Abstract

This research study aims to determine the factors behind the low legal awareness of Troso weaving craftsmen in recording creations and to examine this legal awareness using the approach of Law Number 28 of 2014 and the Sharia Economic Law. The type of method used in this research is sociological juridical based on a qualitative approach. The data sources used are primary data (interviews) and secondary data. The research results show that the legal awareness dimension of some Troso weaving craftsmen in recording creations is still relatively low. The low legal awareness of craftsmen is influenced by factors, namely cognitive and affective. Cognitive is closely related to the level of understanding of the procedures for requesting creation registration, and effectiveness is related to an attitude that tends to be apathetic and skeptical is caused by a mindset pragmatic that is only oriented towards production or sales. The reality of legal awareness shows its application Law Number 28 of 2014 in society has not been fully effective, and if viewed from Sharia Economic Law, the reality of low awareness in recording creations is a form of non-compliance in implementing the principles of benefit and written principles in Islamic law. It is hoped that the results of this research can contribute to raising full awareness of Troso weaving craftsmen in recording their creations so that every work they create in the form of woven motifs will have legal protection and their exclusive rights will not be denied. Kajian penelitian ini bertujuan untuk mengetahui faktor-faktor yang melatarbelakangi rendahnya kesadaran hukum pengrajin tenun Troso dalam pencatatan ciptaan serta menelaah kesadaran hukum tersebut dengan pendekatan Undang-Undang Nomor 28 Tahun 2014 dan Hukum Ekonomi Syariah. Jenis metode yang digunakan dalam penelitian ini adalah yuridis sosiologis dengan basis pendekatan kualitatif. Sumber data yang digunakan berupa data primer (wawancara), dan data sekunder. Hasil penelitian menunjukkan bahwa dimensi kesadaran hukum sebagian pengrajin tenun Troso dalam pencatatan ciptaan terbilang masih rendah. Rendahnya kesadaran hukum pengrajin tersebut dipengaruhi oleh faktor yaitu kognitif dan afektif. Kognitif erat kaitannya dengan tingkat pemahaman terhadap prosedur permohonan pencatatan ciptaan, dan afektif berkaitan dengan sikap yang cenderung apatis dan skeptis yang disebabkan mindset pragmatis yang hanya berorientasi pada produksi atau penjualan. Realitas kesadaran hukum tersebut menunjukkan penerapan Undang-Undang Nomor 28 Tahun 2014 di masyarakat belum sepenuhnya berjalan efektif, dan apabila ditinjau dari Hukum Ekonomi Syariah realitas rendahnya kesadaran dalam pencatatan ciptaan merupakan bentuk ketidakpatuhan dalam pengamalan prinsip kemaslahatan dan prinsip tertulis dalam hukum Islam. Hasil penelitian ini diharapkan dapat berkontribusi menumbuhkan kesadaran penuh pengrajin tenun Troso dalam pencatatan ciptaan sehingga setiap karya ciptaannya berupa motif tenun nantinya memiliki perlindungan hukum dan hak eksklusifnya tidak teringkari.

Abstract

The position of successor heirs in Indonesia lacks clear legal regulations, necessitating reliance on jurisprudence as a guiding framework for law enforcement officials. This study explores the benefits of jurisprudence in shaping the development of successor heirs' rights in Indonesia. Employing a normative juridical approach, the research relies on descriptive analysis and library research. The findings highlight two significant advantages of jurisprudence in this context. Firstly, jurisprudence clarifies material legal aspects by integrating provisions concerning successor heirs into Indonesia's legal system, notably through Article 185 of the Compilation of Islamic Law. This integration fosters legal coherence and clarifies successor heirs' rights and obligations. Secondly, jurisprudence aids in formal legal aspects by ensuring the completeness of administrative data for inheritance litigation in the Religious Court. This enhances procedural fairness and facilitates efficient resolution of cases involving successor heirs. Jurisprudence contributes to legal certainty, fairness, and societal benefits in inheritance matters. Its role in interpreting and supplementing existing laws underscores its importance in navigating legal complexities and ensuring justice for successor heirs in Indonesia. Posisi ahli waris pengganti di Indonesia membutuhkan perhatian mendalam karena ketidakjelasan dalam peraturan hukum yang mengaturnya. Kurangnya regulasi secara eksplisit mengenai ahli waris pengganti menuntut pihak penegak hukum untuk mengandalkan sumber hukum lain sebagai pedoman dalam penyelesaian kasus terkait. Yurisprudensi menjadi penting dalam membantu hakim memutuskan kasus-kasus semacam itu. Penelitian ini bertujuan untuk menggali manfaat kaidah yurisprudensi terhadap ahli waris pengganti dalam konteks perkembangan hukum di Indonesia, menggunakan pendekatan yuridis normatif serta metode analisis deskriptif dan penelitian perpustakaan. Hasilnya menunjukkan bahwa kaidah-kaidah hukum yurisprudensi memberikan kejelasan terhadap kedudukan ahli waris pengganti dalam sistem hukum Indonesia, termasuk melalui Pasal 185 Kompilasi Hukum Islam. Selain itu, yurisprudensi juga membantu dalam aspek formalitas hukum dengan memastikan kelengkapan data administratif untuk proses peradilan di Pengadilan Agama. Dengan demikian, yurisprudensi dianggap dapat memberikan kepastian, keadilan, dan manfaat hukum bagi masyarakat terkait kasus kewarisan yang melibatkan ahli waris pengganti

Abstract

Job creation regulated in Law 6 of 2023 still leaves legal problems at the norm level, especially regarding workers' rights. This study analyses the workers' rights regulations regulated in the International Covenant on Economic, Social, and Cultural Rights 1976 (ICESCR) and the ILO Convention associated with labour clusters. This research uses normative legal research. The results of this study are first, the rights of workers/labourers regulated in the Eco Covenant and the ILO Convention are the right to work, get a decent wage, not forced to work; leave; the right to be free from forced labour; get weekly breaks; and the role of the state represented by the government to guarantee the rights of workers/labourers. Second, there is a discrepancy between the Eco Covenant and the ILO Convention regarding the regulation of labour in the labour cluster, so it is contrary to human rights principles. The state should pay more attention to the provisions of the Eco Covenant and the related ILO Conventions, and the internal regulation of the employment cluster must be inclined to workers/labourers with a lower bargaining position than employers. Cipta kerja yang diatur dalam Undang-Undang 6 Tahun 2023 masih menyisakan permasalahan hukum dalam tataran norma, khususnya dalam wilayah hak pekerja/buruh. Tujuan dari adanya penelitian ini adalah untuk menganalisis peraturan tentang hak-hak pekerja/buruh yang diatur dalam Kovenan Ekosob dan Konvensi ILO yang dikaitkan dengan klaster ketenagakerjaan. Penelitian ini menggunakan penelitian hukum normatif. Hasil penelitian ini adalah pertama, hak-hak pekerja/buruh yang diatur dalam Kovenan Ekosob dan Konvensi ILO adalah hak bekerja; mendapatkan upah yang layak; tidak dipaksa bekerja; cuti; hak terbebas dari kerja paksa; mendapatkan istirahat mingguan; dan peran negara yang direpresentasikan oleh pemerintah untuk menjamin hak-hak bagi para pekerja/buruh. Kedua, terdapat ketidaksesuaian antara Kovenan Ekosob dan Konvensi ILO dengan pengaturan ketenagakerjaan yang diatur dalam klaster ketenagakerjaan, sehingga bertentangan dengan prinsip-prinsip dari hak asasi manusia. Seharusnya negara lebih melihat lagi kepada ketentuan Kovenan Ekosob dan Konvensi ILO yang terkait dan pengaturan dalam pada klaster ketenagakerjaan harus condong kepada pekerja/buruh yang memiliki posisi tawar yang lebih rendah daripada pengusaha.

Abstract

This study aims to analyse and criticise the application of sustainable development principles in forest spatial planning. The research method used is normative juridical research, and the approach used is the context and statutory approaches. The study results show that law in the primary sector must refer to sustainable development and people's welfare. Forest destruction cannot be considered a consequence of activities in this sector; it also reflects the failure of spatial planning in an area. The embodiment of spatial planning that can realise environmental preservation must lead to how the law exists in the community. The community around the forest area, as the leading actor, plays a crucial role in controlling and protecting the forest, and their involvement is vital for successful environmental preservation. An extraordinary, measurable, planned, and directed spatial arrangement is urgently and significantly needed. This is done so that the living environment is maintained and planned. Good planning is expected to lead to good spatial use, but this requires consistent management so that environmental sustainability remains aligned with spatial planning scenarios.Penelitian ini bertujuan untuk menganalisis dan mengkritisi tata ruang dalam pinjam pakai kawasan hutan dalam hubungannya dengan prinsip-prinsip pembangunan berkelanjutan. Metode penelitian yang digunakan ialah penelitian yuridis normatif dan pendekatan yang digunakan adalah pendekatan konseptual, dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa hukum di sektor kehutanan harus mengacu kepada pembangunan berkelanjutan dan kesejahteraan rakyat. Kerusakan hutan tidak dapat dianggap sebagai konsekuensi dari kegiatan di sektor kehutanan, kerusakan tersebut juga mencerminkan gagalnya penataan ruang di suatu daerah. Perwujudan tata ruang yang dapat mewujudkan pelestarian lingkungan hidup harus mengarah kepada bagaimana hukum yang ada di masyarakat, karena masyarakat sekitar Kawasan hutan dapat menjadi aktor utama pengendali dan penjaga hutan itu sendiri. Atas dasar hal tersebut dibutuhkan penataan ruang yang terukur, terencana dan terarah yang bersifat extraordinary, ini dilakukan agar lingkungan hidup tetap terjaga dan terencana. Perencanaan yang baik diharapkan dapat mengarah pada pemanfaatan ruang yang baik, namun hal ini membutuhkan tata kelola yang konsisten agar kelestarian lingkungan hidup tetap sejalan dengan skenario penataan ruang.

Abstract

Abstract The digital economy era has driven the use of technology that relies on data utilization to support various economic activities, such as the use of data analytics. The use of data analytics to provide more relevant features and ads to users of various online platforms has legal implications that must be supported by a legal framework for personal data protection in Indonesia. This study is done to analyze the gap in the development of legal framework in Indonesia in regards to the use of data analytics. Using normative legal research, this study explains the legal implications and outlines the legal issues related to the use of data analytics and the risks faced by online platform users as data owners. The analysis using the statutory approach in this research found that there are several legal issues and normative limitations that make it difficult to implement the concept of transparency and consent in efforts to protect personal data of online platform users, which is the main target of the use of data analytics. The findings of this study also indicate that the use of more complex technical terms is not found in regulations governing the protection of personal data, and hinders further normative exploration related to the use of data analytics that distinguish the types of data used into more complex terms and classifications.

Abstract

IEL plays an important role in achieving the SDGs which is influenced by the design and application of the law. International trade agreements can limit government policies that support sustainable development, while international financial regulations affect the flow of funds for sustainable projects. The role of multilateral development banks and international investment is significant in supporting the SDGs. This study examines the extent to which IEL affects the implementation of the SDGs and recommends best practices and strategies that can be adopted to increase IEL's contribution to sustainable development. This research uses a qualitative approach and analyzes legal documents, case studies, and expert interviews. The interesting findings of this study show that the IEL supports the rule of law by promoting transparency and accountability. However, there are still challenges such as power imbalances between developed and developing countries, legal compliance, and the integration of IELs with the SDGs. In addition, IELs can support or hinder the SDGs, depending on their design and implementation. The impact of free trade agreements on the SDGs shows the economic and environmental benefits as well as the challenges of inequality and environmental degradation. Meanwhile, the recommendations that can be given from this study are that to increase IEL's contribution to the SDGs include the integration of sustainable policies in trade agreements, green investment, strengthening law enforcement mechanisms, transparency and stakeholder participation, and the development of international cooperation.

Abstract

The principle of Equilibrium (balance) in indigenous and tribal peoples is an ethical demand considering the moral, social, and legal values prevailing in society. This concept is closely related to the communal mentality of customary law. This writing aims to understand how the principle of Equilibrium (balance) is applied to the cosmological rights of indigenous and tribal peoples as an effort to implement Pancasila values. The method used in this research is normative legal research with a statutory approach, supported by observation and interviews, then analyzed prescriptively to achieve a clear understanding of the issues discussed. This principle of balance serves as a guide for creating a balance between rights and obligations which can be realized concretely through legal and non-legal norms in the context of customary law communities. This allows various rights owned by indigenous peoples to be recognized and respected. Therefore, the government needs to prioritize Pancasila values in development and pay attention to the cosmological rights of indigenous and tribal peoples. Thus, customary law can be a means to answer various legal problems faced by the people in their daily lives in certain areas while maintaining the cosmological rights of the indigenous peoples themselves.

Abstract

This research aims to analyze criminal liability in relation to fault, specifically intention (dolus) and negligence (culpa), committed by optical fiber operators from the perspective of positive law, in conjunction with the synchronization of the criminal justice system and the maqashid shariah in relation to the resulting harm to society. The study utilizes primary, secondary, and tertiary legal materials, supported by qualitative analysis, considering that the research is of a juridical normative nature, and employs a legislative, case-based, and comparative approach. In addition to providing compensation, the findings indicate that the fault of the optical fiber operator (schuld) as a corporation, whether through dolus or culpa, leads to criminal liability for damages to roads, drainage systems, and sidewalks as public infrastructure. Businesses may sometimes be parties that benefit from the crimes they commit, making it unjust to impose criminal penalties on management, including the possibility of applying a Deferred Prosecution Agreement (DPA), particularly in cases where the loss can be quantified economically, through legal reforms. Authorities responsible for regulations concerning urban development are also accountable, meaning that local government administrations (district/city) hold responsibility. The use of criminal mediation as part of restorative justice, also within the frameworks of the crime control model, due process model, juridical model, and steering model, is relevant. To achieve fair legal objectives from the perspective of Positive Law, synchronization within the criminal justice system is needed, including substantial, structural, and cultural synchronization, as well as aligning with Islamic legal ideals and the maqashid shariah, which are in accordance with Divine Justice and the principles of Hifdz ad-din, Hifdz an-nafs, Hifdz al-aql, Hifdz al-mal, and Hifdz an-nasl, as the philosophy of Islam for the welfare of the universe (rahmatan lil ‘alamin). Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana sehubungan dengan kesalahannya berupa kesengajaan (dolus) dan kelalaian (culpa) yang dilakukan oleh operator fiber optik dalam pandangan hukum positif dengan sinkronisasi sistem peradilan pidana dan maqashid syariah sehubungan timbulnya kerugian bagi masyarakat. Dipergunakannya bahan hukum primer, sekunder dan tersier didukung analisis kualitatif, mengingat jenis penelitiannya yuridis normatif serta dipergunakan pendekatan undang-undang, kasus, dan komparatif. Selain memberikan ganti rugi, temuan penelitiannya menunjukkan bahwa kesalahan operator kabel optik (schuld) sebagai korporasi, baik dolus maupun culpa, mengakibatkan pertanggungjawaban pidana atas kerugian dan kerusakan jalan, sistem drainase, dan trotoar sebagai fasilitas umum. Bisnis kadang-kadang menjadi pihak yang mengambil keuntungan dari kejahatan yang mereka lakukan, maka dianggap tidak adil untuk menjatuhkan hukuman pidana kepada manajemen, termasuk tidak menutup kemungkinan diberlakukan Deferred Prosecution Agreement (DPA), utamanya dalam kasus yang berkaitan dengan suatu perkara yang kerugiannya dapat diukur dengan ekonomi dengan melakukan pembaruan hukum. Pemegang kekuasaan atas peraturan yang mereka keluarkan mengenai pembangunan kota, maka pemerintah daerah kabupaten/kota juga bertanggung jawab. Penggunaan mediasi pidana sebagai salah satu komponen keadilan restoratif tidak terkecuali dalam crime control model, due process model, model yuridis dan model kemudi. Untuk mencapai tujuan hukum yang berkeadilan dari sudut pandang Hukum Positif perlu adanya sinkronisasi sistem peradilan pidana meliputi sinkronisasi substansial, sinkronisasi struktural, dan sinkronisasi budaya dan cita-cita hukum Islam yang sesuai dengan keadilan Ilahi dan Maqashid Syariah seperti Hifdz ad-din, Hifdz an-nafs, Hifdz al-aql, Hifdz al-mal, dan Hifdz an-nasl sebagai falsafah umat Islam untuk kemaslahatan alam semesta (rahmatan lil ‘alamin).

This study identifies specific legal loopholes and regulatory deficiencies contributing to white-collar crime, advocating adaptive legal reforms and a collaborative approach to fortify the legal framework. In the context of Dubai's rapidly growing economy, this study delves into the escalating global phenomenon of white-collar crime, focusing specifically on its prevalence within the emirate's financial sector. The study addresses the potential exploitation of legal frameworks and regulatory gaps, offering a contextualized analysis of the contributing factors amid Dubai's economic expansion. The research employs a comprehensive literature review to identify existing gaps in understanding, focusing on the distinctive challenges faced by Dubai. The research aims to furnish a comprehensive understanding of white-collar crime in the financial sector, emphasizing the mechanisms through which legal loopholes and regulatory shortcomings may facilitate such offenses. By pinpointing vulnerabilities, the study provides actionable insights for policymakers, regulatory authorities, and stakeholders to fortify the legal infrastructure and prevent financial misconduct. The findings not only deepen the comprehension of white-collar crime challenges in Dubai but also furnish practical insights for mitigating future risks, presenting a roadmap for policymakers to combat the evolving nature of financial offenses in the region. Abstract

Every victim of terrorism is entitled to a remedy that the state must guarantee by law. However, Law No. 5/2018 on the Eradication of Criminal Acts of Terrorism limits victims of criminal acts of terrorism to three years since the enactment of the law to be able to apply for reparations. This will certainly harm those victims who have passed the three years, but have not submitted a request for reparations. This research aims to examine the position of the right to recovery for victims of terrorism in the context of international law and the compatibility between the limitation period and international law. This conceptual research uses qualitative methods, legal research, and is descriptive. The result shows that terrorism crime can be qualified as a gross violation of human rights. Therefore, the state must provide remedies to the victims affected by the law's enactment, namely to those victims of terrorism who lost the right to apply for remedy three years after the law's enactment. Then, it can also be concluded that the right to reparations for victims of terrorism is inherent to every victim and the restriction on the right to reparations for victims of terrorism by the law is contrary to the international human rights law norms. Setiap korban tindak pidana terorisme berhak atas pemulihan yang harus dijamin oleh negara secara hukum. Namun, UU No. 5/2018 tentang pemberantasan tindak pidana terorisme membatasi selama tiga tahun sejak berlakunya undang-undang tersebut bagi korban tindak pidana terorisme untuk dapat mengajukan pemulihan. Hal itu tentunya akan merugikan para korban tersebut yang setelah lewat waktu tiga tahun, tapi belum megajukan permohonan pemulihan. Penelitian ini bertujuan untuk mengkaji kedudukan hak atas pemulihan korban tindak pidana terorisme dalam konteks hukum internasional dan kesesuaian antara aturan pembatasan tersebut dengan aturan hukum internasional. Penelitian konseptual ini menggunakan metode kualitatif, penelitian hukum, dan bersifat deskriptif. Hasil penelitian menunjukkan bahwa tindak pidana terorisme dapat dikualifikasikan sebagai pelanggaran berat HAM. Oleh karena itu, negara wajib untuk melakukan pemulihan terhadap para korban yang terdampak dari berlakunya undang-undang itu, yaitu terhadap mereka para korban tindak pidana terorisme yang kehilangan hak untuk mengajukan pemulihan setelah tiga tahun sejak berlakunya undang-undang itu. Kemudian, dapat disimpulkan pula bahwa kedudukan hak atas pemulihan korban tindak pidana terorisme adalah bersifat melekat (inherent) pada setiap korbannya dan pembatasan terhadap hak atas pemulihan korban tindak pidana terorisme oleh undang-undang tersebut tidak sesuai dengan norma hukum HAM internasional.
