Abstract

The Board of Directors is one of the most important organs in a Limited Liability Company. Management of the Company that carried out by the board of directors includes running business activities, controlling, and making business decisions that have an impact on a Limited Liability Company whether the decision will cause loss or profit. In making business decisions, the Board of Directors must do so in the manner of good faith, carefully, and in accordance with the aims and objectives of the Company's establishment. If the directors already made the decision the correct manner, they cannot be held personally accountable for the decisions they make. That is what a Business judgment rules is, a doctrine that provides protection to directors to not be personally responsible if the business decisions taken cause losses to the company. Relying on a literature study, the business judgment rule is implicitly regulated in article 92 paragraph 1 and 97 paragraph 5 of Law no. 40 of 2007 regarding the Limited Liability Companies, several cases related to the business judgment rule, this article intends to analyze the implementation of the doctrine of the business judgment rule in Indonesia

Abstract

Establishment of the National Agency for the Placement and Protection of Indonesian Workers (BNP2TKI) To optimize the protection of migrant workers abroad which is more integrated, the government forms a national body whose duty is to protect Indonesian migrant workers abroad. A Non- Departmental government agency that is responsible to the President who is domiciled in the national capital, namely the National Agency for Placement and Protection of Indonesian Workers (BNP2TKI), whose functions are coordinating and integrated placement and protection of migrant workers abroad, with several tasks as follows: 1. Placing on the basis of a written agreement between the government and the government of the country that uses TKI or legal entity users in the destination country; 2. Providing services, coordinating, and supervising: documents, final departure briefing (PAP), problem solving, sources of funding, departure until repatriation, improvement of the quality of prospective migrant workers, information, quality of implementing TKI placement, and improving TKI welfare and his family. In accordance with the principle of international law, legal protection for citizens ceases when the citizens of that country cross the borders of the state jurisdiction. Protection of Indonesian workers abroad or in recipient countries is carried out in accordance with international law and applicable laws in the country.

Abstract

Countries are burdened with the obligation to prevent, reduce and control pollution of the marine environment caused by various sources. Countries can be held responsible for actions that cause pollution of the marine environment either intentionally or unintentionally because the State has an obligation to prevent activities that can cause pollution or damage to the environment in its territory and outside its jurisdiction. Based on existing data, plastic waste that can be produced in Indonesian waters reaches 1.65 million tons / year. Research data has outlined the distribution of plastic waste in several countries, one of which is Indonesia. In the survey conducted, Indonesia was the second country after China with a high amount of plastic waste not managed well. The Government of Indonesia has issued Presidential Regulation No. 83 of 2018, on handling marine waste, and contains the National Action Plan 2018-2025 involving various Ministries / Institutions and Local Governments. As the host of the Our Ocean Conference 2018 meeting, out of 22 Commitments delivered by Indonesia, 5 of them were commitments related to efforts to tackle plastic waste at sea. Implementation of Presidential Regulation Number 8 of 2018 is important to be carried out to overcome marine waste in Indonesia, besides that the application of this Presidential Regulation will prove Indonesia's commitment in the eyes of the international world in keeping the sea healthy. Not only in making rules, but also in the concrete steps of the rules.

Abstract

Death penalty is essentially a country that takes the life rights of its citizens so that it is contrary to human rights. But it can be justified throughout its application on the grounds of defending other citizens' human rights and positively legally regulating the state towards a tendency of abatement and ultimately elimination altogether. The application of the death penalty can only be carried out against crimes that transcend humanitarian boundaries, threaten the lives of many people, damage the order of life and human civilization, and damage the country's economy. Crimes that can be sentenced to death include: premeditated murder, terrorism, drug trafficking and dealers, and corruption.

Abstract

The Formulation of Criminal Sanctions holds a strategic position in an effort to decrease corruption crime. Until now, the application of criminal sanctions in Indonesia has not provided a direction for the occurrence of a significant decrease in corruption. This can be seen from the issued by Transparency International 2017 about the ranking of the most corrupt countries in the world, where Indonesia still in the 5thranks in ASEAN. This research purposes to analyze and to formulate the harmony in the formulation of criminal sanctions for corruption, with the goal of Indonesian criminalizing law system so that the ultimate goal is suppressing the level of corruption in Indonesia can be achieved. This study is used the statute, conceptual and case approach as a method to analyze the legal substances and the results of this research had been shown, there are several weaknesses in the criminal punishment system according to The Act Number 31 on 1999 andThe Act Number 20 on 2001; where, the system of corruption criminalizing is complicated that make the punishment for corruption cannot reach the goal of punishment. For the better law system in the future, it is more appropriate criminal sanctions needed to be formulated, so that the purpose of criminal penalties for corruption can be achieved, used by conducting a plea bargaining in the beginning, that the perpetrator must return state losses and pay fines but still be found guilty through the determination of the judge.

Abstract

This research entitled “The Role of Local Government in The Provision of Budget Associated with The Development of Integrated Waste Treatment Facility”. This study used empirical research. Data of this study was collected through various techniques including interviews and requested data from the area under investigation. One of the permit requirements in the field of environmental law was that the activities of the business should have AMDAL ensures that the business activity would not cause major and significant impact on the environment. Environmental management and environmental law enforcement, should be implemented firmly and wisely. One of the policies implemented was to enter one of the documents in the environmental feasibility of the licensing of development are estimated to have an impact. Local government was not given to the indigenous village Ships fully, delays in awarding these funds, making the development of the Integrated Waste Management was still unrealized. Abstract

Tujuan penelitian ini untuk mengkaji perlindungan hukum terhadap perempuan apabila terjadi perceraian dari perkawinan campuran; Tingkat keberterimaan desa adat terhadap perempuan yang mengalami perceraian dari perkawinan campuran. Pengaruhnya terhadap keberadaan kaum perempuan Bali setelah bercerai dari perkawinan campuran. Metode hukum normatif menggunakan pendekatan peraturan perundang- undangan, pendekatan konsep, pendekatan sejarah dan analisis hukum dengan menggunakan interpretasi hukum. Teori yang digunakan sebagai pisau analisis adalah teori hukum, serta teori pluralisme hukum. Hasil penelitian: Secara filosofis, perlindungan hukum untuk perempuan Bali yang mengalami perceraian akibat perkawinan campuran mulai memperoleh perhatian karena bersinggungan dengan keberadaannya sebagai bagian dari warga desa adat apalagi perempuan yang semula berkasta brahmana tidak bisa kembali ke rumah deha. Merespon keberadaan perempuan yang sudah nyerod (turun kasta) akibat perkawinan campuran, desa adat umumnya mau menerima perempuan yang bersangkutan dengan membayar uang penanjung batu sebagai prasyarat untuk bisa kembali diterima di desa adat sebagaimana layaknya krama istri (warga desa adat yang perempuan) lainnya. Secara Hukum, pengaruhnya bagi perempuan Bali perempuan Bali terhadap keberadaannya dalam lingkungan sosial di desa adat. Secara sosiologis. sejumlah desa adat menerima kembali dengan tangan terbuka perempuan dengan status bercerai dari perkawinan campuran, terkait kewajibannya ngayah dan haknya mendapatkan pengayoman dari desa adat juga diprioritaskan.

Abstract

Penelitian ini difokuskan pada product liability dan relevansi pencantuman klausula baku pada transaksi jual-beli gitar elektrik. Dalam prakteknya pelaku usaha menolak tuntutan konsumen yang mengalami kerugian akibat menggunakan produknya. Penolakan pelaku usaha dituangkan secara tertulis dalam bentuk klausula eksonerasi pada setiap perjanjian baku yang telah dipersiapkannya. Jenis penelitian yang digunakan adalah penelitian hukum empiris yang bersifat deskriptif. Penentuan sampel yang digunakan adalah non probability sampling dengan bentuk snowball sampling yakni penarikan sampel didasarkan pada penunjukan atau rekomendasi dari sampel sebelumnya, tidak ada ketentuan pasti dalam bentuk angka atau prosentase mengenai jumlah sampel yang akan diteliti, besarnya jumlah sampel didasarkan atas titik jenuh. Pengolahan dan analisa data dilakukan secara deskriptif kualitatif. Berdasarkan penelitian yang dilakukan dapat diketahui bahwa implementasi ketentuan product liability belum efektif diterapkan oleh pelaku usaha di Denpasar akibat lemahnya pengawasan yang dilakukan oleh struktur hukum serta lemahnya budaya hukum masyarakat khususnya pelaku usaha terkait pemahaman mengenai kewajiban dan tanggung jawab dalam menjalankan usaha. Klausula baku yang dicantumkan pelaku usaha tidak relevan karena memenuhi unsur terlarang dari ketentuan Pasal 18 ayat (1) huruf b Undang-Undang Perlindungan Konsumen.

Abstract

Indonesia sebagai negara kesatuan, merupakan negara kepulauan, yang mempunyai kekayaan sumberdaya alam dan jasa lingkungan yang terkandung di dalamnya, dapat dipahami sebagai potensi nasional yang harus ditata dan dikelola secara baik. Selain itu Indonesia juga memiliki pulau-pulau terluar yang sekaligus merupakan garda terdepan dalam keamanan dan ketahanan negara. Meskipun demikian harus disadari bahwa penataan dan pengelolaan pulau-pulau terluar di Indonesia belum dilakukan secara optimal, tak terkecuali di Provinsi Maluku Utara. Hal ini terkonfirmmasi melalui pulau sipadan dan ligitan harus lepas dari yurisdiksi Indonesia, di Maluku Utara, maraknya pencurian ikan di perairan Maluku Utara setidaknya menjelaskan bahwa pengamanan pada pulau-pulau terluar melalui kebijakan ditingkat daerah belum optimal dilakukan oleh pemeritah Provinsi Maluku Utara. Oleh karena itu pulau-pulau terluar sebagai fungsi pertahanan berperan sebagai pintu gerbang dalam menjaga keutuhan Negara Kesatuan Republik Indonesia, melalui pengawasan sehingga pulau-pulau terluar terjaga dan terawasi, sehingga ketahanan nasional terlindungi dari berbagai ancaman.. Selain itu fungsi ekonomi, yang berbasis pada sumber daya yang merupakan ekosistem penting bagi penyediaan pariwisata maupun sumber daya poerikanan dapat ditata dan dikelola dengan agar meningkatkan kesejahteraan masyarakat di pulau-pulau terluar, ini semua dapat terwujud jika ada kebijakan nasional maupun lokal di tingkat Provinsi. Metode pendekatan yang digunakan dalam penelitian dengan melakukan kajian pada prinsip hukumm peraturan perundangan perlindungan pulau-pulau terluar undang-undang terkait lainnya sehingga dapat dijadikan dasar dalam merumuskan kebijakan di tingkat daerah dalam rangkat memberikan perlindungan yang lebih optimal dalam penataan dan pengelolaan pulau-pulau terluar.

Abstract

This study aims to find out about the protection and empowerment of people with disabilities in Buleleng Regency. In Buleleng regency, either government or private buldings including their public places are not built with fully provided accessibility for persons with disabilities. Furthermore, the persons with disabilities still having trouble to obtain their rights due to social and cultural factors, economic factors, weak policies and law enforcement in favor of disabled and also there is no legal umbrella that clearly regulates the protection and empowerment of persons with disabilities. As for this research is the normative legal study with using qualitatively analysis techniques. The fulfillment of social and economic rights is realized by the government of Buleleng Regency in the form of Social Assistance for Persons with Disabilities with giving an amount of money each month. The persons with disabilities are also trained to be given jobs according to their abilities. There are also Regional Regulations on the protection and fulfillment of the Rights of Persons with Disabilities which is soon be enacted that is include rights and legal protections for persons with disabilities, such as : the right to fullfill equality before the law until intellectual rights are protected.
