Abstract

Syaz as the principle to detect the validitiy of the content of prophetic tradition (hadis) has two major elements: isolation and opposite meaning. The development of major principle of syaz can be formulated into four minor principles: the hadis does not contradict the Qur’an; does not contravene the more valid hadis; does not opposite to the ijma’ (agreement of the prophet’s companions); and does not contradict the highly accurate reason that manages to detect the authenticity of hadis associated with the prophet. The scholars of hadis seem to be very careful in implementing the principle of ghayru syudzudz. This attitude is evident in the strict category in classifying a hadis as syudzudz. Researches on the syaz of hadis have clear methods and procedures. When these methods and procedures are applied consistently, there will be no discrepancy between the validity of sanad (chain) and matn (content).

Abstract

Pada tradisi awal Islam Sanad  hadis sudah dipergunakan sejak  para dan merupakan tradisi ilmiah dan sistem periwayatan yang dapat dipertahankan dan dipertanggung jawabkan. Unsur-unsur sanad dalam periwayatan hadis adalah  bagian yang sangat penting baik dalam menentukan kualitas hadis maupun dari segi kuantitasnya. Metodode yang digunakan pada karya ilmiah ini adalah analisis teori. Pada tinjauan historis, sanad digunakan oleh agama Yahudi atau terdapat dalam kitab yahudi, Mishnah, termasuk  masyarakat Jahiliyah dalam menuturkan silsila dan syair-syair mereka juga menggunakan metode sanad meskipun  tidak jelas sejauh mana metode itu diperlukan. Para ulama hadis Sanad hadis merupakan bagian dari agama.

Abstract

Ishtisan is one source ijtihad, which means assuming something better to achieve a kemaslahatan. Ishtihsan be used as evidence because they are more able to realize the objectives of shari'ah. Scholars who use ishtihsan as a source of Islamic law of which the Imam Abu Hanifah, Imam Malik and some followers of Imam Ahmad bin Hanibal.Kaitan ishtihsan with legal reform lies in the maqasid Islamic Shari'a, which aims to realize and maintain the benefit of mankind.

Abstract

This article examines the equitableness of the Prophet’s companion (‘adalah al-sahabah) through historical and methodological perspective. The term of ‘adl means ‘straight’, ‘balance’,  ‘impartial’ or ‘put something on the right place’. In the Hadith perspective, ‘adl (equitably) is a man who constantly commands the right and forbids the wrong. Thus, its clear that ‘adl is a nature or a character of somebody which lead him to the right action. The term of ‘sahabah’ rooted from sa-hi-ba means ‘owner’ or ‘accompany’. In Hadith perspective, sahabah is a man who had been living along with The Prophet Muhammad for a or several years or involved once or several times in a war together with The Prophet Muhammad. Sahabah also means a man who met The Prophet Muhammad in the belief circumstances. Majority of ulamas (muslim scholar) said that the ‘adalah al-sahabah is guaranteed, so that they do not have to be criticized. However, the debate of ‘adalah al-sahabah among ulamas can be deal with redefinition of ‘adl as this article aims.

Abstract

In the modern era, human being frequently encounter a number of problems in terms of modernization. The welfare, which is fully of materialistic things, does not contribute to the happiness of the people apart  from people background or different level in the community. In this regards, this article mainly concern on Sufism in the Islam discipline. Sufism itself tries to emphazise the purification of spirituality based on universal values. This effort will then be implemented through different practices toward soul purification such as tarekat and suluk. These practices are alive in the community not only in the rural area but also in the urban context. However, these lead to bring the community in the traditional ascetism as well as in the religious understanding. The latest then will be named as neo-sufism.

Abstract

Imam Malik adalah tokoh hadis dan tokoh mażhab fikih, yang lahir dan dibesarkan, serta wafat di Madinah. Dalam sirah hidupnya, beliau menimba ilmu dari ulama di Madinah, dan meriwayatkan hadis-hadis dari kalangan sahabat, dan tabiin yang menetap di Madinah. Beliau menulis hadis 4.000 lebih dan menghapal 100.000 hadis, tiada ulama yang menandingi hapalan hadis imam Malik di zamannya, sehingga beliau disebut-sebut sebagai tokoh utama ekslusifisme sunnah ulama Madinah yang ditandai dengan karya monumentalnya, yakni kitab al-Muwaththa’. Kitab yang disusun langsung monumental dan memiliki pengaruh yang kuat terhadap ulama hadis dan ulama fikih di Madinah. Madinah dipinpin oleh Khalifah Ja’far al-Manshur menjadikan kitab al-Muwaththa’ sebagai acuan utama dalam menyusun undang-undang di Madinah. Sehingga, dapat dikatakan bahwa semua amalan-amalan masyarakat Madinah sepenuhnya merujuk pada hadis-hadis yang termaktub dalam kitab al-Muwaththa’ tersebut. Pengaruh yang demikian besar ini, pada gilirannya melahirkan ekslusifisme hadis-hadis ahl al-Madinah

Abstract

Konsep politik Islam yang ditunjukkan oleh al-Qur’an dan petunjuk Nabi saw. memunculkan beragam pandangan mulai dari yang radikal sampai yang moderat. Persoalan tentang negara, pelaksanaan syariat serta jihad merupakan isu yang sering diperbincangkan. Sebuah negara didirikan untuk menerapkan hukum Islam dan syariat secara utuh, sementara jihad dengan melakukan pemberontakan tidak disepakati oleh Ibnu Taimiyah. Baginya, prinsip-prinsip mereka yang mengikuti Nabi saw. dan jama’ah kaum muslimin adalah mengedepankan persatuan, meninggalkan perang terhadap penguasa dan meninggalkan pemberontakan bersenjata.
