Abstract

Requests for Land Release by private parties often lead to disputes. This is a derivative of the difference in legal force of the proof of the Deed of Release of Land Rights made by the Head of the Land Office and the Statement of Release of Land Rights made by the Head of the Land Office. This study aims to obtain empirical knowledge about the comparison between notarial deeds and Certificate of Release of Land Rights by the Head of the Land Office in the process of releasing land rights for private interests. This article is classified as literature research with a qualitative approach. The method used is an empirical juridical study. The results of the study explained that in the process of proving the release of land rights for personal interests, a notarial deed was used which was an Authentic Deed and a statement made before the Head of the Land Office.

Abstract

This study aims to determine how the implementation of the social fund management system in the welfare of the community in Baitul Mal As'adiyah Wonomulyo. This article is included in field research with a qualitative approach. The methodology used is descriptive analysis studies and case studies. The results of the study concluded that the existence of Baitul Maal As'adiyah has a role and benefits in helping to improve micro, small and medium enterprises in the vicinity, namely by collecting Zakat, Infaq, and Shodaqoh funds from the community and then distributed to 8 asnaf and those who are entitled to receive them in the context of poverty alleviation efforts. In addition, the existence of Baitul Maal As'adiyah is able to minimize the space for the role of loan sharks whose existence is very detrimental to small businesses.

Abstract

The potential of waqf as one of the asset instruments of Muslims in Indonesia has a great opportunity in sustainable economic development in the era of rapid technological development. These potentials and opportunities prompted this research to be carried out with the aim of knowing the perspective of Sharia economic law on collecting cash waqf funds through the use of Fintech or what is familiarly called E-Waqf. Furthermore, how this application encourages the interest of the younger generation in waqf and the factors that influence it. This article is classified as a literature research with a qualitative approach as the basis. The methodology used is a juridical-normative study for the review of E-Waqf law, and a qualitative method in mapping the interest of millennials in waqf. The results of this study show that the use of E-Waqf in waqf is allowed with several conditions that must be met. Meanwhile, the interest of the younger generation in waqf through E-Waqf is still relatively low. This is due to the lack of trust of the younger generation in waqf institutions that manage waqf assets

Abstract

The implementation of the standard agreement in the Insurance Agreement according to Law No. 40 of 2014 confirms that insurance is an agreement made between the insurer and the insured, which is regulated in Article 246 of the KUHD. As an agreement that affirms the fulfillment of binding rights and obligations between the insured party and the insurer, both parties must comply with all points of agreement that are part of the agreement in the agreement. This article is classified as a literature research with a qualitative approach. The methodology used is the study of descriptive analysis. The results of the study concluded that, according to the applicable legality, if an uncertain event occurs, AXA Mandiri makes a change to the policyholder for losses suffered based on the results of fund management.

Abstract

This research aims to describe the legal aid for the poor from the perspective of fiqh tanfiziyyah at the Menang Jagad Legal Aid Institute, North Lampung Regency. This research is a qualitative, in which data collection is done by observation and in-depth interviews. The data was analysed by using inductive method to get conclusion. This research found that first, the implementation of Regional Regulation Number 4 of 2013 concerning the provision of legal aid in North Lampung Regency is an effort to provide legal aid to the poor in accordance with the laws and regulations contained in Law Number 16 of 2011 concerning legal aid, and Regional Regulation Number 04 of 2013, as well as a derivative of Regent Regulation Number 18 of 2014. Second, the implementation of the provision of legal aid in North Lampung Regency through the legitimacy of Regional Regulation Number 4 of 2013 in the perspective of fiqh siyasah tanfiziyyah is in accordance with the norms of Islamic law and is obliged to provide services. Because in Islam itself it has been confirmed that every Indonesian citizen in his position before the law is the same. Namely, as an obligation of law enforcement and justice for all individuals.

Abstract

Property rights are hereditary, strongest and fullest rights that a person or legal entity can have over land keeping in mind social functions. Based on Article 20 of the UUPA it is stated that the distinguishing properties of property rights and other rights. Article 25 of the UUPA explains that property rights can be used as debt security by being burdened with dependent rights. In Law Number 4 of 1996 concerning Dependent Rights on land and objects related to land, it is stipulated that land rights can also be burdened with dependent rights when used as collateral to obtain credit at a bank. However, people in East Strait Village, Meranti Islands Regency cannot make property rights certificates as credit collateral. This article is classified as literature research with a qualitative approach. The methodology used is the study of normative law. The results of the study found that land owned by the community could not be charged with Right of Dependent. The Certificate of Dependent Rights cannot be issued because the land in the area is designated as included in the peat area or the PIPPIB map as stipulated in Presidential Instruction Number 5 of 2019 concerning the Termination of Granting New Permits and Improving the Management of Primary Natural Forests and Peatlands. The issuance of this Presidential Instruction is considered not in accordance with the authority of the holder of the title certificate as stipulated in the UUPA.

Abstract

This study is oriented in identifying the dimensions of moderate jurisprudence values in the judge's decision on divorce caused by the misuse of online karaoke applications in case number 400/Pdt.G/2021/PA. Jpr at the Jayapura Religious Court. This article is classified as literature research with a qualitative approach. The methodology used is the study of normative-empirical law related to the theory of moderate jurisprudence initiated by Quraish Shihab. The results of the study concluded that moderate and comprehensive legal considerations related to polemics on marriage cases caused by digital developments were reviewed from several factors, including; First, the value of fiqh al-maqasid. In the basis of divorce law rulings which refer to the difficulty of the potential realization of marriages that are sakinah, mawaddah, wa rahmah. Second, the value of fiqh al-awlawiyat in the basis of divorce law rulings which emphasizes the consideration of priority scales to avoid damage rather than attracting benefits when the marriage is maintained. Third, the value of fiqh al-muwazanat in the basis of divorce law decisions that emphasize greater benefit by choosing the path of divorce. Fourth, the value of fiqh al-maa'lat in the basis of legal rulings that can have social implications for the realization of the benefits of married life in the digital era

Abstract

As a student, ideally prioritize consumptive behavior that prioritizes academic affairs. In fact, students often focus on lifestyle dimensions and aspects outside academia. This raises questions about students' motivations and the extent of their awareness of basic needs. This study examines the consumption patterns of State Islamic University (UIN) Raden Intan Lampung students who adhere to a modern lifestyle. This study explores the impact of Sharia economic law on the consumption behavior of the class of 2020 student groups who took the Sharia Economic Law program at the Sharia Faculty. This research includes field research with a quantitative approach. The methodology used is a descriptive analysis study. The primary data of this study consisted of Sharia Economic Law students class of 2020 from the Sharia Faculty of UIN Raden Intan Lampung. Data collection was carried out through interviews, observations, and questionnaires. The results of the study found that. Students majoring in Sharia Economic Law at UIN Raden Intan Lampung do not follow the Islamic Economic Law, especially the theory of Al Ghazali Consumption. Their emphasis on complementary and aesthetic needs, rather than basic needs, shows a lack of awareness of basic needs and a tendency towards extravagance and luxury.

Abstract

The minimum age of marriage is 19 years in Law Number 16 of 2019 concerning Marriage, which has an impact on the rampant application for marriage dispensation. This regulation should be a reference for the community in order to create an ideal and harmonious married life, but people tend to choose marriage dispensation even though it will have a negative impact on children's financial, psychological, and also children's health. The research aims to analyze the role of judges to minimize early marriage and judges' considerations to reject or approve applications for marriage dispensation, especially in the Kraksaan region. This article is classified as literature research with a qualitative approach. The methodology used is an empirical juridical study. The results of the study concluded that; The role of judges is very vital, especially in educating parents not to proceed with applications for marriage dispensation for the good of children.

Abstract

The Islamic Financial Institutions play a crucial role in the economy of a country, including Indonesia, but they face challenges such as bankruptcy, insecurity, and inadequate supervision. This research examines the principle of transparency in Wadi'ah savings contracts at BTM An-Nur Mandiri Jaya from the perspectives of Shariah Economic Law and Positive Law. In this study, the researcher analyzes the application of transparency principles in Wadi'ah contracts at BTM An-Nur Mandiri Jaya, focusing on Shariah Economic Law and relevant Positive Law. A qualitative field research method is employed, supported by relevant literature. The research findings indicate that BTM An-Nur Mandiri Jaya has successfully implemented transparency principles in Wadi'ah contracts, including account opening, deposits, withdrawals, and closures, based on Shariah Economic Law. However, compliance with Positive Law, particularly POJK Number 19 of 2021 Article 32 Paragraph 1 and Law Number 1 of 2013 Article 2 Letter e, remains incomplete, as evidenced by the lack of online media access to obtain information. In conclusion, BTM An-Nur Mandiri Jaya needs to enhance transparency practices in accordance with legal provisions, especially by providing online access to information.
