Abstract

The presence of legal uncertainty in the Ngabang District Court Decision No. 48/Pid.Sus/2019/PN.Nba raises questions about the impact of the Public Prosecutor's negligence in determining the charges. In this case, the prosecutor failed to establish charges that corresponded to the defendant's actions, necessitating a review of the legal certainty affected by such negligence. This research is categorized as a library study with a qualitative approach. The methodology used is normative analysis, focusing on analyzing and evaluating the impact of the prosecutor's negligence in establishing charges. The findings conclude that the Public Prosecutor's negligence in determining the appropriate charges leads to legal uncertainty, the violation of human rights, and disorder. It also limits the authority of the judicial panel. Therefore, the Public Prosecutor must exercise greater caution in selecting charges, as the indictment plays a crucial role in the judicial process.

Abstract

In the perspective of Islamic law, ideally, every income that has reached the threshold should be subject to a certain amount of zakat. In reality, many online entrepreneurs in Kota Langsa are indifferent to this matter, causing academic concern behind the lack of awareness in paying zakat. This article falls under field research with a qualitative approach. The methodology used is descriptive analysis study. Primary data sources include in-depth interviews with online business operators in Kota Langsa. Secondary data sources comprise scholarly articles published within the last five years. The research concludes that the lack of awareness stems from confusion among the public regarding the amount and procedures of zakat in online trade that must be fulfilled. Therefore, governmental socialization efforts are needed to stimulate public interest in its distribution.

Abstract

This paper discusses the complexity of the application of adultery laws in Indonesia, particularly in a comparison between the Criminal Code and the Aceh Qanun. The transformation of adultery regulations reflects the evolution of society's views and responses to social change. This research aims to understand the essence and implications of this regulatory transformation. In the context of legal harmonization, this research reveals the challenges and opportunities of harmonizing universal values with local and religious values, especially in the aspect of Islamic law in Aceh. The research conclusion provides a nuanced view of the dynamics of legal harmonization in Indonesia, emphasizing the need to create harmony in the legal system.

Abstract

This study aims to evaluate the impact of asset recovery on the Bireuen District Attorney's Office on law enforcement and corruption eradication in the Bireuen Regency Government. This research is classified as literature research with a qualitative approach. The methodology used is a normative juridical study of the Attorney General's Regulation of the Republic of Indonesia Number 7 of 2020 concerning the Second Amendment to the Attorney General's Regulation Number PER-027/A/JA/ 10/2014 concerning Guidelines for Asset Recovery. The results of the study concluded that asset recovery by the Bireuen District Attorney's Office had a significant positive impact on law enforcement and corruption eradication in Bireuen Regency. Asset recovery strengthens public trust in law enforcement agencies, increases accountability, and reduces corruption.

Abstract

The provisions of Isbāt nikāh have differences in the views of the Compilation of Islamic Law (KHI) and the Shafi'i school of jurisprudence (Fiqh Syafi’iyah). These differences have attracted the attention of the author to study them. The method used in this research is descriptive comparative analysis, which involves examining and comparing a problem through explanation, interpretation, recording, and data analysis. The research results indicate that isbat nikah is found in the Compilation of Islamic Law and the Shafi'i school of jurisprudence. However, the term Isbāt nikāh is not mentioned in the Shafi'i school of jurisprudence. In contrast, the KHI specifically regulates this issue in Article 7, paragraphs 1, 2, 3, and 4. The provisions of isbat nikah, according to the KHI and the Shafi'i school of jurisprudence, differ significantly. Almost all the provisions of isbat nikah in the KHI are not found in the Shafi'i school of jurisprudence.

Abstract

Every marriage requires harmornisan and also permanence, to realize that, harmony between spouses is very important. This harmony in marriage law is called kafaah. The benchmark is not only compatibility in morals, but also related to age, social status and education. Many divorce phenomena occur due to the unfulfillment of the income of wives and children. Further explored this is due to the poverty factor caused by many variables. This study was conducted to answer two questions, first whether poverty is a contributing factor to divorce. Second, what is the reason for the divorce that occurred in the Pidie community. This research is classified as field research with a qualitative approach. The methodology used is the study of phenomena in the maqāṣid review. The results of the study concluded that the peceraian factor is caused by many aspects, poverty is one of them. As for divorces that occur due to poverty dip.

Abstract

Regional autonomy and autonomous regions in Indonesia are affirmed in Article 18 of the 1945 Constitution, providing the constitutional basis for the regional governance system. Ideally, regional autonomy enables regions to independently and effectively manage their governmental affairs. However, in reality, there is a discrepancy (disparity) between theory and practice, particularly in the context of the Special Autonomous Region of the Capital City. This study is a literature-based research with a qualitative approach, employing normative juridical methodology. The study concludes that the establishment of the Special Autonomous Region of the Capital City should first comply with the provisions of Article 18 of the 1945 Constitution, and only then consider Article 18B, especially in the context of relocating the capital city to East Kalimantan. Article 18 of the 1945 Constitution emphasizes the "principle of autonomy" in regional governance, particularly for special regions like the Special Autonomous Region of the Capital City. The formation of the Special Autonomous Region of the Capital City must align with the requirements of Article 18 of the 1945 Constitution before considering Article 18B, particularly in the context of the capital relocation plan.

Abstract

Although restrictions on religious freedom are stipulated in the Qanun, However, judging from modern legal science, both state law and international law, there is no formal law that regulates the sanction of converting, namely apostate fingers. Unlike Aceh, as an Islamic sharia region, Aceh has its own qanun where apostates will be subject to sanctions in the form of flogging, fines, imprisonment, and coaching to re-embrace Islam. This regulation is certainly a serious topic both from the perspective of Islamic and national legal authorities, especially how human rights institutions both locally and nationally respond to it. This article is classified as literature research with a qualitative approach. The methodology used is a comparative study of law, especially between conventional law and Aceh Qanun. The results of the study concluded that sociologically, regarding freedom of religion in Aceh Province, it does not conflict with international human rights because the uqubat ta'zir given to perpetrators is approved by all levels of Acehnese society. Precisely if uqubat ta'zir is not given to the perpetrators of apostate jarimah, then the stability of security and religious order in the province is shaken, and minorities, namely people of religions other than Islam, do not feel oppressed by the sociological impact of the law applied by the people of Aceh.

Abstract

From the perspective of Islamic law, adolescents in the Islamic sharia region (Aceh) should ideally be guided by strong moral and ethical values. Intensive religious education, a harmonious family environment, and a supportive community are the main foundations in the formation of adolescent character. Adolescents who grow up in an environment that emphasizes the importance of prayer, fasting, zakat, and other virtuous values are expected to be able to avoid deviant behavior and criminal acts. However, the situation in Karang Baru, Aceh Tamiang shows a different picture. Many teenagers in this area fall into immoral crimes, both consensual and coercive such as molestation and rape. This article is classified as a literature research with a qualitative approach. The methodology used is normative legal studies and phenomenological studies. The results of the study concluded that the causes of immoral acts are multifactorial and interrelated. Low education and difficult economic conditions are significant factors, exacerbated by an unsupportive environment and easy access to alcohol and unfiltered technology.

Abstract

The activities related to Dam Haji not only impact the rights of protection for pilgrims in fulfilling the requirements, obligations, and pillars of the pilgrimage. There is a multiplier effect from these activities that occurs annually. This impact is closely related to the reduction of extreme poverty and stunting, and the realization of economic entities in the second and third sectors, directed by policies concerning the Hajj economic ecosystem. To date, there is no definitive rule of law that governs the payment, implementation, and distribution of Dam Haji. Detailed data on these Dam Haji activities are also not available. Meanwhile, support from Hajj stakeholders, Islamic community organizations, and the results of Hajj discussions recommend that the state should ensure the proper management of Dam Haji for social and economic benefits to both countries. This management represents state intervention, specifically through the Ministry of Religious Affairs, which should use its discretionary power as a regulator to issue regulations as the legal basis that must be followed by all stakeholders and the public.
