Abstract

Perlunya diberikan perlindungan hukum pada korban kejahatan secara memadai tidak saja merupakan isu nasional, tetapi juga internasional. Masa depan korban kejahatan seksual harus lebih diperhatikan dibandingkan hanya memberikan sanksi pidana terhadap pelaku. Pemberian sanksi pidana yang berat termasuk pemberian hukuman mati masih belum menyelesaikan permasalahan yang dihadapi oleh korban. Oleh karena itu, mediasi penal harus lebih dikembangkan dengan memberikan lebih banyak perhatian terhadap korban. Mediasi penal dalam kejahatan seksual lebih menitik beratkan pada perlindungan terhadap korban yang dalam hukum positif di Indonesia belum sepenuhnya terakomodir. Tujuan yang ingin dicapai adalah peningkatan tanggung jawab pelaku terhadap tindak pidana yang telah dilakukan terhadap korban. Sistem peradilan pidana kedepan harus lebih banyak mengakomodir kepentingan korban. Kata kunci; Mediasi penal, Kejahatan seksual,

Abstract

Human rights are basic rights that humans have from the time they were born or when they began to interact with society. This right cannot be taken by anyone, even the state has the responsibility to protect the rights possessed by each individual, regardless of whether he is an individual belonging to the ethnic majority or ethnic minority. Regarding ethnic minorities, there is already protection for ethnic minorities regarding their rights which under international law are generally regulated in international instruments, Rohingyas in Myanmar are ethnic minorities who experience many violations such as the termination of citizenship, restriction of freedom of confession religion, oppression of children and women. Some instruments that regulate violations experienced by the Rohingya ethnic group are the Universal Declaration of Human Rights, the Declaration on the Rights of Population which includes Minority Groups Based on Citizenship.

Abstract

Claims for compensation based on the interests of the marine environment as well as the blue economy concept launched by the government must of course be the basis for the claims of losses given by polluters to restore victims, both human victims (fishermen) and victims of the marine ecosystem, considering that several international instruments have been ratified by the system. national law regarding provisions regulating compensation for oil pollution by tankers. The fair value of compensation for oil pollution due to tanker accidents can be realized by using an economic approach. Analysis of economic theory on law needs to be used, so that the value of justice can be measured properly. Economic concepts, such as the concept of maximization (maximization theory), the concept of equilibrium (equalibirium theory) and the concept of efficiency (efficiency theory) are needed to become a benchmark for the value of justice. The calculation method required for the calculation of claimable compensation is the contingent analysis method, which is a method of calculation based on the assignment of monetary values to environmental goods or commodities, the desire to pay polluters for goods and services produced by natural resources and the environment (willingness to pay). , as well as acceptance to accept something decreasing (willingness to accept).

Abstract

Environmental control in this case is intended to include prevention, mitigation and recovery carried out by the government, regional government and those in charge of businesses and/or activities in accordance with their respective authorities, roles and responsibilities. One of the instruments for preventing pollution and/or environmental damage consists of; environmental economic instruments, environmental-based laws and regulations, environmental-based budgets and other instruments according to the needs and/or developments of science.

Abstract

Countries are burdened with the obligation to prevent, reduce and control pollution of the marine environment caused by various sources. Countries can be held responsible for actions that cause pollution of the marine environment either intentionally or unintentionally because the State has an obligation to prevent activities that can cause pollution or damage to the environment in its territory and outside its jurisdiction. Based on existing data, plastic waste that can be produced in Indonesian waters reaches 1.65 million tons / year. Research data has outlined the distribution of plastic waste in several countries, one of which is Indonesia. In the survey conducted, Indonesia was the second country after China with a high amount of plastic waste not managed well. The Government of Indonesia has issued Presidential Regulation No. 83 of 2018, on handling marine waste, and contains the National Action Plan 2018-2025 involving various Ministries / Institutions and Local Governments. As the host of the Our Ocean Conference 2018 meeting, out of 22 Commitments delivered by Indonesia, 5 of them were commitments related to efforts to tackle plastic waste at sea. Implementation of Presidential Regulation Number 8 of 2018 is important to be carried out to overcome marine waste in Indonesia, besides that the application of this Presidential Regulation will prove Indonesia's commitment in the eyes of the international world in keeping the sea healthy. Not only in making rules, but also in the concrete steps of the rules.

Abstract

Law No. 35/2014 on Child Protection articles 16 to 18 states that a child whose freedom is deprived according to the applicable law, has the right to receive appropriate legal remedies in accordance with the applicable law. Therefore, the punishment of children at present is directed at realizing children's welfare and prioritizing the best interests of the child as an integral and social welfare which is then regulated in a special justice system called the Juvenile Criminal Justice System (SPPA). The birth of the SPPA Law provides legal protection for children by presenting the concept of diversion and restorative justice. However, there are still many cases resolving without diversion, so it is necessary to study law enforcement against children who abuse narcotics. The method I use is empirical legal research methods using qualitative data analysis techniques. The data collection technique is done through document study. Based on the results of the research, it can be seen that the law enforcement process for children who commit crimes of narcotics abuse cannot be said to be effective with the objectives of the SPPA Law due to several factors such as differences in the perspective of legal officers, lack of facilitators, and limited infrastructure.Keywords: Diversion Concept, Narcotics, Minors.Undang-Undang No 35 Tahun 2014 tentang Perlindungan Anak pasal 16 sampai 18 menyatakan bahwa seorang anak yang kebebasannya dirampas sesuai dengan hukum yang berlaku, berhak mendapat upaya hukum yang layak sesuai dengan hukum yang berlaku. Oleh karena itu pemidanaan terhadap anak pada masa kini diarahkan untuk mewujudkan kesejahteraan anak dan mengutamakan kepentingan terbaik bagi anak sebagai integral dan kesejahteraan sosial yang kemudian diatur dalam sistem peradilan khusus yang disebut Sistem Peradilan Pidana Anak (SPPA). Lahirnya UU SPPA memberikan perlindungan hukum terhadap anak dengan menghadirkan konsep diversi dan keadilan restorative. Tetapi masih banyak penyelesaian kasus tanpa ada yang melalui upaya diversi, sehingga diperlukan adanya kajian penegakan hukum terhadap anak yang menyalahgunakan narkotika. Adapun metode yang penulis gunakan adalah metode penelitian hukum empiris dengan menggunakan teknik analisis data kualitatif. Teknik pengumpulan data dilakukan melalui studi dokumen. Berdasarkan hasil penelitian dapat dilihat bahwa proses penegakan hukum bagi anak yang melakukan tindak pidana penyalahgunaan narkotika belum dapat dikatakan berjalan efektif dengan tujuan UU SPPA karena beberapa faktor seperti adanya perbedaan perspektif aparat hukum, kurangnya tenaga fasilitator, dan keterbatasan sarana prasarana.Kata kunci : Konsep Diversi, Narkotika, Anak dibawah umur.
