Abstract

Menurut Undang-undang Nomor 26 Tahun 2007 tentang Penataaan Ruang, bahwa Tata Ruang Wilayah adalah wujud dari struktur dan pola ruang, di mana struktur ruang adalah susunan pusat-pusat pemukiman dan system jaringan prasarana dan sarana yang berfungsi sebagai pendukung kegiatan sosial ekonomi masyarakat secara hierarki memiliki hubungan fungsional, sedangkan pola ruang secara nasional adalah distribusi peruntukan ruang dalam suatu wilayah yang meliputi peruntukan ruang yang berfungsi sebagai kawasan lindung dan peruntukan ruang yang berfungsi sebagai kawasan budidaya. Berdasarkan latar belakang masalah sebagaimana dikemukakan di atas, maka dapat dirumuskan beberapa masalah antara lain : Bagaimana Implementasi Kebijakan Penataan Ruang di Indonesia serta Bagaimana Kepastian Hukum Penataan Ruang Setelah Berlakunya Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang. Jenis penelitian yang dipergunakan dalam penelitian ini adalah jenis penelitian hukum normatif, yaitu melakukan analisis kebijakan penataan ruang oleh Pemerintah setelah berlakunya undang-undang Nomor 26 Tahun 2007 tentang Penataan Ruang. Hasil pembahasan dalam penelitian ini Implementasi Kebijakan Penataan Ruang di Indonesia Kebijakan penataan ruang oleh pemerintah setelah berlakunya Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang oleh Pemerintah dan pemerintah daerah dengan melibatkan peran masyarakat. Peran masyarakat merupakan hal yang sangat penting dalam penataan ruang karena pada akhirnya hasil penataan ruang adalah untuk kepentingan seluruh masyarakat serta untuk tercapainya tujuan penataan ruang, yaitu terwujudnya ruang wilayah nasional yang aman, nyaman, produktif, dan berkelanjutan dan Kepastian hukum penataan ruang wilayah setelah berlakunya Undang-Undang Nomor 26 Tahun 2007 tentang Penataan Ruang dimana kepastian hukum merupakan indicator profesionalisme dan syarat bagi kredibilitas pemerintahan, sebab bersifat vital dalam penyelenggaraan pemerintahan dan pembangunan, serta dalam pengembangan hubungan internasional. Tegaknya kepastian hukum juga mnesyaratkan kecermatan dalam penyusunan berbagai kebijakan pembangunan. Sebab berbagai kebijakan publik tersebut pada akhirnya harus dituangkan dalam system perundang-undangan untuk memiliki kekuatan hukum, dan harus mengandung kepastian hukum. Untuk menjamin adanya pemerintahan yang bersih (clean government) serta kepemerintahan yang baik maka pelaksanaan pembangunan hukum harus memenuhi kewajiban procedural (fairness), pertanggungjawaban publik (accountability) dan dapat dipenuhi kewajiban untuk peka terhadap aspirasi masyarakat (responsibility). According to Law Number 26 of 2007 concerning Spatial Planning, Regional Spatial Planning is a form of spatial structure and pattern, where spatial structure is the arrangement of residential centers and a network system of infrastructure and facilities that function to support community socio-economic activities in a hierarchical manner. has a functional relationship, while the national spatial pattern is the distribution of space allocations in a region which includes space allocations that function as protected areas and space allocations that function as cultivation areas. Based on the background of the problem as stated above, several problems can be formulated, including: How to Implement Spatial Planning Policy in Indonesia and What is the Legal Certainty of Spatial Planning After the Enactment of Law Number 26 of 2007 concerning Spatial Planning. The type of research used in this research is normative legal research, namely analyzing spatial planning policies by the Government after the enactment of Law Number 26 of 2007 concerning Spatial Planning. The results of the discussion in this research are Implementation of Spatial Planning Policy in Indonesia Spatial planning policy by the government after the enactment of Law Number 26 of 2007 concerning Spatial Planning by the Government and regional governments by involving the role of the community. The role of the community is very important in spatial planning because ultimately the results of spatial planning are for the benefit of the entire community and to achieve the goals of spatial planning, namely the creation of safe, comfortable, productive and sustainable national regional space and legal certainty for regional spatial planning after its enactment. Law Number 26 of 2007 concerning Spatial Planning where legal certainty is an indicator of professionalism and a requirement for government credibility, because it is vital in the administration of government and development, as well as in the development of international relations. Upholding legal certainty also requires accuracy in the preparation of various development policies. Because these various public policies must ultimately be stated in the legislative system to have legal force, and must contain legal certainty. To ensure clean government and good governance, the implementation of legal development must fulfill procedural obligations (fairness), public accountability (accountability) and fulfill the obligation to be sensitive to community aspirations (responsibility).

Abstract

Lingkungan hidup adalah kesatuan ruang dengan semua benda, daya, keadaan, dan makhluk hidup, termasuk di dalamnya manusia dan perilakunya yang mempengaruhi kelangsungan perikehidupan dan kesejahteraan manusia serta makhluk hidup lainnya. Hukum pidana pada hakikatnya adalah “hukum sanksi” yang tujuannya untuk mengatur dan menentukan ketertiban dalam masyarakat, menjamin keamanan dan juga keselamatan negara. Maksud dari kata-kata tersebut yaitu bahwa hukum pidana merupakan sarana pemaksa untuk melindungi warga masyarakat terhadap perbuatan yang merugikan atau yang mengakibatkan terjadinya penderitaan pada pihak lain yang dalam hal ini adalah pencemaran lingkungan hidup. Pencemaran lingkungan hidup adalah masuknya atau dimasukannya makhluk hidup, zat, energi, dan/atau komponen lain ke dalam lingkungan hidup oleh kegiatan manusia sehingga kualitasnya turun samapai tingkat tertentu yang menyebabkan lingkungan hidup tidak dapat berfungsi sesuai dengan peruntukannya. Dalam penulisan artikel ini diambil beberapa perumusan masalah yaitu, Bagaimanakah kebijakan hukum pidana terhadap pelaksanaan UU No. 23 Tahun 1997 tentang Lingkungan Hidup saat ini? dan bagaimanakah kebijakan hukum pidana terhadap pelaksanaan UU No. 23 Tahun 1997 tentang Lingkungan Hidup pada masa mendatang? Metode penelitian yang digunakan dalam penelitian ini adalah metode hukum normatif dengan jenis penelitian yang digunakan adalah jenis penelitian yuridis normative dan dikaji dengan pendekatan perundang-undangan (the statute approach). Kebijakan hukum pidana lingkungan hidup pada saat ini belum dapat dikatakan secara optimal karena dalam penanganannya masih dalam batas teguran, sehingga belum ada vonis hakim yang dapat memenjarakan ataupun memidanakan pelaku tindak pidana pencemaran lingkungan hidup. Untuk kebijakan hukum pidana lingkungan hidup untuk masa yang akan datang pengawas lingkungan harus melakukan sosialisasi dan membuat buku pedoman pengawasan kegiatan lingkungan untuk pengawasan lingkungan hidup. The living environment is the unity of space with all objects, forces, conditions and living creatures, including humans and their behavior which influences the continuity of life and welfare of humans and other living creatures. Criminal law is essentially a "law of sanctions" whose aim is to regulate and determine order in society, guarantee the security and safety of the state. The meaning of these words is that criminal law is a means of coercion to protect citizens against actions that are detrimental or cause suffering to other parties, which in this case is environmental pollution. Environmental pollution is the entry or entry of living creatures, substances, energy and/or other components into the environment by human activities so that their quality decreases to a certain level which causes the environment to be unable to function according to its intended purpose. In writing this article, several problem formulations were taken, namely, what is the criminal law policy regarding the implementation of Law no. 23 of 1997 concerning the current environment? and what is the criminal law policy regarding the implementation of Law no. 23 of 1997 concerning the Environment in the future? The research method used in this research is a normative legal method with the type of research used being normative juridical research and studied using a statutory approach. Environmental criminal law policy at this time cannot be said to be optimal because its handling is still within the limits of warnings, so there has been no judge's verdict that can imprison or criminalize perpetrators of criminal acts of environmental pollution. For environmental criminal law policy for the future, environmental supervisors must carry out outreach and create a guidebook for monitoring environmental activities for environmental monitoring.

Abstract

Pengesahan Surat Tanda Nomor Kendaraan (STNK) diatur dalam Peraturan Kepolisian Negara Republik Indonesia Nomor 7 Tahun 2021 tentang Registrasi dan Identifikasi Kendaraan Bermotor serta Undang – Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Dan Angkutan Jalan bahwa pengesahan STNK wajib dilaksanakan setiap tahun dan diajukan sebelum masa berlaku berakhir. Dikeluarkan trobosan Samsat Drive Thru yang memberikan pelayanan lebih cepat pada layanan kantor samsat. Namun kenyataannya masih banyak masyarakat yang tidak melakukan pengesahan STNK. Sehingga dapat dirumuskan rumusan masalah yaitu : 1. Bagaimana efektivitas pengesahan STNK melalui Samsat Drive Thru Badung, dan 2. Bagaimana hambatan dan upaya kepolisian dalam pengesahan STNK melalui Samsat Drive Thru Badung Berdasarkan Peraturan Kepolisian Negara Republik Indonesia Nomor 7 Tahun 2021. Jenis penelitian ini adalah penelitian hukum empiris dan bersifat deskriptif dengan menggunakan asas legalitas, konsep efektivitas, dan konsep penegakan hukum. Teknik pengumpulan data secara triangulasi dengan melakukan observasi, wawancara, dan studi dokumen terkait dengan efektivitas pengesahan STNK melalui Samsat Drive Thru Badung. Selanjutnya analisis data menggunakan pengolahan data secara kualitatif. Efektivitas Pengesahan Surat Tanda Nomor Kendaraan (STNK) melalui Samsat Drive Thru Badung apabila diukur dengan indikator pencapaian tujuan, adaptasi, dan integrasi masih perlu dimaksimalkan. Meskipun terdapat peningkatan dari tahun ke tahun terhadap pengesahan STNK melalui Samsat Drive Thru Badung namun masih ditemukan masyarakat yang tidak melaksanakan pengesahan STNK. Terdapat beberapa hambatan dalam pengesahan STNK melalui Samsat Drive Thru Badung antara lain faktor hukum, faktor penegak hukum faktor masyarakat, serta dari faktor sarana dan fasilitas. Upaya yang telah dilakukan kepolisian dalam pengesahan STNK melalui Samsat Drive Thru Badung yaitu dengan memberikan kebijakan hukum dengan tetap berdasarkan aturan yang berlaku, meningkatkan kegiatan sosialisasi, meningkatkan kemampuan personil penegak hukum, memperbaiki sarana dan fasilitas, serta melakukan pengawasan dan evaluasi terhadap pelaksanaan pengesahan STNK melalui Samsat Drive Thru Badung. Kata Kunci : Efektivitas, Pengesahan STNK, Samsat Drive Thru Validatoin of Vehicle Number Certificates (STNK) is regulated in Republic of Indonesia National Police Regulation Number 7 of 2021 concerning Registration and Identification of Motorized Vehicles and Law Number 22 of 2009 concerning Road Traffic and Transportation that ratification of STNK must be carried out every year and submitted before the term expires. A Samsat Drive Thru breakthrough was issued which provides faster service to Samsat office services. But in reality there are still many people who do not validate their STNK. So that the formulation of the problem can be formulated, namely: 1. What is the effectiveness of validating STNK through the Badung Drive Thru Samsat, and 2. What are the obstacles and efforts of the police in validating STNK through the Badung Drive Thru Samsat Based on Republic of Indonesia National Police Regulation Number 7 of 2021. This type of research is empirical legal research and is descriptive in nature using the principles of legality, the concept of effectiveness, and the concept of law enforcement. The technique of collecting data is triangulation by conducting observations, interviews, and studying documents related to the effectiveness of validating STNK through the Badung Drive Thru Samsat. Furthermore, data analysis uses qualitative data processing. The effectiveness of validating vehicle registration certificates (STNK) through the Badung Drive Thru Samsat when measured by indicators of goal attainment, adaptation and integration still needs to be maximized. Even though there has been an increase from year to year in the validation of STNK through the Badung Drive Thru Samsat, there are still people who do not carry out the validation of STNK. There are several obstacles in validating STNK through the Badung Drive Thru Samsat, including legal factors, law enforcement factors, community factors, as well as facilities and facilities. Efforts that have been made by the police in validating STNK through the Badung Drive Thru Samsat, namely by providing legal policies that are still based on applicable regulations, increasing outreach activities, increasing the ability of law enforcement personnel, improving facilities and facilities, as well as monitoring and evaluating the implementation of STNK validation through Badung Drive Thru Samsat. Abstract

Perkembangan dewasa ini, Pulau Bali memiliki tantangan yang dilematis antara dua hal berseberangan yakni kearifan lokal dan komersialisasi. Derasnya arus perkembangan globalisasi dan modernisasi memberikan dampak yang sangat berpengaruh terhadap pariwisata Bali. Apabila ditelaah berdasarkan kajian hukum, perlu kiranya dilakukan suatu upaya yakni hukum dekontruksi. Hukum dekontruksi secara garis besar ditujukan untuk evaluasi atas subtansi hukum yang berkenaan dengan kearifan lokal dan komersialisasi pariwisata budaya Bali. Penelitian ini bertujuan untuk melakukan suatu bentuk upaya mengkaji kembali dan merevisi peraturan yang ada untuk menghindari eksploitasi dan menekan arus komersialisasi budaya pada Pariwisata Bali. Penelitian ini menggunakan metode normatif dengan mengkaji peraturan perundang-undangan, buku, jurnal, dan artikel yang berkaitan dengan hukum dekontruksi dan perkembangan pariwisata budaya Bali. Hasil penelitian menunjukkan bahwa pendekatan hukum dekonstruksi dapat menjadi solusi efektif untuk menangani komersialisasi pariwisata budaya Bali dengan melakukan identifikasi dan penalaran kritis terhadap sejumlah regulasi yang sudah ada berkenaan dengan pariwisata budaya Bali. The current development of Bali Island has a dilemmatic challenge between two opposing things, namely local wisdom and commercialization. the current development of globalization and modernization has a very influential impact on Bali Tourism. Based on legal studies, it is necessary to make an effort, namely deconstruction law. The deconstruction law is generally aimed to evaluate the substance of the law relating to local wisdom and commercialization of Balinese cultural tourism. This research aims to make an effort to review and revise existing regulations to avoid exploitation and suppress the flow of culture commercialization in Bali tourism. This research uses a normative method by reviewing legislation, books, journals, and articles related to deconstruction law and the development of Balinese cultural tourism. The results show that the legal deconstruction approach can be an effective solution to deal with the commercialization of Balinese cultural tourism by identifying and critically reasoning about existing regulations regarding Balinese cultural tourism.

Abstract

ABSTRAK Kejaksaan selain kewenangannya dalam melakukan penuntutan juga memiliki kewenangan sebagai eksekutor untuk melaksanakan putusan pengadilan. Permasalahan yang terjadi dalam pelaksanaan pidana tambahan pembayaran uang pengganti yakni belum optimalnya pengembalian kerugian keuangan negara berkaitan dengan kewenangan Kejaksaan sebagai lembaga yang bertugas mengeksekusi sebuah putusan pengadilan. Oleh sebab itu, untuk mengetahui permasalahan dalam pelaksanaan pidana tambahan ini, penelitian ini akan dilakukan di Kejaksaan Negeri Klungkung sebagai salah satu Kejaksaan Negeri yang ada di wilayah hukum Provinsi Bali. Adapun rumusan masalah pertama, Bagaimana pelaksanaan pidana tambahan pembayaran uang pengganti di Kejaksaan Negeri Klungkung dan apakah hambatan dalam pelaksanaan pidana tambahan pembayaran uang pengganti di Kejaksaan Negeri Klungkung Penelitian ini memuat penelitian hukum empiris, dengan menggunakan sifat penelitian eksplanatoris.Sumber Data terdiri dari Sumber Data Primer, Data Sekunder, Teknik pengumpulan data yang dugunakan dalam penelitian ini adalah wawancara, Analisis data yang dipergunakan di dalam penelitian ini adalah analisis kualitatif. Berdasarkan dari hasil penelitian yang telah dikaji dan diuraikan, maka kesimpulan yang dapat disampaikan adalah sebagai berikut, Pelaksanaan pidana tambahan pembayaran uang pengganti belum berjalan sempurna, sehingga tujuan pidana tambahan ini belum tercapai secara maksimal. Dan kedua, Hambatan dalam pelaksanaan pidana tambahan pembayaran uang pengganti di Kejaksaan Negeri Klungkung yakni peraturan-peraturan hukum yang ada belum mendukung penuh upaya pelaksanaan pidana tambahan ini. Kata kunci : Pidana Tambahan, Uang Pengganti, Korupsi ABSTRACT The Attorney General's Office, in addition to its authority in carrying out prosecutions, also has the authority as executor to carry out court decisions. The problem that occurs in the implementation of additional criminal payments for replacement money is that the return of state financial losses is not yet optimal related to the authority of the Attorney General's Office as an institution tasked with executing a court decision. Therefore, to find out the problems in the implementation of this additional sentence, this research will be conducted at the Klungkung State Prosecutor's Office as one of the State Prosecutors' Offices in the jurisdiction of the Province of Bali. As for the formulation of the first problem, How is the implementation of additional criminal payment of replacement money at the Klungkung District Attorney's Office and what are the obstacles in implementing additional criminal payment of replacement money at the Klungkung District Attorney's Office This study includes empirical legal research, using the nature of explanatory research. The data sources consist of primary data sources, secondary data. The data collection technique used in this research is interviews. The data analysis used in this research is qualitative analysis. Based on the results of the research that has been reviewed and described, the conclusions that can be conveyed are as follows, The implementation of additional punishment for payment of replacement money has not been perfect, so that the purpose of this additional punishment has not been optimally achieved. And second, obstacles in the implementation of the additional penalty for payment of replacement money at the Klungkung District Attorney, namely the existing legal regulations have not fully supported efforts to implement this additional penalty. Abstract

Police Service 110 or formerly popular as Call Center110 is a form of Polri service to the public to report/complain about problems that occur related to Kamtibmas disturbances or criminal acts/violations faster for the implementation of maximum public security services. Based on this, problems can be formulated, namely: how is the implementation of the 110 police service by the Bali Police operations bureau in Denpasar city in handling traffic accident cases and what are the factors that hinder the handling of traffic accident cases through the 110 police service by the Bali Police Operations Bureau in Denpasar city. The type of research used is empirical juridical research, descriptive, using primary data and secondary data, data collection techniques in empirical legal research, namely document studies, interviews and observations. Data is processed and analyzed with qualitative techniques according to the nature of the data then presented descriptively, then analyzed qualitatively. The results of this study are the implementation of police service 110 by the Bali Police operations bureau in the city of Denpasar in handling traffic accident cases are: the operator opens the Police Service Agent Application 110; receive Reports/Complaints while verifying caller's identity and location; record Reports/Complaints; forward the Report/Complaint to the nearest police ranks; monitor follow-up from the ranks of the police/related function units and officers in the field; receive progress reports; inform the status of the Report; Record a series of follow-up Reports/Complaints; and provide responses to the whistleblower. The inhibiting factors of handling traffic accidents through the 110 police service are internal factors and external factors.

In Bali, foreign tourists who drive motorized vehicles, both two-wheeled and four-wheeled vehicles to go to tourist attractions. According to Article 281 junto Article 77 paragraph (1) Number 22 of 2009 concerning Traffic and Road Transportation, that everyone who drives a motorized vehicle on the road is obliged to obey traffic regulations. The increase in violations by foreign tourists is the task of the Polresta Traffic Unit to take firm action against violators. The purpose of the study was to determine law enforcement against Foreign Citizens who ride rented motorbikes by the Denpasar Police Traffic Unit and the obstacles and efforts to enforce the law against Foreign Citizens who ride rented motorbikes by the Denpasar Police Traffic Unit. This type of research is empirical legal research, namely research with field data as the main data source, such as interview results and observations. There are two types of data used, namely primary data obtained from Members of the Denpasar Police Traffic Unit through interviews and direct research. Secondary data obtained through literature studies of various studies. The conclusion of the study on law enforcement of Foreign Citizens riding rented motorbikes by the Denpasar Police Traffic Unit is that Foreign Citizens (WNA) riding rented motorbikes by the Denpasar Police Traffic Unit use Law Number 22 of 2009 concerning Traffic and Road Transportation as a guideline in taking action against violations. Obstacles in law enforcement are factors of legislative constraints, law enforcement, facilities and infrastructure and the community. Efforts that can be made by the Traffic Unit are to apply preemptive (education), preventive (prevention), and repressive (law enforcement or sanctions) methods.

Abstract

Undercover buy or disguised purchase is a narcotics investigation method, where a police officer acts as a buyer in a narcotics sale and purchase transaction, with the intention that the seller or intermediary can be arrested along with the evidence. The implementation of Undercover Buy in the jurisdiction of the Gianyar Police has been implemented several times, and in 2024 out of 54 case disclosures, the police have carried out Undercover Buy 6 times. The basis for implementing Undercover Buy is Article 75 letter j and Article 81 of Law Number 35 of 2009 concerning Narcotics. The purpose of this research is to determine the implementation and obstacles to the implementation of undercover buying in arresting perpetrators of narcotics trafficking crimes in the jurisdiction of the Gianyar Police. This research is an empirical legal research, this research is explorative and descriptive, the data used are primary data and secondary data, in collecting data the author uses document study techniques, interviews and observations, then the data processing and analysis used are qualitative analysis and quantitative analysis.  The research conclusion is that the implementation of undercover buy in the arrest of perpetrators of narcotics trafficking crimes in the jurisdiction of the Gianyar Police was carried out in 3 stages, namely initial preparation in the form of completing administration and determining the Operation Target, implementing undercover buy and finally the arrest stage, after being arrested the officer will carry out the investigation process. Obstacles in the implementation of undercover buy are caused by internal factors, namely factors originating from the police in the form of minimal members implementing undercover buy and the ability to implement undercover buy and external factors, namely non-technical factors, namely obstacles in obtaining information from informants.

Abstract

One of the rights that must be realized in providing various health efforts to the entire community is the implementation of quality health development. One form of health efforts is physiotherapy services. When practicing physiotherapists provide assessment sheets to patients and written and oral explanations regarding the duration and type of therapy to be given. Some cases that appear in the public provide a warning that health workers in carrying out their duties must be careful and responsible, and legal protection is needed to prevent errors of omission, which result in lawsuits. The purpose of this study is how the implementation of legal protection and what obstacles exist in the implementation of legal protection to physiotherapists as independent physiotherapy in Denpasar City. The research uses empirical research method and descriptive approach. Data were obtained from interviews with representatives of the Denpasar Branch Physiotherapy Association and independent Physiotherapy Practices in Denpasar City. The results of this study show that the physiotherapy profession often faces interventions from other professions, especially through referral letters or written requests that mention specific physiotherapy technology interventions. In the implementation of home visits, physiotherapists explain repeatedly about the importance of Informed consent, because during the action during home visits it will greatly complicate the action and reduce concentration during therapy due to limited time, infrastructure and conditions are not conducive. Conclusion of this study Legal protection for physiotherapists is crucial to ensure safe, ethical and professional practice. Clear regulations help regulate the rights and obligations of health workers and protect patients from potential violations. It is recommended that health workers need to keep abreast of regulatory developments to remain relevant and comply with established standards.

Abstract

One of the problems that is often faced by a criminal justice system in Indonesia is the high number of cases that enter the court. This not only burdens the judiciary, but also slows the settlement of the case. One type of case that often piles up in court is a minor crime, which should be handled with simpler procedures. Responding to the issue, the Supreme Court issued Perma No. 2 of 2012 which aims to provide guidelines for judges in handling minor criminal acts more effectively even though the purpose of this Perma is very good but, in fact in the field there are still irregularities in its application. The purpose of this study carried out the Tri Dharma of Higher Education, especially in the field of research conducted by students and this study aims to analyze the types of minor criminal acts regulated in the Criminal Code and the Implementation of Perma No. 2 of 2012 concerning adjusting the limits of minor criminal acts and the number of fines in the Criminal Code on handling minor criminal acts to realize legal protection and provide recommendations to improve the benefits of applying the regulation and provide input for the improvement of the criminal justice system in Indonesia. used in this study is an empirical type of research with this research is descriptive. The results of this study are minor criminal acts to realize legal protection impact on increasing the evisiency of handling minor criminal acts, especially in the conflict of the judicial process.
