The rapid development of information technology that provides advantage apparently has a negative impact on users, namely the possibility of leakage of personal data. Cloud Computing is one example of IT development that provides uploading and downloading storage files in a very simple way. However, there were many cases involving the platform in the case of data leakage. The objective of this research is to identify the regulation and how the cloud computing service providers are responsible for this. Cloud computing is implicitly regulated in the Indonesian law which require registration of reliability certificates to guarantee its security. A law theory presented by Prof. Dr. Mochtar Kusumaatmadja, SH, LL.M., who stated that the law is progressive is not in accordance with cloud computing regulations that have not been specifically regulated.

Perusahaan asuransi wajib memenuhi ganti kerugian klaim asuransi dari pemegang polis. Namun memungkinkan perusahaan asuransi tidak dapat memenuhi klaim. Sehingga permasalahan tersebut diselesaikan melalui akta perdamaian (akta van dading) oleh para pihak di pengadilan negeri. Akan tetapi pada praktiknya bisa saja akta perdamaian dibuat setelah perusahaan asuransi dicabut izin usahanya. Hal ini dikhawtirkan melanggar Pasal 43 UU Perasuransian yang menyatakan perusahaan asuransi wajib menghentikan kegiatan usahanya dan dilarang melakukan tindakan yang dapat mengurangi aset ataupun menurunkan nilai aset perusahaan. Metode yang digunakan penelitian ini ialah yuridis normatif, yaitu mengkaji permasalahan dengan peraturan perundang-undangan serta hasil penelitian dari studi kepustakaan. Penelitian ini diuraikan secara deskriptif analisis dan menarik kesimpulan dari permasalahan kekuatan hukum akta perdamaian dalam pemenuhan ganti kerugian klaim asuransi pada perusahaan asuransi yang dicabut izin usahanya. Berdasarkan penelitian ini diketahui bahwa akta perdamaian para pihak tetap memiliki kekuatan hukum, walaupun dilakukan saat perusahaan asuransi dicabut izin usahanya. Namun dalam melakukan pemenuhan ganti kerugian klaim asuransi yang didasari oleh akta perdamaian harus memperhatikan itikad baik para pihak. Kemudian pelaksanaan pemenuhan ganti kerugian klaim asuransi perlu diikuti dengan pembubaran badan hukum dan penunjukan tim likuidator sebagaimana diatur Pasal 44 UU Perasuransian.

Abstract The purpose of this study is to determine the Principle of Transfer Of Undertaking Protection Of Employment (TUPE) in Outsourcing Companies in Indonesia, the Concept of a Specific Time Work Agreement in outsourcing companies and to know the implementation of the TUPE principle on the rights of outsourcing workers with status Fixed time work agreement (PKWT). The method used in this research is the method of normative legal research which is a legal concept written in statutory regulations (law in books) or human norms. The results of the study in this journal are to protect the rights of agency workers with the status of a Fixed Time Work Agreement (PKWT), the company providing worker services is obliged to include a work continuity guarantee clause, guarantee the fulfillment of workers' rights in accordance with applicable laws and regulations as well as guarantee for calculating the working period in the event of a change of service provider companies for workers / laborers to determine wages. Abstrak: Tujuan dari penelitian ini adalah untuk mengetahui Prinsip Transfer Of Undertaking Protection Of Employment (TUPE) pada Perusahaan Alihdaya (Outsourching) di Indonesia, Konsep Perjanjian Kerja Waktu Tertentu pada perusahaan alihdaya (Outsourching) serta mengetahui Implementasi prinsip TUPE pada Hak-Hak pekerja Outsourching dengan status Perjanjian Kerja waktu tertentu (PKWT). Metode yang digunakan pada penelitian ini adalah metode Penelitian hukum normatif yang merupakan konsep hukum yang tertulis dalam peraturan perundang-undangan (law in books) atau kaidah/norma manusia. Hasil kajian dalam jurnal ini yaitu untuk melindungi hak-hak pekerja outsouching dengan status Perjanjian Kerja Waktu Tertentu (PKWT), Perusahaan penyedia jasa pekerja berkewajiban untuk mencantumkan klausul jaminan kelangsungan bekerja, jaminan terpenuhinya hak-hak pekerja sesuai peraturan perundang-undangan yang berlaku serta serta jaminan perhitungan masa kerja apabila terjadi pergantian perusahaan penyedia jasa pekerja/buruh untuk menetapkan upah.

Hak Cipta sebagai salah satu Kekayaan Intelektual telah mengalami disrupsi digital. Peran teknologi informasi dan komunikasi memberikan akses yang luas terhadap konten-konten digital di internet, seperti film-film pada layanan multimedia video-on-demand Netflix. Platform yang tergolong baru ini telah menyediakan tontonan film Indonesia melalui online streaming secara berlangganan. Namun pada praktiknya, belum diterapkan mekanisme pembagian royalti yang sesuai dengan ketentuan dalam Undang-undang Republik Indonesia Nomor 28 Tahun 2014 tentang Hak Cipta. Metode penulisan yang digunakan adalah metode pendekatan yuridis normatif, yaitu meneliti dan menggunakan data yang diambil dari berbagai sumber tertulis mengenai monetisasi Hak Cipta Digital. Penelitian ini menggunakan spesifikasi penulisan deskriptif analitis, yaitu dengan menuliskan, mengklasifikasikan, dan mendeskripsikan peraturan perundang-undangan dikaitkan dengan teori hukum dan praktik pelaksanaan objek penelitian. Tahap penelitian yang dilakukan adalah studi dokumen yang dilakukan dengan mencari data sekunder menggunakan bahan hukum primer, sekunder, dan tersier. Hasil penelitian memberikan saran yang dapat diterapkan untuk mengimplementasikan Undang-undang Nomor 28 Tahun 2014 tentang Hak Cipta dalam rangka penarikan royalti terhadap film dan Hak Cipta Digital.

Dalam arti luas, administrasi publik sering diartikan sebagai semua kegiatan negara dalam melaksanakan kekuasaan politiknya, sedangkan dalam arti sempit, itu adalah kegiatan eksekutif dalam melaksanakan pemerintahan. Perbedaan ini secara tidak langsung menyatakan bahwa pengertian "administrasi" dalam hukum administrasi publik berbeda dengan "administrasi" dalam ilmu administrasi publik. Artikel ini akan menjelaskan perbedaan antara kedua istilah ini dalam administrasi publik.

This study aims to identify the existence of Biak’s Frans Kaisepo Airport as an international airport. This research was conducted in Biak Numfor Regency. The data was collected through the interview method and then analyzed through descriptive and qualitative analysis. This study shows that the existence of a Regional Regulation (Perda) regulates the existence of the Airport. In the era of Papua's special autonomy, there is a possibility that there will be government compensation for the rights of indigenous peoples and there is no agreement between several clans who consider the customary land owners where the Airport was established, including the lack of public awareness in maintaining and protecting the Airport as a regional asset in increasing Regional Original Income (PAD), as well as efforts to improve community welfare based on the mandate of Law Number 1 of 2001 (Special Autonomy for Papua Province) and Law Number 1 of 2009 concerning Aviation.

The purpose of this study was to determine the urgency of Polri's specialization in eradicating Corruption Crimes. The research method used was an empirical juridical research method which was carried out to seek and obtain data directly in the field according to the problems studied. This research was carried out at the Papua Regional Police and the Papua Police Sub-Directorate of Corruption by conducting interviews with the Karo HR and the Head of the Papuan Police's Head of Corruption Crime Sub-Directorate. The results showed that the role of the National Police investigators, especially the Papuan Police in enforcing the law on corruption, was due to several causes, including: juridical, psychological, technical, skills, and facilities and infrastructure factors.

This study aims to determine the authority relationship between Finance and Development Supervisory Agency (BPKP) Auditor and the South Sulawesi Police Institution, the legal status of the BPKP auditor's inspection and evidence in criminal procedural law, and obstacles in the BPKP auditor's inspection. This study employed an empirical juridical approach to identify how a rule actually applies in society. The data were obtained through field observations, interviews with investigators from South Sulawesi Police Institution and BPKP Auditor, and the study of various related documents. The results showed that the authority between The Regional Police and the BPKP Auditor was only dependent on a request for assistance to carry out financial and state economic calculations based on a cooperation agreement or Memorandum of Understanding (MOU) between the National Police Institution and BPKP. Therefore, the BPKP indeed plays a role in revealing corruption indications despite its authority only for calculating state losses, where if the BPKP’s audit report states a loss, the Regional Police Investigator increases the stage of the Investigation, but if the results state no loss, the investigation will be stopped. Thus, there is no indication of corruption.

This study aims to identify and analyze the efforts of Jayapura’s Environmental Management Agency in tackling environmental crimes and to analyze the hindering factors of environmental crimes. The research method used in this study is the Juridical Empirical research method, approaching the problem by looking at the norms or legal provisions, then connecting it with the facts that exist from the problem. Jayapura’s Environmental Management Agency (BPLH) carries out several activities in an effort to tackle environmental crimes, including conducting socialization of Law Number 32 of 2009, Conducting an inventory and classification of reported environmental crimes, conducting guidance to business actors related to the business or activities, Supervising the business and or activities related to the results of parameter tests. The hindering factors of environmental crime prevention in Papua consist of unavailable funds, wide area, lack of support from decision makers, lack of human resources, lack of supporting facilities and infrastructure.

Indonesia is a country with a variety of cultures that stretch from Sabang to Merauke. Cultural diversity makes Indonesia establish more legal systems. Other than the Dutch’s positive legal system, Indonesia’s legal pluralism also applies to the Islamic legal and the traditional law systems which are so-called Indonesia’s original law according to which traditional law experts. Legal centralism (positive law) imposed by the state on the Indonesian people is a form of neglect of other legal systems, especially the traditional law system. Without realizing it, the majority of the Indonesian population are indigenous people from various ethnic groups, but are shackled by legalistic positivism based on written regulations. However, it is different from most Papuan indigenous peoples with a strong desire to make traditional law an independent legal system. The independent traditional law system must be a legitimate desire from the values that live and grow in society. Therefore, traditional law is an option for Papua indigenous peoples in resolving any disputes, because the ideal law is able to satisfy all parties without winning one party and defeating the other.
