Abstract

Abstract

Marriage,as a holy tie between persons, can be analysed from two perspectives: as a tradition and an aspect regulated by state law. In a certain circumstance, the tradition of marriage can be different or even in opposition to state’s marriage formal law. The marriage system of Wong Sikep in several regions in Central and East Java Provinces can be seen as one important example. Based on library research, this article analyzes the issue of legal pluralism that potentially occurs because of the implementation of multi laws in a certain field in a society - state law and adat law -. It shows how Wong Sikep communities respond differently to marriage formal system implementation, part of them still practice their adat law purely and some others who have conducted adjustment with state’s (marriage) law. Keywords: marriage, Wong Sikep, Samin, legal pluralism

Abstract

This paper aims to explain the local wisdom related to ecology of Belitung people. It has existed from generations to generations. There three forms of local wisdom related to ecology, namely dukun kampung, kelekak, and hutan larangan. Although they have that local wisdom, the forest area in Belitung remains damage. It indicates that the local wisdom has not been implemented into their life, particularly in relation to the environment where they live. However, the reality in the forest is not similar to the mangrove plants. Although the local wisdom does not orient to the sea, the mangrove plants is in a very good condition. Analysing that case, this paper focuses on the understanding of Belitung people on mangrove plant related to their local wisdom. Keywords: local wisdom, ecology, mangrove sustainability, coastal area, environmental damage

Abstract

As shown from the gap between actual situation of gender inequity and the implementation of gender policy, it can be seen that the representation of gender policy is low. Gender mainstreaming is a knowledge as well as a strategy to build gender equality. The sensitivity of gender issue has been acknowledged by international community commitment through several international meetings, that this issue must be integrated into national policy. Although Indonesia has ratified The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) into the UU No. 7 year 1984, the Gender Mainstreaming policy has only implemented in 2000 with the Inpres No 9. The gap between Human Development Index and Gender Development Index, despite the increase of both indexes, also shows that the problem of marginalization of women is still exist in Indonesia. The data from the indexes also show that Indonesia is unable to fulfill the MDG’s goal in preventing the number of death of mother in delivering baby. As strategy, the Gender Mainstreaming shows challenges from individual as well as bureaucracy, not to mention problem in ideas, interest and institution that tend to exclude gender as priority. The exsternal challenges are capitalism through media that sometimes have differentinterest. As strategy gender mainstreaming needs media to disseminate gender problem and gender knowledge. Keywords: gender mainstreaming, representation, women’s knowledge, strategy, policy

Abstract

The coastal area of Pohuwato, Tomini Bay, degrades, in which the mangrove forests has been converted into fishpond. During the last ten years, the mangrove forest has widely converted into fishfond. The expansion of fishpond area is widely due to the presence of migrants fom South Sulawesi. The process is not simple, in which the locals formerly rent it to the migrants and eventually sell it to them. Uniquely, the migrants’ economic ethos in fishfond activities is well-recognized by the locals. The empowerment of coastal community, therefore, should consider the diversity of their jobs, culture, and livelihood. This paper examines the development of migrants’ economic expansion in the coastal area of Tanjung Panjang, Pohuwato. Keywords: migrant, fishpond, Tanjung Panjang, economic culture, Pohuwato, Tomini Bay

Abstract

This article aims to address the importance of non-formal financial institution role toward the social mobility of fisherman as well as the development of Indonesian small scale fishing sector. This institution can be an individual entrepreneur or financial agent, which provides credit or other stimulus. From qualitative approach, the social mobility of fisherman and the development of fishing is a consequence of economic relations complexity. However, the role of non-formal financial institution is a dominant factor. This institution is important and always needed as far as the formal financial institutions have not been able to provide opportunity for all fishermen to access the capital. The compatibility of formal finance system and socio- economic characteristics of fishermen is an important factor to encourage the increase of formal finance system role in fishery. Keywords: fishery, fisherman’s income, invesment, social mobility

Abstract

Abstract A term of islah is quite familiar for Indonesian Muslims. It is an Islamic reconciliation term adopted from Al-Quran and Sunnah to end a conflict. With this term, those people who have been conflicting try to improve their relation to look for a better future by getting rid of their anger and vengeance. The cases of Tanjung Priok (1984) and Talang Sari (1989) tragedy, which caused hundreds of killed Muslims during Soeharto regime, are real examples to see how islah is practiced. Instead of being the best way for conflict resolution, it was part of the problems causing those cases unfinished in the formal court. It had caused the group of the victims divided within two groups; pros and cons of islah. Using islah as the pretext, many of the victims tended to finish it informally with the violators, although the rest still insisted to bring it to the court. The fragmented memory among them about the cases caused a lot of difficulties to prove it legally. Exploring the Islam sources as well as the case of Tanjung Priok and Talang Sari in Post-New Order Regime, this paper examines whether islah is a solution or precisely a part of the problem. This paper aims to put the term of islah and its significant in a proper way; therefore, this paper can contribute to the development of peace and conflict studies. Keywords: Islah, Tanjung Priok (1984), Talang Sari (1989), islamic law, victims, conflict resolution

Abstract

This paper aims to explain the Krakatau explosion in 1883 and its impact, mainly on the 1888 social movement in Banten. Krakatau explosion in 26-27 August 1883 was one of the tremendous volcano explosions in the 19th century, after the Tambora explosion in 1815. The impacts of explosion, such as high tsunami wave, ash, gas covered the atmosfer, had given other impacts on social, political, and economic aspects, as well as scientific sphere. Climate change affecting the ecology, such as the increase of death because of starvation and diseases, increase religion fanatism. This religious fanatism generated the social movement in Banten peaking in 1888. Keywords: volcanoes, Krakatau, Banten, religious fanaticism, social movement.

Abstract

This paper explains the ways state universities construct the meaning as well as implementing the idea of autonomy and governance. Cases studies were conducted, which involved three Indonesian state universities, namely the University of Indonesia, the Syarif Hidayatullah Islamic State University, and the Jakarta State University. Through the Trakman’s model (2008) about the university governance, this paper underlines that there is no appropriate model to explain the autonomy and governance of Indonesian state universities. Result shows that the state’s role in the state universities is still dominant, both in the academic area, such as curriculum and dissemination of knowledge, and in the nonacademic area, such as finance; therefore, the autonomy seems to be taken for granted instead of being embedded. Moreover, there is ambivalence due to the state’s limited budget, which then allows the market and the global providing fund for higher education.
