Abstract

Every marriage will give birth the union of assets that can be obtained by husband and wife during the marriage if not excluded by the marriage agreement. However, the Marriage Law explicitly and clearly stipulates that the marriage agreement must be made before the marriage takes place or at the time the marriage takes place. The existence of these legal provisions, in fact, is not entirely known by every prospective husband and wife and raises new problems related to land law that limits ownership rights to land and buildings for Indonesian citizens who marry other citizens without marriage agreements. This is the reason for the birth of a material test suit against the provisions of the Marriage Law contained in the Decision of the Constitutional Court No. 69 / PUU-XII / 2015. This decision forms the basis and legal basis for new arrangements as a source of legal renewal on the procedures for marriage agreements and their legal consequences for joint assets acquired in marriage. The born of legal renewal is the marriage agreement that can be made any time during the marriage in the form of an authentic deed at the notary and can be retroactive from the date the marriage takes place as long as the husband and wife agree and bind as a law to the parties. For this reason, the legal consequences of the legal status of joint assets acquired during marriage are the personal property of each husband and wife and their contents are binding on third parties as long as the third party has an interest.

Abstract

The research aims to discuss Assimilation of Prisoners in Mataram Open Correctional Institution. The legal issue proposed in this research include How is the provision of assimilation for prisoners from prisons to the Mataram Open Correctional Institution. This study used normative legal research that examines the legal norms regarding the provision of assimilation from prisons to open prisons and stages of assimilation in the Mataram Open Correctional Institution. The approach of the thesis used legislation and conceptual approach. The technique of collecting legal materials are (1) literature study by systematically processing the legal material and (2) making known interpretations in law science to the laws and regulations relating to this research and the conclusion ultimately drawn deductively. The result of this script concludes that the assimilation requirement for prisoners is not the same but differentiated based on criminal acts committed by prisoners. The criminal acts are categorized into general crimes and special crimes which are included in "extraordinary crimes".

Abstract

The principle of good faith in land sale agreement, especially in disputes between the seller and buyer is still limited to the execution of the contract. In court view the existence of good faith principle is not to correct the contents of the agreement, but the means to assess whether the parties have been good in fulfilling their performance or not. The court did not apply the principle of good faith to judge whether the contents of the sale agreement were fair and fair or not. Whereas in the context of the protection of a third party who obtains a good goodwill, the principle of good faith is applied selectively. A third party is deemed to have acquired a good good will if he or she does not know that it belongs to the seller. The Buyer-party benchmark is considered really do not know is not know even though it has been worthy of examination both the land letters and the physical land of the object of sale. In addition, buyers also have to find out by multiplying information from the parties who berwenag like village head, head of the hamlet, the BPN or to the court.

Abstract

Before the reformation, the authority of People’s Advisory Assembly of Indonesia Republic (MPR-RI) given by the 1945 Constitution was so centered only to this institution, that there was not check and balance among the structures of state institution that enables for democracy. The reformation spirit, starts an effort to do restructuring in the state institutions, especially, MPR. It aims to minimize or limit the duty and authority of MPR in order to achieve democratic atmosphere and give the priority to checks and balances and to resume the people’s power fully to the people’s hand. This was based on the consideration that this research attempted to find out the norms and legal theory about the existence of MPR authority. according to the new the 1945 Constitution, MPR was changed from the highest state institution to be equal to the other state institutions (DPR, DPD, President, BPK, and the Institution of Justice, namely, MK MA, and KY). The MPR authority was limited in three main cases: changing and deciding Constitution (Article 3, subsection (1)); second, administering President and/or Vice President (Article 3, subsection (2)); and third, dismissing President and/or Vice President in the period of their position according to Constitution (Article 3, subsection (3)). Thus, MPR did not elect and administer President but it just inaugurates President. This direct Presidential election gave the effect that the President is responsible to the people directly, not to MPR. The Duty of MPR, which also decides on the GBHN, was removed because in this system the President made the programs him self, not made by MPR.

Abstract

The province of North Kalimantan is the youngest province in Indonesia, located in the northern part of Kalimantan Island. Northern Kalimantan Province is established based on Law No. 20 of 2012 establishing the Northern Kalimantan Province. Nunukan Regency is one of five districts / cities in the province of North Kalimantan covering an area of ​​14,263.68 km2. Geographically, Nunukan Regency is located in the northernmost region of Kalimantan, which borders directly with a neighboring country, Sabah-Malaysia. The legal status of the land becomes a written proof that is legally recognized. All land rights are recorded in the form of National Land Agency (BPN) certificates. BPN creates duplicates of landowners to avoid future risks, such as: B.: Lost certificates, burned certificates and duplicate certificates. In Indonesia, land ownership status is governed by the Basic Law of Agriculture (UUPA) No. 5 of 1960 on Agricultural Principles. Rural residents living in the Border Coast, especially in the Nunukan Subdistrict, Nunukan Utara district, is the Nunukan Regency, a leased land owned by PT. Inhutani as the de facto landlord (HGU), above the property for PT. Inhutani in the Nunukan district, Nunukan district, Nunukan Utara district stands thousands of buildings owned by both the community and the government, where the majority have no legal proof of domination. The problem in this study is the legal status of the ownership of land in the border coastal areas and the policy of the local government in providing legal solutions to control the use of land in coastal areas. Based on the results that concludes the legal status of the land of coastal residents who live in the region as the right boundary, as the conversion of Hak Guna Usaha (HGU) by PT.Inhutani is used, that researchers know ended Hak Guna Usaha ( HGU) was on the ground since 2009. But it was extended to 2038. While the legal solution for providing legal certainty of the owner of the building in the country of PT. Inhutani receives until the bleaching of the rights building use rights (HGB) to the community, because PT. Inhutani is no longer productive / operates and produces forest products, in Nunukan sub-district, Nunukan Utara village, but only the establishment of settlements and thousands of municipal and state buildings.

Abstract

Tulisan ini bertujuan untuk mengetahui bagaimana signifikasi dan faktor-faktor hukum bagi pertimbangan hakim dalam menjatuhkan pidana dengan syarat bagi anak pelaku tindak pidana narkotika, guna memberikan keadilan dan kemanfaatan bagi anak yang berkonflik dengan hukum yang mencarinya dalam ruang persidangan. Berdasarkan kajian penulis terhadap putusan No. 5/Pid.Sus Anak/2015/PN. Stb dengan menggunakan pendekatan kasus (case approach) dalam memahami ratio legis dan ratio decidendi-nya, maka dapat disimpulkan beberapa hambatan hakim dalam menjatuhkan pidana bersyarat bagi anak pelaku tindak pidana narkotika. Anak sebagai salah satu subyek di dalam negara, turut mendapat perlindungan konstitusi tersebut. Artinya, negara dengan berdasarkan kewenangan dan kedudukannya memperhatikan secara seksama segenap fenomena yang meliputi kehidupan anak. Dimana negara lalu mengatur fenomena-fenomena tersebut dengan membuat suatu hukum sebagai aturan-aturan yang mengikat serta harus dipatuhi oleh setiap individu dalam masyarakat, sekaligus penerapan sanksi bagi yang melanggar aturan. Arti penting perlindungan hukum bagi anak dapat dipahami dari posisinya sebagai bagian dari generasi muda suatu bangsa yang memiliki potensi untuk memajukan bangsa kelak ketika dewasa. Anak perlu mendapat perlindungan dan pembinaan agar dapat tumbuh dan berkembang dengan baik.

Abstract

The purpose of this research is to determine and understand the role of Indonesia Arbitration Centre (BANI) in resolving business disputes in Indonesia and procedure in Indonesia Arbitration Centre to dispute business settlement. Method of approach in this research use Legislation approach (statute approach), conducted by reviewing laws and regulations relating to the issues discussed. Conceptual Approach, examines the views/concept of the experts people to the issues of discussed: Based on above, the results of this reasearch are: Indonesia Arbitration Centre is currently favored to dispute resolution by the parties who are in business, It is seen from the development of BANI in settlement the business dispute both after and before enactment of The Act Number 30 of 1999 on Arbitration and Alternative Dispute Settlement. Dispute Settlement procedures at BANI can be done by submission of application and registration, defendant feedback, foration the arbitral tribunal, arbitration reconnaissance, determination the arbitration decision and the submission and registration of the arbitration decision.

Abstract

Penelitian ini dimaksudkan untuk menjawab dua isu hukum pokok yaitu 1). Bagaimana pengaturan organisasi perkumpulan sebagai badan hukum berdasarkan peraturan perundang-undangan di Indonesia? 2). Bagaimanakah konsekwensi yuridis Putusan Mahkamah Agung terhadap legalitas Badan Hukum Nahdatul Wathan (NW)? Untuk menjawab permasalahan yang telah dirumuskan dalam penelitian ini, digunakan beberapa metode pendektan : Pendekatan perundang-undangan (statute approach) dan Pendekatan Konsep (conceptual approach) . Berdasarkan hasil penelitian menunjukkan : 1). Pengertian perkumpulan di Indonesia sangat sederhana, hanya didasarkan kepada adanya kumpulan orang yang mempunyai maksud dan tujuan sehingga semua badan usaha dan badan hukum yang ada di Indonesia diartikan sebagai suatu Perkumpulan. Badan hukum yang telah ada di Indonesia yang dipersamakan dengan Perkumpulan apakah itu perseroan terbatas, koperasi, yayasan semuanya sudah memiliki payung hukum yang jelas dan tinggi yaitu Undang-Undang sedangkan Perkumpulan, pengaturan mengenai Badan Hukum Perkumpulan masih didasarkan pada peraturan peninggalan kolonial Belanda yaitu staadsblaad No 1870 dan juga tersebar pada peraturan-peraturan lain. Pengaturan mengenai pengesahan badan Hukum Perkumpulan hanya diatur dalam Peraturan Menteri saja yang kedudukannya jauh dibawah undang- undang yaitu Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 6 Tahun 2014 tentang Pengesahan Badan Hukum Perkumpulan. 2). Bahwa dengan telah terbitnya Putusan Mahkamah Agung Nomor 37 K/TUN/2016 yang membatalkan Surat Keputusan Menteri Hukum Dan Hak Azasi Manusia Nomor AHU-00297.60.10.2014 tanggal 11 juli 2014, maka eksistensi Organisasi Sosial Keagamaan yang didirikan berdasarkan Akta Nomor 48, tanggal 29 Oktober 1956, yang dibuat oleh Hendrik Alexander Malada, Notaris Pembantu Mataram, yang didaftarkan dan ditetapkan oleh Menteri Kehakiman RI melalui Surat Nomor J.A.5/105/5, tanggal 17 Oktober 1960 tetap di akui.

Abstract

The title of article is The Law and Justice with the Life of Human in Islamic Perspective with the aim is to give the description about the rule of law in regualating the human life, so that created the properity,safety, peacefulness in social life. The analysis which is used in this article is descriptive analysis that conducted by library studi, it means that the author use the main data is secondary data that obtained from the relevant references,then it is analyzed an described. According to the result of analysis indicate that, the performance of human life is needed the existence of norms of law to regulate the human life in the social function in order to be created the safety and peacefulnees in society. For attaining that condition is needed the fairness,than the fairness can be obtained if there is equality,between rights and obligation on each person and the full responsibility.

Abstract

Fungsi hukum dalam komersialisasi dan eksploitasi invensi dan kreasi kekayaan intelektual yang dihasilkan oleh Industri kecil menengah merupakan bagaian dari upaya yang dapat dilakukan agar industri kecil menengah memperoleh kepastian dan perlindungan hukum terhadap penggunaan atau pemanfaatan invensi dan kreasi yang dihasilkannya. Untuk mendapatkan perlindungan hukum agar tidak diklaim dan untuk dapat menuntut pihak lain yang menggunakan tanpa ijin, maka industri kecil menengah yang menghasilkan invensi dan kreasi tertentu sesuai dengan peraturan yang berlaku di bidang kekayaan intelektual di Indonesia maka wajib hukumnya untuk didaftarkan (prinsif konstitutif), kemudian setelah dilakukan pendaftaran Hak Kekayaan Intelektual tersebut dalam pengekploitasian dan pengkomersialisasiannya agar Industri kecil menengah aman, maka dapat dilakukan dengan mekanisme Hukum Jual beli, lisensi (ijin pemanfaatan), Joint venture (usaha patungan) dan melalui mekanisme franchising (waralaba).
