Abstract

The effort to develop the creativity of classroom teachers in schools with special needs is an effort to develop children's potential, in order to have religious spiritual strength, to create interactive and educational classroom management that is comfortable and conducive. However, the creativity of classroom teachers has not been realized and the teacher's own lack of creativity in managing education classes for children with special needs in inclusive schools in Sabang City. Based on the results of research through observation, documentation and interviews with the head of SDN 1 and SDN 4 Sabang as the main subject and four teachers (each school two teachers), it is known that SDN 1 and SDN 4 strongly support every teacher who teaches in class who have children with special needs separately always develop their creativity in planning classes for special needs students. Class planning is very necessary in inclusive schools, because inclusive schools are not separated between normal children and children with special needs. In every planning involved an element of determination which means that in planning implied decision making. Teacher creativity in class planning for children with special needs in inclusive schools in Sabang is: First: Creativity in giving direction. Second: Creativity in helping students to motivate themselves. Third: Creativity in prioritizing the goals or objectives set. Fourth: Creativity in making guidelines for the preparation of strategic plans and operational plans and the selection of alternative decisions. Fifth: Creativity in evaluating progress to be achieved. The constraints of teachers in managing class children with special needs in inclusive schools in Sabang are: First: Lack of training, Second: lack of funds, Third: lack of human resources (HR), Fourth: lack of time.

Abstract

This article is aimed to describe the implementation of religious moderation-based learning model in an attempt to build and cultivate students character. In constructing the learning proses, teachers were lacking of softskill which implicated to students’ character that tend to be radical, extreme, and exclusive in facing the social reality. This study employed a library research method within a qualitative approach. Data were collected by reading numerous relevant literature associated with the implementation of religious moderation-based learning model. The result of study indicated that the implementation of religious moderation-based learning models can be performed in a number of ways, such as the following: 1) building and nurturing the universality of religious moderation, 2) building and internalizing the different values as sunnatullah (natural law), 3) constructing the spirituality and rationality in line with social reality, 4) building and empowering the attitudes of rahmatan lil ‘alamin in social reality, and 5) conducting preventive, corrective, and curative actions toward radicalism, extremism, and exclusivism. The result of this study can be recommended to the headmasters and teachers so that they can implement this learning model responsibly, fully discipline, and accountably. Also, they can cooperate with other stakeholders for the good implementation of this religious moderation-based learning model. Abstrak: Artikel ini bertujuan mendeskripsikan implementasi model pembelajaran berbasis moderasi beragama dalam upaya membangun dan membina kharakter siswa. Guru dalam mengkonstruksikan proses pembelajaran sangat lemah soft skill yang berimbas siswa cenderung radikal, ekstrem, dan eksklusif pada saat berhadapan dengan realitas sosial. Penelitian ini menggunakan metode library research dengan pendekatan kualitatif dan pengumpulan data dengan cara membaca berbagai literatur untuk mendeskripsikan model pembelajaran berbasis moderasi beragama. Hasil kajian model pembelajaran berbasis moderasi beragama dapat diimpletasiskan dengan cara-cara sebagai berikut: 1) membangun, dan mengembangkan ide universalisme moderasi beragama, 2) membangun, dan menginternalisasikan nilai perbedaan sebagai sunnatullah, 3) mengkonstruksikan spiritualitas, dan rasionalitas dengan realitas sosial, 4) membangun, dan membina sikap rahmatan lil ‘alamin dalam realitas sosial, dan 5) melakukan tindakan preventif, korektif, dan kuratif terhadap sikap radikal, ekstrim, dan eksklusif. Hasil kajian ini dapat direkomendasikan kepada kepala madrasah, dan guru supaya dapat mengimplementasikan model pembelajaran berbasis moderasi dengan penuh rasa tanggung jawab, disipin, dan amanah, serta dapat bekerja sama dengan stakeholder lain demi terlaksana model pembelajaran berbasis moderasi beragama.

Abstract

Corruption has made the life of the state have porous joints. Economy as the mainstay of the joint life experience fragility, currency values decline significantly. Social joints also suffer the same fate, now corruption has become commonplace in everyday life portrait began to level the structure of RT (Neighborhood) up to the level of institution of the President. In fact, even this body of organisms may have been "plagued" the virus of corruption that is far more devastating impact than physical disease viruses. Many people suspect that corruption in Indonesia is still running and even increased in almost every element of the institution due to the form of sanctions contained in the positive law. Where sanctions are used as a "cure" the disease is not effective or have no impact on the offender and not relevant to apply again. From the above problem, the author wishes to conduct research regarding the form of criminal sanctions for corruption in Indonesia using qualitative approaches that are library research (literature study), and data collection techniques using documentary study of the books, scientific works, newspapers, magazines, and scholarly journals. After doing research, followed by analyzing each of the data obtained, the researchers found a conclusion that could answer the focal issues under review, islamic law view that corruption is a criminal sanction ta'zir, where the imposition of sanctions tailored to the level of crimes committed, sikologis actors and their environment, with the shape and type of sanctions that may deter perpetrators and educate the offender and other people not to commit criminal them. And including sanctions model in Islamic law is a prison and a fine. The rules contained in Islam and the state (positive law) have the same goal, namely to create peace between humans. For this reason, positive criminal law must not conflict with Islamic law. Although the regulations stipulated in Indonesia are not taken from the texts of the al-Qur`an or al-Hadith. But still in line with the basic principles set out in Islamic law. Abstrak Korupsi telah membuat sendi kehidupan bernegara mengalami kekeroposan. Sendi perekonomian sebagai penopang utama kehidupan mengalami kerapuhan, nilai mata uang secara signifikan mengalami kemerosotan. Sendi sosial juga bernasib sama, saat ini korupsi telah menjadi hal lumrah dalam potret kehidupan keseharian mulai tingkat struktur RT (Rukun Tetangga) hingga ke tingkat Lembaga Kepresidenan. Bahkan organisme tubuh inipun mungkin telah “dijangkiti” virus korupsi yang jauh lebih dahsyat dampaknya dari virus-virus penyakit jasmani. Banyak kalangan menduga, korupsi di Indonesia tetap berjalan dan bahkan meningkat hampir di setiap elemen lembaga dikarenakan bentuk sanksi yang terdapat dalam hukum positif. Dimana sanksi yang dijadikan "obat" terhadap penyakit tersebut tidak efektif atau tidak berdampak apapun terhadap pelaku dan tidak relevan untuk diterapkan lagi. Dari masalah diatas, penulis berkeinginan untuk melakukan penelitian tentang bentuk sanksi pidana korupsi di Indonesia dengan menggunakan pendekatan kualitatif yang bersifat library research (penelitian kepustakaan), dan tehnik pengumpulan datanya menggunakan telaah dokumenter terhadap kitab-kitab, karya ilmiah, surat kabar, majalah, dan jurnal keilmuan. Setelah melakukan penelitian yang dilanjutkan dengan menganalisa setiap data yang diperoleh, peneliti menemukan kesimpulan, Hukum islam memandang bahwa Sanksi tindak kriminal korupsi adalah ta'zir, dimana pemberian sanksi disesuaikan terhadap tingkat kriminal yang dilakukan, sikologis pelaku dan lingkungannya, dengan bentuk dan jenis sanksi yang dapat menjerakan pelaku dan mendidik pelaku serta masyarakat lain untuk tidak melakukan kriminal tersebut. Dan termasuk model sanksi dalam hukum islam adalah penjara dan denda. Aturan-aturan yang terdapat dalam islam dan negara (hukum positif) adalah memiliki tujuan yang sama, yaitu untuk menciptakan kedamaian antar umat manusia. Untuk itulah hukum pidana positif harus tidak bertentangan dengan hukum islam. Walau peraturan-peraturan yang ditetapkan di indonesia tidak diambil dari nash-nash al-Qur`an maupun al-Hadits. Tetapi tetap selaras dengan prinsip dasar yang ditetapkan dalam hukum islam.

Abstract

This paper studied the establishment and administration of Maẓālim Court system in Sokoto Caliphate in the 19th century. This was with a view to investigating the efforts and commitment of the founders of the Sokoto Caliphate to the administration of justice which was one of the central arguments of the leaders of the 1804 Sokoto Jihad against the Hausa aristocrats before the 19th century. The case in point – Maẓālim Court was the apex court in the Islamic judicial system, and open establishment of the Caliphate the leadership in justification of their commitment to justice established this court in Sokoto which was the seat of power of the Caliph. Using a qualitative methodology, the paper found that Maẓālim court was established and was operated by the Caliph in Sokoto during the 19th century. In addition, it was however discovered that the court was operated in Sokoto with three mandates: accepting and administering fresh judicial complaints; administering appeals from the lower courts, and operating an Ombudsman mandate. But its operation was not exclusively by the Caliph alone; rather it was operated in some instances by the Wullāt (representatives) of the Caliph as indicated in the text. Thus, this paper concluded that the establishment and administration of the Maẓālim court in Sokoto was a clear indication of the commitment of the founders of the 19th century Sokoto Caliphate to the administration of justice as a justification to their course of rising against the injustices of the former Hausa aristocrats.

Abstract

The purpose of this study is to discuss about the function of legislation in Fiqh Siyasah point of view. According to Fiqh Siyasah,the legislative power is called al-sulthah al-tasyri’iyyah, which is tasked with forming a law that will be enforced in society for the benefit. The people who sit in the legislative institution should be selected people such as Mujtahid, Mufti,and the professional people in various fields. Further, there are some functions of legislative institution. Firstly, the provisions that are already contained in Al-quran and As-sunnah,the law issued by al-sulthah al-tasyri’iyyah is a ilahi law which is shariaed in Al-quran and As-sunnah. Secondly, making some creative reasonings or Ijtihad on the problems explicitly that are not elaborated in Al-quran and As-sunnah. Therefore, the sulthah al-tasyri’iyyah role is to carry out ijtihad to assign the law based on the knowledge of Mujtahid and Mufti. Abstrak Penelitian ini membahas tentang fungsi legislasi dalam pandangan fiqih siyasah. Adapun dalam Fikih Siyasah, kekuasaan legislatif disebut dengan al-sulthah al-tasyri’iyyah, yang bertugas untuk membentuk suatu hukum yang akan diberlakukan didalam masyarakat demi kemaslahatan. Orang-orang yang duduk dilembaga legislatif harus dari orang-orang pilihan seperti para mujtahid dan ahli fatwa (mufti) serta para pakar-pakar dalam berbagai bidang. Sedangkan fungsi dari lembaga legislatif adalah Pertama, ketentuan yang sudah terdapat dalam Al-Quran dan Sunnah, undang-undang yang dikeluarkan al-sulthah al-tasyri’iyyah adalah undang-undang yang bersifat ilahiah yang di syariatkan dalam Al-Quran dan Sunnah. Kedua, melakukan penalaran kreatif atau ijtihad terhadap permasalahan secara tegas yang tidak dijelaskan oleh Al-Quran dan Sunnah. Maka disinilah peran al-sulthah al-tasyri’iyyah yang di isi oleh para mujtahid atau ahli fatwa untuk melakukan ijtihad menetapkan hukumnya dengan ilmu yang mereka miliki.

Abstract

The propagation of Islam and community development is inseparable in the message of Islam. Da’wah as the first method used by all the Prophets/Messengers of Allah (SWT) to deliver the task of salvaging the Ummah from wrong direction to the path of peace and success. With da’wah a lot have been achieved in the history of Islam which continued to exist up to the present time. These giant efforts have continued to yield tremendous transformation in the number of Muslims and welfare services which Muslim organizations established. Kano State is one of the areas that attracted many migrant Scholars (Ulama’) to propagate Islam which led to the emergence of many Islamic non-governmental organizations (INGOs). Before Islam and the activities of these Organizations people in some parts of Kano worshiped at Tsumburbura and other pagan shrines and a lot of offerings took place; to the extent that the welfare and development of the Ummah was neglected. This paper adopts qualitative method and discovered that, these organizations have been transforming the lives of people in the state not only in da’wah but also through many community services such as Mosques, Islamic schools, Mobile healthcare, accommodations for revertees, Ramadan welfare among others. However, some of these programmes are not properly documented and presented due to administrative lapses and lack of good accountability that will attract more supports/funds everywhere that would enhance their activities. It recommends massive awareness for more community services from these organizations, training and re-training for all the executives and patrons of these groups and good record keeping..

Abstract

This research aims to see whether the influence of technology on financial transparency is an effort to be able to build public trust in financial management in accordance with Sharia organizations or not. To give confidence to the public in financial management, it requires disclosure of information to the public as a disclosure of the performance report of an institution or organization. Transparency is a disclosure in the form of financial performance reports that are presented in an open, detailed, clear, easily accessible manner and can be conveyed periodically. This research was conducted based on literature studies from various sources from previous studies. This research method uses a qualitative descriptive research method that will describe the subject under study. The results of this study can be concluded that information technology on financial transparency is in accordance with Islamic maqasit. Abstrak: Penelitian ini mempunyai tujuan untuk mengetahui apakah pengaruh teknologi informasi terhadap transparansi keuangan sebagai salah satu upaya untuk dapat membangun kepercayaan masyarakat dalam pengelolaan keuangan telah sesuai dengan maqasit Syariah atau tidak. Untuk memberikan kepercayaan terhadap public atas pengelolaan keuangan maka diperlukan keterbukaan informasi kepada public sebagai pengungkapan laporan kinerja suatu Lembaga atau organisasi. Tranparansi merupakan pengungkapan dalam bentuk laporan kinerja keuangan yang disampaikan secara terbuka secara rinci, jelas, dapat mudah untuk di akses dan dapat di sampaikan secara periodic. Penelitian ini di lakukan berdasarkan studi literatur dari berbagai sumber dari penelitian-penelitian sebelumnya. Metode penelitian ini menggunakan metode penelitian deskriptif kualitatif yang akan mendeskripsikan dari subjek yang diteliti. Hasil dalam penelitian ini dapat disimpulkan bahwa teknologi informasi terhadap transparansi keuangan telah sesuai dengan maqasit Syariah.

Abstract

'Abd al-Qadir Wangah is a preacher and scholar who is well known in the Malay Archipelago. His field expertise is more to Usuluddin who is the core of one's Islam. The proof, he authored several books that talk about the science of Tawhid such as Taqrīb al-Ikhwān fī Taʿallum ʿAqā’id al-Īmān, Asās al-ʿItiqād and so on. Therefore, this paper focuses on the debate on monotheism through the nature of qidam Allah SWT in addition to presenting the methodology of al-qiyās al-iqtirānī in describing the tafṣīlī evidence of the debate on that nature. This qualitative study uses the method of documentation and content analysis through the text of Taqrīb al-Ikhwān by ‘Abd al-Qādir Wangah as well as logic references such as Īḍāḥ al-Mubham, Mughni al-Ṭullāb and so on. Aspects of the debate will focus on the biography of ʿAbd al-Qādir Wangah briefly. Later, this study will include a debate on the nature of salbiyyah, especially on the nature of qidam. Next, this paper will discuss the methodology of al-qiyās al-iqtirānī specifically according to the logical scholars and its application in describing the evidence of qidam and in Taqrīb al-Ikhwān. As a result, the use of al-qiyas al-iqtirānī is applied by ʿAbd al-Qādir Wangah indirectly through two contexts of muttaṣilah verses instead of ḥamliyyah both or munfaṣilah both or one ḥamliyyah and another muttaṣilah or ḥamliyyah munfaṣilah or mutta in describing burhān the nature of qidam of Allah SWT. Abstract: ʿAbd al-Qādir Wangah seorang pendakwah dan ulama Melayu yang sangat terkenal di Nusantara. Kepakaran bidangnya lebih kepada Usuluddin yang menjadi teras agama Islam seseorang. Buktinya, beliau mengarang beberapa kitab yang membicarakan berkenaan dengan ilmu Tauhid seperti Taqrīb al-Ikhwān fī Taʿallum ʿAqā’id al-Īmān, Asās al-ʿItiqād dan sebagainya. Oleh yang demikian, makalah ini memfokuskan perbahasan tauhid menerusi sifat qidam Allah SWT di samping mengemukakan metodologi al-qiyās al-iqtirānī dalam menghuraikan dalil tafṣīlī terhadap perbahasan sifat tersebut. Kajian berbentuk kualitatif ini menggunakan kaedah dokumentasi dan analisis kandungan menerusi teks Taqrīb al-Ikhwān karya ‘Abd al-Qādir Wangah serta rujukan ilmu mantik seperti Īḍāḥ al-Mubham, Mughni al-Ṭullāb dan sebagainya. Aspek perbahasan akan tertumpu kepada biografi ʿAbd al-Qādir Wangah secara ringkas. Kemudian, kajian ini akan memuatkan perbahasan sifat salbiyyah khususnya pada sifat qidam. Seterusnya, makalah ini akan membincangkan berkenaan metodologi al-qiyās al-iqtirānī secara khusus menurut para ulama mantik dan aplikasinya pada menghuraikan dalil qidam dan baqā’ dalam Taqrīb al-Ikhwān. Hasilnya, penggunaan al-qiyas al-iqtirānī ini diaplikasikan oleh ʿAbd al-Qādir Wangah secara tidak langsung menerusi dua konteks ayat yang muttaṣilah bukannya secara ḥamliyyah kedua-duanya atau munfaṣilah kedua-duanya atau satu ḥamliyyah dan satu lagi muttaṣilah atau ḥamliyyah munfaṣilah atau muttaṣilah munfaṣilah dalam menghuraikan burhān sifat qidam Allah SWT.

Abstract

This article discusses about the dynamics of persecution in Langsa which carried out by the government against the Naqsabandiyah tarekat, the foundation of Prof. Dr. Kadirun Yahya. The purpose of this study is to observe the dynamics of persecution toward the Thariqat Naqsabandiyah Khalidiyah, the foundation of Prof. Dr. Kadirun Yahya in Seulalah Baru of Langsa City in the province of Aceh since the thariqat is considered to deviate by some citizens. The type of this research is qualitative with socio-anthropological and ethnographic approaches. The writer collected the data through literature and field studies. This study found that there was an effort of the persecution to close the Naqsabandiyah Thariqat temporaryly by the government of Langsa because the tarekat was considered as heretic in society. In that case, the one who acted was the Islamic Sharia Department of Langsa. Actually, the tarekat is such a good thing, and it is also a platform and wasilah in getting closer to the creator. Moreover, there are problems in society and the local government such one of them is the dynamics of the persecution against the tarekat Naqsabandiyah, Foundation of Prof. Dr. H. Kadirun Yahya in Langsa. Abstract: Artikel ini membahas dinamika persekusi yang dilakukan pemerintah terhadap kelompok tarekat naqsabandiyyah yayasan Prof.Dr.Kadirun Yahya yang terjadi di kota langsa. Tujuan dari penelitian ini adalah ingin mengetahui dinamika persekusi Thariqat Naqsabandiyah Khalidiyah Yayasan Prof. Dr. H. Kadirun Yahya di Seulalah Baru Langsa, Aceh yang dianggap sesat oleh sebagian masyarakat. Jenis penelitian ini adalah kualitatif dengan pendekatan sosio-antropologi dan etnografi. Penulis mengumpulkan data melalui studi pustaka dan lapangan. Adapun temuan dari penelitian ini adalah persekusi yang dilakukan terhadap tarekat naqsabandiyyah berupa adanya usaha penutupan sementara dari pihak pemerintah kota langsa, dalam hal ini yang bertindak adalah dinas syariat Islam kota Langsa, dikarenakan di anggap sesat tarekat tersebut di masyarakat. Ternyata tarekat yang selama ini dianggap di masyarakat sesuatu hal yang baik, dan merupakan wadah serta wasilah dalam mendekatkan diri pada sang pencipta, terdapat problematika di masyarakat dan pada pemerintah setempat, salah satu dinamika yang terjadi yaitu persekusi yang dilakukan terhadap tarekat Naqsabandiyyah yayasan Prof.Dr.H.Kadirun Yahya di Langsa

Abstract

Mastery of foreign languages ​​in this global era is very necessary to expand the network, namely education and business networks and even politics. For this reason, at the secondary school level, foreign languages ​​must be equipped, namely English and Arabic. This study aims to determine the extent of the mastery of English and Arabic students in MAN 1 Aceh Barat and how the supporting factors in learning two languages ​​at the same time. The author conducted this research using a qualitative method which will describe the ability to master the language through interviews using two English and Arabic then the interview will be assessed as a result of the test proficiency. The results showed that out of 9 students there was 1 student who could not master two languages ​​but 8 of them had the ability to speak Arabic and English. However, most of them have more difficulty mastering Arabic than English. Then, how can they learn the language well because the parents are very supportive of providing facilities in the form of language lessons or other support, besides that the environment also greatly influences language learning.
