Abstract

This study discusses the formulation of regional policies in the field of conservation-based spatial planning to strengthen tourism districts. The purpose of this study is to identify and analyze the factors that influence spatial planning policies in areas that have agricultural and tourism contours. This research uses a descriptive-analytical method with a qualitative approach. The results of this study indicate that there are several factors that influence conservation and tourism-based spatial planning policies in the regions, including national policies, regional policies, community needs, and regional tourism potential. Based on the results of this analysis, the researcher recommends that tourism-based spatial planning policies in the regions should be prepared by considering these factors and involving various related parties, such as the government, community, and tourism actors. According to this article, a team or working group should be established with the express responsibility of creating, overseeing, and assessing a conservation and tourism-based spatial planning policy. Furthermore, depending on regional features, this paper proposes the creation of regional spatial planning policies by combining regional RTRW and RDTR laws into a unified policy package.

Abstract

Cross-border e-crimes pose significant challenges due to the borderless nature of cyberspace and the complexities of international legal cooperation. This research examines the existing international legal frameworks, such as the Budapest Convention on Cybercrime, and their effectiveness in harmonizing laws and facilitating cross-border investigations. The study applies the doctrinal research methodology to analyze the regulations on cybercrimes. It analyzes the role of international standards of due process and prosecution in upholding individual rights and ensuring fair trials in cross-border cases. The legal frameworks for collecting and sharing digital evidence across borders are fragmented, creating significant challenges for international cooperation. Emerging technologies further complicate the governance of cybercrime. Law enforcement agencies face legal and privacy issues when accessing cross-border data stored in the cloud. The execution of mutual legal assistance requests in cybercrime cases remains slow and inefficient. Gaps in international frameworks hinder lawful access to electronic evidence, while cross-border cybercrime investigations experience delays due to language barriers, incompatible laws, and limited technical expertise within national agencies. These challenges underscore the need for a unified approach to tackle cross-border e-crimes effectively.

Abstract

The harmonization process in the formation of regional regulations in Indonesia is designed to ensure alignment between local regulations and national law. However, the centralistic approach often adopted in this harmonization process tends to limit the flexibility of local governments in formulating regulations that suit local needs. This issue raises concerns that the constitutionally granted authority of local governments to create localized regulations may be eroded. This study aims to analyze the impact of a centralistic harmonization approach on the effectiveness of regional autonomy, particularly in the context of local regulation. Using a normative juridical method with a descriptive-analytical approach, this research evaluates legislation, legal documents, and related literature to understand the implications of harmonization on local regulations. The findings indicate that overly centralistic harmonization can hinder innovation and adaptation of local regulations, reducing the capacity of local governments to respond to the needs of their communities. These findings emphasize the need for a more flexible and inclusive harmonization procedure to ensure that local regulations can still function effectively within the national legal framework. The implications of this study suggest that a more balanced approach between centralization and decentralization is necessary to maintain sustainable, adaptive, and responsive regional autonomy.

Abstract

The principle of equilibrium is an ethical demand closely related to the communal mentality of customary law, encompassing moral, social, and legal values. Therefore, this research aimed to understand the application of equilibrium to the cosmological rights of indigenous and tribal people in implementing Pancasila values. Normative legal research was used with a statutory method to achieve a clear understanding of the issues discussed. The results showed that equilibrium served as a guide for creating a balance between rights and obligations realised concretely through legal and non-legal norms. Furthermore, the different rights owned by indigenous people were recognised and respected. In this context, the government needs to prioritise Pancasila values in development and pay attention to the cosmological rights of indigenous and tribal people. Customary law must address various legal issues faced by people in specific areas and uphold the fundamental rights.

Abstract

This paper discusses the inventions in the pharmaceutical sector containing the nature of 'evergreening' based on the Supreme Court of India's ruling in Novartis's versus the Union of India. Patent ‘evergreening refers to the business practice of patent applications for inventions in the pharmaceuticals or medicines sector that are insignificant novel compared to previous similar inventions to extend the patent protection period that implies the increasing selling price of drugs on the market. These differences resulted in India's having to anticipate the legal issues and exclude patents for inventions containing 'evergreening' properties by applying high patentability requirements. Patent' evergreening' has implications for blocking the purpose of patent existence as a tool of dissemination of science because this practice extends the period of temporary monopoly rights ownership of patents and hinders public access to medicines at affordable prices. This research uses comparative legal methods to determine the characteristics of the patentability requirement between the Indian Patent Law, TRIPs, and the Indonesian Patent Law. The decision has implications for Indonesia as a consideration, especially for the Government of Indonesia in drafting the new law that anticipates the practice of patent 'evergreening' in Indonesia.

Abstract

Website accessibility and digital content for people with disabilities in Indonesia remain inadequate. Based on the Internet Inclusive Index, Indonesia ranks 66th out of 120 countries with a score of 69.75 and fails to meet the Web Content Accessibility Guidelines (WCAG). Despite the enactment of Law Number 8 of 2016 concerning Persons with Disabilities and the ratification of the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) in 2011, accessibility rights to information and communication technology have not been fully realised. Existing studies have yet to comprehensively examine how digital law can be effectively applied to close the gap between legal norms and the digital inclusion of persons with disabilities. This research fills that gap by analysing the intersection of disability rights and digital law, identifying key legal and sociocultural barriers that contribute to the digital divide. Employing normative juridical methods and a statutory approach, the study is analysed using qualitative descriptive techniques. The digital divide is found to stem from three main factors: legal substance, institutional structures, and societal culture. The novelty of this research lies in its use of digital law as a conceptual and regulatory framework to formulate inclusive digital policy recommendations. These include the strategic implementation of Articles 5 and 127 of Law No. 8 of 2016, as well as the proposal for a government-regulated digital portal based on universal design principles. Additionally, a cultural shift from a compassion-based to a rights-based approach is essential to ensure that persons with disabilities are recognised as equal participants in the digital society.

Abstract

IEL plays an important role in achieving the SDGs which is influenced by the design and application of the law. International trade agreements can limit government policies that support sustainable development, while international financial regulations affect the flow of funds for sustainable projects. The role of multilateral development banks and international investment is significant in supporting the SDGs. This study examines the extent to which IEL affects the implementation of the SDGs and recommends best practices and strategies that can be adopted to increase IEL's contribution to sustainable development. This research uses a qualitative approach and analyzes legal documents, case studies, and expert interviews. The interesting findings of this study show that the IEL supports the rule of law by promoting transparency and accountability. However, there are still challenges such as power imbalances between developed and developing countries, legal compliance, and the integration of IELs with the SDGs. In addition, IELs can support or hinder the SDGs, depending on their design and implementation. The impact of free trade agreements on the SDGs shows the economic and environmental benefits as well as the challenges of inequality and environmental degradation. Meanwhile, the recommendations that can be given from this study are that to increase IEL's contribution to the SDGs include the integration of sustainable policies in trade agreements, green investment, strengthening law enforcement mechanisms, transparency and stakeholder participation, and the development of international cooperation.

Abstract

Every victim of terrorism is entitled to a remedy that the state must guarantee by law. However, Law No. 5/2018 on the Eradication of Criminal Acts of Terrorism limits victims of criminal acts of terrorism to three years since the enactment of the law to be able to apply for reparations. This will certainly harm those victims who have passed the three years, but have not submitted a request for reparations. This research aims to examine the position of the right to recovery for victims of terrorism in the context of international law and the compatibility between the limitation period and international law. This conceptual research uses qualitative methods, legal research, and is descriptive. The result shows that terrorism crime can be qualified as a gross violation of human rights. Therefore, the state must provide remedies to the victims affected by the law's enactment, namely to those victims of terrorism who lost the right to apply for remedy three years after the law's enactment. Then, it can also be concluded that the right to reparations for victims of terrorism is inherent to every victim and the restriction on the right to reparations for victims of terrorism by the law is contrary to the international human rights law norms. Setiap korban tindak pidana terorisme berhak atas pemulihan yang harus dijamin oleh negara secara hukum. Namun, UU No. 5/2018 tentang pemberantasan tindak pidana terorisme membatasi selama tiga tahun sejak berlakunya undang-undang tersebut bagi korban tindak pidana terorisme untuk dapat mengajukan pemulihan. Hal itu tentunya akan merugikan para korban tersebut yang setelah lewat waktu tiga tahun, tapi belum megajukan permohonan pemulihan. Penelitian ini bertujuan untuk mengkaji kedudukan hak atas pemulihan korban tindak pidana terorisme dalam konteks hukum internasional dan kesesuaian antara aturan pembatasan tersebut dengan aturan hukum internasional. Penelitian konseptual ini menggunakan metode kualitatif, penelitian hukum, dan bersifat deskriptif. Hasil penelitian menunjukkan bahwa tindak pidana terorisme dapat dikualifikasikan sebagai pelanggaran berat HAM. Oleh karena itu, negara wajib untuk melakukan pemulihan terhadap para korban yang terdampak dari berlakunya undang-undang itu, yaitu terhadap mereka para korban tindak pidana terorisme yang kehilangan hak untuk mengajukan pemulihan setelah tiga tahun sejak berlakunya undang-undang itu. Kemudian, dapat disimpulkan pula bahwa kedudukan hak atas pemulihan korban tindak pidana terorisme adalah bersifat melekat (inherent) pada setiap korbannya dan pembatasan terhadap hak atas pemulihan korban tindak pidana terorisme oleh undang-undang tersebut tidak sesuai dengan norma hukum HAM internasional.
