Abstract

Tulisan ini membahas tentang reformulasi zakat profesi dalam kerangka kaidah hukum Islam. Sementara ahli, menempatkan zakat profesi dalam logika perdagangan namun sebagian lain menempatkannya dalam konteks pertanian. Perbedaan dua perspektif ini berakibat pada jumlah atau prosentase dan waktu pembayaran zakat profesi. Tulisan ini hendak merumuskan bagaimana zakat profesi dalam teori hukum Islam. Analisis penulis dalam menjelaskan zakat profesi dalam perdebatan hukum ini menggunakan pendekatan al-Qawaid al-Ushuliyyah dan al-Qawaid alFiqhiyyah. Dengan menganalisis data-data kitab fiqh klasik dan kontemporer, tulisan ini menyimpulkan bahwa zakat profesi perlu diletakkan dalam pendekatan filosofi hukum yaitu maqãshid al-syariah dan mas}lahah sehingga ketentuan hukum zakatnya tidak secara kaku mengadopsi rumusan fiqh klasik semata.

Abstract

This study aims at analyzing Islamic and positive laws in Indonesia regarding the obligation of zakat for the Goverment Employee (ASN). This is Important for finding the basis for the state in goverming zakat regulation for Muslim ASN with a payroll cut of 2.5 percent by the Ministry of Religius Affairs as well as for getting arguments in terms of islamic law and politics of law as well as their relation to these regulations. The method used in this study is a qualitative research with a statutory approach with data in the form of zakat laws and regulations enforced in Indonesia, both in terms of religious and state norms. The findings of this study indicate that there are important issues from this regulation in the perspective of Islamic law and politics of law: First, the regulation of zakat obligations for the goverment employees is not in accordance with Islamic law; Second, the method of determining muzaki (zakat payers) by the state is still biased because it declares that all the Muslim goverment employees are Muzaki; Third, the basic calculation for compulsory zakat has not calculated the gross basic needs of the goverment employees and the expenditure of basic needs (hajah ashliyyah) yet.

Abstract

Islamic banking is committed to using Islamic ethical values. This certainly raises the question, whether Islamic banking that is committed to Islamic ethical values also has a high commitment to social and environmental responsibility called Corporate Social Responsibility (CSR, called social responsibility). The purpose of this study was to determine the effect of partial and simultaneous CSR disclosure on CAR, ROA, ROE, and BOPO. Based on the purposive sampling method, the sample in this study was 4 BUS and 7 UUS which published sustainability reports using GRI guidelines 4 and annual reports in 2014-2017. The analytical method used in this study is multiple linear regression. The results of this study indicate that this study shows a positive effect on CAR, because the disclosure of high CSR will increase investor loyalty and trust to invest. CSR social indicators are not needed on CAR, because it takes a long time to see their effects. All CSR indicators also do not approve of ROA and ROE. The company’s ROA and ROE are issued at the end of the year, while CSR is issued at the beginning of the following year at the AGM. CSR economic indicators show a negative effect on BOPO, because they will save resources so they will reduce their operational costs, social indicators have a positive effect on BOPO because the higher the social activities will increase the operational costs incurred

Abstract

The study investigates the processes and mechanisms of the legislationof Aceh Qanun 6/2014 on Jinayat Law. It asks the role of Islamic law in suchlegislation process and the challenges of the application of Islamic penal lawin Aceh under the Indonesian legal system. This qualitative research uses bothtextual and empirical sources and employs statute, empirical and conceptualapproaches. This study demonstrates that the legislation of Islamic penal codein Aceh has philosophical, sociological and juridical grounds and complieswith the procedure of legislation of state law in Indonesia. Despite technicalproblems, the legislation advanced by ulama, scholars, local legislators, theprovincial government and the representation of Muslim society of Aceh,is relatively successful in integrating fiqh, state law and customary law intothe Islamic penal code, resulting in what is call as collective consensus (ijtihadjama’i). These findings reveal that the Qanun was endorsed on the pillars oflegal pluralism (fiqh, adat and state law) that fits into the principle of rechstaatand Pancasila that is adopted by the Indonesian legal system. Objek penelitian ini adalah proses dan mekanisme Qanun Aceh Nomor6 Tahun 2014 tentang Hukum Jinayat. Penelitian ini beranjak dari pertanyaanutama penelitian tentang bagaimana proses dan mekanisme legislasi hukumjinayat menjadi hukum positif di Aceh dalam sistem hukum Indonesia. Penelitianini berbentuk kualitatif, menggabungkan antara penelitian kepustakaan(library research) dengan penelitian lapangan (field research). Pendekatan yangdigunakan terdiri dari pendekatan perundang-undangan (statute approach),pendekatan emperis, dan pendekatan konseptual. Proses pembentukannyamemiliki landasan filosofis, sosiologis dan yuridis dan digabungkan dengaprosedur hukum perundang-undangan di negara Indonesia. Pihak yang terlibatdalam perumusan materi muatan raqan Jinayat Aceh terdiri dari unsur ulama, cendikiawan Aceh, institusi penegak hukum (Mahkamah Syar’iyah, Kejaksaan,Kepolisian dan Wilayat Hisbah) serta masyarakat melalui lembaga swadayamasyarakat. Pemerintah Aceh melibatkan Tim Ahli Eksekutif dan Tim AhliLegislatif dalam pembahasan materi muatan Rancangan Qanun hukum Jinayat.Dinamika pemikiran yang muncul dalam perumusan materi muatan hukumJinayat telah disepakati sehingga Rancangan Qanun Hukum Jinayat dapatdisahkan bersama antara legislatif dan eksekutif. Temuan ini, membuktikanterakomodirnya berbagai sistem hukum di Indonesia dan terintegrasinyakandungan syariat, fikih, hukum positif dan adat yang disesuaikan dengandasar negara dan Pancasila dengan mengadopsi sistem hukum Indonesia yangberlaku.

Abstract

Madura Island has its own uniqueness from a socio-culture that breathes Islam. This is a positive value in dealing with halal tourism in the world. The fact that currently all districts in Madura have not welcomed halal tourism as a mainstay to increase the number of tourist visits both domestic and foreign. This can occur because public participation in policy making is still lacking or even non-existent. Because seeing the very strong diversity of the Madurese community with Islam, it is a must to implement a halal tourism policy. Public participation in drafting local regulations on tourism management in Madura can be seen in the FGD. This shows that the model of community participation in Madura is in accordance with a basic model of public participation, and a realism model of public participation. Meanwhile, based on Islamic values, the implementation of FGD can be included in the shura concept contained in Islam. The general public response wants the application of halal tourism on the island of Madura. But on the other hand they also emphasize the existence of halal tourism which actually implements tourism in accordance with the Shari’a.

Abstract

The political policy of the Dutch colonialists in the late 19th and early 20th centuries had followed up on Snouck Hurgronje’s recommendations, especially the relationship between Islam and politics and between Islam and adat. One of the recommendations was that Islam must be separated from the political aspect. In terms of relations with customary law, Islamic law can only be enforced when it be recognized by customary law, which is then known as the receptie theory. The implementation of this theory had been clearly of negative value for the existence of Islamic law. However, the positive side cannot be ignored. Some of the policies carried out by the colonizers were mobilizing the kingdoms in the archipelago to record the acts of kingdoms or applicable customary law by transmitting manuscripts from previous works. This research is a study of customary law documents and statute manuscripts those have been enforced in several Islamic kingdoms by looking at the writing, promulgation and re-copying period. The analysis is equipped with a historical approach. The findings of this study that after the acceptance of the receptie theory, rewriting of customary law documents was most intensive and its peak when it was recorded in 45 volumes adatrechtbundels. Volume I was first printed in 1910 AD. By that, the Government emphasized that the law that had been applied was a customary law. Whereas by featuring the customary law, in essence it also accentuated the Islamic law.

Abstract

This article examines the shift of contract objectives from what originally set for non-profit objectives to business ones. Such shift is found in the three contracts; wakalah (power of attorney), hawalah (underground banking), and kafalah (guarantee). Referring to their uses in several Islamic financial products in Indonesia and comparing to the sharia resolution of Sharia Authority Council Malaysia and Islamic law (fiqh), the majority of these contracts is proven to apply fees (ujrah) and used both independently and in combination with other contracts. Here, the fees are mostly applied in the Islamic financial institutions, but unfortunately the customers who are involved in the contracts get less. This, in turn, affects and changes the contract classification which originally included the three in the non-profit contract and eventually turns them into the business contract. If the contracts are set for business objectives, they are then considered as service/lease based contracts (ijarah). In the construction of a real agreement (contract), this shift has implications on changes in the rights and responsibilities of the parties involved and can raise a dispute cause of misunderstanding of the status of the contract as voluntary (tabarru’) or business (tijari).

Abstract

This article tries to present a map of the geographic distribution of the followers of Islamic fiqh schools, especially Madzãhibu al-Arba’ah al-Mu’tabarah, namely the Hanafî school, Mãlikî school, Syafi’i school, and Hanbalî school throughout the world. The spread of Islamic fiqh schools of al-mu’tabarah has reached various parts of the world from the birth of the first generation until today. Fiqh is one of the essential aspects that Islam is very concerned about. The legal aspects produced by the jurists who are istinbathed from the texts both al-Qur’an and hadith have colored the lives of Muslims in religious life. Hanafî, Mãlikî, Syafi’i, Hanbalî and others schools are manifestations of the Islamic scholars’ concern for the practice and rules of worship so that they become a bridge in the framework of taqarrub to Allah SWT through role models exemplified by Rosulullah SAW. This research study uses a Literature Review approach using interactive data analysis techniques. The results showed that the fiqh schools at least had their own unique regional bases that were not owned by the others.

Abstract

Salah satu perkara yang cukup ramai di Pengadilan Agama beberapa tahun terakhir, lebih khusus Pengadilan Agama yang ada di Lombok adalah perkara pengangkatan anak. Perkara pengangkatan anak di Pengadilan Agama di Lombok terus bermunculan, dan mengalir dengan beragam polemik hukum, dari persoalan status anak angkat, status orangtua kandung, status orangtua angkat, dan berbagai motivasi para pihak dalam pengangkatan anak. Melihat derasnya kasus yang muncul dari pengangkatan anak di lingkungan masyarakat Sasak Lombok, Pengadilan Agama di Lombok memiliki pola putusan yang hampir sama, yakni hanya mempertimbangkan aspek normativelegalistik-positivistik, baik dari aspek prosedural, dokumen administrative, keterangan saksi, dan beberapa bukti yuridis lainnya yang digunakan oleh majelis hakim. Sehubungan dengan tingginya budaya pengangkatan anak di lingkungan masyarkat Sasak dan berbagai persoalan sosial-masyarakat yang muncul akibat budaya pengangkatan anak itu di satu sisi, yang secara otomatis memicu membeludaknya kasus pengangkatan anak di Pengadilan Agama Lombok di sisi lain, maka tulisan ini akan membahas tentang perlindungan anak angkat yang memicu perubahan sosial keagamaan masyarakat Sasak yang ada di Lombok. Abstract

West Nusa Tenggara (NTB) is one of Indonesia’s leading halal tourist destinations. This makes business opportunities open for the local community and will be able to improve the welfare of the community. All districts participated in the development of halal tourism to increase the number of tourist visits to NTB. The city of Mataram, the capital of the NTB province, is no exception. Mataram is also actively building and developing halal tourism by packaging existing tourist destinations into attractive halal tourist destinations. Seeing the rapid development of halal tourism in NTB, this study was conducted to examine the development of Halal Tourism in the City of Mataram and to determine the contribution of the development of halal tourism to the welfare of the people in Mataram City. This research is a descriptive qualitative study in which the primary data are informants from the City of Mataram Tourism Office, Mataram City Promotion Board, Tourism Actors and tourists that visiting Mataram while secondary data are obtained from various reports, books, publications, websites and others. The results of this study aimed that the development of halal tourism carried out by the Mataram City Government was quite good. This is proven by the increasing number of tourists visiting Mataram City each year. Development of halal tourism is done by improving facilities and infrastructure at tourist destinations, promoting both local and international, providing public transportation that is good enough to access tourist attractions, providing accommodations in accordance with sharia provisions so as to provide comfort for tourists especially Muslim tourists. With various efforts to develop tourist destinations that have been carried out by the Government of the City of Mataram has an impact on improving the welfare of the people of the City of Mataram, which is illustrated through the increase in the HDI index from year to year.
