Abstract

Justice and openness are among the values of working culture needed to support the development of civil society and democracy. Justice means that the works done by civil servants should be free from discrimination in any aspects, while openness means everyone who deals with the government offices should get transparent informations about things they deal with. This research aims to analyse the effects of the ethnical working culture to justice and openness in working culture of the civil servants in the Pasaman Barat Administrations. The research finds that ethnical culture tend to influence the civil servants in working justly and openly. To solve the problem, civil servants’ working culture in the government offices needs to change, which can be done by integrating the working culture set by the government with the positive ethnical culture and religious teachings in order to build democratic civil society. Abstract

This research purposed are to know social impact of foresty management done by HPH Company and influence to community around forest, conducted in Solok Selatan Regency, to know depended level of community to forest and nature resource as basic needs and specifying the target of change which wish to be reached and recommended the best approach for improving benefit of foresty management to community and also participated of community in the effort forest everlasting. This research use qualitatif method with observation, indepth interview and Focus Group Discussion (FGD). Result of reseacrh show that the forest is very important for community as protected area from flood disaster and dryness and as wood source for cummunity. But, until now condition of forest felt having changes or degradation, especially felt from climate change side and quantity and quality water changes. There is a negative responce about HPH company existence, mostly happened because lack of socialization and communications among side. Effort of repair recommended are to develop more condusif relation between government, community with company, with interest many socialization and communications to find best solutions to the all problem. Abstract

This study aims to determine the cause of changes in the function of Minangkabau traditional clothing into the fashion of dance and reception, and whether the changes brought to the degredation of symbolic meaning of the traditional fashion. Through a qualitative approach and techniques of documentation, interviews and triangulation, member check, and peer debriefing, it was found that there have been changes in the function of traditional clothing into the fashion of dance and reception. The reason is because of a lack of understanding of users and choreographer. It is only driven by its aesthetic value alone, without appreciate the value of philosophy in addition to the lack of supervision of customary institutions. Thus there has been a degredation of traditional symbolic value when the traditional clothing was used in dancing and reception. Abstract

There is a unique stratification within the fishermen society; highest position is held by the owner of the ship, middle position is tungganai (guardian), and the lowest is the crew (labor fishermen) and traditional fishermen. Poverty is in the lowest end. They struggle difficultly to go out of their poverty. In terms of motivation, the poor fishermen work hard to have a better life. However, the condition and situation do not give them the chance to escape poverty. Key words: poverty, fishermen

Abstract

The primary mission of constitutionalist thought is the limitation of power of the government. This limitation means the guarantee and protection of rights of the society. The thought about the limitation of government power aims to avoid power abuse, authoritarian and irresponsible acts. In the constitutional democratic countries, constitutionalism is one of qualifications of democratic countries. Abstract

The purpose of this study was to review the judge’s verdict on case No. 166/PID.B/2006/PN PDG in terms of: (1) whether the judge’s verdict fulfills the elements of legal certainty, fairness, and benefit, (2) whether the judge’s verdict relies on the national and international human rights instruments as well as reviewing the aspects of violations of human rights particularly in cases of child abuse. The type of the human rights cases is domestic abuse of under-aged girls. This research used qualitative method with normative judicial approach. Data processing is done using content analysis. The conclusion of the research; (1) Council of Judges needs to understand the ratification of the Child Protection Law and Law on the Elimination of Domestic Violence as well as the International Human Rights Instruments by the Government of the Republic of Indonesia relating to the Convention on Children’s Rights, in order to stress the domestic child abuse as a form of violation against human rights and as a crime against humanity, (2) in order to protect the victims of domestic violence, particularly women and girls, judges should implement the Child Protection Law and Law on the Elimination of Domestic Violence in their verdicts and the Convention of Children’s Right, because the Penal Code KUHP has not guaranteed fully the protection of children and women as primary victims of domestic violence. Abstract

Segment of the third world's poorest people live in households headed by women, because in these households there is no man who can give income. When female heads of families are in a poor position then their ability to meet food needs for family members bear is also questionable. For the case of West Sumatra, although women are culturally Minangkabau tribe, has a fairly dominant position in the division of inheritance, which means has the advantage economically, but not necessarily female heads of families in West Sumatera is able to create and maintain a stable food security for the household, especially if fosterage family not just the nuclear family only. The power and intervention of ‘mamak’ is very strong in the decision making of high inheritance. This phenomenon indicates that the Minangkabau women actually do not have control over resources, such as land and other high inheritance. Moving on from the facts presented above writer is interested to dig further in research on women's roles Minangkabau tribe who became head of the family for the creation of household food security, with the focus of study in the Eastern District of Padang. Abstract

The author described, integration between two ethnics Minangkabau and Batak Mandailing was running at Buayan, a small village in West Sumatera. It caused by the Batak Mandailing adaptation ability and tolerance nature Minangkabau people. The sameness of religion (Islam) is the push factor to their integration. In addition, the long process of socialization that occurs in people Mandailing of Minangkabau cultural trait, as well as the amalgamation and the dominance of Minangkabau culture. It described by consider of some daily activities and special event, like badoncek at marital ceremony. Although the description was not neglect conflict, but conflicts at Buayan were not expanding in society before, and they have the musyawarah as the resolution conflict mechanism. All processes that occur precisely shows the acculturation from Minangkabau cultural trait to the Mandailing. Key words:  ethnical working culture, civil servants, civil society, democracy

Abstract

This article is based on a research aiming to study the street vendors’ social movement in the city of Bandar Lampung, particularly in Bambu Kuning market, by using the Marxist conflict perspective. The Bandar Lampung municipal policy to sweep the street vendors has caused them to resist. This research is qualitative, using observation technique, participative observation, in-depth interviews, and library research for data collecting. There are five important discoveries in the research; 1) street vendors movement, in Marxist conflict perspective, is a resistant act both openly and closely or latent. 2) Sweeps by Bandar Lampung municipality, which is based on public agreement on certain values such as bylaws Perda No 8 Tahun 2000 which aims at the street vendors, is a form of hegemony. 3) Movement by the street vendors, both openly and latently, which is perceived as a resistance in this research, is a counter hegemony. 4) Hegemony, resistance, negotiation, and compromise are indispensable things in a conflict between the ruling class and the subject class. 5) In Bambu Kuning market, there are people who control the street vendors as well as subordinated by the Bandar Lampung municipality. They are the market thugs usually called preman. Their position in the Bambu Kuning case is in “grey area” or not clear; representing none of both the street vendors and the municipality. This article is a summary of research studying Minangkabau traditional costumes, with focus on the costume of penghulu (head of tribe), which has symbols in it. The penghulu costume as a kind of visual language reflects the position of the wearer in the society, in correlation with his title, as a carrier of the Minangkabau traditional norms.
