Abstract

This study discusses economic growth, that economic growth does not only provide positive impacts but also negative impacts such as the existence of monopoly crimes that grow because unfair competition practices are based on tight business competition because they are required to increase profits as much as possible. The company PT. Charoen Pokphand Indonesia Tbk (CPIN) is indicated to have committed a monopoly violation in controlling food in the poultry sector in its business activities. The purpose of this study is that the government is expected to be truly present in trying, and anticipating, and or overcoming crimes in the field of monopoly practices and unfair business competition. Namely in overcoming the practice of controlling products from upstream to downstream, the authority in this case is the Business Competition Supervisory Commission (KPPU). This research method uses Normative Juridical analysis using secondary data with primary materials in the form of laws and expert opinions. The results of this study are that Business actors must implement Law No. 5 of 1999 Regarding Their Business Activities, and also the Business Competition Supervisory Commission (KPPU) must take a legal approach to PT Charoen Pokphand Indonesia (CPIN). In this study it can be concluded that all independent farmers are in a very weak position. Because they do not have a bargaining position against suppliers who supply input components such as seeds, feed and medicine, and do not have bargaining power from the sales side, because the market is controlled by poultry integrators such as in this study PT. CPIN. So that monopoly practices occur in product control from upstream to downstream.

Abstract

This research examines the implementation of the Internal Control System (SPI) at the Aviation and Space Research Organization (ORPA) which is under the National Research and Innovation Agency (BRIN). The aim of this research is to evaluate the effectiveness of SPI in supporting the achievement of organizational goals and identify the obstacles faced in its implementation. The research method used is descriptive qualitative with a case study approach. Data was obtained through in-depth interviews and analysis of related documents. The research results show that the implemented SPI has helped in increasing the operational accountability and transparency of ORPA BRIN. However, there are still several obstacles, such as limited human resources and policy changes that affect SPI's performance. Based on the research results, it can be concluded that the implementation of SPI in ORPA BRIN is not optimal. This is caused by deficiencies in SPI elements, such as the control environment, risk assessment, and control activities. In the control environment element, there are deficiencies in the aspects of commitment to competence, human resource development policies, the role of effective Government Internal Oversight Apparatus (APIP), and working relationships with stakeholders. This research provides recommendations for ORPA BRIN to increase human resource capacity, strengthen commitment to competence, and build close collaboration with APIP and stakeholders to support more effective implementation of SPI.

Abstract

This research investigates the impact of Good Corporate Governance (GCG) on the financial performance of property companies listed on the Indonesia Stock Exchange (BEI) from 2018 to 2023. Key governance variables include the board of commissioners, board of directors, audit committee, institutional ownership, and managerial ownership. A quantitative associative method was utilized, with data collected from the annual reports of 31 property companies selected via purposive sampling. The analysis was conducted using multiple linear regression with SPSS 25 software. The study reveals that the board of commissioners, board of directors, and audit committee positively and significantly affect financial performance. Conversely, institutional and managerial ownership show a significant negative impact. These findings underscore the importance of effective governance structures in enhancing company performance. Larger boards of commissioners and directors, along with an active audit committee, contribute to better financial outcomes. However, higher levels of institutional and managerial ownership may lead to decisions that negatively affect performance. Good Corporate Governance practices significantly influence the financial performance of property companies. This research provides valuable insights for improving governance frameworks to enhance financial health in the property sector.
