Abstract

In cases where the objection raised by the Defendant/Legal Advisor is accepted, the Defendant must be released from detention, allowing the Public Prosecutor to initiate a fresh prosecution with an amended indictment. Challenges arise during re-prosecution concerning the authority of the District Court Judge to order detention. This research adopts a normative legal approach. The findings indicate that, firstly, the District Court Judge lacks the authority to detain the Defendant, as the release from detention resulted solely from an error by the Public Prosecutor in indictment preparation. Re-detention by the District Court Judge is deemed a violation of the presumption of innocence and the principle of equality before the law. Secondly, future reforms to the Criminal Procedure Code should encompass provisions for the release of the Defendant from detention upon acceptance of objection, coupled with a confirmation of the District Court Judge's non-authorization to detain in the subsequent case. This study recommends a reform of the Indonesian Criminal Procedure Code (KUHAP) to enhance legal certainty regarding the detention of the Defendant in subsequent cases. Abstract

The debate on eradicating criminal acts of corruption for criminal law reform is legal and theoretical. This article discusses an important aspect of eradicating criminal acts of corruption in criminal law reform, namely how the position of the law applied in criminal law reform is seen in society from a legal theory perspective since the passing of the New Criminal Code in Indonesia. This problem was analyzed theoretically using normative legal research methods and the conclusion was obtained that the dynamics of eradicating corruption in Indonesia since the enactment of the New Criminal Code will experience a slowdown in the law enforcement process. This is because there are several articles that do not have firmness and legal certainty, such as article 603 of the new Criminal Code which reduces the sentence period for corruptors. The New Criminal Code has made corruption offenses the same as general offenses, so that they no longer have special characteristics or fall into the category of special crimes. Therefore, the Government should review the articles related to corruption offenses in the New Criminal Code so that the legal regulations do not experience a setback compared to the Corruption Eradication Law. Apart from that, there must be synchronization of regulations between the New Criminal Code and Law Number 30 of 2001 concerning the Eradication of Corruption Crimes.

Abstract

The President has taken a policy to dissolve state institutions, most recently through Presidential Regulation Number 112 of 2020, which dissolved 10 non-structural state institutions. This is suspected as a decisive step to create effectiveness in the legal system within the state institutions. Factually, there are currently too many regulations being created by state institutions, causing an overlap of duties and authorities, and inefficiency due to self-entanglement, making each state institution difficult to operate. Therefore, there is a need for a reduction in state institutions to achieve regulatory reform that is results-oriented, not just procedural. This is based on the goal of legal development, which is not only inherent in substance but also in legal structure and culture. The purpose of this research is to understand, examine, and analyze the President's considerations for the dissolution of non-structural state institutions and to analyze the implications of the dissolution of non-structural state institutions on the formation of regulations and legal order in Indonesia. This research method uses normative legal research with a legislative approach and a conceptual approach referring to literature studies. The conclusion of dissolving non-structural state institutions is aimed at improving bureaucratic performance by minimizing overlapping duties and functions that result in the waste of authority and budget inefficiency. Additionally, there is a need for further regulation at the legislative level regarding non-structural institutions to establish fixed procedures from formation to dissolution, similar to the concept of regulating state ministries in Law No. 39 of 2008 concerning State Ministries.

Abstract

Selama ini apabila terjadi pelanggaran disiplin keilmuan kedokteran diselesaikan di melalui MKDKI. Padahal disisi lain, pelanggaran disiplin keilmuan kedokteran sebenarnya bagian dari dimensi hukum pidana. Namun dalam praktiknya, hingga saat ini posisi hukum MKDKI, dikarenakan MKDKI masih di wilayah eksekutif dan tidak terdapat upaya banding. Sedangkan MKDKI telah melaksanakan quasi peradilan seperti halnya peradilan dibawah kekuasaan kehakiman, sehingga memunculkan kerugian konstitusional terhadap dokter. Penulisan hukum ini, menggunakan pendekatan metodologi hukum normatif dengan sumber data sekunder di dukung data primer. Hasil penelitian menunjukan bahwa MKDKI telah melakukan fungsi peradilan sedangkan MKDKI berada diwilayah eksekutif. Selain itu, dalam putusan MKDKI tidak ada upaya banding, maka secara hukum sangat penting mendirikan peradilan profesi medis dibawah kekuasaan kehakiman untuk mewujudkan law enforcement dan fair trial dan dalam konteks ius constituendum, pertama, peradilan profesi medis berdiri secara tetap dalam peradilan umum, dalam hal ini pengadilan negeri diseluruh Indonesia. Kedua, peradilan profesi medis berdiri secara tetap dalam peradilan umum dalam hal ini pengadilan negeri di seluruh Indonesia, akan tetapi sifatnya ad hoc.

Abstract

This research explores the newfound avenues for capital acquisition among creative economy stakeholders through banking institutions, leveraging intellectual property rights (IPR) as valuable collateral following the enactment of PP No.24/2022 in tandem with Law No.24/2019. Employing normative-empirical methodologies encompassing regulatory analysis, conceptual frameworks, and case studies, the study underscores the imperative for banking institutions to minimize risk exposure while extending credit facilities. PP No.24/2022 elucidates provisions within Law No.24/2019, offering creative economy actors opportunities to access credit capital by leveraging registered intellectual property assets. Notably, registration with the Director General of Intellectual Property Rights Center of the Ministry of Law and Human Rights confers state legitimacy on IP ownership. The intrinsic economic potential of intellectual property assets underscores their viability as collateral, prompting banking institutions to facilitate business capital loans, contingent upon adherence to legal protocols and due diligence. Integral to this process are adherence to regulatory standards, prudent risk management, and consideration of prospective debtors' credibility and economic viability. While collateralization remains pivotal, each bank exercises discretion in evaluating collateral based on individual assessments of prospective debtors. Furthermore, ongoing reviews within the banking and non-banking sectors aim to standardize policies concerning credit provision for creative economy actors. Key considerations include methodologies for valuing intellectual property, ranging from conventional cost, income, and market approaches to contemporary methods encompassing cost-benefit analyses, expert evaluations, and innovation surveys.

Abstract

Derden Verzet adalah upaya hukum luar biasa untuk melawan keputusan hakim yang merugikan seseorang. Perlawanan pihak ketiga diatur dalam Pasal 195 ayat (6) dan (7) HIR, atau Pasal 206 ayat (6) RBG. Pasal 195 ayat (6) HIR. Perlawanan pihak ketiga terhadap penyitaan eksekutorial hanya dapat dilakukan setelah ada putusan yang memiliki kekuatan hukum tetap. Pada prinsipnya, perlawanan yang diajukan oleh pihak ketiga terhadap penyitaan eksekutorial tidak menghentikan eksekusi. Dalam hal ini, pihak ketiga harus dapat membuktikan bahwa dia adalah pemilik dari barang yang disita. Selain itu, penentang harus benar-benar memiliki kepentingan untuk meminta pengangkatan penyitaan eksekusi tersebut karena telah merugikan haknya. Jika pihak ketiga dapat membuktikan bahwa barang tersebut adalah miliknya dan bukan milik tergugat, maka penentang harus diakui sebagai penentang yang jujur, dan perintah penyitaan harus dicabut. Dengan demikian, putusan mengenai perlawanan pihak ketiga terhadap penyitaan eksekusi hanya berhubungan dengan pencabutan penyitaan eksekusi atas barang milik pihak ketiga dan tidak memutuskan hak kepemilikan tanah. Namun, dalam prakteknya, terdapat keputusan-keputusan mengenai Derden Verzet yang memutuskan mengenai kepemilikan hak atas tanah yang dipersengketakan. Hal ini menimbulkan masalah hukum dalam pelaksanaan eksekusi karena bantahan atau perlawanan pihak ketiga terhadap keputusan eksekusi hanya berhubungan dengan pencabutan penyitaan eksekusi atas barang milik pihak ketiga.

Abstract

Regional regulations are the product of Regional Government legislation which must not conflict with higher regulations according to the hierarchy of statutory regulations and must not be outside the will of the Central Government. In the context of supervision by the Central Government, it is necessary to harmonize the Draft Regional Regulations. This research focuses on discussing the urgency of harmonizing Regional Regulations and the application of Pancasila values ​​in harmonizing Regional Regulations. The research method used is qualitative with a normative juridical approach and prescriptive characteristics. From the results of the study, it was found that the urgency of harmonizing regional regulations is summarized in 3 (three) reasons, namely first, because regional regulations are a sub-system in the national legal system and are in the hierarchy of statutory regulations. Second, regional regulations can be tested through the judicial review or executive review. Third, to ensure legal certainty in the process of forming regional regulations. In essence, the harmonization of regional regulations is based on the application of Pancasila values, this is carried out as a form of preventive effort to prevent overlapping legal products. Abstract

The Nusantara Capital City (IKN) is a designated region as the Capital of Indonesia, replacing the DKI Jakarta. As a special administrative region, IKN led by a Chief Authority, whose appointment is directly designated, appointed, and terminated by the President in consultation with the DPR. This article delves deeply into the democratic phrase within the provisions of Article 18 paragraph (4) of the UUD 1945. The importance of electing the Chief Authority through direct appointment, and the participation of the people in the election of the Chief Authority. This research is a normative empirical legal study, utilizing a legislative framework approach and a survey involving 20 respondents, based on qualitative analysis. The results of this research indicate that the democratic phrase in Article 18 paragraph (4) of the 1945 Constitution is not accommodated in the IKN Law. The urgency of direct appointment in elections is to streamline bureaucratic processes, resulting in a greater role for the central government, Furthermore, the absence of a Regional Budget (APBD) for conducting regional elections, and from the distributed questionnaires, it is evident that, on the whole, people are aware of the plan to relocate the capital city but are unaware of who the local leaders are and how the selection process for the Chief and Deputy Chief Authority is conducted

Abstract

One of the elements that must exist in a legal and democratic state is the protection of human rights, including child protection, which will determine the future of the Indonesian state and ensure that future generations have clear regulations. This research is normative legal research, namely legal research that places law as a building block of norms. The juvenile criminal justice system is used by law enforcement to decide criminal sanctions against children who commit criminal acts or children who are in conflict with the law. The best interests of the child must be the main priority in child punishment. However, according to Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, Juvenile criminal justice falls under the scope of the General Court. In completing diversion and restorative justice procedures in accordance with statutory provisions for children in conflict with the law, Settlement efforts use mediation, conciliation, and restitution methods simultaneously to unite the parties in a settlement. Therefore, it is mandatory to ensure that cases of children in conflict with the law do not involve the judicial process. Instead, the case was transferred outside the judicial process (non-litigation).

Abstract

Penelitian ini menganalisis secara kritis indikasi kesalahan dalam pengaturan wewenang Penuntut Umum dalam penutupan perkara demi kepentingan hukum berdasarkan penyelesaian di luar pengadilan menggunakan pendekatan keadilan restoratif. Penelitian ini menggunakan metode penelitian hukum normatif. Wewenang penutupan perkara demi kepentingan hukum berdasarkan penyelesaian di luar pengadilan menggunakan pendekatan keadilan restoratif yang dimiliki oleh Penuntut Umum berdasarkan Pasal 3 Perja Nomor 15 Tahun 2020 mengandung sejumlah permasalahan hukum seperti permasalahan karena terdapat ketidaksesuaian dengan teori dan praktik-praktik tentang jenis-jenis seponeering, permasalahan karena bertentangan dengan Undang-Undang tentang Kejaksaan Republik Indonesia yang telah mengatur bentuk diskresi penuntutan atau asas oportunitas, permasalahan karena bertentangan dengan praktik penerapan KUHAP dan KUHP dalam praktik di pengadilan sehingga restorative justice berpotensi untuk dipraperadilankan dan dilimpahkan perkaranya ke pengadilan serta permasalahan-permasalahan lainnya. Permasalahan tersebut kian jelas jika mengingat ratio legis diaturnya pelaksanaan diskresi penuntutan yang hanya dimiliki oleh Jaksa Agung dalam Undang-Undang Nomor 15 Tahun 1961 adalah untuk menghindarkan penyalahgunaan wewenang dan tindakan negatif bernegara lainnya seperti kolusi, korupsi dan nepotisme Oleh karenanya untuk mencegah terjadinya konflik hukum dikemudian hari Jaksa Agung harus mencabut Perja Nomor 15 Tahun 2020.
