Abstract

This study aims to determine the productive zakat distribution system and the problems encountered in the productive zakat distribution system in BAZNAS Gorontalo city. This research is a qualitative field research. The target informants are BAZNAS and recipients of productive zakat assistance. Collecting data using the method of observation, interviews, and documentation. While the analysis uses qualitative analysis (non-statistical) which is descriptive qualitative. The results show that the productive zakat distribution system at BAZNAS includes: zakat allocation procedures, mustahik selection systems and zakat determination, muzakki and mustahik information systems, as well as documentation and reporting systems. There are two problems with the productive zakat distribution system, First, the mustahik determination system is not right on target, BAZNAS only relies on data from the village, and in providing information to mustahik, BAZNAS does not directly meet the mustahik candidates but only informs the neighbors . This seems to contain elements of nepotism. Second, in the distribution of goods by BAZNAS to the selected mustahik, there are types of goods in the form of cigarettes which are haraam by the third MUI fatwa in 2009. This is certainly not in accordance with the provisions of zakat which is a means to achieve the benefit of the people. As an implication, BAZNAS in its efforts to assist the government in eradicating poverty in Gorontalo City is expected to be really observant in determining mustahik by going down and being directly involved in selecting candidates for mustahik and not only based on data from the village.

Abstract

The implementation of marriage between one of the conditions of marriage is the existence of two witnesses, but to appoint a witness, it cannot be done carelessly such as appointing an evil witness. According to majority scholars, it is illegal to marry under an evil witness because that person is not a just person. Imam 'AlaUddin is of the opinion that it is legal to marry under an unfavorable witness for the following reasons: first, the Law of Ashal; Marriage will not take place if there are no witnesses, but in this case the nature of justice is not necessary but the aim is only to inform the public. Second, the Law of Intellect (ra'yun); Whereas if a poor person comes from the local population / area then he / she legally becomes a witness of marriage. Third, marriages occur in various places, both in villages and in remote areas, if only to find out firsthand whether a witness is fair or not, it will be burdensome and troublesome. Therefore, it is enough to look at the witness's general assessment, without having to know the details whether he or she has ever committed a major sin or not. Imam 'Alauddin took legal sources from the Koran, Hadith, and Istihsan. Based on this method, the ijtihad used by the imam 'Alauddin is a istihsan.

Abstract

In dealing with the Covid-19 pandemic, the Indonesian government uses Large-Scale Social Restrictions (PSBB) as an option to accelerate the handling of Covid-19. There is a narrative struggle regarding the limitation of human rights behind the policy of implementing the PSBB. The research uses a form of normative juridical legal research. Retrieving data through documentation, and data analysis through reduction, data presentation and conclusion. The narrative struggle that occurs regarding the protection of rights in handling Covid-19 is shown by the tug-of-war between the interests of health and the rights of community activities, where the policy of limitation has implications for the fulfillment of life's needs. The implementation of PSBB in Indonesia must be done optimally by improving domestic human rights legal instruments by incorporating public health and safety factors as the legality of human rights restrictions.

Abstract

M. Quraish Shihab is one of the great Muslim scholars in Indonesia, who is very productive in his work and has great concern for the development of tafsir al-Quran. In addition, he is also known to have a concern for the development of Islamic law, including family law in Indonesia. The legal thought pattern is more rational-progressive by contextualizing the text in the dimensions of space, time, and culture. Among the results of his ijtihad which is quite a lot of discussion is about the hijab. The author also presents some other thoughts such as polygamy, sirri marriage, and nusyuz to see the thought pattern of M. Quraish Shihab. In the context of KHI as a reference to Islamic family law in Indonesia, he is not fully in agreement with the legal substance. The result of this research is Quraish tried to re-read the religious text in this case the source of Islamic law, namely the Qur'an and Hadith as well as the results of ijtihad scholars. The istislahi (based on mashlahat) became the foundation of the Quraish in responding to the development of family law practices. This method pays close attention to the side of human welfare in every provision of the Shari'ah that has been revealed. The principle of equality is also a concern of the Quraish in discussing the relationship between husband and wife.

Abstract

ABSTRACT The problem of prostitution is nothing new in Indonesian society, currently online-based prostitution is increasingly rampant. This phenomenon is a social problem because it involves social and moral values ​​in people's lives. This social problem cannot be overcome if there is no special attention from all parties, both government and society. From this, the authors are interested in conducting research related to the implementation of the Metro City Regional Regulation Number 07 of 2016 concerning Community Social Disease Management, especially the practice of online prostitution in Metro City. This research is a field research (Field Research) which describes the implementation, obstacles and solutions to the implementation of the Metro City Regional Regulation Number 07 of 2016 concerning Community Social Diseases Management of the practice of online prostitution in Metro City. Based on the results of the research, it can be concluded that the implementation of the Metro City Regional Regulation Number 7 of 2016 concerning Community Social Diseases Control regarding online prostitution has not been implemented optimally, Satpol PP officers who are in charge of local regulations have taken serious control but sanctions are given to disease perpetrators. social in the community only in the form of social guidance and sanctions. In the regional regulation Number 07 of 2016 concerning Community Social Diseases Management, it has not yet provided clear sanctions to perpetrators of social diseases such as online prostitution, because there are no implementing or guardian regulations regarding these regional regulations. Because the guardian's function explains the articles in regional regulations. The solution is that the local government must issue a guardian or implementing regulations from the Metro City Regional Regulation Number 07 of 2016 concerning Community Social Disease Management and need active participation of all components in tackling social diseases, especially those related to online prostitution. Abstract

The Constitutional Court's decision rejecting the petition for judicial review related to criminal articles for adultery and LGBT perpetrators in the Criminal Code can certainly reap the pros and cons. Because the Court'sdecision is a decision with a disenting opinion. Of the 9 judges, 5 judges thought the petition was unacceptable, while the other 4 judges thought the petition was acceptable. Therefore, this decision is interesting to study and analyze further from the point of view of law, psychology, religion and other sciences which have a correlation with the object of this decision. Theoretically, it is found that the concept of human rights (especially regarding LGBT) is not only related to the concept of universal human rights, there is also the concept of particular human rights, meaning that when discussing human rights issues, there are normative boundaries that are juridical, religious, and traditional / custom. Based on these universal and particular human rights concepts, it can be concluded that the correct decision by the Constitutional Court was to grant a request for a judicial review in relation to the criminal article for adultery and LGBT perpetrators.

Abstract

Ijma’ adalah salah satu metode yang pembahasannya semakin berkembang karena konsep Ijma’ yang dirumuskan oleh para ulama fuqaha terdahulu ternyata di masa sekarang menimbulkan pertanyaan mengenai bagaimana Ijma’ bisa diimplementasikan. Ketika Ijma’ dipahami sebagai kesepakatan ulama maka ulama yang seperti apakah pada saat ini yang dapat membentuk sebuah kesepakatan yang dapat dipakai umat. Kemudian masih memungkinkah akan adanya sebuah ijtihad berbentuk Ijma’ yang akan dikaitkan dengan kontek negara bangsa ini. Dengan metode library research dan content analysis terhadap penafsiran beberapa ayat Al-Qur’an yang terkait. Tujuan penelitian ini adalah sebagai konteks negara bangsa bahwa Ijma’ dapat dilakukan oleh pemerintah dalam hal ini lembaga legislatif sebagai wakil rakyat, sehingga produk-produk hukumnya jika disepakati bisa dikatakan dengan Ijma’. Dan upaya kontekstualisasi konsep rukun Ijma’ dari segi kriteria mujtahid maupun secara yuridis historis bahwa Ijma’ itu adalah sebuah konsensus, maka dalam konteks negara bangsa peraturan-perundang-undangan menjadi keniscayaan menjadi sebuah Ijma’. Konsep Ijma’ ini akan menghasilkan sebuah dalam konteks negara bangsa peraturan-perundang-undangan menjadi keniscayaan menjadi sebuah Ijma’. Seperti Undang-Undang Perkawinan, Wakaf, dan peraturan perundangan lainnya.

Abstract

In the era of digitalization of science and modern information-communication technology, the tradition of legal thought (at-turas) among Islamic legal methodological thinkers (uṣuliyyin) is increasingly developing in the context of extracting law (istinbaṭ al-ahkam). However, the thinking of legal methodology itself is considered by them to have a crisis of methodology in addition to a crisis of paradigm. Meanwhile, various contemporary legal cases (al-waqi'iyyah al-mu'asirah) continue to emerge that demand statutory legal certainty. Even the substance of the methodology of Islamic law (uṣul al-fiqh) is considered by a minority, many of which are no longer relevant to the needs of this modern era. Therefore, as a problem solving to overcome this methodological crisis, the alternative is to rely on maqaṣid asy-syari'ah, both as a doctrine and as a method of ijtihad. Because in its application it is not only based on religious texts (al-Qur'ān and sunnah), but searches and excavations behind the text in an effort to determine and determine legal certainty in every case that occurs. Such application and implementation has been, is being and continues to be developed by contemporary Islamic legal methodological thinkers.

Abstract

Abstrack The government system is a vital aspect of discussion in a country's state of statecraft. Speaking of systems of government, we won't get away with the parliament. After the amendment of UUD 1945, Indonesia experienced many changes in its systems, including those of its parliament. The parliament, which had previously used unicameral concepts with the MPR as the only representative body in Indonesia. After the constitutional amendment of Indonesia, a new parliament was born in DPD, which was automatically converted into the bicameral parliament system in the Indonesian Parliment system. DPR is the first chamber and DPD is the Second chamber of the goverment. DPD presence is actually a stabilizer for the performance of parliament to execute the check and ballences principle. Institutionally, the two institutions are aligned, but the authority held by these institutions is very different. More limited than the state of parliament has, especially in the fields of legislation and surveillance. Keywords : The government system, the bicameral parliament system, MPR, DPR, DPD Abstrak Sistem pemerintahan merupakan aspek yang sangat vital untuk dibahas dalam sistem ketatanegaraan suatu negara. Membahas soal sistem pemerintahan, kita tidak akan terlepas mengenai sistem parlemen. Setelah amandemen UUD 1945, Indonesia mengalami banyak perubahan sistem ketatanegaraan, termasuk dalam hal sistem parlemen. Sistem parlemen yang sebelumnya menggunakan konsep unicameral dengan MPR sebagai satu-satunya lembaga perwakilan di Indonesia. Setelah amandemen konstitusi Indonesia, lahirlah lembaga perwakilan baru yaitu DPD sehingga sistem parlemen di Indonesia berubah menjadi konsep parlemen bikameral. Dalam sistem parlemen di Indonesia, DPR merupakan kamar pertama dan DPD merupakan kamar kedua. Kehadiran DPD sebenarnya sebagai penyeimbang atas kinerja dari DPR untuk melaksanakan prinsip Check and ballences. Secara institusional, kedua lembaga ini memiliki kedudukan yang sejajar, akan tetapi kewenangan yang dimiliki kedua lembaga ini sangat berbeda. Kewenangan yang dimiliki DPD jauh lebih terbatas dibandingkan yang dimiliki DPR khususnya dalam bidang legislasi dan pengawasan. Abstract

This paper contains legal issues arising from the promulgation of the Supreme Court Regulation Number 5 of the Year, which is a legal substance derived from Law Number 16 of 2019. The research method used in this paper is normative legal research which is carried out using secondary data. or library data. Das sollen, as an implication of the new regulation, creates a potential that makes applications for dispensation of marriage wide open. This is evidenced by the existence of a court decision, one of which is Decision Number: 13 / Pdt.P / 2020 / PA.Bgi., Which makes giving dispensation to marriage for those who are not yet old enough, on the basis of consideration of fulfilling administrative requirements, which are in accordance with the provisions of Article 7 paragraphs (1) and (2) of the Marriage Law jo. Article 6 (e) Government Regulation Number 9 of 1975. Therefore, it is very necessary to make new statutory provisions, which are limitative in nature, so that, it is hoped, can minimize deviant practices of the provisions regarding the marriage age limit for women and men who want to get married but not old enough.
