Abstract

Penelitian ini dilakukan untuk melihat bagimanakah penyelesaian sengketa tanah ulayat pada proyek pembangunan jalan di Kabupaten Sorong Papua Barat. Tujuan penelitian adalah untuk mengetahui dan memahami praktek pelaksanaan penyelesaian sengketa dan juga faktor penyebab terjadinya sengketa tanah ulayat pada proyek pembangunan jalan di Kabupaten Sorong Papua Barat. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis empiris yaitu jenis penelitian sosiologis atau yang disebut dengan penelitian lapangan, yang mana penelitian ini mengkaji terkait ketentuan hukum yang sedang berlaku dan juga terjadi pada lingkungan masyarakat tersebut. Hasil penelitian ini menunjukkan bahwa terdapat kekurangan dalam penerapan peraturan perundang-undangan pelaksanaan pembangunan jalan yang berlaku terhadap kebiasaan dan kebutuhan masyarakat di Kabupaten Sorong Papua Barat. Kekurangan tersebut terkait tidak dapat berjalannya peraturan-peraturan perundang-undangan yang telah ditetapkan oleh pemerintah dengan kondisi dan kebutuhan masyarakat yang masih mengutamakan hukum Adat setempat untuk melaksanakan pengadaan dan penyelesaian sengketa tanah ulayat pada proyek pembangunan jalan di Kabupaten Sorong Papua Barat.

Abstract

Government regulation No. 24 1997 on the land registry, in section 2 mentioned that the land registry implemented bersasarkan some of the principle of which the principle of simple and affordable. principle simple intended to the provisions of anyway and procedure can easily be conceived by the parties concerned, especially the holder of land rights. then the principle of affordable intended affordability for parties that require especially with regard needs and the ability of class of economic weak. in particular the people in the district Lombok Western, the implementation of the principle that has not been in accordance with what to expect. in peroses registration land rights through sporadic still takes a long time and cost expensive.

Abstract

Kedudukan pemberi fiducia semakin kuat maka dalam undang-undang Nomor 42 Tahun 1999 tentang Fidusia, Pasal 29 ayat (1) huruf c, ditambah ketentuannya menjadi, jika pemberi fiducia cidera janji, maka penerima fiducia dapat menjual langsung obyek jaminan fiducia melalui penjualan di bawah tangan. Dalam Pasal 29 ayat (1) huruf c Undang-Undang Nomor 42 Tahun 1999 tentang Fidusia yang memberikan kewenangan kepada pihak penerima fidusia/kreditor fidusia untuk menjual barang jaminan dengan cara di bawah tangan kesepakatan antara pihak penerima/kreditor fiducia, dengan pemberi/ debitur fiducia. Setelah jangka waktu satu bulan setelah jatuh tempo debitur wanprestasi, ketentuan tersebut harus ditambah satu ayat yang isinya: kesepakatan antara pemberi dan penerima fidusia di cantumkan diawal perjanjian, sehingga berbunyi; sejak debitur fiducia wanprestasi maka telah terjadi kesepakatan antara pemberi dan penerima fidusia, penerima fidusia berhak menjual barang jaminan dengan cara di bawah tangan. Dalam Pasal 29 ayat (1) huruf c ada ketentuan yang menyatakan bahwa untuk menjual barang jaminan harus diumumkan dalam dua surat kabar dalam waktu 1 bulan. ketentuan ini harus ditambah satu ayat, sehingga berbunyi; jika dalam jangka waktu buku berakhir terdapat pembeli barang jaminan fiducia dengan harga yang mengutungkan, maka jangka waktu pengganti satu bulan sebagaimana diatur dalam Pasal 29 ayat (1) di cabut.

Abstract

Magang merupakan syarat mutlak bagi calon notaris untuk menjadi seorang Notaris, dengan munculnya Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris untuk ketentuan magang diperpanjang menjadi 24 (duapuluh empat) bulan yang semula hanya 12 (dua belas) bulan demikian berdasarkan Pasal 3 huruf f, proses magang sangat erat kaitannya dengan tempat dimana calon notaris melakukan magang yaitu di kantor Notaris, bagi kantor Notaris yang menerima magang tentu sedikit banyak rahasia aktanya akan diketahui oleh calon notaris yang sedang magang. Penulis dalam tesis ini ingin menelaah dan menganalisa lebih lanjut tentang tanggung jawab calon notaris yang sedang magang dalam merahasiakan akta dan bentuk-bentuk sanksi bagi calon notaris yang sedang magang yang membocorkan rahasia akta. Metode penelitian yang digunakan adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau bahan hukum sekunder sedangkan dalam mencari dan mengumpulkan data dilakukan dengan dua pendekatan, yaitu pendekatan undang-undang dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa calon notaris yang melaksanakan magang dalam suatu kantor Notaris berkewajiban menjaga rahasia akta dan segala keterangan yang diperoleh dalam pembuatan akta hal tersebut berdasarkan pada Pasal 16 A ayat 2 UUJN, pelaksanaan atas isi pasal tersebut merupakan bentuk dari tanggung jawab calon notaris kepada negara, dalam hal calon notaris membocorkan rahasia akta, maka dapat dikenai sanksi secara pidana yaitu sebagaimana diatur dalam Pasal 85 Undang-Undang Nomor 43 Tahun 2009 Tentang Kearsipan juncto Pasal 54 ayat (1) Undang-Undang Nomor 14 Tahun 2008 Tentang Keterbukaan Informasi Publik serta sanksi secara perdata sesuai Pasal 1365 KUHPerdata.

Abstract

Mining activities in Indonesia obviously have to open a network for remote areas and development activities in accordance with its designation, which leads to the development of new growth centers in some areas. This will encourage and provide benefits in the construction of basic infrastructure for the region, increase revenues, and employment. The business activities of mineral and coal are expected to drive the development of economic empowerment, especially in eastern Indonesia. Development of mineral and coal mining sector should be based on good mining practices and correct by observing the basic elements in accordance with the principles of sustainable development, of the various aspects of life of human beings and other living things in an ecosystem. Artisanal mining management policy carried out by the local government should bersendikan the constitutional mandate that is expected to be as big as possible for improving standards of living for the welfare as well as the objectives of the state. Artisanal mining policy carried out by the local government is not only focused on improving the local economy, but must have meaning and value proportional balance between the growth rate of public welfare with environmental sustainability of the ecosystem. With regard to the mining policy, local government and the parliament as an element of the regional administration has a strategic position and authority in the application of the policy is to create an atmosphere of constructive working relationship in accordance with the mandate of the laws and regulations. The existence of Parliament has a very important position in directing and controlling the various aspects of government policy to play an active role through the functions. Involvement of the oversight function of Parliament against all attitudes / acts carried out by the local government, is an instrument for measuring the basic validity and justification for these policies. With this research is expected to provide an integral understanding of scientific concepts about the functional relationship between the Parliament and Local Government through the oversight function of Parliament in the implementation of mining policy carried out by the people of Local Government. Under the oversight function, the role of Parliament can perform certain actions to steer towards things that should be done as well as control over the circumstances undue occur in any government policy. The method used in this study is a normative method which is based on materials of law and accompanied by field studies as supporting material to the object being studied and analyzed in this study.

Abstract

This research aims to know the menganalisi and land that is already dominated by the subject of the law for many years and has been completed with the certificate. But still there is no outside parties are demanding land rights. How did with prisif in good faith as set forth in militate crustaceans land. Sehinggan need to see land registry implementation procedures in order to obtain the power of the law of the strongest, according to the Government Regulation Number 24 in 1997, the power of legal land rights Certificates according to the provisions of article 32 paragraph (2) the Government Regulation Number 24 in 1997 and the accountability of the Agency which issued the Certificate of land rights over the land containing juridical defect. The approach used in this study is Statutes Approach, as is the provision of article 32 paragraph (2) Government Regulation No. 24 of 1997 about the land registry, conceptual approach related provision of article 32, paragraph (2) Go-vernment Regulation No. 24 of 1997 about land registry and Analitical approach based on the provisions of article 32 paragraph (2) the Government Regulation number 24 in 1997 about the land registry.

Abstract

Before the reformation, the authority of People’s Advisory Assembly of Indonesia Republic (MPR-RI) given by the 1945 Constitution was so centered only to this institution, that there was not check and balance among the structures of state institution that enables for democracy. The reformation spirit, starts an effort to do restructuring in the state institutions, especially, MPR. It aims to minimize or limit the duty and authority of MPR in order to achieve democratic atmosphere and give the priority to checks and balances and to resume the people’s power fully to the people’s hand. This was based on the consideration that this research attempted to find out the norms and legal theory about the existence of MPR authority. according to the new the 1945 Constitution, MPR was changed from the highest state institution to be equal to the other state institutions (DPR, DPD, President, BPK, and the Institution of Justice, namely, MK MA, and KY). The MPR authority was limited in three main cases: changing and deciding Constitution (Article 3, subsection (1)); second, administering President and/or Vice President (Article 3, subsection (2)); and third, dismissing President and/or Vice President in the period of their position according to Constitution (Article 3, subsection (3)). Thus, MPR did not elect and administer President but it just inaugurates President. This direct Presidential election gave the effect that the President is responsible to the people directly, not to MPR. The Duty of MPR, which also decides on the GBHN, was removed because in this system the President made the programs him self, not made by MPR.

Abstract

Mergers and Acquisitions is a legal phenomenon that occurs in companies incorporated as legal entities including financial institutions. Mergers and Acquisitions aim to strengthen institutional structures and strengthen cooperative capital in the hope of improving member welfare. The legal aspects of Mergers and Acquisitions on cooperatives emphasize the legality aspect, the reasons for Mergers and Acquisitions, the processes and their legal consequences. It's just that the Acquisition in the future must be calculated and regulated in legislation because not many cooperatives are doing it Acquisition is needed as one business strategy to develop cooperatives to exist in the middle of society.
