Abstract

Digitalization provides option for film-maker industry to penetrate their film release into digital mediums through film streaming platforms, one of which is Bioskop Online. Along with the ease of accessing film digitally, there is still a criminal loophole such as piracy or hijacking that goes alongside. The purpose of this reseacrh is to analyze copyrights protection on films that are released on film streaming platforms according to Law Number 28 of 2014 concerning Copyright, and also the implementation of watermark technology applied by Bioskop Online as an effort to protect the copyright of content in it. This research using  normative juridicial research method through a statute approach, also using secondary data sources and another supporting data in the form of interviews with Head of Content in Bioskop Online platform. The results concluded that films that released in Bioskop Online streaming platform is legally protected by the Copyright Law. Furthermore, the watermark technology used by Bioskop Online is also protected by Copyright Law as a copyright management information, copyright electronic information, and a technological protection measures.

Abstract

Non-fungible tokens (NFTs) make it easier for artists to utilize the moral and economic rights to their artworks in digital form. Unfortunately, the implementation of NFTs is still not accompanied by special regulations governing it. Law Number 28 of 2014 concerning Copyright can at least be a reference for its regulation because after all, one of the assets underlying the sale and purchase of NFTs is a work of art which is also protected by copyright. The purpose of this study is to analyze the position and legal protection of digital artworks in the NFT system from the perspective of Law Number 28 of 2014 concerning Copyright. This research uses a normative juridical approach method by taking secondary data sources and supporting data in the form of interviews with NFT creators which are then analyzed qualitatively. The results showed that digital artworks in the NFT system have the same position as works of art in general as they are also protected by copyright under Article 40 of Law Number 28 of 2014 concerning Copyright. However, there are several aspects in its implementation that are different from the Copyright Law, such as the royalty acquisition mechanism which is not based on a license agreement, but uses a smart contract which has become a default option offered in the NFT marketplace platform system. The NFT marketplace platform and the government exist as parties in charge of protecting copyright law.

Abstract

This research was motivated by the polemic on the recommendation of the General Election Supervisory Board (Bawaslu) of Tasikmalaya Regency regarding the disqualification of incumbent Tasikmalaya Regent Candidates who allegedly took advantage of government programs during the 2020 Tasikmalaya Regency Regional Head Election (Pilkada). Meanwhile, the General Election Commission (KPU), which did not implement the recommendations, was decided to have acted according to its authority. Demonstrations were rife everywhere which raised the precariousness of the Pilkada at that time. So, the author's research object is the disqualification recommendation documents which are formally and materially reviewed according to Law Number 10 of 2016 concerning the Election of Governors, Regents, Mayors with qualitative research of the type of retrospective case studies collecting recommendation documents disqualified from Bawaslu, KPU, DKPP, sources of legislation, interviews and the mass media. The results showed that the recommendation for disqualification violated authority in terms of time (onbevoegdheid ratione temporis), so that the Bawaslu was considered unprofessional.

Abstract

Political parties fulfill the criteria as corporations in the Corruption Crime Eradication Law. Political parties that benefit from the results of criminal acts of corruption have not been held criminally responsible for their administrators or members. This paper examines the rationale for criminal accountability of political parties in criminal acts of corruption committed carried out by the management or members and their criminal law policies. This paper is a type of normative juridical research in a broad sense. The basic idea of criminal accountability for political parties in acts of corruption must consider six things, among others; blameworthiness, need, moderation, inefficiency, control costs, and the victim's interests. For future reforms, it is necessary to regulate the formulation of the main types of punishment that are structural or institutional in nature.

Abstract

Transnational bankruptcy resolution is still a legal problem in ASEAN. This problem arises because there is no harmonization of legal regulations regarding transnational bankruptcy in ASEAN. Several countries in ASEAN are taking other ways to overcome this problem. This is done by entering into bilateral agreements or by adopting the UNCITRAL Model Law. Indonesia still does not strictly regulate transnational bankruptcy. Looking at the problems above, in this journal a comparison will be made regarding the resolution of transnational bankruptcy in Singapore, Malaysia and Indonesia as well as the application of international law in Indonesia in resolving transnational bankruptcy. This research was prepared with the aim of knowing and analyzing the legal regulations regarding transnational bankruptcy in ASEAN as well as identifying and analyzing the roots of obstacles to transnational bankruptcy in Indonesia. normative and comparative juridical approach methods, namely research that is focused on reviewing and comparing library materials or secondary data such as statutory regulations, international regulations, legal works using analytical descriptive research specifications and studied using qualitative data analysis methods. Based on the results of research and discussions carried out by analyzing decision Number 138/Pdt.Sus-PKPU/2016/PN.Niaga.Jkt.Pst, it was found that Indonesia has not regulated the mechanism for resolving transnational bankruptcy, so it is necessary to apply international law in resolving it by resorting to petition efforts. recognition and implementation of the bankruptcy decision in the country concerned.

Abstract

One of the legal consequences of marriage is related to the status and position of the child born. If a child is born out of wedlock, then the child is considered a child out of wedlock. A child out of wedlock can be legalized as a legitimate child if the parents submit an application for validation of the child's recognition to the Court. The purpose of this study was to find out the basis for the judge's consideration of the decision of the Salatiga District Court Number 24/Pdt.P/2021/PN Slt after the validity of the Constitutional Court decision Number 46/PUU-VIII/2010 and the legal consequences of the decision of the Salatiga District Court Number 24/Pdt. P/2021/PN Slt on the ratification of children out of wedlock. The research method used in this research is normative juridical legal research which is descriptive-analytical by using secondary data sources and supported by primary data to strengthen the research results. Data analysis was carried out using qualitative analysis methods. The results of the study show that  The judge's considerations in determining Number 24/Pdt.P/2021/PN Slt are in accordance with the laws and regulations in force in Indonesia, especially Law Number 24 of 2013 concerning Population Administration and Presidential Regulation Number 96 of 2018 Concerning Requirements and Procedures for Civil Registration and Registration. 2. With the granting of the stipulation, the Petitioner can use a copy of this stipulation to register the registration of the validation of his child's recognition at the Salatiga City Population and Civil Registration Service.
