Abstract

Responsibility for the Notary Protocol is regulated in the Notary Office Law Number 30 of 2004 as amended to become Law Number 2 of 2014 concerning the Position of Notary (UUJN). Notary Protocol is a collection of documents constituting State Archives that a Notary must keep and maintain. This normative legal research method is an attempt to see how the application of positive law to the Notary Protocol's accountability process from Notaries who will be appointed as State Officials. Research Results 1) Arrangements that have been arranged have not been implemented, the Notary is not responsible for appointing a Substitute Notary and is negligent of the Protocol. 2) The Regional Supervisory Council has not implemented the rules and procedures that have been regulated in UUJN and the Regulations of the Minister of Law and Human Rights. 3) The legal consequences that are regulated are not carried out. A Notary appointed as a State Official must take leave because a Notary is prohibited from holding multiple positions.

Abstract

In many cases of corruption, apart from the existence of bad conspiracy, the perpetrators were almost entirely related to the abuse of authority and position which was carried out very precentable by structured. The modus operandi of corruption in the banking itself occurs by way of abuse of authority over positions carried out by the Bank's leadership, so that it can have an impact on public distrust of the banking industry. In some cases,condition of customer confidences drop in the bank's performance will have an impact on the occurrence of a “rush money” where in these conditions customers withdraw money on a large scale, this can result to make the economic country collapps if it does not handled properly. Authors used a descriptive research method that tried to dissect the relationship between the abuse of authority in the leadership position of the Bank and state losses. From the research results obtained a finding the corruption can cause losses to state finances and economic shocking, including cases of corruption that occur due to misuse of bank leadership associated with their duties and authorities in a position.

Abstract

In the elucidation of Law Number 28 of 2014 Concerning Copyright, it is one part of intellectual property that has the widest range of protected objects. Currently, people are enjoying or looking for entertainment, especially songs, simply through digital platforms. This article will discuss claims for compensation for copyright infringement through the YouTube digital platform. The method used in this study is normative law, while the data used includes both primary and secondary data. From the results of research through analysis of cases of copyright disputes between Nagaswara who is the copyright holder of the song "Lagi Syantik" and Gen Halilintar it was found that the use of the song works used by Gen Halilintar through the YouTube platform, it is not enough just to include the name of the creator. However, you must first obtain permission from the creator or copyright holder. The permit referred to can be in the form of a mechanical rights license or performing rights. If a song is used without permission, problems with criminal or civil threats will arise if the song is used without permission from the creator or copyright holder.

Abstract

According to Article 613 paragraph (1) of the Civil Code, it is stated that the surrender of receivables on behalf of and other incorporeal objects are carried out by making an authentic deed and/or private deed, by which the rights to the object are delegated to another person. In a cessie, the takeover of bank receivables by a third party does not mean that only the receivables are taken over, but is accompanied by the takeover of the bank's rights and obligations, including the transfer of collateral for the debtor's debt. The research method used in this study is a Normative Juridical approach, the research results obtained are 1. As a result of the Cessie Deed being carried out unilaterally by the creditor, the Jessie is carried out by making an authentic deed or private deed, the Jessie is transferred by the creditor, and there will be a replacement of the creditor only if the cassie is carried out by Article 613 of the Civil Code, but if the cassie is carried out unilaterally by the creditor then the cassie deed has no legal consequences because the cassie in the deed does not fulfill one of the elements of Article 613 of the Civil Code 2. In case, the taking over of a receivables bank by a third party does not mean that only the receivables are taken over, but it is accompanied by the takeover of the rights and obligations of the bank, including the transfer of collateral for the debtor's debt. The transfer of receivables by Jessie does not result in the termination of the existing agreement made between the creditor and the debtor. 3. The debtor's legal protection for a session which is carried out unilaterally by the creditor according to the Civil Code Article 613 such submission to the debtor has no consequences unless the delivery is notified to him or in writing it is approved and acknowledged if the cassie is carried out unilaterally by the creditor the Jessie has not resulted in the debtor, in other words, the Jessie has not occurred or has not been transferred and the debtor can file a lawsuit in court.

Abstract

The rampant distribution of expired food and drinks does not only occur before major holidays, but also occurs on weekdays, which is common in the community. Everyone, at one time either in a single position/alone or in a group with other people. under any circumstances, a citizen must be a consumer for a particular product or service, entitled to legal protection that must be provided by the state. One of the protections that must be provided by the state is consumer protection. This study uses a juridical method by conducting legal research that prioritizes literary materials which basically aims to find secondary data consisting of primary, secondary and tertiary legal materials. This is done so that people do not consume products or services that endanger safety, health, and so on, so that people get satisfaction. In RI Law. No. 8 of 1999, concerning consumer protection (UUPK). Legal protection for consumers can be in the form of non-litigation mechanisms, namely settlements without a judicial process based on Article 47 of Law No. 8 of 1999 concerning consumer protection. As well as the legal form of protection for consumers who experience losses from the distribution and trade of expired food is protection. laws to be upheld and enforced. The responsibility of the business actors for the losses they experience, the consumer can report it to the relevant parties or agencies.

Abstract

Tujuan pendaftaran tanah menurut Pasal 3 huruf a Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah yaitu untuk memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas suatu bidang tanah, Surat Penyataan Fisik Bidang Tanah (Sporadik) merupakan gerbang awal dari pihak yang mendaftarkan tanahnya secara sporadik. Kegunaan dari surat ini ialah sebagai bentuk penegasan bahwa yang bersangkutan telah menguasai sebidang tanah tersebut secara sah sebelum memohon pengajuan hak atas tanah tersebut. Di sebagian besar Daerah Kabupaten Pasaman Barat Provinsi Sumatera Barat masih sangat banyak tanah-tanah yang belum terdaftar atau belum bersertipikat. Dalam penulisan ini menggunakan metode yuridis empiris. Dari hasil penelitian disimpulkan bahwa 1) Bank Bsi KCP Pasaman Barat menerima agunan berupa Surat pernyataan penguasaan fisik bidang tanah secara sporadic untuk dijaminkan sebagai anggunan untuk pinjaman KUR dibawah 100 juta 2). pihak Bank Bsi KCP Pasaman Barat hanya menjadikan surat sporadik tersebut sebagai pegangan untuk menjadi jaminan pada kredit KUR karena sporadik tidak bisa diikat hak tanggungannya dan tidak dibunyikan dalam akad kredit KUR tersebut.

Abstract

Dalam pemberian Hak Tanggungan dengan membuat Akta Pemberian Hak Tanggungan (APHT) oleh PPAT terlebih dahulu dibuat perjanjian utang piutang yang menjadi dasar Hak Tanggungan. Fransisca terhadap PT Bank Central Asia (BCA), Kantor Notaris/PPAT R. Sabar Partakosoema, Dinny Herlela, Kepala Badan Ketahanan Nasional Jawa Barat, dimana dalam hal ini Tergugat II yaitu Kantor Notaris/PPAT R.Sabar Partakosoema kalah penggugat Surat Hak Milik (SHM) dan juga APHT atas nama tergugat, penggugat juga merasa dirugikan karena kerugian tersebut, penggugat sebagai pihak yang melaporkan kerugian tersebut dibuat, namun penggugat yaitu Maria Fransisca tidak merasa bahwa dia telah kehilangan SHM dan APHT. Penelitian ini menggunakan jenis penelitian yuridis normatif, yaitu penelitian yang difokuskan untuk mengkaji penerapan kaidah atau norma dalam hukum positif. Hasil penelitian ini adalah tanggung jawab Notaris/PPAT dalam Perjanjian Kredit Dengan Hak Tanggungan. Dalam hal ini Notaris membuat dan mengesahkan akta otentik dalam perjanjian Kredit, dan Pejabat Pembuat Akta Tanah (PPAT) berwenang untuk membuat dan mengesahkan Surat Kuasa Pembebanan Hak Tanggungan (SKMHT). Akibat hukum yang timbul karena pemasangan hak tanggungan yang tidak dilakukan oleh UUJN adalah batal demi hukum dan tidak mempunyai kekuatan mengikat dan kreditur pemegang hak tanggungan akan kehilangan hak istimewanya sebagaimana diatur dalam UUHT. Tanggung Jawab Notaris Dalam Memasang Hak Tanggungan Yang Menyimpang Dari UUJN Terkait Perkara Nomor 285 PK/Pdt/2013 Seperti Mencabut Minuta Akta Jika minuta akta hilang maka dapat dikatakan Notaris tidak melaksanakan kewajibannya untuk menyimpan minuta akta dengan benar.

Abstract

The development of science also has a significant impact on the development of good health service provision. One of the developments in the field of health services is the renewal of electronic medical records. Where the benefits of electronic medical records are of course as a basis or guide to knowing and analyzing diseases and knowing the treatment, care and medical action that must be given to patients, as well as improving the quality of service to protect medical personnel in the promotion of optimal public health. Then this electronic medical record can also be used as a type of evidence to be able to make light of a certain legal event. The medical legal basis for electronic records is evidence based on Law Number 29 of 2004 concerning Medical Practice and Law Number 11 of 2008 concerning Information and Electronic Transactions. Then this research is a normative research or library research that will examine the urgency of proving electronic medical records based on a legal perspective in Indonesia.

Abstract

Di Indonesia Kasus kesalahan pemberian obat yang berujung pada tindak pidana muncul ke permukaan seperti gunung es (iceberg). Peranan Kepolisian dibutuhkan dalam hal pelaksanaan penyelidikan dan penyidikan terhadap suatu kasus yang diduga sebagai tindak pidana terkhusus dibidang Kesehatan, dalam melakukan penyelidikan di pada kasus Kesehatan ini kerap ditemukan kendala dalam penyelidikan sehingga belum sepenuhnya kebenaran yang selengkap-lengkapnya diperoleh. Oleh sebab itu penulis meneliti permasalahan ini dengan rumusan masalah yaitu : 1). Bagaimana pelaksanaan penyelidikan kepolisian terhadap dugaan kesalahan asisten apoteker dalam pemberian obat yang diresepkan dokter di Puskesmas Ulak Karang Selatan Kota Padang dan 2). Apakah kendala dalam pelaksanaan penyelidikan kepolisian terhadap dugaan kesalahan asisten apoteker dalam pemberian obat yang diresepkan dokter di Puskesmas Ulak Karang Selatan Kota Padang?. Metode Penelitian yang digunakan adalah Yuridis Sosiologis (Empiris) dengan melihat hukum positif yang dihubungkan dengan kenyataan yang ada di lapangan dan berfokus terhadap penegakan hukum nya. Hasil penelitian disajikan dalam bentuk deskriptis. Adapun hasil penelitian penulis dapat disimpulkan, pertama yaitu pelaksanaan penyelidikan terhadap dugaan kesalahan asisten apoteker dalam pemberian obat yang diresepkan dokter di Puskesmas Ulak Karang Selatan Kota Padang belum sepenuhnya memenuhi tujuan daripada hukum acara pidana untuk mencari kebenaran materiil guna mengetahui ada atau tidaknya sebuah tindak pidana yang terjadi sehingga membuat terang suatu peristiwa yang diduga sebagai tindak pidana, menggali sebanyak-banyaknya keterangan atau barang bukti sebagai informasi yang kemudian hasil tersebut dituangkan ke dalam laporan hasil penyelidikan sebagai persiapan pelaksanaan penindakan dan atau pemeriksaan. Kendala yang dihadapi penyelidik adalah hingga saat ini kasus tidak berkembang sebab penyelidik kesulitan dalam mengartikan luka berat untuk penerapan pasal dikarenakan keterangan dari beberapa saksi yang mengatakan dampak pengobatan hanya iritasi dan tidak akan menyebabkan kebutaan permanen yang dijelaskan oleh Ahli Farmakologi Klinis dan Ahli Kesehatan.

Abstract

In Indonesia, SOE has a strategic role as a pioneer for business activities that cannot yet be carried out by the private sector, providing public benefits in the form of providing adequate goods and/or services to meet the needs of many people and actively providing assistance and guidance to the community. However, the challenges faced by SOEs are that there are too many SOEs, some SOEs have poor financial, operational and governance performance, and the roles and functions of SOEs themselves are still not efficient in supporting the national economy. Therefore, restructuring SOE has been carried out in an effort to streamline the number of SOEs in Indonesia, one of which is through a Merger. There are two road transport SOEs that currently play a role in the development and operation of national road transportation and have equivalent core businesses, namely Perum DAMRI and Perum PPD. Perum DAMRI and Perum PPD were both affected by the Covid-19 Pandemic so that both their financial and operational performance deteriorated. The Ministry of SOEs together with the Ministry of Finance initiated the merger of the two companies as a strategic effort to nourish the two companies. This study aims to analyze the legal aspects of the Merger of Perum PPD into Perum DAMRI. This research seeks to answer the following questions: what is the legal process for the merger of Perum DAMRI and Perum PPD based on regulations in force in Indonesia. The research method used is normative juridical. This study concludes that the merger of Perum with Perum has not been regulated directly in the existing laws and regulations in Indonesia. The merger of Perum PPD into Perum DAMRI currently still refers to regulations regarding the merger of SOE Companies. Several regulations related to the Merger of Public Corporations in Indonesia, especially regarding the Merger of Perum PPD into Perum DAMRI, including Law No. 19 of 2003 on SOE, GR No. 43 of 2005 concerning Mergers, Consolidations, Acquisitions, Changes in Legal Entity Forms of State-Owned Enterprises, Law No. 5 of 1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition, Law No. 13 of 2003 concerning Manpower as amended by Perppu No. 2/2022, Law no. 22 of 2009 concerning Road Traffic and Transportation as amended by Perppu No. 2/2022, and Government Regulation No. 30 of 2021 concerning Implementation of the Road Traffic and Transportation Sector.
