Abstract

The appearance of Islamic law implementation demand in public domain in Indonesia has its root since the formation era of Republic Indonesia after independence. However, this issue became more important after reformation era, especially after the fall of new order regime and enactment of Law No. 22/1999 on Regional/Provincial Government. Meanwhile, the implementation of Islamic law in Aceh has its own legality and legitimacy in the framework of Indonesian law state and in line of its constitution. This grant of acknowledgment to implement sharia law for Aceh based on Law No.44/1999 on Special Status of Aceh Province and Law No. 11/2006 on Aceh Government. Legally based on both law, some provincial regulations have been enacted to speed up the implementation of sharia law in Aceh.

Abstract

Waqf is one of the instruments in Islamic economics to boost up the economic justice and welfare of society. Indonesia, as the largest Muslim country in the world, has the potency to utilize this sector. Per 2012, according to Ministry of Religious Affairs, there are 3.49 billion square meters of land waqf spreading in 420.003 locations all around Indonesia. If these numbers were converted into cash, it surely will result in a fantastic number. However, most of these lands were still unproductive (idle) as most of them are only used for building mosques, schools, funerals, and other unproductive buildings. In some provinces in Indonesia, like Aceh, the used of asset waqf other than what it was literally stated by the giver is prohibited. The rules were set by traditional religious clerics with very rigid interpretations. Consequently, it creates mindset of its people that waqf should be treated in such a rigid way although they knew it could be used for a bigger purpose and get bigger maslahah for the whole ummah. To change the mindset is not easy as it has been ongoing for generations. One of the way is by inserting the local value and approach into management waqf. In Aceh, there were many models of muamalah that have been practicing and living in the society for such a long time. Among many, Angkat Bloe model is seen suitable to be inserted into management waqf. Angkat Bloe is a kind of contract that is commonly used in trading activities for the purpose of the asset that has been sold to be returned. Prior transaction, the seller and buyer set an agreement that the asset will be sold back to the seller after the buyer operate it for certain times at the same price as it was sold. Based on the above explanation, this paper will try to put an effort in providing solutions by inserting the local model into management waqf. The model will be justified using Quranic verses and related hadiths, the concept of maslahah, the view of ulama. The rationales and possible obstacles will also be highlighted.

Abstract

Islamic microfinance provides an alternative model for a significant number of underprivileged people who are not served by conventional microfinance. In order to give access to sustainable services to a greater extent, the Islamic microfinance is in paramount need of the adoption of innovative business models and sound practices into the industry. To this end, the research seeks to propose two tier mudarabah model based on cash waqf as an alternative to Islamic microfinance institutions. The objectives of the study are: to a) help develop and implement an appropriate business model; b) safeguard the maqasid al-Shari`ah so as to promote the well-being of the people through establishing justice and eliminating hardship; and 2) help make a reform in the present institutional framework for Islamic microfinance and waqf institutions. The study finds that cash waqf based microfinance institutions can play an important role inter alia in financial inclusion and developing socio-economic conditions of the poor and underprivileged people in society.

Abstract

This article describes the salaf doctrines as a religious group which has puritanical and radical interpretation on Islam. These doctrines are the master frame of salafi movement as the cornerstone of any ideas propagated. Among its doctrines are back to Qur’an and Sunnah; adhere Sunni (Ahlussunnah wal Jama’ah) within its ideology which differ the other Islamic groups interpretation; anti political parties and anti-western. To hold literal interpretation in interpreting Al-Qur’an and Sunnah (Prophet tradition) is one of its concept and paradigm to avoid speculative and reasonable interpretation. Although this religious group was engaged in political sphere by striving in “the holy war” in Moluccas around 2000 in the name of Lasykar Jihad (Jihad Paramilitary Force), from then on it became apolitical movement.

This article examines the relation ontolog y zakat profession and its relevancet o the implementation of creative consumptive pattern in which there is a shift in the meaning of zakat interpretation of fiqh issues as doctrinal truth becomes a social problem-empirical. This article makes charity the profession as part of the search for solutions to various social problems Muslims present and future.

Abstract

Al-Siyasah al-Shar'iyyah (SS) in Islamic history had played significant role in guiding and regulating the relations, activities and policies of Muslim states towards meeting Maqasid al-Shari'ah. Over time, this science became conservative and overloaded with general Shari'ah rules, and thus deficient of establishing a robust system of public policy formulation and analysis comparable to the current well developed conventional public policy system. Most of the literatures on al-Siyasah al-Shar'iyyah, past and present, still discuss the subject within the general principles of the Shari'ah. The present paper adopts content and thematic analyses to develop SS theoretical framework. It has used the new framework to present policy cases in Islamic Turath scientifically. Once refined, the new SS framework can be used for contemporary public policy analysis from Islamic perspective. The paper has set new direction for presenting SS scientifically that suits contemporary public policy analysis.

Abstract

The manufacture of the community forest should be improved, considering are still many empty land that is unproductive and needs of wood is very large. The community forest is the forest growing above the ground that burdened a right belongs to the community with the provisions of broad minimum 0.25 ha, closure of tree canopiesand other plants more than 50 %.Bireuën Regency in Aceh Province will plan development the community forest of 191 hectares with aid programs of the provincial government.The community have not been able to manage the forest maximally. Therefore, still have to need empowerment in the community forest management. Mudharabah system is an economic system of Islam or often called system for results with for sharing profit and loss without interest rates. The Percentage division results using mutual agreement. When using mudharabah system, the community will become more prosperous and aggressive in developing thecommunity forest. One of all purpose of this idea is the realization communityforest management of Mudharabah system. Lacking empowerment and insufficient capital to be the reason for the community not interested to manage the community forest. Mudharabah system provides convenience in managing the community forest involving investors, cooperatives, local community as a farmer, and the Village Government.

Abstract

The study on the relevancy of institutional economics to mainstream Islamic economics especially in Islamic finance is not widely known. The relevancy issue arises due to: the role of revelation and reason; and the assumption of an ideal Islamic financial institutions; the role of both institutional environment and institutional arrangements on the setting-up of the Islamic financial institutions. Thus, the discussion in this paper provides a brief (and admittedly unbalanced) sketch of the new institutional economics which is relevant to Islamic finance. The literature in NIE is expanding rapidly and gaining increasing adherents and influence in Islamic finance. Our findings show that it is a highly diverse field and its many branches are rich in theoretical insight, relevant for policy and empirically useful.
