Abstract

This study aims to provide a juridical analysis of the integration of automation technology within the legal framework of the creative economy in Indonesia, with a specific focus on the use of Point of Sale and Enterprise Resource Planning systems. Automation technology is increasingly recognized as a vital tool for enhancing efficiency, transparency, and professional business management in the creative industry. However, the rapid advancement of such technologies has not been fully matched by adequate legal certainty, particularly within the existing creative economy regulations. This research employs a normative legal method with a conceptual and statutory approach, supported by content analysis of relevant policy documents and literature. The findings indicate that, although the regulatory framework acknowledges the importance of technological utilization, normative gaps remain concerning the governance of digital automation particularly in areas such as data protection, system-based labor relations, and equitable access to technology. Using the lens of law and economics, this study emphasizes the need for regulations that promote innovation while maintaining a balance between economic efficiency and social justice. The results have practical implications for policymakers, especially in designing responsive implementing regulations that accommodate digital transformation within the creative economy sector. The study recommends the formulation of specific legal instruments for automation technologies and the enhancement of digital literacy programs for creative economy actors as strategic measures to address future challenges

Abstract

The increasing scale of environmental degradation in Indonesia indicates that the fundamental problem of environmental law does not merely lie in normative deficiencies, but rather in a paradigmatic failure rooted in an anthropocentric and procedural legal orientation. Such an orientation reduces environmental protection to formal administrative compliance, while substantive protection of ecological carrying capacity and environmental limits has not been treated as binding legal constraints. This article aims to examine the paradigm of ecological law within the Indonesian environmental legal system through a normative approach grounded in the philosophy of science, focusing on ontological, epistemological, and axiological dimensions. This study employs doctrinal legal research using statutory, conceptual, and philosophical approaches, analyzed qualitatively through deductive legal reasoning. The findings reveal that Indonesian environmental law remains caught between an economic growth oriented development paradigm and the constitutional mandate to ensure environmentally just and sustainable governance. The ecological law paradigm offers a conceptual framework to reconstruct environmental law by recognizing the intrinsic value of the environment, integrating scientific knowledge and environmental ethics into legal reasoning, and reorienting law enforcement toward ecological justice and ecosystem restoration. This article argues that a shift toward an ecological law paradigm is a normative prerequisite for effective environmental protection and for fulfilling constitutional obligations to safeguard intergenerational justice.

Abstract

Indonesia is currently facing an increase in fuel oil (BBM) consumption that is not matched by domestic production, resulting in Indonesia becoming a net oil importer. To maintain price and supply stability, the government has implemented a single-gate fuel import policy by strengthening the role of Pertamina. However, this policy is short-term in nature and does not provide structural protection against the risks of global price fluctuations and supply disruptions. The high level of dependence on imports therefore remains a serious threat to national energy security. At the same time, Indonesia does not yet have a comprehensive legal framework governing the establishment and management of a Strategic Petroleum Reserve (SPR). In fact, the SPR functions as an emergency reserve policy instrument that can safeguard supply during crisis situations without requiring direct intervention in market mechanisms. This study examines the urgency of regulating the SPR within Indonesia’s energy law by conducting a comparative analysis with the legal framework of the United States, as regulated under the Energy Policy and Conservation Act (EPCA) of 1975. The study shows that the U.S. SPR system is able to balance market mechanisms and state intervention, while strengthening national energy security through a strong legal foundation. This research recommends that reform of Indonesia’s energy law through the establishment of an SPR policy is urgently needed to reduce import dependence and to strengthen the sustainable stability of energy supply.

Abstract

The marriage legalization (itsbat nikah) procedure aims to provide legal protection for parties bound by marriage. Unregistered marriages are not only practiced by poor people in villages or the uneducated, but also by the upper middle class and educated. Ironically, unregistered marriages are used to manipulate existing legal regulation. Most parties who enter unregistered marriages are people who are not legally permitted to marry. Previous research shows that the number of marriage legalization applications in Indonesia continues to increase. Problem has not been resolved even though the regulations regarding marriage registration have been in effect for more than 50 years. The question that arises is whether itsbat nikah procedure is still relevant or or needs improvement. To answer this question, this study compares the Indonesian regulation on legalization with Sharia law in Malaysia. This comparison is made because both countries have regulations on Itsbat Nikah, and in Malaysia, it shows a decrease in cases of unregistered marriages. This study employed an empirical normative research method with the theory of "law as a tool of social engineering." The results indicate that the Indonesian marriage legalization law remains inefficient, and this study found that of efficient regulations in Malaysian law were identified.

Abstract

Penelitian ini bertujuan untuk menganalisis konstruksi hukum, implementasi prinsip good governance, serta implikasi fiskal dalam pengelolaan Program Makanan Bergizi Gratis di Indonesia. Permasalahan utama yang dikaji meliputi kesesuaian kebijakan dengan kerangka hukum keuangan negara, efektivitas penerapan prinsip transparansi, akuntabilitas, efisiensi, dan partisipasi, serta potensi risiko tata kelola yang muncul dalam pelaksanaannya. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, melalui analisis terhadap regulasi, doktrin hukum, dan literatur ilmiah terkait. Hasil penelitian menunjukkan bahwa meskipun secara normatif kebijakan ini telah memiliki dasar hukum yang memadai, implementasinya masih menghadapi berbagai kendala, seperti lemahnya pengawasan, inefisiensi anggaran, serta potensi penyimpangan dan moral hazard. Selain itu, alokasi anggaran program ini juga berimplikasi pada keseimbangan fiskal dan menimbulkan trade-off terhadap pembiayaan sektor publik lainnya. Penelitian ini menyimpulkan bahwa diperlukan penguatan tata kelola melalui reformasi regulasi, peningkatan akuntabilitas berbasis kinerja, serta penguatan mekanisme pengawasan yang terintegrasi. Temuan ini diharapkan dapat memberikan kontribusi dalam pengembangan kebijakan publik yang lebih transparan, akuntabel, dan berkelanjutan dalam pengelolaan keuangan negara.

Abstract

This study examines the role of the Intelligence Division of the Attorney General’s Office of the Republic of Indonesia in supporting state defense, as well as the opportunities and challenges arising in the era of artificial intelligence (AI). The analysis is grounded in the 1945 Constitution, Law No. 3 of 2002 on National Defense, Law No. 16 of 2004 on the Attorney General’s Office, and its amendment under Law No. 11 of 2021. This research employs a normative juridical method with statutory and conceptual approaches, particularly the theory of the rule of law and the concept of law enforcement intelligence. The findings indicate that prosecutorial intelligence plays a strategic role through early detection, security, and intelligence mobilization, positioning it within the non-military defense system to maintain national stability. Technological advancements provide opportunities for modernization through big data, machine learning, and predictive analytics. However, challenges include AI-based crimes, limited human resources and digital infrastructure, disinformation risks, and ethical and privacy concerns. Therefore, institutional transformation is necessary to strengthen technological capacity, data integration, and digital competencies in optimizing its role in the digital era.

Abstract

The Free Nutritious Meal Program (MBG) is a public policy directly related to fulfilling children’s rights to food, health, education, and development. This article analyzes MBG as an instrument for fulfilling children’s rights and public services, and assesses senior high school students’ voices as a legal basis for evaluating its implementation. This study uses a socio-legal or juridical-empirical approach, supported by statutory and conceptual approaches. Primary data were obtained through questionnaires from 103 students, with the analysis focused on 102 students who had received MBG. The data were analyzed descriptively through frequency tabulation, percentages, and mapping based on availability, accessibility, acceptability, quality, food safety, participation, and accountability. The findings show that MBG reduces spending on snacks, provides satiety, and improves access to food at school. However, issues remain regarding taste, menu variety, food waste, container hygiene, food freshness, drowsiness, and complaint channels.

Abstract

Changes in Indonesian consumer consumption patterns, previously focused solely on price and function, now consider environmental sustainability aspects. This encourages companies to develop eco-friendly products to meet consumer needs. However, the growing sustainable investment trend has introduced risks, including greenwashing practices by FMCG companies. Greenwashing harms not only consumers but also the environment and the companies themselves. This research uses a normative juridical method with statutory and conceptual approaches. Findings indicate that FMCG companies engage in greenwashing when claiming environmental friendliness on packaging labels without substantiation or committing one of the seven greenwashing sins. Thus, more comprehensive and specific regulations are needed, based on Lon Fuller's eight principles of legal certainty, to provide legal certainty regarding greenwashing practices and better protect consumers and the environment.

Abstract

This research examines the normative tension between the 3% GDP budget deficit ceiling under Law Number 17 of 2003 on State Finance and the fiscal flexibility introduced by Law Number 2 of 2020 during the COVID-19 pandemic emergency. The central issue is whether this rigid deficit ceiling satisfies the principle of legal certainty when applied under specific emergency conditions. This study employs normative legal research with a statute approach and a conceptual approach, employing a prescriptive analytical method. The findings indicate that the 3% ceiling, as a fixed legal norm, potentially conflicts with legal certainty principles when emergency conditions demand greater fiscal flexibility. This research recommends explicit normative reformulation governing deficit exceptions within a state financial law framework that remains adaptive yet measurable and accountable.

Abstract

Children who come into contact with the law require special protection to ensure the fulfillment of their human rights, including the rights to health, education, and development. This study discusses the regulation of children's rights fulfillment in the criminal justice process through mechanisms of diversion and restorative justice based on the Indonesian legal system, as well as analyzes whether their implementation has been able to optimally realize children's rights. The research uses a normative legal method with a statutory and conceptual approach through literature review. The results show that Law Number 11 of 2012 has regulated diversion and restorative justice as forms of child protection. However, its implementation has not been optimal due to resource limitations, differing understandings among law enforcement officials, and minimal institutional support. Strengthening the implementation is necessary so that children's rights protection can be effectively realized.
