Abstract

As proprietors of Intellectual Property Rights (IPR), creative professionals (designers, creators, and inventors) in Karawang regency own exclusive rights that enable them to independently profit from their works in the form of royalties or licensing. However, in reality, they have difficulties in accessing capital needed to expand their business. Some financial institutions might not accept IPR as collateral for credit even though the law principally states that they are valuable assets and therefore eligible as collateral. Copyright Law No. 28 of 2014 (Article 16) and Patent Law No. 13 of 2016 (Article 108) both permit owners and holders of intellectual property rights to utilize such rights as collateral for loans under a fiduciary arrangement. The laws should apply to copyrights and patents, but so far they haven't, which is a shame because in theory they should. The lack of a change to Article 43 of BI Regulation Number 14/15/PBI/2012, which pertains to the forms of credit collateral, makes it difficult to use intellectual property rights as security for loans. To make the concept relevant, the regulation has to be changed

Abstract

The use of a brand when in a trading activity is often classified as unfair competition, in an attempt to gain an advantage by taking advantage of someone else's brand, either by falsifying it in its entirety or only in certain parts, in other words, equality at its core. Many consumers are deceived when buying branded products because of plagiarism in the logo design or product packaging that has been known by the public and is very similar to the original form. There are still many business actors who are dishonest and violate the law. There are business actors who still plagiarize famous brands so that the products they make attract many fans. Therefore, there is a need for healthy competition in trade, so that no party feels disadvantaged in the process of trade, this study adopts the normative juridical method with a legislative approach and conceptual approach. The results showed that disputes related to the sale of counterfeit trademarks can be resolved both through court and out-of-court channels. The actions of sellers of counterfeit goods who trade products without the permission of the brand owner are certainly detrimental to the owner of the brand. In the face of brand infringement disputes, a wise step that brand owners can take is to resolve the issue out of court through mediation. This approach is expected to prevent further losses, especially for brand owners, while maintaining their reputation in the public eye regarding plagiarism issues. However, if mediation does not reach an agreement, the brand owner has the option of filing a lawsuit in the Commercial Court

Abstract

This study discusses related to consumer protection when business actors are based on the Commercial Court decision decision Number No.28 / Rev.Sus-bankruptcy/2017/PN Pn.Jkt.Pst is caused by not being able to meet its debt obligations in accordance with the terms of bankruptcy under Article 2 Paragraph (1) of Law No. 37 of 2004 concerning bankruptcy and postponement of debt repayment obligations. The purpose of this study to determine the legal remedies that consumers can do and the liability of the company manager if the company is declared bankrupt due to errors or omissions. This research method uses the type of Normative research by using the method of statutory approach (statue approach), in which researchers examine further from the side of the applicable legislation. The method of data collection used is a literature study, analyzing the legal material obtained, which is in accordance with the problem and the purpose of the study. The results showed that bankruptcy brings significant consequences for the debtor, especially in terms of loss of control over its assets and the transfer of responsibility to the curator. This shows the importance of the curator's role in maintaining the value of the bankrupt's assets and protecting the interests of all related parties. We are of the opinion that there is a need for increased understanding and socialization of the rights and obligations of debtors and bankruptcy procedures so that business actors can be better prepared to face difficult situations. In addition, the government needs to consider policies that are more supportive of post-bankruptcy business recovery, so that business actors have the opportunity to bounce back and contribute to the national economy.

Abstract

The granting of Cultivation Rights (HGU) in the Nusantara Capital City (IKN) serves as a crucial instrument to support long-term investment aimed at achieving inclusive and sustainable national development. However, the extended duration of HGU, reaching nearly two centuries, poses significant challenges, particularly in ensuring the alignment of this policy with the principles of national agrarian law as stipulated in Law No. 5 of 1960 on Basic Agrarian Regulations (UUPA). Article 6 of the UUPA emphasizes that all land rights carry a social function, requiring the use of land to benefit the broader community. This study analyzes the agrarian law implications of granting HGU in IKN concerning social justice, environmental sustainability, and the protection of indigenous community rights. Using a normative juridical approach, the research examines Law No. 3 of 2022 on IKN, Government Regulation No. 12 of 2023, and the principles of national agrarian law. The findings indicate that while the HGU policy provides certainty for investors, it has the potential to create social disparities, disregard the rights of indigenous communities over customary land, and trigger the exploitation of natural resources, leading to ecosystem degradation. As a solution, the study recommends periodic evaluation mechanisms, protection of indigenous community rights through public consultations and fair compensation, as well as harmonization of agrarian regulations. The implementation of digital technology is also essential to enhance transparency and public participation. With inclusive, sustainable policies grounded in the social function of land, IKN can become a symbol of equitable and environmentally friendly national development transformation.

Abstract

Major corruption cases such as the Bank Century, e-KTP, Tambang and BLBI scandals are examples of how corruption can involve high-ranking officials and cost the state trillions of rupiah long marriage Agreement made by a husband and wife before or during marriage which regulates the Purpose of the Marriage Agreement Regulates separation or division of assets acquired during and before marriage. Prevent disputes related to assets in the event of divorce, corruption or death of one of the partners. The research method used is Normative Juridical. Separation of Assets Based on the Marriage Agreement. Assets are based on Article 29 of Law Number 1 of 1974 concerning Marriage and Articles 119-131 of the Civil Code. Relationship with Assets Assets obtained from corruption can be confiscated by the state if they are proven to be related to a criminal act. Abstract

Customary law is a collection of norms and rules derived from the habits or customs of the community, both written and unwritten. Marriage is a physical and mental bond between a man and a woman with the aim of building a family that is sakīnah, mawaddah, rahmah and barakah. The provisions of customary law and Islamic law have significant differences. Marriage in Islamic law regarding joint property and mutual inheritance between adopted children and adopted parents can be done through the institution of mandatory wills. These two legal provisions adopted from customary law are the result of the ijtihad of Indonesian scholars, because the second issue is not found in fiqh. This innovative creation of Indonesian scholars, apart from being a manifestation of the dynamic and creative characteristics of Islamic law, is also the identity of Islam Nusantara in the field of law. Seen from this aspect, the Indonesian KHI, in the language of the Law, can be referred to as Indonesian Jurisprudence because in addition to having an Indonesian personality, it also adopts customary law that lives in local traditions.

Abstract

Abstract Since entering the Reformation era, Indonesia has entered a new era in the government system, where most of the affairs for basic services that were previously in the hands of the central government are devolved through decentralization policies, which are also referred to as regional autonomy policies. Regional development in the autonomy era provides an opportunity for local governments to innovate by building local growth centers to encourage regional economic growth. In practice, Indonesia adoptsasymmetric decentralization, which in principle can be based on conditions: (1) administrative (management), (2) political, and (3) fiscal. Regarding fiscal decentralization, starting from the regime of Law 25/1999, Law 33/2004, to Law 1/2022, the central role of fiscal decentralization from the beginning aimed to support the financing of devolved affairs, known as the Money Follows Functions principle. The fiscal decentralization policy provides certainty that the devolved affairs can be properly implemented by the Local Government. However, in its empirical dynamics, during the 23 years that regional autonomy has been implemented, at least there are various problems originating from regulations and local governments themselves, which result in inefficiencies in regional spending. Starting from the effect of incumbent spending allocations in regional head elections (pilkada), known as the political budget cycle (PBC) effect; weak local government governance that causes inefficiencies in regional financial management; central and regional budgeting support that has not been optimal in implementation; to the biggest problem, namely the problem of corruption of the Regional Budget by the definitive Regional Head and the ranks of the regional government. This research uses a normative juridical approach method with a statutory approach accompanied by an analytical descriptive case approach. The type of data is secondary data collected and studied using literature studies and analyzed using qualitative analysis methods. The results and discussion of this study conclude, First, it cannot be denied that corruption drastically distorts fiscal decentralization in the regions. It is estimated that about 30 percent of Anggaran Pendapatan dan Belanja (APBD) funds evaporate due to corruption, and about 70 percent of them occur in the procurement of government goods and services. the emergence of APBD corruption is weak planning and budgeting. There are several sectors that are vulnerable to potential corruption, especially in expenditures sourced from the Transfer to Regional Funds, Village Funds and Deconcentration Funds, which have implications for the high cost economy. Second, the ideal formulation used to inhibit the potential for corruption in the regions, especially the APBD, includes optimizing the implementation of fraud audits such as investigative audits or corruption audits, creating an internal whistleblowing system for local governments, improving the regional budgeting system, and strengthening the Government Internal Supervisory Apparatus. In terms of encouraging sustainable regional development governance, policy recommendations are needed, including: increasing sustainable public transparency; considering results-based accountability; making extensive use of ICT (Information and Communication Technology); increasing the role of reward and penalty mechanisms; and changing the paradigm from money follows function to money follows program. Abstract

This paper examines the problems with Law Number. 23/2019 on the Management of National Resources for National Defence (PSDN), given that the PDSN Law contradicts several principles and constitutions that apply in Indonesia. Focusing on the overly broad function of the Reserve Component in national security in addressing hybrid threats, the centralisation of military funding that Article 75 of the PSDN Law attempts to violate, military and Reserve Component trends in other countries that have a focus on defence diplomacy, and the role of the Reserve Component in national security. Abstract

The restriction of legal standing for judicial review applicants at the Constitutional Court, which is limited to Indonesian citizens as regulated in Article 51(1) of the Constitutional Court Law, has created discrimination and injustice for foreign citizens whose constitutional rights are violated by the enactment of laws in Indonesia. This contradicts the principle of equality before the law guaranteed by Article 28D(1) of the 1945 Constitution. This research aims to analyze the normative conflict between the legal standing restriction in Article 51(1) of the Constitutional Court Law and the principle of equality before the law, as well as to formulate a reconstructed concept of legal standing regulations that ensures greater justice for foreign citizens in constitutional review processes at the Indonesian Constitutional Court. The study was conducted through comprehensive research and analysis of legal principles, constitutional norms, and constitutional law doctrines related to the concept of legal standing and the principle of equality before the law. The research findings indicate that the restriction of legal standing for foreign citizens in judicial review creates a legal vacuum in the protection mechanism of foreign citizens' constitutional rights. This study presents a novel finding in the form of a reconstructed concept of Article 51(1) of the Constitutional Court Law, which expands legal standing to foreign citizens under the condition that they can demonstrate a nexus between their constitutional injury and the implementation of the law under review.

Abstract

The Regional Representative Council (DPD), established after Indonesia's third constitutional amendment, was designed with dual missions: providing checks and balances against the House of Representatives (DPR) and channeling regional aspirations into central government policies. However, the DPD's limited authority has compromised its effectiveness in fulfilling these missions. This study examines whether the DPD's current regulatory framework reflects balanced power relations and effective checks and balances while representing regional interests in central government policies. It also explores potential restructuring of DPD-DPR authority to achieve these objectives. Using juridical-normative methodology, this research reveals that Indonesia's post-amendment representative system reflects asymmetric weak bicameralism, failing to achieve balanced DPD-DPR power relations or effective checks and balances. This weakness consequently undermines regional interest representation in central policy-making. The study proposes asymmetric strong bicameralism as a solution for achieving balanced power relations while ensuring regional representation. This reconstruction necessitates amending Law Number 17 of 2014 to strengthen the DPD's position as a regional representative institution.
