Tujuan penelitian ini adalah berupaya menganalisis dan menjawab permasalahan mengenai prinsip dan pengaturan tentang akta akad Hawalah berdasarkan Undang-Undang Nomor 21 Tahun 2008 tentang perbankan syariah dan untuk menganalisis Bentuk dan Subtansi akta akad Hawalah antara Nasabah (Debitur) dengan Bank pada Perbankan Syariah Penelitian ini dikualifikasikan sebagai penelitian hukum normatif yang berangkat dari pertentangan norma. Sumber bahan hukum penelitian ini diperoleh dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian ini menunjukkan bahwa Pertama :Terkait dengan Prinsip yang di gunakan dalam membuat akad hawalah adalah prinsip yang harus didasari dengan prinsip syariah dan aturan yang berdasarkan Al-Qur’an dan Hadist. Kedua: substansi hukumnya berkaitan dengan akta autentik yang dibuat oleh Notaris berupa akad hawalah merupakan produk hukum akad hawalah.

This reseach is a normative – empirical type of reseach concerning “Legal study of direct investment related to hospitality business in Lombok Barat Regency”. This reseach is made to find out and analyze investment policies related to hospitality business existing in Lombok Barat regency and to find out the contribution of these policies to encourage the development of local investment. The reseach result shows that there are several Law and regulation existing as policies made by local government to rule direct investment specially hospitality business in their area such as local law, The decision of the head of the regency, The decision of the head of Investment coordinating body eventhought none of these policies specifically rule investment in hospitality business. Contributions of these policy to encourage the development of investment in hospitality business could be seen from the increase number of hospitality business investment year to year from year 2007-2011. Investment policy that formulated by local government has adjusted to Investment Law number 25 of 2007 concerning Investment such as the implementation of non-discrimination principle by giving an equal treatment toward domestic and foreign investment, mentioning the right, obligation and responsibility of the investors also giving investment facilities and incentives. In the other side it still necessarry to make some changes for the perfection of those local policies specially to shorten the bureaucracy line and to support the implementation of investment guidance, control and supervision.

Kewajiban Notaris dalam merahasiakan akta merupakan kewajiban ingkar bagi Notaris yang diatur dalam Undang-undang Jabatan Notaris pada Pasal 16 ayat (1) huruf f yang menjelaskan bahwa Notaris wajib Merahasian isi akta dan segala keterangan yang diperoleh dalam proses pembuatan akta kecuali ditentukan lain dalam Undang-undang. Menimbulkan 2 (dua) pertanyaan mendasar berkaitan dengan Batas – batas Notaris dalam memberikan keterangan agar tetap dapat menjaga kerahasiaan aktanya dalam Proses Peradilan dan Tanggung gugat Notaris atas kerugian yang diderita oleh para pihak akibat Kesaksian Notaris di Pengadilan. Dari hasil penelitian diketahui bahwa berdasarkan Peraturan Perundang – undangan,Notaris memiliki hak untuk merahasiakan semua yang diberitahukan kepadanya selaku notaris, sekalipun ada sebagian yang tidak dicantumkan dalam akta. Hal ini terkait dengan hak ingkar seorang notaris, hak dimana seorang notaris dapat mengingkari posisinya sebagai seorang saksi yang mana dibolehkan oleh undang-undang untuk membeberkan semua rahasia yang disimpannya, dalam keadaan tertentu. Notaris sebagai Warga Negara Indonesia berkewajiban memberikan keterangan dalam proses hukum dengan persetujuan Majelis Kehormatan Notaris. Hal tersebut diatur berdasarkan ketentuan dalam Pasal 66 ayat (1) Undang-Undang Jabatan Notaris.

This research uses juridical sociological approach which study about the norms of law that used to solve divorce cases and the norms’ implementation toward judge’s concideration in giving adjudication. Besides, it study the causal factors of divorce cases in Dompu and kind of law concideration that apllied in judge’s adjudication. The source of data are collected from related documents, recorded interview with the judges and people in Dompu who have an experience of divorce in Dompu, West Nusa Tenggara Barat and know the causal factors of the divorce. Result of the research shows that divorce cases in Dompu is increases from year to year since 2013, which numbers of divorce cases are 479 cases (17.91%). On 2014 the numbers are 691 divorce cases (25.85%). On 2015 the amount are 719 cases (26.89%). Moreover, on 2016 the amount are 785 cases (29.35%). Those divorce cases consists of talak divorce and suit divorce. There are some factors which causes the divorce which gets from Religious Court of Dompu. First is cheating that make the couple in the quarrel all times. Second is one of the couple who works as Indonesian workers overseas (TKI/TKW) which should leave his wife or her husband in a long time.the third factor is the husband cannot fulfill the money for household expenses for his wife and children so the wife bring a lawsuit to the Religious Court of Dompu. Those factors are new tendencies in Dompu along the development of technology especially communication technology. The example is the use of hand phone. This device ease a person (husband/wife) communicate with someone who they cheated with and make a secret love relationship since by using hand phone, the wife or husband will be hard to find out that relationship.

Mafsadat opportunities contained in article 53 of KHI because of the obscurity limits allowed because pregnancy made her pregnant mate in article 53 KHI. The impact is not uncommon to Article 53 KHI made pregnant as a result of adultery legality mating. This is clearly not in accordance with Islamic law strictly prohibits the practice of adultery. To analyze these problems, in this study the two proposed formulation of the problem which is how the view of Islamic law to the formulation of Article 53 of the KHI and the factors that encourage pregnant mating society, to eliminate aspects mafsadat in article 53 of KHI, in the context of al-dzari saddu 'at, the necessary editorial changes such as the addition of boundary conditions cause pregnancy and accompanying sanctions. The formulation of Article 53 KHI as pregnant kwin solution can be realized by adding the editorial-related restrictions that can cause pregnant mating carried out in the absence of sanctions and sanctions for pregnant mating caused adultery form of social repentance.

The purpose of this study was to determine and analyze the fund execution of mortgages rights and legal effects arising from the execution of mortgages that are not registered to the office of land agency.The research method that used in this study was Normative legal research and Empirical law research, with the legislation approach, conceptual, and sociological. Data analysis and legal materials was done by analyzing the various regulations that specifically regulate the rights of dependents as well as analyzing the findings data on the fields that related to practice of unregistered mortgages.Based on the results of the research, the creditor can still execute mortgages that are not registered in the office of land agency, by means that there is a guarantee from Notary in the form of Covernote. The creditor refers to the Power of Attorney for Load Rights (SKMHT) which has been made with the Deed of Assignment Rights (APHT) in the presence of a Notary or PPAT, and asks PPAT to register the Mortgage Right at the Office of Land Agency, with time limit of 3 (three) month maximum.The legal consequences of the execution of an unregistered mortgage cause the creditor of the mortgage does not have the position of the preferred creditor, but the same as the position of the concurrent creditor. From the decline of the creditor's status, because it does not meet the fundamental and conditions that require mortgage rights are registered. As well as mortgage rights can coused invalidated by law.

In practice pukum enforcement in Indonesia, the rules of law which are used in penangulangan domestic violence is not just limited to the provisions in the Book of Criminal Law (Penal Code) and Act No.. 23 Year 2002 on Child Protection. As for the articles about crime in the Penal Code which can be used against perpetrators of domestic violence are the provisions that define the special requirements to be the occurrence of criminal acts such as the relationship of father and son or mother and child, as well as the articles that are not determine the presence of these special requirements. Some of the acts that included the scope of domestic violence and has been formulated as a criminal act in Article 304-309 of the Criminal Code is that it formulates a crime against children, Article 356 Paragraph 1, which regulates criminal acts against women as a wife who is only limited to physical violence. Article 285-296 of the Criminal Code governing rape and lewd acts, not fully accommodate other forms of sexual violence and other forms of outside approval. The violence causes violence in the household is the economic factor, namely the demands of subsistence resulting in frequent occurrence of violence, excessive jealousy of the wife or husband, excessive emotions or the hardness of the husband to his wife, a view which assumes that men males higher degree than women. Besides the lack of legal knowledge as well be the cause of domestic violence as for prevention efforts undertaken is an effort perfentif and prevention efforts are refresif namely prevention efforts undertaken after the occurrence of criminal domestic violence.

Penelitian ini dimaksudkan untuk menjawab dua isu hukum utama yaitu : 1). Indikator apakah yang menjadi syarat adanya cacat yuridis dan cacat administrasi dalam proses penerbitan sertifikat hak atas tanah oleh Badan Pertanahan Nasional (BPN)? 2). Bagaimanakah implikasi yuridis legalitas sertifikat kepemilikan hak atas tanah yang mengandung cacad yuridis dan cacad administrasi? Jenis penelitian yang digunakan yaitu penelitian hukum normatif Dengan menggunakan pedekatan, perundang-undangan, pendekatan konseptual dan pendekatan kasus. Tekhnik pengumpulan bahan hukum dilakukan dengan cara penelitian kepustakaan dan analisis secara kualitatif dengan pola berpikir menggunakan metode kajian induktif. Berdasarkan hasil penelitian menunjukkan bahwa : 1). Bahwa dengan mengacu pada Ketentuan Pasal 64 ayat (3) Perkaban No. 3 Tahun 2011 dapat disimpulkan bahwa pembatalan hak berdasarkan putusan pengadilan umum baik perdata maupun pidana dikategorikan sebagai pembatalan hak karena cacat administrasi dan hanya Putusan Peradilan Tata Usaha Negara yang dikategorikan sebagai cacat hukum karena hanya Putusan PTUN yang secara tegas memerintahkan pembatalan sertipikat hak atas. 2). Adanya Keputusan PTUN tidak secara otomatis merubah legalitas kepemilikan Hak atas tanah seseorang, melainkan dengan keputusan PTUN tersebut oleh para pihak dapat dijadikan alat bukti ketika mengajukan gugatan kepemilikan hak atas tanah ke Pengadilan Negeri. Sedangkan terhadap Putusan Pengadilan Negeri yang terkait dengan adanya cacad yuridis dalam proses penerbitan sertifikat dapat menjadi dasar bagi pemilik hak atas tanah untuk menindaklanjuti ke BPN untuk proses penerbitan sertifikat berdasarkan Putusan Pengadilan yang telah berkekuatan hukum tetap.

This research aims to analyze the annulment of agreements binding sale and purchase rights over land unilaterally. Particularly related to the validity of the agreement and selling land rights by using a binding sale and purchase deed and its cancellation. Based on the results showed: (1) the treaty binding sale and purchase agreements is born of nature opens in Book III of the book of law civil law (KUHPer). Binding agreement and selling these arise due to things (requirement) that have not been fulfilled or things (requirements) was agreed upon by the parties must be met, for example, are related to the payment of the price has not been paid. (2) changes to the price that has been disepakti by the parties previously could only be done if there is agreement from both parties in this case the seller and the buyer. This means that adjustment against price in selling land rights cannot be used as an excuse by the seller to cancel the agreement unilaterally.

This research aims to normatively study and analyze the government’s obligation to make spatial planning and land use management; and also to review and analyze the legal conception of spatial planning and land use management in accordance with the legislations existing in Indonesia. This study is normative, i.e. a research which examines the fundamentals/principles of law, review the norms and legal concepts regulating spatial planning and land use management. This research applies normative approach; there are statute approach, conceptual approach, and comparative approach. It uses library resources which consist of primary, secondary, and tertiary legal materials. The research discovers that government is required to establish spatial planning and land use management on the basis of philosophical, juridical, and empirical foundations. Furthermore, spatial planning is a process to determine the spatial structure and pattern which covers the arrangement and establishment of the spatial plan. While the land use management is a pattern of the land use management which covers possession, use and utilization of land which constitute land use consolidation through institutional arrangements associated with the use of land as an integrated system for the benefit of a fair society. Spatial planning and land use management is an integral and inseparable, as land use management is part of the spatial plan, so that they are actually under the same legal basis. This research recommends that spatial planning and land use management should fully be committed to create the spatial and land utilization and also natural resources effectively and efficiently.
