the parties in a mediatiion process for resolving land boundry detemination, thirdly, how the Bandung City Land Office attempts to overcome obstacles in resolving boundary disputes. land through mediation. The research method uses analytical descriptive methods. The approach method used is normative juridical. Data collection techniques, namely literature studies and field studies. Data analysis uses qualitative juridical methods. The results of this research are that the process of resolving land boundary disputes through mediation at the Bandung City Land Office has not been fully implemented in accordance with applicable provisions, namely the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning Handling and Settlement of Land Cases, because the process is often The mediation carried out did not reach an agreement as explained in Article 1 point 11 of the regulation. In this case, the Bandung City Land Office resolved the dispute that occurred, by deliberation through mediation to find the best solution.

Abstract

Interfaith marriage are still a hot topic of discussion among Indonesian society, to overcome this problem the Supreme Court (MA) issued SEMA Number 2 of 2023 which contains a prohibition on the Courts not to approve applications for registration of interfaith marriages. This research aims to determine the Human Rights perspective on SEMA Number 2 of 2023, by applying normative juridical methods, and library research as a technique in collecting data. The results of this study show that SEMA Number 2 of 2023 has drawn pros and cons, from a human rights perspective, the prohibition in SEMA Number 2 of 2023 is considered discriminatory and not in line with human rights principles, which ignores the freedom to practice religion and guarantee the protection of marriage rights without religious restrictions as stated in Article 3 paragraph (3) of Law Number 39 of 1999 concerning Human Rights, Article 28 E paragraph (1) and Article 29 paragraph (2) of the 1945 Constitution, Article 16 paragraph (1) of the Universal Declaration of Human Rights (UDHR), Article 2 paragraph (1) and Article 23 paragraph (2) of the International Covenant on Civil and Political Rights.

Abstract

Hubungan kerja antara PT. Danamas Insan Kreasi Andalan di Semarang dengan pekerja menerapkan sistem kerja no target no pay. Dalam kasus hubungan kerja dengan sistem no target no pay, pekerja yang melakukan pelanggaran akan tidak mendapatkan gaji dan dikeluarkan sehingga pekerja tidak bisa bekerja lagi dan pekerja yang melakukan kesalahan fatal bisa di pidana. Penelitian ini bertujuan untuk mengetahui bagaimana bentuk perjanjian sistem kerja no target no pay dan perlindungan hukum bagi pekerja yang terikat perjanjian sistem kerja no target no pay. Penelitian ini menggunakan metode penelitian yuridis empiris yaitu dengan mengetahui bagaimana bentuk perjanjian sistem kerja no target no pay dan perlindungan hukum bagi pekerja yang terikat perjanjian sistem kerja no target no pay. Sumber data yang digunakan dalam penelitian ini adalah sumber data primer dan sumber data sekunder. Pengumpulan data dilakukan dengan cara observasi dan wawancara. Analisis data penelitian ini dihubungkan dengan permasalahan yang kemudian diteliti dan diuraikan dalam bentuk narasi. Dari penelitian ini dapat diperoleh bagaimana bentuk perjanjian kerja no target no pay dan perlindungan hukum bagi pekerja yang terikat perjanjian sistem kerja no target no pay. Hal ini dilakukan agar pekerja mendapatakan haknya sesuai dengan yang telah diperjanjikan dalam sistem kerja no target no pay.
