Abstract

Perkembangan teknologi mempengaruhi segala aspek, terutama dalam penyelenggaraan pemilu yang sangat terlihat pengaruhnya terhadap kampanye pemilu melalui media sosial. Dalam implementasinya kampanye pemilu terdapat adanya kampanye hitam (Black Campign) yang dilakukan oleh Buzzer dengan akun palsu untuk mempengaruhi opini public melalui berita bohong dan pencemaran nama baik. Penelitian ini secara yuridis normatif menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasi penelitian ini perlu diaturnya secara tegas mengenai adanya pelanggaran pemilu yang utamanya dilakukan oleh Buzzer lewat media sosial dan dalam implikasinya kampanye hitam harus berdasarkan asas Juber dan Jurdil dalam pembentukan pengaturannya yang nantinya bila ditemukan suatu pelanggaran harus adanya delik aduan untuk ditindak lanjuti yang memerlukan waktu paling lambat 7 hari, bila lewat batas waktu tersebut adanya pelanggaran tidak dilanjutkan, maka dari itu dapat dikonsepkan dengan di temukannya pelanggaran pemilu dapat langsung di laporkan atau sebagai delik umum yang nantinya lembaga yang berwernang dalam menindak adanya kampanye hitam harus dapat bersinergi dengan baik mulai dari Lembaga Bawaslu, KPU, Kepolisian agar terciptanya pemilu damai dan berkeadilan. Perlu adanya pengaturan yang jelas dalam UU Pemilu mengenai kampanye yang dilakukan oleh Buzzer, baik dari pengaturan, penyelenggaraan dan sanksinya harus disesuaikan.

Abstract

In line with the development and the trend of Creative Economy business in Indonesia, the creation of business that are “Design Centric” by nature or having an orientation towards aesthetic design are flourishing, specifically lifestyle business who invested their time and money to build store layout that could be a brand signifier on the business that they have. Although, until now there are still a legal polemic in relations of which Intellectual Property (“IP”) Object that are suitable to protect store layout that include Three Dimensional Marks, Industrial Design and Copyright in protecting store layout. This Journal would analyze the concept of store layout, and the existing legal framework that have been enacted to protect store layout overseas, especially those relating to three dimensional marks. After that, this Journal would analyze the legal inconsistencies between the law of Trademarks, Industrial Design and Copyright in protecting store layout. The usage of qualitative descriptive analysis will be used to have perspective in relations about this phenomena, especially those from chosen regulators. At the end of the Journal, the writer’s hope that there will be an understanding of the problem of store layout protection based otn the existing system in Indonesia. Furthermore, the writers also hope that it will lead to the best available solution to fix the effectivity of legal protection of store layout as three dimensional marks subject.

Abstract

Corruption is the main factor in doing business in Indonesia. The subject of corporate law plays a major role in the rate of economic growth in Indonesia, thus causing a tendency for corruption crimes by corporations. Enforcement through penal channels imposed on corporations reaps problems, such as a decline in public trust which results in a decrease in corporate income which has implications for mass termination of employment. The purpose of this paper is to examine the opportunities and challenges of implementing the Deferred Prosecution Agreement (DPA) or suspension of prosecution in the enforcement of corporate crimes carried out with a non-penal approach based on John Rawls' social justice. This study uses a juridical-normative method with conceptual, legislative, and comparative approaches. The results of the paper show that the importance of the implementation of the DPA and its potential application lies in the prosecutor as the ruler of the case by applying the principle of opportunity. The challenges in its implementation are related to the differences in the state legal system that uses the DPA mechanism, the shift in the principle of enforcing corruption crimes as extra ordinary crimes from primum remedium to ultimum remedium. The recommendations offered include the urgency to establish a special law that regulates the DPA mechanism in Indonesia as a consequence of the civil law legal system, adding a mechanism if the corporation has good faith in submitting an agreement with the prosecutor through Self-Report and opportunities to improve corporate governance.

Abstract

Abstract The objectives of this research are 1) To analyze the effect of transfer of receivables on mortgage rights as debt collateral, especially in the aspect of legal certainty for creditors and debtors. 2) To examine the legal consequences of the transfer of receivables on the validity and implementation of mortgage rights based on Decision Number 202/PDT/2021/PT DKI, as well as the implications for the parties involved. With these objectives, the problems discussed are 1) How is the effect of transfer of receivables in the context of mortgage rights as debt collateral. 2) What are the legal consequences of the transfer of receivables on the validity and implementation of mortgage rights in Decision Number 202/PDT/2021/PT DKI. With the formulation of these problems, this research uses normative juridical research with a statutory approach (statue approach), conceptual approach (conceptual) and case approach (case approach) using agreement theory, legal certainty theory, responsibility theory. The data is reviewed through a literature study of laws and regulations, legal doctrine, and analysis of relevant court decisions.The results show that the transfer of receivables that is not accompanied by notification to the debtor, as stipulated in Article 613 of the Civil Code, does not bind the debtor and has the potential to cause legal disputes.In Decision Number 202/PDT/2021/PT DKI, the transfer of receivables made by PT Bank UOB Indonesia to a third party without prior notification to the debtor was declared legally invalid because it did not fulfill the normative provisions, including the absence of re-binding of the mortgage.This creates legal uncertainty and harms the rights of the debtor.In addition, the process of exercising the mortgage rights by a third party cannot be legally implemented due to the loss of formal legal relationship between the new creditor and the collateral object. The conclusion of this research emphasizes the importance of debtor notification in the cessie process, as well as the need for strict legal procedures in the transfer of receivables secured by mortgage rights so as not to cause violations of the principle of good faith and legal protection for all parties.The suggestions made are that every transfer of receivables should be accompanied by written notification to the debtor and re-recording of mortgage rights in order to ensure legal certainty and justice in banking practice. Abstract

The practice of corporate counterclaims against environmental expert witnesses in forest fire cases shows symptoms of legal abuse in the form of Strategic Lawsuit Against Public Participation (SLAPP). This study analyzes the case of PT Jatim Jaya Perkasa against Prof. Bambang Hero Saharjo in the perspective of SLAPP in Indonesia and examines the role of Good Corporate Governance (GCG) principles in limiting deviant corporate actions. This research uses normative juridical method with statutory approach and case approach. The data is analyzed descriptively qualitatively. The results show that the lawsuit contains elements of intimidation against scientific and public participation in environmental law enforcement. Although Article 66 of the PPLH Law, Permen LHK No. 10 of 2024, and Perma No. 1 of 2023 have provided a basis for legal protection for environmental fighters, including expert witnesses, the implementation of the three regulations is still weak and has not become an effective guideline at the practical level. Therefore, it is necessary to strengthen the implementation of regulations through active supervision and internalization of GCG values by corporations so that the law is not used as a tool of repression against public participation.

Abstract

This study examines the role of local content requirements regulations in Public-Private Partnership (PPP) schemes within Indonesia’s infrastructure sector, and compares it with Vietnam’s policy approach. Local content requirements regulations aim to strengthen domestic industries, create employment, and reduce reliance on imported products by prioritizing the use of local goods and services. However, their implementation also presents challenges, especially in attracting foreign investors who require flexibility in supply chains and technology access. The case study of the Cirata Floating Solar Power Plant project illustrates the technical and administrative application of local content requirements and how foreign investors adjust their business strategies accordingly. Compared to Vietnam, which adopts a more incentive-based approach through price preferences without explicit TKDN obligations—Indonesia enforces stricter requirements. The study emphasizes the need for a balanced policy that protects local industries while fostering a competitive investment climate to ensure sustainable infrastructure development. Abstract

Pembelian dan penjualan hak atas tanah antara penjual dan pembeli tidak selalu melibatkan penulisan langsung akta jual beli. Namun, proses pembelian dan penjualan hak atas tanah dapat didahului dengan penulisan perjanjian jual beli beserta kuasa hukum. Notaris memiliki kewajiban untuk teliti, artinya mereka harus cermat dan tepat dalam menyusun akta-akta mereka. Namun, dalam praktiknya, notaris seringkali gagal menjalankan tugasnya dengan cermat, seperti dalam putusan Nomor 686/Pdt.G/2022/PN Jkt.Sel, di mana seorang notaris ditemukan lalai dalam menjalankan tugasnya, mengakibatkan kerugian bagi pemilik tanah akibat adanya orang palsu yang berpura-pura sebagai pemilik tanah dan menandatangani perjanjian jual beli dengan kuasa hukum. Penelitian ini menggunakan metode penelitian yuridis normatif, merujuk pada norma-norma hukum dengan menganalisis sumber-sumber bibliografis atau sekunder sebagai dasar untuk mengatasi masalah. Kegagalan notaris dalam memeriksa identitas pihak-pihak yang terlibat dalam penyusunan akta dapat mengakibatkan kerugian bagi pemilik tanah. Perlindungan hukum yang dapat diberikan meliputi ganti rugi dalam bentuk pemulihan kondisi semula, larangan pengulangan tindakan serupa, serta pengakuan hukum atas kesalahan notaris dan tanggung jawab hukum notaris atas tindakan tidak adil dalam pembuatan akta jual beli disertai kuasa hukum dapat dikenakan sanksi perdata berdasarkan Pasal 1365 KUH Perdata atas perbuatan melawan hukum yang merugikan pemilik hak atas tanah dan secara administratif atas pelanggaran Pasal 16 ayat (1) huruf (a) Undang-Undang Notaris.

Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan hukum kreditur konkuren dalam proses kepailitan, dengan fokus pada studi kasus Putusan Nomor 15/Pdt.Sus-Pembatalan Perdamaian/2022/PN.Niaga/Jkt.Pst. Latar belakang penelitian ini berangkat dari kompleksitas yang dihadapi oleh kreditur konkuren, yang sering kali dirugikan dalam proses kepailitan karena tidak memiliki jaminan kebendaan dan posisi tawar yang lemah dibandingkan dengan kreditur preferen dan separatis. Metodologi yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, yang berfokus pada analisis norma-norma hukum yang berlaku serta penerapannya dalam konteks perlindungan hukum bagi kreditur konkuren. Rumusan masalah dalam penelitian ini mencakup dua aspek utama, bagaimana kedudukan hukum kreditur konkuren dalam proses kepailitan berdasarkan putusan yang diteliti dan bagaimana implementasi perlindungan hukum terhadap kreditur konkuren sesuai dengan peraturan yang berlaku. Hasil penelitian menunjukkan bahwa kreditur konkuren memiliki hak untuk berpartisipasi dalam proses PKPU dan dapat mengajukan permohonan pembatalan perdamaian jika debitor tidak memenuhi kewajibannya. Kesimpulan dari penelitian ini menegaskan bahwa meskipun kreditur konkuren memiliki kedudukan hukum yang sah, mereka tetap menghadapi tantangan dalam perlindungan hak-hak mereka, sehingga diperlukan reformasi regulasi dan penguatan peran lembaga pengawas untuk memastikan keadilan dalam proses kepailitan. Abstract

The objective of this research was to study the business practices on Land and Apartment Rights of which refer to Western Law whilst the Indonesia Land Law including Apartment Law based on Adat Law. The transaction is running expeditiously in business community. Refer to Apartment Law in Indonesia, the transaction of which based on Adat Law. The conception stated that land rights transaction is "terang, riil dan tunai" ("transparent, real and cash") it means that the transaction should be in cash, real and delivery in front of Land Deed Officer_Pejabat Pembuat Akta Tanah (PPAT). The legal problem is how the developer can sell the Apartement ("strata title") to the consumer with pre-payment (indent) of which the Apartment not yet construct or under construction or in planning. The result of this research is that the developer sold the Apartment by Pre-Project Selling of which the Bank Institution ask the Developer the Buy Back Guarantee. The method of this research is legal document study. The conclusion of this research is the transaction should be in front of Notary Public by issuing a fair Pre-Agreement (Perjanjian Pengikatan Jual Beli_PPJB).
