Abstract

Abstract The growth the actors of LGBT in Indonesia highly increases. During 2009 – 2012, it is calculated that the growth increases 37%. The increasing also follows the escalating of the access of internet, phornography, drugs and the existence of the number of LGBT communities. Despite the biological factor, the influence of close environment particularly family, friend, sexual violence, the contents of phornography and drugs are alerted as the cause of LGBT. In protecting the current case of LGBT, it needs the role of parents or familiy in the basic sex education correctly ( islami ) based on the growth common sense of the children in giving the understanding and building the sexual behaviour as the aptitude.

Abstract

Arisan is a common tradition in Indonesia and also practiced in the countries of Muslims in various parts of the world. Contemporary scholars have different opinions regarding this “muamalah”. Some of them consider it haram and some of them consider it mubah. There are also those who consider it mubah with conditions and there are also those who consider it as makruh. Therefore, it is important to know the strongest opinions among the various fatwas and their arguments. What is the Islamic jurisprudence law related to arisan? From this study, it is expected that those who want to know the ruling of arisan can get good valuable data to position themselves as followers of the haram fatwa of arisan and the mubah fatwa of arisan. This research is a library research with a qualitative approach. After being studied, it was found that the strongest law for arisan is mubah. Arisan is included into mubah due to the fact that arisan is a qordh (debts), while the Islamic law allows the qordh contract and the Messenger of Allah i himself also performed the qordh contract. All the arguments which forbid them can be explained by their weaknesses because they are not in accordance with the facts of arisan and the facts of the dalil which are used as the evidence.

Abstract

The Islamic boarding school is the oldest forms of Islamic educational institution in Indonesia. It’s expected to conform with the most recent developments. If not, the Islamic educational institution will be increasingly left behind by the development of contemporary education. The combination of Islamic education and modern education must be applied, it will make the Islamic educational institution be better. This paper is intended to convey the relevance of Islamic education, in this case boarding school and modern education. The Islamic boarding school should be able to adapt to the current development of education, either through the methods and technologies used. This conclusion is that the Islamic education in school has parallels with general education. In fact, Islamic education today can’t be sight as an anti-modernization and education seem ancient. Therefore, not least the current Islamic education that has been able to transform itself into a parallel education with other education in Indonesia. Although it must be admitted, there is the boarding school that still maintain the pattern of classical education, but by no means anti-renewal. Even today, many boarding schools that already have a higher education institutions, such as : high schools, institutes and universities. This shows, that Islamic education is ready and able to adjust with the times.

Abstract

Justice, tolerance, and mutual forgiveness is the fundamental values of Islam. Theprinciple must be understood and imitated and realized in social attitudes. But infact, the principle of nonviolence and peace in Islam was limited to the principle ofnot integral to the individual Muslim. This has often resulted in various conflictsin society. This paper focuses existence of Ahmadiyah conflict. Ahmadiyahposition as a minority group should get protection from the state. The State mustensure and protect the rights of religious freedom which is owned by Ahmadiyah.So with the protection provided by the state, the new state acts can be said to be inaccordance with the constitutional mandate.

Abstract

In this paper contains background of qaul qodim and qaul jadid. Where qaul qodim appeared in Iraq and qaul jadid in Egypt.Both qaul the results of thought of Imam Syafi'i. In his time, thought Syafi’i has evolved along with various backgrounds around. Initially, opinions or thoughts Syafi’i experience different impacts on the surrounding of social environment. But gradually, Imam Syafi'i thought it could be based on the usul fiqh. Even the book ar-treatise written by the Imam Syafi'i fiqh is considered as the basic premise of the law.Syafi’i great services for today can be felt, especially in Indonesia. Where there are many fatwas are set by the mufti and judge thanks to Imam Shafi'i contribute ideas. Qaul results of qaul jadid think do Syafi’i in egypt is the result of a refinement of thinking done in a long time. Egypt condition brought the contribution of his edea in the repertoire of new knowledge in an environment in various schools of thought. This is what makes that particular context will bring new experiences and views.

Abstract

Qur’an, as it is believed by Muslims, is The Holy Book as well as the manifestation of The Words of God (Kalamullah). It has meanings which obviously was being ‘monopolized’ by The Ulama. In regarding of consequence, the authority of interpreting this Kalamullahseems ‘limited’ only for particular groups. Then, according the author it becomes the main factor leads the stagnancy of Quranic interpretation studies in this modern era. In this context, Schleiermacher’s teory about ‘psychological explication’ (1998), Paul Ricoeur’s theory about ‘distantiation and appropriation’ (1976), and ‘the marginalized reading of Scripture’ theory proposed by Simopoulos (2007), create a new path in interpreting Quran. From those theories, the author sheds the lights on hermeneutical interpretation of al-Fatihahby as one of the marginalized groups in Indonesia, the Waria. This paper concludes that the waria use their hermeneutical way of understanding the Scripture and produce not only anoriginal interpretation, but also contextual and full of theological reflections.

Abstract

Sebagai solusi untuk menyelesaikan berbagai permasalahan yang dihadapi oleh bangsa Indonesia saat ini yakni dengan membumikan kesadaran bangsa Indonesia terhadap kesaktikan dan keberadaan pancasila pada hati bangsa itu sendiri. Pancasila merupakan hasil dari para pendiri bangsa untuk menjawab dan mampu memberikan kehidupan yang saling menjunjung tinggi nilai-nilai perjuangan bangsa itu sendiri. Keberadaan pancasila sebagai dasar negara, ideology nasional, filsafat bangsa, juga sebagai kristalisasi dari prinsip dasar untuk Indonesia yang diyakini mampu menjawab semua persoalan yang dihadapi bangsa serta mampu berdiri kokoh pada nilai-nilai pancasila itu sendiri. Oleh sebab itu, rekontruksi serta membangkitan kembali Pancasila seharusnya menjadi tujuan terdepan dalam pengentasan masalah yang sudah dibuat melalui program pemerintah, agar nilai Pancasila dapat dijiwai oleh setiap bangsa Indonesia.Para pendiri bangsaIndonesia berkeyakinan bahwa Pancasila dapat membebaskan rakyat dari perdebatan antarumat beragama, perbedaan suku, etnis, ras, dan golongan atau intoleransi terhadap sesama yang mayoritas maupun yang minoritas. Pada tulisan ini, penulis ingin membeikan pesan secara kontekstual mengenai persoalan yang dihadapi bangsa Indonesia. Sehingga langkah untuk meredam persoalan tersebut bangsa Indonesia harus mengambil langkah yaitu membumikan kembali kesaktian pancasila dalam bumi khatulistiwa.

Abstract

The article is to explain the function of Islam as the concrete gudance and its relationship with the morality of the nation. Through the descriptive-analitical approache, it can be stated that the function of Islam as the concrete gudance of the nation lies in a complext relationship with the whole cultural elements of the nation in one side and the system of values and norms operating concretely in the societies in other side. How completely this religion provides its moral system as the cutural capital of the nation if it lies in a small portion of the arena of the culture of the nation, it will become a mere formal atribute which will not give a significant influence on the formation of the moral attitude of the nation. The absence of the congruence relationship between the sacreed mission of the religion and the moral life of the society can be understood that the existence of the religion is antropologically not sufficient to become “the police” having ability to control the moral attitude of the societies because of its marginal position in the configuration of our culture. Hence, it is not fair to blame all of the anomalies of the society on the religion, because there are still many other determinat variables except the religion, including the government apparatus’ example. The appearance of the disobedience of some parts of societies to the social values and norms does not always denote the moral wickedness of the nation. However, it means a social criticism. the disobedience to the social values and norms will jeopardize the social order if it is carried out for the sake of indivial and communal pleausre. The operation of Islamic stipulations in a concrete manner must be supported by all of the institutions existing in the society, including the family, education institution, and the government.

Abstract

Globalization with its liberalism-capitalistic concept promotes us about materialism that everything has to count as matter. Including how is their perspective about the relation between the human and environment. It is inevitable that environment just as object to emerge the benefit for human being and their life. This paradigm emerges the concept of sustainable development to emphasize and strengthen the link between the conservation of natural ecosystems and human development. The concept of sustainable development as such has been on the scene since at least 1987 when the World Commission on Environment and Development published the Brundtland Report. The substance of "development" becomes more dominant than the substance "sustainable" of "environment" it self, so that we need a concept of Prophetical Environmental Approach, which esteems the environment on sight of development as God's legacy for being kept its eternality. Method: This protocol outlines the methodology for a systematic mapping exercise to identify the research studies measuring the sustainable development approach and comparing it with prophetical environmental approach. Our primary research questions are: what is the rationale of sustainable concept? Why does the environment become worse? Is the Prophetic Environmental Approach worth to be new alternative on environmental paradigm? Based on that research questions, this research will search and compile the primary literature (journals), both international and national related to the topic of sustainable development.

Abstract

Indonesia is an area that is unstable and prone to conflict. Confronted in a variety of social problems such as high levels of poverty, unemployment, social inequality, social tension, and political instability, as well as the political institutions of democracy are not yet effective, the areas in Indonesia holds the potential conflict which at times can be sticking to the surface into a violent conflict open. The violent conflict in the past, such as occurred in Maluku, North Maluku, Poso, West Kalimantan, Aceh, Papua, bringing the impact of conflict with the social damage and casualties is not small. While, though most areas of conflict in Indonesia has now entered a post-conflict situation, the potential for conflicts (latent conflict) is still very high. Thus potential conflicts at times can turn into open violent conflict, when efforts prevention conflict and peace-building have not worked effectively. The high pluralism in Indonesia create potential conflicts of Indonesia is also high. Potential friction and misunderstandings are also high. Both conflicts on a small scale or a large scale. In a small scale, the conflict is reflected in the communication not connected or not running as it should, causing a sense of hurt, angry, frustrated, disappointed, irritated, confused, wondering, and others. Meanwhile, large-scale conflict embodied in, for example, social unrest, multi-cultural chaos, hostility between races, ethnicities and religions, and others. One of the factors that encourage the appearance of a conflict-prone society is a problem related to the elements Tribe, Religion, Race, and groups (SARA). Especially religious differences, common be driving the emergence of tensions in society, for example, issues related to the establishment of a means of worship, religious activities and the implementation of practical political problems.
