Abstract

One of the goals of the Cooperative is for the welfare of its members based on the principle of kinship and mutual cooperation, so that the management is required to apply the standard of professional management and responsible as to uphold the principles of transparency, accountability, independence and accountability both legally and economically and democratically. Cooperative as a pillar of the economy of the Indonesian nation must make its contribution to improving the economy of the community. Several cases that emerged recently as in the case of fraud by unscrupulous members of the cooperative board, the credit agreement that violates the rules so as to make the cooperative becomes a loss, lack of monitoring and evaluation internally by the cooperative supervisors. It would be a black mark to the development of cooperatives in Indonesia, so that the necessary urgency enforcement seriously and comprehensively both by the Ministry and the Department of Cooperatives and SMEs as well as elements of other law enforcement in order to restore the good name of the cooperative in the community as one of the pillars of the economy-based society.

Abstract

Execution liberation land right for development base on public interest must be on procedure that commended on law and regulation especially related by liberation to land right for development base on public interest. One of law and regulated are UUPA number 5 year 1960 as the top of regulated about land and as the main gate of human right to land right, beside that many regulation that related to liberation land right for execution development base on public interest. In the contex of requirement of land are relation closely by legality of pallet ownership that oftenly make problem on practice especially in processes for liberation to right land for exeploited development base on public interest, the social right in mastered land and perpetrator development oftenly use development mission for publict interest that forgetting the mean of welfare and social need. Therefore the fact in execution liberation land right must be done by deliberation of general consensul among owner of land with the government, so will be doing by applicant of land liberation, before that the land will be analysis with suitable development creteria by Bappeda and than inviting land owner to look for the suitable price without to prejudicate the right owner of land and than payed according wide of the land.

Abstract

Figures abuse of narcotics in Indonesia is still quite high, so that Indonesia still had to be alert to prevent and combat the abuse and trafficking of illegal narcotics comprehensively and synergy by involving the various elements, both the role of government through institutional functions especially law enforcement agencies, as well as the role of the community as the main shaft within the legal system for the prevention of abuse of narcotics. Based on data from the National Narcotics Agency of West Nusa Tenggara and West Nusa Tenggara Regional Police, West Lombok district, including one of the areas of drug users is high enough in Nusa Tenggara Bara, it is potentially an increase in the prevalence of drug abuse. Community role in the prevention of abuse and trafficking of narcotics reaffirmed in Law No. 35 Year 2009 on Narcotics in Chapter XIII on Community Participation. Optimizing the role of society are also part of the National Narcotics Agency action plan in 2017 as a performance optimization measures in the context of prevention and in order to curb the prevalence of drug abuse. The purpose of this research is to know and analyze the role of society in prevention of narcotics abuse in West Lombok regency, using empirical law research conducted in West Lombok regency, that is research that examine and analyze law effectiveness and law application in relation to society role in prevention of narcotics abuse. The results showed that the role of the community in the prevention of narcotics abuse in West Lombok regency includes: First, the prevention form through education, training or legal counseling is done through cooperation with related institutions or institutions, including National Narcotics Board of West Nusa Tenggara, Social and Cultural Service, Resort Lombok Barat and Non Governmental Organization. Second, strengthening the role of village government is done by active involvement in the prevention of narcotics abusers in the determination of activities and programs, cooperation with law enforcement, and supervision of community activities as part of the development of public order and security. Third, report the narcotics crime to law enforcers, taken by establishing communication with law enforcement that is National Narcotics Board of West Nusa Tenggara and Resort Police of West Lombok.

Abstract

In the development of Islamic inheritance law. There is amatter concerning substitute heirs having the purpose of searching for justice for the theirs. Basically, the substitute heirs become heirs because the parents having the inheritance rights have passed away before the inheritors. The concept of substitute heirs under section 185 Compilation of Islamic Law that applies to all descendants of the heir who died first of the heirs and the heirs of the successor does not exceed an equal heir with being replaced. Beside that also, because the position of substitute heirs are not described in the Holy Koran it directly, but the content maslahah line with the objectives of Islamic Law that is to realize a sense of justice for the heirs. Because, the position of substitute heirsis not something contrary to maqashid al-Shari’ah, the benefit rational because the result of an ijtihad and considerations of justice upon the inheritance for heirs.

Abstract

Mahkamah Konstitusi sebagai The Guardian of Constitutions sekaligus pula sebagai lembaga yang dapat melindungi hak asasi manusia berwenang menguji Pasal 31 ayat (4) UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010 menyatakan bahwa sejatinya penyadapan (interception) adalah sebuah perbuatan melawan hukum. Hal ini dikarenakan penyadapan merupakan sebuah tindakan yang melanggar privasi orang lain dan oleh karenanya melanggar hak asasi manusia (HAM). Pengaturan penyadapan melalui Peraturan Pemerintah adalah tidak tepat. Bentuk Peraturan Pemerintah hanya merupakan pengaturan administratif dan tidak memiliki kewenangan untuk menampung pembatasan atas HAM.

Abstract

The purpose of this research is to know and understand about the procedure of revocation of the replacement certificate, which agency is authorized to cancel the replacement certificate, the factors causing the revocation of the certificate of land title replacement that violate the procedure at the Land Office of Central Lombok Regency, and the legal consequences of the cancellation Issuance of a substitute certificate that violates the procedure The research of this thesis uses empirical normative legal research that is conducted based on legislation and its application in concrete event using legislation, conceptual, and sociology approach. That the procedure of revocation of the replacement certificate refers to the Regulation of the Minister of Agrarian Affairs and Spatial / National Land Agency Number 11 of 2016 on the Settlement of Land Cases, Regulation of the Minister of Agrarian Affairs / Head of National Land Agency Number 9 Year 1999 concerning Procedures for the Granting and Revocation of Land Rights and Rights of Management. Whereas the authorized institution to make revocation of the substitute certificate violates the procedures of the Ministry of Agrarian Affairs and Spatial / National Land Agency which is delegated to the Head of Regional Office of the Ministry of Agrarian Affairs and Spatial / National Land Agency. That the factors causing the revocation of the replacement certificate Violate the procedures at the Land Office of Central Lombok Regency, namely: a. The Law Enforcement Factor, in this case, the National Land Office of Central Lombok Regency is not careful in issuing the land title replacement certificate and not checking the application of the substitute certificate issued by Budi Santoso Hardjosuwito. b. Community Factors, in this case the lack of honesty, awareness and understanding of the public in making a request for the issuance of a replacement certificate in accordance with the provisions of prevailing laws and regulations. That the effect of the revocation law Issue a replacement certificate that violates the procedure, such as the applicant revocation of the replacement certificate may to apply for registration of the rights at the office of the land agency of Central Lombok District, whereas for the reinstatement of the revocation of the replacement certificate that the ownership rights over the object of the dispute land has no legal force due to Canceled, but the petitioner may proffer for administrative remedy.

Abstract

Law No. 32 Year 2004 on Regional Government , gives broad authority to autonomous regions to organize Regional Government . With such authority , giving an opportunity for the region to explore and exploit all the potential that exists for the welfare of the people . In contrast with broad authority , also open opportunities for abuse of governmental authority , thus requiring supervision. With this research conducted , in hope will provide more advanced impact on the concept of financial management oversight by the Regional Chief and Council , so the possibilities are not in want will be solved as soon as possible . The method used in this study is a research method that uses normative law approach and conceptual approach , by conducting periodic review - review of the regulations in order to answer the law or which deals with issues that are relevant to the subject . Abstract

Penyelenggaraan pemerintahan daerah yang dilaksanakan berdasarkan asas otonomi dan tugas pembantuan sebagaimana telah diamanatkan dalam ketentuan Pasal 18 dalam UUD 1945 merupakan landasan konstitusional bagi daerah untuk membangun serta mengembangkan diri sesuai dengan prinsip otonomi daerah. Daerah diberikan keleluasaan dan kebebasan untuk mengatur dan mengurus segala urusan pemerintahan daerah menjadi urusan rumah tangga sendiri, sehingga dapat berinisiatif secara mandiri untuk merumuskan berbagai strategi kebijakan berdasarkan kebutuhan serta kepentingan yang dapat memberdayakan kehidupan masyarakat setempat. Pemerintahan daerah diberikan kemampuan (hak) untuk dapat berbuat serta tugas (kewajiban) yang harus dilakukan sesuai dengan ruang lingkup kewenangan sebagai daerah otonom. Bentuk tindakan nyata yang harus dimiliki oleh suatu daerah otonom adalah kemampuan untuk menggali serta mengembangkan potensi sumber daya alam menjadi Pendapatan Asli Daerah (PAD) sebagai sumber penerimaan utama. PAD salah satu tolok ukur dan/atau persyaratan untuk dapat dikategorikan sebagai daerah otonom dalam konsep otonomi daerah. Kewajiban bagi unsur penyelenggara pemerintahan daerah optimalisasi dalam upaya memperkuat/memperbesar kemandirian daerah melalui PAD dengan intensifikasi maupun extensifikasi sumber penerimaan sebagai sendi utama dari esensi pelaksanaan otonomi daerah.

Abstract

Kedudukan atau status dari KPPU dalam menjalankan fungsi kewenangannya menjadi hal yang sangat penting, mengingat Undang-Undang nomor 5 Tahun 1999 telah memberikan KPPU kewenangan yang sangat besar, sehingga menyerupai kewenangan lembaga peradilan (quasai judicial). Pasal 35 dan Pasal 36 Undang-Undang No. 5 Tahun 1999 secara tegas memberikan kewenangan yang sangat luas kepada KPPU untuk dapat berlaku sebagai penyidik, penuntut maupun sebagai pemutus terhadap kasus-kasus persaingan usaha. dalam konteks demikian maka timbul opini yang menganggap bahwa KPPU adalah sebagai peradilan khusus untuk kasus persaingan usaha. Dipandang dari sifat putusan KPPU yang otomatis memiliki kekuatan hukum tetap apabila terhadapnya tidak diajukan keberatan dan penegakan melalui mekanisme penetapan untuk eksekusi ke pengadilan negeri, maka proses hukum yang seharusnya melanjuti proses penegakan putusan KPPU adalah upaya hukum eksekusi, yang didasarkan kepada penetapan eksekusi pengadilan negeri. Putusan KPPU tidak bisa eksekusi oleh KPPU sendiri, karena dalam kepala putusan tidak mencantumkan irah-irah “Demi Keadilan Berdasarkan Ketuhan yang Maha Esa”.

Abstract

Corporate Social Responsibility (CSR) is one of the obligations that must be implemented by the company in accordance with the contents of article 74 of Law - Corporate Law (Company Law) the latest, Law. No. 40 of 2007. This study aims to analyze and assess how PT. State Electricity Company NTB do CSR. In addition, through this research will also be identified in about constraints - the constraints faced by PT. State Electricity Company NTB in implementing CSR. This study used juridical - normative and juridical - empirical, that is by doing an inventory of domestic law and related to corporate social responsibility in relation to the alleviation of problems - social problems, obtain explanations and know - things about corporate social responsibility, and the constraints faced. From the results it can be concluded in the implementation of social responsibility, PT PLN doing activities - activities as follows: Community Relations, this activity involves the development of understanding through communication and information to the relevant parties. Community Services, program assistance in these activities related to public service or public interest. Community Empowering, this activity consists of programs that provide wider access to the public to support their independence. Nature Conservation, environmental development program implemented in the form of educational assistance for community activities around the location of transmission and distribution are not capable, but has great intelligence and willingness to continue their education. Additionally, conducted through nature conservation activities such as participation greening program organized by external parties to cooperate with the Government and the realization of the greening around PLN installation. In the implementation of CSR, PT PLN encountered obstacles - obstacles as follows: The main challenge faced by PT PLN any public mistrust and misperceptions that arise from the surrounding community PLN installation. PT PLN unable to maximize service due to power shortage.
