Abstract

This research is entitled Effectiveness of Duties and Authority of Regional Inspectorate of Regional Inspectorate of Palopo City?, Perspective of Siyasah Duturiyah. The main research problem is how effective the duties and authorities of the regional inspectorate of Palopo City are from the perspective of Siyasah Duturiyah? .This type of research is a qualitative descriptive field research using a normative juridical approach and a syar'i approach. The results showed that Implementation of the duties and authorities of the Palopo City Regional Inspectorate in the form of an audit, a review, an evaluation, monitoring and assistance. The review is here to ensure that what we are going to do is in accordance with the laws and regulations.second Obstacles experienced by the Palopo City Regional Inspectorate, namely. First, the Limited Number of Government Internal Supervisory Apparatus (APIP). Second, Budget Limitations. third The perspective of Siyasah Dustruiyah in carrying out the duties and authorities of the Palopo City Regional Inspectorate in carrying out its supervisory function has not used the Islamic concept or the Siyasah dustruiyah concept, because the implementation of the duties and authorities of the Palopo City Regional Inspectorate is guided by the provisions of the applicable laws and regulations. Meanwhile, in Islamic law the implementation of the supervisory function is carried out with the concepts of hisbah and muraqabah.

Abstract

Good governance can be seen from aspects, oneofthem is measuring the maturity of government institutions in carriying out their functions and rules, from the lowest level to the highest in the government sysrem. Indonesia is known as a coutry that implments a decentralized system, which makes local governments run their own government, in the case at the village government level also gets is own authority in regulating its government, therefore, to provide a balance in running the govermentin the village, the village head neads partners in running the government, so a legislative body is formed, known as the village consultative body (BPD), one of the duties and functions of the BPD is to provide supervision over the performance of the village head in carrying out his duties as head of government at the village level. Departing from this background, the author takes two main problems, namely the from of BPD panciro’s supervision of the village head, and the view of Islamic law on the supervisory function carried out by the BPD against the village head. In this study the author uses a qualitative field research method. As for the research result obtained from the research location, firstly, the panciro’s BPD in carrying out its supervisior function is carried out in a complrkx and family manner, for example in a work program, the BPD involves itself starting from program planning, to the realization stage, so that it can provide supervision as well as performance appraisel fillage head. Secondly, in Islamic low or in this case siyasah syaríah known al-Hisbah which means calling for good and keeping away from evil, seeing the from of supervision carried out by the panciro BPD, then this concept is indirectly developing in government where the BPD as much as possible prevents irregularities deviations that can harm society.

Abstract

This study aims to find out how the reality of unemployment in Soppeng Regency is and to know the role of the Soppeng Regional Government in dealing with Unemployment in Soppeng Regency. The research method used in this study is field research through an empirical juridical research method and a syar'i method. The effects of this have a look at suggest that, the reality of unemployment that occurs in Soppeng Regency causes the unemployment rate to continue to increase due to uncertain macroeconomic conditions in the region, especially Soppeng so that companies cannot develop their business in Soppeng so that the labor recruitment process is not optimal. The role of the Department of Manpower in dealing with unemployment in Soppeng Regency is to increase the distribution of workforce placement by establishing work connectivity networks, expanding job opportunities, and training & labor productivity in an effort to reduce unemployment. The role of the Department of Manpower and Transmigration in the Siyasa Syar'iyyah, in this case the Siyasa Syar'iyyah is appropriate and does not conflict with the rules contained in the Siyasa Syar'iyyah. That the manpower service is equivalent to a state leader in the context of an Islamic State. Both have the same task, namely to realize the benefit of the people.

Abstract

The purpose of this study was to determine the realization of PERDA No. 1 of 2014 concerning the Regional Medium-Term Development Plan of Polewali Mandar Regency with a siyasa syar'iyyah perspective. This research is a field research with a juridical and syar'i approach. The regional medium-term development program in Polewali Mandar Regency from 2014 to 2019 has been carried out in accordance with the mandate of PERDA No. 1 of 2014 concerning the RPJMD for Polewali Mandar district. Although the implementation of this five-year development has been carried out, in some developments there are still many things that need to be reviewed, because there are still developments that are not in accordance with the wishes and needs of the community and the development that has been carried out touches the main parts of people's lives that have not been realized evenly in all areas. region.

Abstract

The Ombudsman is a state institution whose existance is quite important in the constitutional system, because to supervise the implementation of public services is one of the main tasks of a state government. This study aims to determine how the authority of the Makassar City Ombudsman in public services. This study uses emprical and normative research methods, whit an empirical juridical approach, normative jurdical and syar’i, the data used are secondary and primary data taken from the field, namely the Ombudsman of Makassar City. The results show that the Makassar City Ombudsman in resolving public service disputes is still not optimal due to limited authority, so that not all reports can be handled by the Makassar City Ombudsman because on of the requirements is to be domiciled in Makassar.

Abstract

Differences in views regarding governance in Islam have caused debate among the people, for that al-Maududi tries to answer this problem by returning to the Qur'an, the sunnah, and the example given by Khulafa al-Rasyidun. This study aims to determine the system of government in Islam and the division of power according to Abu al-A'la al-Maududi and the possibility of its application in Indonesia. The research method used is library research, with a normative syar'i and philosophical approach. The results show that the Islamic government system according to Abu al-A'la al-Maududi can be grouped as a caliphate Islamic government system based on shura. Power is divided into legislative (ahl al-hal wa al-aqd), executive (ulu al-amr) and judicial (qadha). The application of the concept of Islamic government according to Abu al-A'la al-Maududi in Indonesia is faced with opportunities in the form of the existence of Islamic law in Indonesia, the view of Indonesia as an Islamic state and Islamic values ​​in line with the nation's goals. The obstacles faced are the plurality of Indonesia, the view that there is no need to establish an Islamic state and the rejection of women's groups. The challenge is in the form of nationalist Islamic intellectual groups and secularization.

Abstract

This study aims to determine the procedures for using the Online Single Submission (OSS) system and the impact on society based on the perspective of Siyasah Syariah at the Investment and One-Stop Service Office of Gowa Regency, while the issues raised are the licensing mechanism through the Online Single Submission (OSS) system and the impact accepted by society from the point of view of Siyasah Syar'iah. The research uses normative syar'I and normative juridical research approaches, qualitative descriptive research types, research locations in DPM-PTSP Kab. Gowa, secondary data sources in the form of literature such as journals, thesis books and primary data in the form of interviews, observation and documentation, techniques and processing used display, editing, reduction, analysis and conclusions. The findings obtained are, Licensing through the OSS system at PTSP Kab. Gowa has shown a positive impact on the community, both in terms of procedures for using the system and the benefits obtained by the community with the system, which illustrates that it has been running well in accordance with the service principles of simplicity and convenience, so that this is in accordance with what is contained in several concepts. Siyasah Syar'iyah, namely maslahah mursalah and maslahah al-'ammah regarding the formation of government policies must provide benefits for the whole community

Abstract

This study aims to find out how the concept of Case Termination Based on Restorative Justice at the Gowa District Attorney's Office (Siyasah Syar'iyyah Study). The main problem is divided into several sub-problems, namely: How to stop cases based on restorative justice at the Gowa State Prosecutor's Office, What are the forms of cases related to restorative justice, and what is the siyasa syariyyah perspective on ending cases based on restorative justice. The research method used is data collection in the form of observation, interviews, documentation and reference tracing. The results of this study indicate that the implementation of restorative justice focuses more on conditions for creating justice and balance for the perpetrators of criminal acts and their victims themselves, and the perpetrators of criminal acts do not need to be sentenced to death but can be carried out with restorative justice efforts, in order to reduce the excess capacity of correctional institutions. or state prisons, restorative justice can also eliminate grudges for potential perpetrators of crimes so that they will not repeat their actions and can embrace and provide an understanding to the wider community about the dangers of committing a crime. In the perspective of siyasa syar'iyyah, termination of cases based on restorative justice can be carried out using the method of forgiving and paying diyat and law enforcers are not justified in acting arbitrarily in resolving cases, but must uphold justice in accordance with the regulations.

Abstract

The aim of this research is to reveal the historical facts of the values ​​and culture of the Balanipa kingdom. The unique characteristics of the kingdom, which combines the concepts of democracy and deliberation, are a special attraction. These values ​​are related to religiosity, community, regional culture and traditions, the system of government, and the concept of Siyasah Syar'iyyah. The method used in this research is a qualitative field research with a historical approach and tries to reveal how the system of the Balanipa Kingdom in Polewali Mandar was mainly from the Siyasah Syar'iyyah Perspective. This research was conducted by collecting a number of data obtained from informants in the field to find various facts or social phenomena, then the author will analyze it and try to formulate theoretically based on what is observed. In conducting field research, observations, documentation and interviews were carried out. Data from literature studies and field study results are displayed as research findings, abstracted to obtain complete information, and interpreted to produce knowledge for drawing conclusions. The results of this study are evidence of the historical acculturation value of the royal government system and democracy as the system of government of the Republic of Indonesia. In general, it can be concluded that the concept of miniature Indonesia has been implemented by the Balanipa Kingdom.

Abstract

This study analyzes parking problems in Makassar City and the government's efforts to overcome traffic jams and illegal parking. Makassar City faces challenges in providing adequate parking space due to rapid population growth and high urbanization. The problems studied include lack of parking space, high land prices, increased vehicle volume, undisciplined behavior of road users, and ineffective implementation of parking regulations. This research also describes the impact of illegal parking such as congestion, energy waste, air pollution, and public inconvenience. Parking is when the vehicle does not move for a while and is abandoned by the driver. According to Sukanto, parking is stopping and storing vehicles (cars, motorcycles, bicycles, etc.) temporarily in a certain space. The space can be in the form of a roadside, garage or yard provided to accommodate the vehicle. This study aims to find out how illegal parking is controlled by the Makassar City Transportation Service and how Siyasah Syar'iyyah views illegal parking supervision. This research is classified as field research with an empirical juridical and normative syar'i approach. The results of this study indicate that the form of control carried out by the Makassar City Transportation Service on several roads is by taking action in accordance with Perwali Number 64 of 2011, such as locking and checking parking permits by business actors. The obstacles faced are the lack of awareness of illegal parking attendants and parking users who park their vehicles in places where parking is prohibited, weak coordination between the Department of Transportation and the PD. Makassar City Parking, as well as other stakeholders. Siyasah Syar'iyyah's view of the Role of the Makassar City Transportation Service in Illegal Parking Control Efforts, that in a hadith narrated by the Muslim Prophet sallallaahu alaihi wasallam narrates: “I saw a man who gets pleasure in heaven because of a tree he cut down on the road because it would interfere with others." shows how noble the Muslims are who practice the demands of Shari'a and Islamic teachings. They have to keep the streets clean, instead of polluting and destroying them. They are encouraged to remove roadblocks or thorns if they come across. This is how the morals of Muslims are taught by Allah's religion while hoping for His reward and pleasure. Therefore, it is hoped that the Makassar City Transportation Service can work together in supervising illegal parking and the intensity of supervision that needs to be increased and also provide strict sanctions to those who violate it, to the parking user community. expected to increase awareness to be more obedient to traffic rules.
