Abstract

Law No. 15 of 2001 Trademarkare manage geographical indication on articles 56 to 58 as part of the substance of geographical indications (GI) basically regulate the protection of the products to local communities as a sign that indicates the place of origin of goods is due to human factors, or a combination of both factors, provide specific characteristics and quality of the goods results of the product. Then, the issuance of Government Regulation No. 51 year 2007 on Geographical indications for clearer protect as expected in the TRIPS Regalements. Constitutionally Article 33, paragraph 3 of the 1945 Constitution mentions "The land, the waters and the natural resources within shall be under the powers of the State and shall be used to the greatest benefit of the people". It means that the people are given the opportunity to manage and exploit the natural resources for the people's welfare. This is the shape of the state which provides the opportunity for people to explore the potential of natural resources to be managed and used as the economic value it is then used and worn as the property of the citizen, and then it became attachedas a fundamental right that cannot be separated from the ownership of the wealth of human rights.

Abstract

Authentic official document as the prima-facie evidence instrument has important role in each legal relation at social life, either in business relation, banking activity, land affair, social activity, and so on. The necessary on written evidence such as authentic document is more increase in line with the need progress of legal certainty in several economic and relations either in national, regional or local level. PPAT is as General Official that provided an authority to make the authentic documents of certain legal deed about rights of land or the owner rights of condominium unit. The authority is provided according to Government Regulation Number 37 Year 1998 about Occupation Regulation of PPAT (Making Official of Land Document). But recently, it has been happened the most interesting controversy when to be issued the Acts Number 30 Year 2004 about Notary occupation, because in the acts is decelerated that notary as a general official that has authority to make the authentic document and he other authorities such as regulated in this acts. The other authorities consist of authority of making document that related to land affairs. The big question, what is authentically of land document that is made by the notary. This article explains as compendiously about how to authentically of land document that to be made by PPAT.

Abstract

This study aims to determine the responsibility and liability of PPAT declared bankrupt based on Government Regulation No. 24 of 2016 concerning Amendment of Government Regulation No. 37 of 1998 concerning on the Position of Land Titles Registrar and reappointment of PPAT which has been bankrupt. This research is normative law research by using the approach of legislation and method of concept approach where analyzed by using method of interpretation and invention of law. The result of this research is that the responsibility of PPAT which is declared bankrupt is to accept sanction of dismissal with respect to his position and the liability of PPAT which declared bankrupt to have to pay the debts arising from bankruptcy that the fulfillment comes from his wealth. PPAT which has completed bankruptcy process and obtained rehabilitation can not necessarily be reappointed as PPAT.

Abstract

This article discuss about prevention of terrorism financing using Stolen Asset Recovery as the alternative model for the prevention. The aims of this aricle to analize excess of Stolen Asset Recovery to prevent financing of Terrorism. This article analyzed using normative juridical approach Statute Conceptual Approach and Approach. There are many obstacles in the implementation of the FATF in combating the financing of terrorism. The first obstacle is the FATF as a watchdog organization that determines which member states must implement the provisions contained in the recommendations given by the FATF. The second obstacle in the FATF recommendation requires immediate asset freeze (freezing without delay) against the alleged perpetrators of crimes that are not appropriate to be applied to the member states to apply the presumption of innocence. Therefore we need an alternative model of another better countermeasures that can be applied and does not interfere with the national interests of member states. There is a body which is a collaboration between the World Bank and the United Nations Office on Drugs and Crime (UNODC) made a model of prevention to help increase a country's development of the prevention of theft of public assets called Stolen Asset Recovery (StAR). StAR has many advantages that the funding models for crime prevention can be adopted to combat terrorist crimes. The advantages include StAR Initiative is done in two ways NCB asset forfeiture and Criminal forfeiture that can be applied in the legal systems are different in each country so that the model is still appreciate the national interest and priority to the country's sovereignty. The second is the StAR Initiative has cooperated so that countries can take the assets of crime in the territory of other countries through specific agreements called Mutual Legal Assistance.

Abstract

Hakim dalam mengadili permohonan ijin poligami yang dasar alasan-alasan dan syarat-syaratnya tidak sesuai hukum positif saat ini yakni pasal 4 ayat 2 dan pasal 5 ayat 1 huruf (a) dan ayat 2 Undang-undang Nomor 1 tahun 1974 tentang Perkawinan tetap dikabulkan dengan pertimbangan kemaslahatan dan keadilan, dan hakim dibenarkan melakukan ijtihad hukum dengan menyimpangi norma hukum yang ada (Istihsan), demi tercapainya kepastian dan keadilan hukum berdasarkan prinsip the judge made of law dan living law, guna memberikan kepastian hukum, manfaat hukum serta keadilan hukum bagi keluarga besar poligami (Rech Ide) untuk menolak akibat bahaya ( Madlorot), yang lebih besar dikemudian hari.

Abstract

This study intended to analyze about the shape of authority and criminal responsibility of the recepient procurement of goods and sevices government committee. Legal issues that arise in this study include: about the authority of the recipient procurement of goods and service government committee, and what defense criminal responsibility of the recipient procurement of goods and sevices government committee. This study is normative legal research based on the consideration that this study departs from the analysis of legislation that describes the scribes the scribes the scribes the authority and criminal responsibility of the recipient procurement of goods and sevices government committee. Approach to be adopted is the approach legislation approach to the concept and historial approach. Legal materials colletion techniques with study of literature. Based on the result of this study concluded this from authority recepient procurement of goods and sevices government committee. Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana kedudukan Komisi Pemilihan Umum dalam sistem ketatanegaraan Republik Indonesia dan bagaimana independensi KPU sebagai lembaga negara dalam menjalankan keputusan Rapat Dengar Pendapat (RDP) DPR. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan metode pendekatan perundang-undangan, metode pendekatan konseptual dengan analisis preskriptip. Hasil penelitian ini diantaranya Kedudukan KPU dalam sistem ketatanegaraan Republik Indonesia adalah sebagai lembaga negara independen yang pada prinsipnya berperan sebagai auxiliary state organ dari kekuasaan eksekutif yaitu untuk membantu presiden dalam menyelenggarakan pemilu yang ditegaskan pada Pasal 22 E UUDN RI 1945, yang kemudian diatur lebih lanjut dengan Undang-Undang No. 15 Tahun 2011, serta Independensi KPU sebagai lembaga negara dalam keharusan menjalankan keputusan RDP DPR menempatkan KPU sebagai lembaga negara independen dan juga sebagai subjek hukum dengan menjalankan isi peraturan perundang-undangan saat ini, yaitu dengan tidak lagi terikat oleh keputusan Rapat Dengar Pendapat DPR dalam menyusun peraturan KPU yang berkaitan dengan pemilihan umum, sesuai dengan putusan Mahkamah Konstitusi nomor 92/PUU-XIV/2016.

Abstract

This study is only aimed at the implementation of the Civil Service certification for teachers in Mataram, starting from the teaching profession allowance arrangement pursuant to Law No. 14 Year 2005, Application of the Law No. 14 Year 2005 in Mataram and the various constraints in the implementation of the Law Law Number 14 Year 2005 in Mataram and proposed solutions to overcome the stretcher. The results of this study found the insinkronisasi the Government Regulation No. 41 of 2009 by the Ministry of Finance (PMK) are used as guidelines in the payment of teachers' professional allowance. It also found the vagueness of norms in Article 35 paragraph (2) of Law No. 14 Year 2005. Although Law No. 14 Year 2005 effective as expected, but there are some obstacles in the implementation of Law No. 14 Year 2005 on the city of Mataram. The solution is that the Minister of Finance to follow the provisions of the Government Regulation Number 41 Year 2009, which ordered that the payments be paid every month teacher certification. To resolve the conflict norms in Article 35 paragraph (2) of Act No. 14 of 2005 so as not to harm the teacher is required to revise Law No. 14 Year 2005 on Teachers and Lecturers, in particular Article 35 paragraph (2) in order to sync with Article 35 paragraph (1).

Abstract

Penelitian yang berjudul tanggungjawab Notaris sebagai penerima titipan Sertifikat hak atas tanah setelah perjanjian pengikatan jual beli dibatalkan pengadilan (Studi Kasus Putusan Mahkamah Agung Republik Indonesia Nomor 3176 K/Pdt/2013), berfokus pada permasalahan apakah Notaris sebagai penerima titipan Sertifikat hak atas tanah akan menyerahkan Sertifikat tersebut ketika perjanjian ikatan jual beli dibatalkan oleh putusan pengadilan yang telah mempunyai kekuatan hukum tetap (inkracht van gewijsde) dan bagaimana akibat hukum apabila Notaris menyerahkan atau tidak menyerahkan Sertifikat yang ada padanya setelah ada putusan pengadilan mempunyai kekuatan hukum tetap. Dari hasil penelitian diketahui bahwa berdasarkan ketentuan Pasal 1694-1739 KUHPerdata dan UUJN beserta peraturan pelaksanaannya, Notaris berkewajiban secara hukum dan berdasarkan kode etik untuk menyerahkan Sertifikat hak atas tanah kepada Pemiliknya apabila akta pengikatan jual beli yang dilakukan kedua belah pihak dibatalkan oleh putusan pengadilan yang berkekuatan hukum tetap (inkracht van gewijsde). Akibat hukum apabila Notaris tidak menyerahkan Sertifikat hak atas tanah yang dititipkan kepadanya setelah adanya putusan pengadilan yang berkekuatan hukum tetap (inkracht van gewijsde) adalah Notaris yang bersangkutan dapat digugat oleh pihak yang merasa dirugikan baik secara perdata, pidana maupun administrasi.

Abstract

Pembentukan daerah otonom baru pada dasarnya dimaksudkan  untuk meningkatkan pelayanan publikguna mempercepat terwujudnya kesejahteraan masyarakat disamping sebagai sarana pendidikan politik lokal. Untuk pembentukan  daerah otonom baru harus memperhatikan berbagai faktor, seperti kemapuan ekonomi, potensi daerah, luas daerah/RTRW, kependudukan dan pertimbangan aspek sosial budaya, pertahanan dan keamnan,  serta pertimbangn  dan syarat lainnya yang memungkinkan darah itu dapat menyelenggarakan dan mengwujudkan tujuan    daerah otonom baru  dan otonomi daerah. Sehubungan dengan kebijakan pemekaran daerah yang diatur PP No. 129 Tahun 2000 tentang Tata Cara Pembentukan Penghapusan dan Penggabungan Daerah yang disempurnakan  dengan PP No. 78 Tahun 2007.Hal ini menunjukan kesungguhan Pemerintah  dalam  menyempurnakan pelaksanaan  otonomi daerah sekaligus  Penataan Ruang sesuai dengan UU No. 26 Tahun 2007 tentang  Penataan Ruang.  Wilayah  pada hakekatnya merupakan pusat kegiatan ekonomi yang dapat melayani wilayah kota itu sendiri maupun wilayah sekitarnya. Untuk dapat mewujudkan efektifitas dan efisiensi pemanfaatan ruang sebagai tempat berlangsungnya kegiatan-kegiatan ekonomi dan sosial budaya, kota perlu dikelola secara optimal melalui suatu proses penataan ruang. Pembangunan politik di Kabupaten Lombok Tengah mengalami perkembangan yang cukup mengembirakan, dimana keberadaan lembaga legislatif memberi warna baru dalam hal kontrol sosial. Pengasan yang dilakukan lembaga legislatif juga perlu memberi peluang bagi masyarakat dan organisasi kemasyarakatan untuk berpartisipasi aktif dalam pemantauan, evaluasi dan pengawasan kerja. Lembaga perwakilan yang efektif memainkan peran dan fungsi kontrol terhadap pemerintah. Keberadaan wakil rakyat yang aspiratif berpengaruh terhadap penyelenggaraan pemerintahan yang efisien, tidak korup dan berorientasi kepada aspirasi masyarakat. Jumlah partai politik peserta pemilu yang sangat banyak, tentunya memiliki kader-kader partai yang berkualifikasi, untuk tingkat lokal sangat beragam akan membawa dampak pada kinerja DPRD itu sendiri.
