Abstract

Law enforcement in cases involving juvenile offenders requires a specific approach, as children are still in the developmental stage. This study aims to analyze the application of restorative justice principles in the handling of juvenile criminal cases at the Central Jakarta Metropolitan Police. The research employs an empirical juridical method, with primary data collected through in-depth interviews, observations, and document analysis. A sociological legal approach is used to examine the implementation of restorative justice policies in social practice. The findings indicate that out of 78 juvenile criminal cases, approximately 70% were resolved through restorative justice mechanisms involving mediation between offenders, victims, families, and community leaders. This approach emphasizes the restoration of social relationships, accountability of juvenile offenders, and out-of-court case resolution to prevent negative impacts on children’s psychological development. Nevertheless, the implementation of restorative justice still faces several challenges, including limited public understanding, resource constraints, and inconsistencies in policy application.

Abstract

This normative legal research examines the house buying and selling system using the murabahah contract at the Bank Tabungan Negara (BTN) Syariah South Tangerang Branch Office. Using deductive methods and literature review, this study outlines seven procedural stages, from the customer's home order, through the granting of power of attorney through a wakalah contract, to the execution of the murabahah contract before a notary. The results indicate that this buying and selling practice does not fully provide fairness to customers. This unfairness is evident in the bank's dominance in unilaterally setting margins, excessively high margins compared to the cost price, and the lack of room for customer negotiation. Furthermore, there is a strict limit on repayment, which can only be made after three additional payments. This situation places customers in a weak bargaining position because they must fully comply with the bank's provisions.

Abstract

Corporate activities often cause widespread ecological and social damage to the environment, while existing legal instruments have not been effective in ensuring the implementation of environmental restoration obligations. Therefore, the application of dwangsom (coercive fines) through court rulings can be a progressive legal breakthrough. This study analyses the role of dwangsom as a legal instrument in encouraging corporate compliance with environmental restoration obligations and assesses its compatibility with the principles of justice, legal certainty, and benefit. The method used is a normative juridical approach through a review of legislation, jurisprudence, and legal literature. The results of the study show that dwangsom plays a strategic role as a means of coercion to increase corporate compliance with court rulings. However, its effectiveness still faces normative and practical obstacles, such as regulatory limitations, differences in judicial interpretation, and weak enforcement mechanisms. Therefore, regulatory strengthening and consistency in judicial practice are needed.

Abstract

Indonesia’s coastal ecosystems have strategic potential to support green investment through blue carbon stored in mangroves, seagrass meadows, and coastal wetlands. This article examines the prospects of blue carbon–based carbon trading and the readiness of national and regional legal frameworks, focusing on Aceh. Using normative and exploratory approaches, it finds that despite existing regulations on sustainable investment and carbon economic value, blue carbon development is hindered by overlapping authorities, the absence of a national roadmap, limited technical guidance, and weak incentives and community involvement. The Aceh case shows adaptive initiatives through regional carbon regulation and mangrove restoration based on carbon credits. The article recommends regulatory harmonization, a national blue carbon roadmap, and strengthened fiscal incentives and community-based benefit-sharing mechanisms to support sustainable coastal development and climate mitigation goals.

Abstract

This thesis examines the legal force of decisions of Honorary Council of the Constitutional Court (MKMK) and the limits of the State Administrative Court (PTUN) authority in reviewing State Administrative Decisions (KTUN) related to ethical violations by the Chairman of the Constitutional Court (MK), particularly through Decision Number 604/G/2023/PTUN.JKT. Using a doctrinal approach, the study finds that the execution of MKMK Decision Number 2/MKMK/L/11/2023 became legally uncertain after the PTUN ruling altered key aspects of the decision, including the revocation of Constitutional Court Decision Number 17 of 2023 and the restoration of Anwar Usman’s dignity. This situation places the enforcement of MKMK’s ethical sanctions under judicial review. Therefore, clearer limits between ethical oversight and legal adjudication are required. Strengthening MKMK’s institutional status with final and binding authority could enhance the enforcement of constitutional judicial ethics.

Abstract

Climate change is a global issue that involves not only ecological dimensions but also complexsocial, political, and legal aspects. Climate change regulation is not merely a normativeinstrument, but a social construction shaped through the interaction of various actors andinterests. This study analyzes the meaning of climate change regulation from a socialconstructionist perspective and examines it through the lens of progressive law. Socialconstructionism is used to understand that regulation is not purely objective, but emerges frominteractions among the state, civil society, the media, and corporations. Meanwhile,progressive law provides a framework to assess whether such regulations are responsive toenvironmental needs and social justice. This qualitative research employs document analysisand in-depth interviews with policymakers and academics. The findings indicate thatinterpretations of climate change regulation are strongly influenced by the social positions andinterests of the actors involved. Regulation is perceived both as a symbolic commitment and asan instrument of advocacy and protection. Inclusive and participatory regulations are foundto be more effective in encouraging collective behavioral change toward sustainability andecological justice.

Abstract

The rapid growth of e-commerce requires the state to reformulate its legislative functions to address the challenges of equitable and sustainable digital transformation. This article aims to analyze the state's constitutional role in formulating adaptive e-commerce regulations as part of a strategy to accelerate the achievement of the Sustainable Development Goals (SDGs). This research uses a normative-juridical approach by examining relevant laws and constitutional principles. The results indicate that the state's role is not limited to being a regulator; it must also act as a facilitator in creating an inclusive and equitable digital ecosystem. Responsive, participatory, and constitutionally based e-commerce legislation has proven to be a crucial prerequisite for ensuring legal certainty, consumer protection, and accelerating digital economic inclusion. This reformulation of the state's functions contributes significantly to the effective and sustainable achievement of the SDGs.

Abstract

Brand is a product's identity and serves as the initial capital for business development for Micro, Small, and Medium Enterprises (MSMEs), making it easier for consumers to recognize and choose products as an alternative among many available in the market. Therefore, legal protection for product identity becomes a strategic instrument. This is regulated in Article 3 of Law Number 20 of 2016 concerning Brands and Geographical Indications. However, in practice, there is an imbalance between the total number of MSMEs and the number of MSMEs whose brands are registered in West Aceh. The problems in this research are the implementation of legal protection for MSME brands and the obstacles in MSME brand protection in West Aceh. The research method is empirical-juridical, conducted by examining secondary and primary data. Legal protection for brands can be obtained by MSME actors when their product brand is registered with the Directorate General of Intellectual Property (DJKI). This registration is concrete proof of the value of legal certainty, as only registered brands are judicially recognized. The obstacles to its protection include: a) Lack of MSME Understanding of the Importance of Brand Protection, b) High Brand Registration Fees, c) Brand Registration Procedures Considered Complicated, d) Low Level of Compliance with Intellectual Property Rights (IPR), and e) Limitations of Human Resources and Infrastructure in MSME Brand Registration. The Regional Government can conduct measured and scheduled socialization to increase brand registration for MSMEs for the purpose of protection and increasing regional economic value.

Abstract

The implementation of Agrarian Reform (AR) in Indonesia has not maximum achievement, especially in redistribution land program. This is due to the absence of a dedicated institution tasked with data collection, inventory, and deposit management. Accelerating the completion of AR must ensure equitable access for all communities, especially smallholder farmers in rural areas. Meanwhile the establishment of the Land Bank Agency has the potential to further diminish the opportunity for completion of the AR program.The current establishment of the Land Bank is more towards supporting the acceleration of investment and infrastructure programs. This research is normative method, using primary legal materials in the form of laws, secondary legal materials in the form of scientific works, and tertiary materials in the form of dictionaries and online news reading materials. The results that the existence of the Land Bank should be more directed towards supporting and strengthening the completion of the RA agenda, particularly the land redistribution program. Abstract

This study examines the legal validity of advertising, marketing, and promotion expenses as international transactions in transfer pricing disputes through the case of Beam Global Spirits & Wine Pvt. Ltd. Using a normative juridical approach and case study method, the analysis focuses on Indian court decisions, Sections 92B and 92F of the Indian Income Tax Act, and the 2022 OECD TPG. The key findings show that the Bright Line Test lacks legal basis and does not reflect the economic substance of the transactions. The Delhi High Court ruled that transfer pricing adjustments are valid only when an international transaction is proven and analyzed using legally recognized methods. The study concludes that the Bright Line Test is inconsistent with domestic law and OECD principles, emphasizing the importance of functional analysis. For Indonesia, this case highlights the need for regulatory reform, improved documentation, and evidence‑based approaches to ensure fairness and legal certainty.
