Abstract

Professional Ethics of Judges in Islam.Judge is a position that is noble in the sightof Allah, but full of risks and challenges, because the risks are so great, the islamic scholars hasset the conditions that must be fulfilled in order to occupy the post of judge, and formulateparticular ethics as a references of the judges so that it do not disobey Allah in al-Qur'an andHadith. A judge must have ethical values that will support the profession and show the authorityof the law in the eyes of the public, to then be justified On God and society. Thus upholding thesupremacy and rule of law is not merely wishful thinking and rhetoric

Abstract

The era of the industrial revolution 4.0 has brought great changes to the human. The Supreme Court as the highest judicial body should embody effective and efficient justice with the simple, fast, and low cost princeples. This study examines the extent to which the Supreme Court Regulations regulate and embody an effective and efficient judicial system in resolving Islamic economic disputes in religious courts. This type of research is qualitative with a normative juridical approach. As a result, the Supreme Court has issued several rules as an effort to embody an effective and efficient judiciary, namely Supreme Court Regulation Number 2 of 2015 concerning the procedure for simple lawsuit resolution, Supreme Court Regulation Number 14 of 2016 concerning Procedures for Settling Sharia Economic Disputes, Regulation of the Supreme Court Number 5 year 2016 concerning Sharia Economic Judge Certification, Supreme Court Regulation 04 of 2019 concerning amendment to Supreme Court Regulation Number 02 of 2015 concerning Simple Settlement Procedures and Supreme Court Regulations 01 of 2019 concerning Electronic Case and Trial Administration. It regulates efforts to embody the resolution for Sharia economic disputes that are effective and efficient, namely through a simple lawsuit, judges must have competence in the field of sharia economics by issuing a sharia economic judge certification policy and providing judicial services electronically.

Abstract

On March 14, 2020, the government of the Republic of Indonesia announced the Covid-19 pandemic as a National Disaster. The whole community was asked to stay at home or work from home. This situation caused the daily activities of the community and government from school, work, trade, and others to become ineffective and delayed. This also affects all national and global corporate activities. Many business entities are disrupted due to the Large-Scale Social Limitation policy, so the company or a person cannot keep their promises as made in the previous agreement. This study examines whether Pandemic Covid-19 can be used as a reason for a person or a company to postpone the performance of achievements because it is considered as an overmacht, and how the legal force. This is a qualitative-library research using a juridical-normative approach. The results showed that overmacht is equated with the term force majeure meaning the state of force, in this case the debtor cannot be held accountable, because the situation occurs outside his control and not because of an element of negligence. The state of overmacht is regulated in the provisions of Article 1244 and Article 1245 of the Civil Code. The Covid-19 pandemic is considered as a forced condition, including the overmacht category, so that it can be used as an excuse for debtors to postpone or not carry out performance according to the agreement, provided that the debtor is able to provide reasons that the failure to fulfill the agreement is not because of them, but because something cannot be predictable, and inevitable.

Abstract

Besides building and developing the socio-economic potential of members and society, Islamic cooperatives are also the center of muamalah activities in an effort to realize and develop a national economy based on the principles of family and economic democracy. The widespread practice of usury especially in the caseof borrowing and investing, and an economy dominated by large companies, makes difficulty for small traders to develop and compete. This resulted in lower economic levels of society. Islamic cooperatives have great potential both in terms of human resources and other supporters. This study examines the role of the Baitul Mu’min Syariah cooperative in reducing the practice of usury and developing the welfare of the Ummah. This is qualitative research that combines library and filed research with an empirical approach. The results showed that the Baitul Mu’min Sharia cooperative was established to improve ukhuwah Islamiyah, the spirit of mutual cooperation and help, and to improve the welfare and prosperity of the congregation. It has contributed greatly to the service of the needs of its members and improve the economy of its members, who are mostly worshipers of the Baitul Mu’min mosque.

Abstract

Law Number 16 Year 2019 in article 7 provides an age limit for each person who will marry at the age of 19 years for men- and 19 years for women. The age limit given by the law does not look comprehensively in biological, sociological readiness, and so on. The modified law should be able to realize the benefit of the husband and wife in fostering the household. Determination of marriage age aims to protect offspring, create a family that is sawah mawaddah wa rahmah, maintain lineage, maintain family relationships, maintain diversity in the family, and prepare for maturity in the economy by paying attention to various aspects, both aspects, psychological, sociological, biological and certainly religious aspects. so that it can create a family in accordance with the marriage ceremony

Abstract

Insurance companies such as PT. Life Insurance Central Asia Raya, PT. Prudential Life Insurance, PT. Generali Indonesia Life Insurance, PT. Tugu Mandiri Life Insurance, PT. MNC Life Insurance, PT. Asuransi Jiwasraya (Persero), and PT. Sequis Life Life Insurance have marketed one of their insurance products with adirect sales system, or better known as direct selling, which was developed by insurance agents by recruiting insurance agents in a row. This paper explains how the Financial Services Authority (OJK) controls the marketing of insurance businesses and the view of Islamic law on the practice of direct selling in insurance marketing. Based on the type, this research is library research. The results showed that the Supervision of the Financial Services Authority was careless from the principles of legal certainty, professionalism, and openness. This is because Direct Selling was not included in the marketing channels stipulated in the Financial Services Authority Regulation (POJK) Number 23 of 2015 concerning Insurance Products and Marketing of Insurance Products. Based on the POJK, direct selling practiced by insurance companies is illegal. The Financial Services Authority emphasizes direct selling as the development of insurance marketing methods by the insurance agent. In the perspectiveof Islamic law, based on Sadd al-Dzari`ah, although basically direct selling is permitted, but the actions of the insurance agent have great potential to endanger the health of the insurance, and the negligence of the supervisionof the Financial Services Authority, the law of this direct selling is haram (forbidden). Therefore, the Financial Services Authority must review the direct selling marketing developed by the insurance agent.

Abstract

The Sultan Adam Law provides an important and interesting role in the development of the historyof law in the Banjar land. This happened during the reign of Sultan Adam Al-Watsiq Billah from 1825 to 1857AD. This Law contains matters of religion and worship, issues of Governance Law, Marriage Law, JudicialProcedures, Land Law, and Transitional Regulations. This article discusses the role of the Sultan Adam Lawin the resolution of religious problems in the Banjar community in South Kalimantan and in Progressive law.The findings of this study are that the Law of Sultan Adam became the guide of the judges in deciding cases,becoming a unifying instrument of the kingdom, and an antidote to deviant sect that developed in the 18thcentury AD The Sultan Adam Law also exists as a progressive law, because as a a legal instrument, this lawcan come out of existing traditions and be able to respond to problems that occur in society and always try toconstantly find new meanings and not be bound by absolute meanings. This Law is also able to act as a law thatlives in the midst of society and to meet their needs.

Abstract

The problems examined in this study is wast are interfaith marriages in accordance with the philosophical values of Indonesian marriage law? and why is the validity of interfaith marriages still being disputed in Indonesian marriage law? Related to the principle of continuing legal conditions and public order, the implementation of registration marriage by registration is a form of acceptance of interfaith marriages and the community has accepted the phenomenon of interfaith marriages as a natural reality and is considered to be true. This research is normative legal research and quantitative sociological legal research. The study methodology is analyzed based on the principle of public order, law smuggling, and continuation of the legal situation or rights that have been obtained. From this research, it was concluded that interfaith marriages were considered incompatible with the philosophical values of Indonesian Marriage law which were based on religious law, and could injure the long struggle history of Indonesian marriage law legislation under the principle of public order. Therefore, the registrations carried out by the civil registry office are not authoritative, but merely administrative.

Abstract

The purpose of this study is to answer the formulation of the problem of how is the objective condition of Islamic law in the politics of law in Indonesia and to find a concept to integrate Islamic Islamic law into State law. The research method is qualitative with a normative, philosophical and sociological approach. Substantially, the idea of formalizing Islamic law in Indonesia cannot be maximized without adaptation and reform to Islamic law, namely through ijtihad and maslahat. Every text of the Al-Qur’an and hadith that contains the law must contain maslahat. So that maslahat is an attempt to explore the meaning of the text of the Al-Qur’an. Maslahat is operationally manifested in the form of ijtihad theories, for example; qiyas, maslahah mursalah, istihsan, syad al-zdari’ah and urf. Likewise, maslahat affirmation of laws that are not contained in the Al-Qur’an and hadith, can be confirmative and can also be negative. The identification of maslahat as the essence of maqashid al-sharia is based on 1) the texts of the Al-Qur’an, the majority of which are in the form of amar and nahyu, (2) Illat and wisdom found in al-Quran and hadith, (3) al-Istiqra’.

Abstract

This paper aims to analyze the judges’ considerations of the Class I B Tanggamus Religious Court in the case of the determination of the Marriage Dispensation Number 008/Pdt.P/2018/PA. Tgm and 0012/ Pdt.P/2019/PA.Tgm, and the reasons put forward by the petitioners, as well as reviewing them from the maslahahah side. This research method is descriptive qualitative, with the Ushul Fiqh approach. Collecting data through documentation and library research, using sources related to the main research problem, both primary and secondary sources with philosophical, juridical, and logical approaches, and content analysis techniques. As a result, the panel of judges gave its decision based on the fact that their marriage could be carried out immediately because the applicants were consensual and always together, and there was a concern that unwanted things would happen in religion or the law. The reasons for parents to marry off their children at a young age (under 19 years) are due to cultural factors, releasing the burden on parents, and because they are pregnant outside of marriage. From the view of maslahah, this dispensation of marriage does not bring benefit, but rather brings harm. Because the impact after marriage, it turns out that one of them always quarrels in his household so he doesn’t live together anymore. And one other even though they still live together, but their lives are very deprived and unworthy.
