Abstract

In the era of reforms characterized by freedom of thought and opinion, the position of makar crime formulation in the criminal law book (KUHP) is very dilemmatic. Its  Formulation is needed to maintain state sovereignty. However,  its presence has not well defined yet. So,  it threatens the independence of Makar crime and its elements. This research will analyze the formulation of Makar crime in the Criminal law book (KUHP), its enforcement in Indonesia post-reforms, and its draft formulation in the Criminal law book (KUHP). Library research method through juridical-normative was used in this research. The result shows that the formulation of Makar crime which was set forth in Article 104, 106, 107, and 108 of the Criminal law book (KUHP) still has not define Makar and its parameters to the elements. Therefore, it is necessary to reform the criminal law effectively in accordance with the principles of law and democratic state in the Draft Law (RUU) of the Criminal law book (KUHP) in order to overcome makar crime.

Abstract

Children are vulnerable groups when dealing with the criminal justice system based on various analyzes. Therefore a special mechanism is needed to protect the interests of children facing the law. It is affirmed in the UN Regulations for the Protection of Children Who Lost their Freedom that the child court system must uphold rights and safety and promote the physical and mental well-being of children. Prison sentences must be used as a last resort. Children who are in conflict with the law, will get a label or stigmatization from the community from the moment the case processes at the police level until the court ruling is even possible forever. This article will discuss the implications of inconsistencies in prison sanctions for children and the purpose of criminal prosecution in RKHUP, that children who proceed in criminal justice, the label will be inherent indefinitely, so it is likely that children tend to commit criminal acts again. Prison sentences will bring children to learn more about their environment.

Abstract

Criminal law, as an instrument of guarding public order, has two functions. The first one is as general function to regulate life and to organize procedures in society. The second one is as particular function to protect legal interests from crime by giving criminal punishment as sanctions for the perpetrators. Conceptually, forgiveness of the judge emerges to modify rigid legal certainty towards flexible legal certainty. This departs from several cases that have actually fulfilled the formulation of criminal offenses, but their actions are not feasible to be sentenced. Therefore, in the concept of the National criminal law, the Draft of Criminal Code (RKUHP) makes a new formula containing local wisdoms that regulate the possibility of forgiveness of the judge to several cases that are improperly being convicted. This paper focuses on the concept of forgiveness of the judge that cannot be separated from the local wisdom values, including religious values and legal wisdoms living in society.

Abstract

Copyright is a high reality of various values, including economic value, this is because copyright that is born of copyright, taste, and intention is able to color the development of human life through objects born from the copyright process. However, in its development various copyrights were not considered in this country. The rise of piracy on song copyrights for example, is only able to benefit the perpetrators of piracy of song copyright economically. The research method used is a juridical legal research method of analysis with the object of research studies aimed at the laws and regulations relating to copyright and principles - applicable legal principles. Substantially, the material changes in Law No. 28 of 2014 is related to the change of type of criminal offense from ordinary offense to complaint offense and in the meantime there are not many creators who can seek justice about it. The results of the research are increasingly unfair with the existence of Clause 112 to Clause 119 of Law Number 28 of 2014 changing copyright offenses to complaint offenses that increasingly marginalize the rights of the creators of copyrighted works in this country. Therefore it is necessary to have a joint discussion related to the political development of criminal law related to copyright offenses. Hak Cipta adalah suatu realitas yang tinggi akan berbagai nilai, termasuk didalamnya nilai ekonomis, hal ini dikarenakan hak cipta yang lahir dari cipta, rasa, dan karsa mampu mewarnai perkembangan kehidupan umat manusia melalui benda yang lahir dari proses cipta tersebut. Namun dalam perkembangannya berbagai hak cipta tidaklah diperhatikan di negara ini. Maraknya pembajakan akan hak cipta lagu misalnya, hanya mampu menguntungkan bagi oknum pelaku pembajakan hak cipta lagu tersebut secara ekonomis,  Metode penelitian yang digunakan adalah metode penelitian hukum yuridis analisis dengan objek kajian penelitian yang ditujukan terhadap peraturan perundang-undangan yang berkaitan dengan hak cipta dan prinsip-prinsip hukum yang berlaku. Secara substansial, materi perubahan dalam UU No. 28 Tahun 2014 adalah yang berkaitan dengan perubahan jenis tindak pidana dari delik biasa menjadi delik aduan serta sementara itu pihak pencipta tidak banyak yang dapat mengupayakan keadilan akan hal itu. Hasil dari penelitian semakin bertambah tidak adil dengan adanya Pasal 112 hingga Pasal 119 Undang-Undang Nomer 28 Tahun 2014 merubah delik hak cipta menjadi delik aduan yang semakin memarjinalkan hak dari pencipta suatu karya cipta di negara ini. Oleh sebab itu perlu adanya pembahasan bersama terkait pembangunan politik hukum pidana terkai delik hak cipta.

Abstract

The purpose of this paper is to compare and evaluate the thoughts of Hans Kelsen with Satjipto Raharjo. Both offer their respective theories, namely Hans Kelsen's pure legal theory and Satjipto Rahardjo's progressive law. In this theory, both of them base their philosophical approach. After reviewing, the theories of these two figures are relevant for interpreting the law. This paper uses a critical paradigm with a combination of normative or doctrinal and sociological or non-doctrinal approaches. The results showed that Hans Kelsen directed his mind that legal positivism considers moral speech, values are finished and final when it comes to the formation of positive law. Pure Legal Theory is not a perfect copy of transcendental ideas, but it does not try to see the law as a posterity of justice. While Rahardjo's progressive law rests on the aspects of rules and behavior. Regulations will build a positive and rational legal system. While the behavioral or human aspects will drive the rules and systems that are built. Tujuan penulisan ini adalah untuk membandingkan dan mengevaluasi pemikiran Hans Kelsen dengan Satjipto Raharjo. Keduanya menawarkan teori masing-masing, yaitu teori hukum murni Hans Kelsen dan hukum progresif Satjipto Rahardjo. Dalam teori ini, keduanya sama-sama mendasarkan pendekatan secara filosif. Setelah dikaji, teori dari kedua tokoh ini relevan untuk memaknai hukum. Tulisan ini menggunakan paradigima kritis dengan pendekatan kombinasi normatif atau doktrinal dan sosiologis atau non doktrinal. Hasil penelitian menunjukkan bahwa Hans Kelsen lebih mengarahkan pikirannya bahwa positivisme hukum yang menganggap pembicaraan moral, nilai-nilai telah selesai dan final manakala sampai pada pembentukan hukum positif. Teori Hukum Murni bukanlah salinan ide transendental yang sempurna, namun tidak berusaha memandang hukum sebagai anak cucu keadilan. Sementara hukum progresifnya Rahardjo bertumpu pada aspek peraturan dan perilaku (rules and behavior). Peraturan akan membangun suatu sistem hukum positif yang logis dan rasional. Sedangkan aspek perilaku atau manusia akan menggerakkan peraturan dan sistem yang dibangun.

Abstract

Legal arrangements in the field of technology transfer related to foreign investment need to be considered in order for the entry of new technology in Indonesia. This article aims to know how the implementation of Technology Transfer under Law No. 25 of 2007 on Investment in Indonesia and Transfer of technology developments in Indonesia with the Law No. 25 Year 2007 on Investment. The method used is a normative juridical analytical descriptive, whereas in analyzing the data using qualitative methods and presented descriptively. From this study shows that the main problem at the root problem of transfer of technology in Indonesia is the law governing the transfer of technology itself. That's because there is no obvious technical regulations regarding foreign investment for technology transfer in the discourse of transfer of technology as stipulated in Law No. 25 of 2007 on Investment is only optional and not become an obligation for foreign investors to come. It was concluded that the concept of technology transfer in foreign investment in Indonesia is based on the principle of self-reliance, development Technology transfer through foreign investment in Indonesia has not had a clear regulation so here said technology transfer is only seen as a choice for investors not as a an obligation which is binding and accompanied with strict punishment. Pengaturan hukum di bidang alih teknologi yang terkait dengan investasi asing perlu dipertimbangkan untuk masuknya teknologi baru di Indonesia. Artikel ini bertujuan untuk mengetahui bagaimana implementasi transfer teknologi berdasarkan UU No. 25 tahun 2007 tentang Investasi di Indonesia dan transfer perkembangan teknologi di Indonesia dengan UU No. 25 Tahun 2007 tentang Investasi. Metode yang digunakan adalah deskriptif analitik yuridis normatif, sedangkan dalam menganalisis data menggunakan metode kualitatif dan disajikan secara deskriptif. Dari penelitian ini menunjukkan bahwa masalah utama pada akar masalah transfer teknologi di Indonesia adalah hukum yang mengatur transfer teknologi itu sendiri. Itu karena tidak ada peraturan teknis yang jelas mengenai investasi asing untuk transfer teknologi dalam wacana transfer teknologi sebagaimana diatur dalam Undang-Undang Nomor 25 Tahun 2007 tentang Investasi hanya opsional dan tidak menjadi kewajiban bagi investor asing untuk datang. Dapat disimpulkan bahwa konsep alih teknologi dalam investasi asing di Indonesia didasarkan pada prinsip kemandirian, pengembangan Transfer teknologi melalui investasi asing di Indonesia belum memiliki regulasi yang jelas sehingga disini dikatakan transfer teknologi hanya dipandang sebagai pilihan bagi investor bukan sebagai kewajiban yang mengikat dan disertai dengan sanksi tegas.

Abstract

The purpose of this paper is to examine the publication of Perma No. 2 of 2015 concerning Procedures for Settling a Simple Lawsuit. Perma can be seen as one solution to meet the needs of the community for dispute resolution procedures quickly and simply. The substance contained in Perma is to uphold the principle of justice which is simple, fast, and low cost. Therefore, the requirements in a simple lawsuit are limited in nature, where if one of the conditions is not fulfilled, the case cannot be resolved through the Simple Lawsuit Procedure in accordance with Perma No. 2 of 2015. The results of the author's research, the Perma substance is needed to be improved, because the limitation of jurisdiction is only one legal domicile and the use of legal counsel in a simple claim is something that needs to be regulated in more detail, in the future to further encourage the use of a simple claim mechanism as a instrument of applying the principle of justice that is simple, fast, and low cost in Indonesia. The Supreme Court needs to regulate in more detail the role of the attorney in simple lawsuits, such as regulating the right to speak a legal representative and the problem of the absence of the principal in the event that the party is a legal entity; Electronic calling via Sms, whasapp and email can be an alternative used in the calling process, so Perma should regulate in more detail the terms and conditions of the validity of the information technology-based calling. Tujuan penulisan ini adalah  untuk menelaah penerbitan Perma No. 2 Tahun 2015 tentang Tata Cara Penyelesaian Gugatan Sederhana. Perma itu dapat dipandang sebagai salah satu solusi untuk memenuhi kebutuhan masyarakat terhadap prosedur penyelesaian sengketa dengan cepat dan sederhana. Substansi yang terkandung di dalam Perma yaitu menjunjung asas peradilan yang sederhana, cepat, dan berbiaya ringan. Oleh karena ini persyaratan dalam gugatan sederhana bersifat limitatif, di mana bila salah satu syarat tidak dipenuhi, maka perkara tersebut tidak dapat diselesaikan  melalui Prosedur Gugatan Sederhana sesuai PERMA No. 2 Tahun 2015. Hasil penelitian penulis, substansi Perma diperlukan pernyempurnaan, karena pembatasan yurisdiksi hanya pada satu domisili hukum dan penggunaan kuasa hukum dalam gugatan sederhana merupakan hal yang perlu diatur secara lebih rinci, di masa yang akan datang untuk lebih mendorong penggunaan mekanisme gugatan sederhana sebagai instrumen penerapan asas peradilan yang sederhana, cepat, dan berbiaya ringan di Indonesia. Mahkamah Agung perlu mengatur lebih rinci peran kuasa hukum dalam gugatan sederhana, seperti mengatur hak bicara kuasa hukum dan masalah ketidakhadiran prinsipal dalam hal pihak adalah badan hukum; Pemanggilan secara elektronik melalui SMS, WA dan email dapat menjadi alternatif yang digunakan dalam proses pemanggilan, maka PERMA sebaiknya mengatur secara lebih rinci syarat dan ketentuan keabsahan pemanggilan berbasis teknologi informasi tersebut.

Abstract

Development is one of the contributors to global warming, especially industrial development. Industrial companies in Kendal Regency in 2017 there were 61 companies with 25,385 workers. The phenomenal industry in Kendal Regency lately is a Special Industrial Zone (KIK) known as Kendal Industrial park (KIP). Kendal Industri Park (KIP) is the largest industrial development city in Central Java with a total development size of 2,200 hectares. Kawasan Industri Park (KIP) is a joint venture between two industrial developers in Southeast Asia naming Sembcorp Development Ltd and PT Jababeka Tbk. This paper examines the implementation of the Sak Uwong Sak Uwit (SUSU) policy in Kendal District where the policy is in response to global warming. The focus of this study is the implementation of a policy, so the method used is a juridical-empirical legal research method. The focus of his study is looking at the law in terms of law in action not in law in books. The Sak Uwong Sak Uwit (SUSU) policy can be implemented even though it is not yet maximized. The bride and groom have received information about this policy and implemented it, but it is different from the mother giving birth who did not get information about this policy so that for the mother giving birth the program did not work. This policy has been able to move the community (law as a tool of social engineering) to care for the environment by planting trees. By planting these trees environmental conservation will be created.Pembangunan menjadi salah satu penyumbang terjadinya pemanasan global (global warming), terlebih pembangunan industri. Perusahaan industri di Kabupaten Kendal tahun 2017 tercatat sebanyak 61 perusahaan dengan 25.385 tenaga kerja. Industri yang fenomenal di Kabupaten Kendal akhir-akhir ini adalah Kawasan Industri Khusus (KIK) yang dikenal dengan sebutan Kendal Industri park (KIP). Kendal Industri Park (KIP) ini merupakan pengembangan kota industri terbesar di Jawa Tengah dengan total ukuran pengembangan mencapai 2.200 hektar. Kawasan Industri Park (KIP) merupakan perusahaan patungan antara dua pengembang industri di Asia Tenggara penamaan Sembcorp Pengembangan Ltd dan PT Jababeka Tbk. Penelitian ini mengkaji tentang implementasi kebijakan Sak Uwong Sak Uwit (SUSU) di Kabupaten Kendal di mana kebijakan tersebut sebagai respon terhadap pemanasan global. Fokus kajian ini adalah implementasi dari sebuah kebijakan, sehingga metode yang yang digunakan adalah metode penelitian hukum yuridis-empiris. Fokus kajiannya adalah melihat hukum dari sisi law in action tidak pada law in books. Kebijakan Sak Uwong Sak Uwit (SUSU) dapat diimplementasikan meski belum maksimal. Calon pengantin sudah menerima informasi tentang kebijakan ini dan melaksanakannya, namun berbeda dengan ibu melahirkan yang tidak mendapatkan informasi tentang kebjaka ini sehingga untuk ibu melahirkan program ini tidak berjalan. Kebijakan ini sudah mampu menggerakkan masyarakat (law as a tool of social engineering) untuk peduli lingkungan yaitu dengan menanam pohon. Dengan menanam pohon tersebut konservasi lingkungn akan tercipta.

Abstract

Law enforcement to transnational fugitives especially those perpetrators of money laundering with international dimension in Indonesia, in particular related to incoming extradition is needed to reconstruct. This is because hitherto, the decision to extradite is the decision of the executive branch as stipulated in Act No.1 of 1979 on Extradition. Hence, the consideration for the government to extradite is more on political concern rather than judicial. This practice is deemed neglecting the protection of human rights and creating legal uncertainty, especially in relation to detention period that could exceed beyond admissible time as stipulated in KUHAP because of the grace period on the issuance of the Presidential Decision. This research is doctrinal and field study. Based on findings in the field, incoming extradition request must be based on the court’s decision, or judicial order in the future to ensure protection of human rights and legal certainty of the person who is subject of the extradition and to the requested country. Penegakan hukum terhadap buronan transnasional, terutama para pelaku pencucian uang di Indonesia, perlu sebuah rekontruksi khususnya terkait dengan ekstradisi. Ini karena sampai sekarang, keputusan untuk mengekstradisi adalah keputusan cabang eksekutif sebagaimana diatur dalam Undang-Undang No.1 tahun 1979 tentang Ekstradisi. Oleh karena itu, pertimbangan bagi pemerintah untuk mengekstradisi lebih pada masalah politik daripada peradilan. Praktik ini dianggap mengabaikan perlindungan hak asasi manusia dan menciptakan ketidakpastian hukum, terutama dalam kaitannya dengan masa penahanan yang dapat melebihi melampaui waktu yang dapat diterima sebagaimana diatur dalam KUHAP karena masa tenggang pada penerbitan Keputusan Presiden. Penelitian ini bersifat doktrinal dan studi lapangan. Berdasarkan temuan di lapangan, permintaan ekstradisi yang masuk harus didasarkan pada keputusan pengadilan, atau perintah pengadilan di masa depan untuk memastikan perlindungan hak asasi manusia dan kepastian hukum dari orang yang menjadi sasaran ekstradisi dan ke negara yang diminta.

Abstract

The national land law structure in force in Indonesia does not mention and does not prohibit the sale and purchase of customary land rights. The fact in customary law has conditions that must be met regarding the transfer of the sale of customary land rights. If it does not meet the requirements, then buying and selling rights to customary land is said to be a deviation regarding the objectives contained in the customary order. Formulation of the first problem, why the legality of buying and selling rights over customary land of the Malay tribe in Dharmasraya Regency, West Sumatra Province. Second, what is the form of transfer of customary land rights according to customary law and national land law in Dharmasraya Regency and what kind of government legal policy is capable of providing protection to customary community rights relating to customary land rights? This paper is the result of research using the Socio Legal Research method that uses primary data and secondary data is a source of questions with the collection techniques carried out by observation and interviews equipped with literature studies and analyzed descriptively prescriptive. The results of the study found a deviation regarding the substance of the transfer of title to the Malay customary land. One of the factors is the undeniable development of the age related to economic survival without thinking about the common rights inherent in customary land. The conclusion is that the customary land is a common right of the customary law community. The meaning of collective rights here is not owned by individuals, ‘ninik mamak’ or customary leaders only. Therefore, the sale and purchase of customary land rights must be returned in accordance with customary law norms attached to the customary law community itself. So that the existence of customary land is maintained in the days to come and is not eroded by time. The future legal politics of the government pays attention to the existence of customary land and recognizes the customary community's customary land to be poured in the form of an authentic deed and poured in the form of a Regency / City Regional Regulation in terms of the transfer of customary rights to other parties, especially investors.
