Mutawasith is the academic journal of Islamic law that was first published in 2018 by the Program of Sharia Economics Law (Muamalah) of the Institute of Islamic Religion Mubarokiyah Tasikmalaya. The Mutawasith Journal is published periodically twice in one year in June and December. The focus of the study from the Mutawasith Journal emphasizes the research or conceptual results relating to the study of Islamic law, sharia economic law, family law, and the social institution of contemporary Islamic Law (actual) by writing methods referring to the standards of scientific writing. The Mutawasith Journal publicly receives contributions from academics and non-academics related to the topic of journal Studies. All published articles do not necessarily present a journal view, or other institution that has a relationship with the publication of a journal.

Abstract

This article aims to analyse the implementation of the gold pawn takeover financing contract at BSI KCP Subang Pamanukan from the perspective of Islamic law. Using qualitative methods to understand more deeply the phenomenon of the research focus, the research case study approach at BSI KCP Subang Pamanukan. Primary data sources come from interviews with the gold pawn BSI KCP Subang Pamanukan, secondary data comes from articles, books, scientific journals and research related to gold pawn takeover financing. Data collection techniques through interviews with gold pawn parties at BSI KCP Subang Pamanukan, observation and documentation. Data analysis techniques in the form of narrative analysis. The results showed that the implementation of debt transfer financing (take over) at BSI KCP Subang Pamanukan was in accordance and did not conflict with DSN-MUI Fatwa No. 31/DSN-MUI/VI/2002, namely in the implementation of the financing using qardh, rahn and ijarah contracts. This refers to the third alternative, and the implementation of some of these contracts is in accordance with Islamic law.

Abstract

The objective of this study was to investigate the marriage age limits in Indonesia, Egypt, and India. Research on age limits in marriage is crucial due to the social and cultural implications of child marriage. The methodology employed is qualitative, utilizing library research. Furthermore, a comparative approach evaluates and contrasts the marriage laws of the three nations concerning age limits. The comparative analysis employs vertical, horizontal, and diagonal methodologies. The research material comprises legislative documents and pertinent academic literature. The results indicate that family laws in Indonesia, Egypt, and India prohibit child marriage. Vertically, Indonesia's marriage age remains unaffected by the Shafi'i school, establishing a minimum of 15 years, whereas Egypt follows the Hanafi madzhab with a minimum age of 18. In India, the authors contend that the influence of the Hanafi madzhab is negligible, particularly as proposed legislation seeks to elevate the marriage age for women to 21. Additionally, horizontal comparisons highlight the distinctions in laws regarding the legality, procedures, and ramifications of marriage in each nation.

Abstract

The legal awareness of fast food MSMEs regarding halal certification in Kerinci Regency is an important topic with the majority of the population being Muslim. However, the low level of legal awareness regarding halal certification can hinder the progress of MSMEs. This study aims to examine the level of legal awareness of fast food MSME players regarding halal certification in Kerinci Regency. Testing the level of legal awareness in terms of knowledge, understanding, attitudes and behavior. This research uses quantitative descriptive method. The research data were collected from primary data in the form of questionnaires distributed and answered by 100 fast food MSME actors, using descriptive analysis as a data analysis tool. The results showed that the level of legal awareness of fast food MSME players in Kerinci Regency is very low, where it can be seen that the value or percentage in terms of knowledge, understanding, attitude and behavior is very low. The findings of this study underscore the need for an effort and method/strategy to increase the legal awareness of fast food MSME players regarding halal certification so that it can provide a breakthrough and at the same time have implications in supporting ongoing halal developments.

Abstract

The research objective was to analyse decision No. 12/Pid.B/2011/Pn.Sinjai related to manslaughter through a normative juridical approach. This research method uses a type of normative juridical research with a statutory, conceptual, and case approach, which analyses primary legal sources such as and cases, which analyses primary legal sources such as the Al-Quran, Hadith, laws and regulations, and court decisions, as well as secondary sources in the form of literature, journals, and court decisions. Secondary sources in the form of literature, journals, and other legal documents, through data collection techniques. Data collection techniques of literature study and document analysis, with qualitative and descriptive-analytical data analysis. Data analysis is qualitative and descriptive-analytical. The results showed that the application of Islamic criminal law in cases of manslaughter needs to consider aspects of the intention and negligence of the perpetrator, as well as the impact on the victim's family and society.

Abstract

This study aims to investigate the factors that influence the purchasing decisions of MSME products (Micro, Small, and Medium Enterprises) in Tasikmalaya with a focus on the role of halal labels, BPOM permits and consumer trust. The method used is a quantitative method with a path analysis model. The research sample was selected using the Simple Random Sampling method by considering relevant consumer characteristics. To identify the relationship between the variables studied and their impact on purchasing decisions of MSME products in Tasikmalaya, data collected from respondents were then analyzed using the Structural Equation Modeling-Partial Least Squares (SEM-PLS) technique. The results of this study indicate that halal labels and BPOM permits have a significant influence on consumer trust and purchasing decisions of MSME products in Tasikmalaya. In addition, consumer trust is proven to act as an intervening variable, strengthening the relationship between halal labels and purchasing decisions.

Abstract

Ta'aruf is a method of introduction between men and women with the aim of marriage, which is carried out through the intermediary of ustadz or parents. However, the practice of ta'aruf is currently experiencing a shift in meaning due to the times, including its implementation online. This study aims to analyze the forms of deviation in the practice of ta'aruf based on the perspective of Islamic law. Using a descriptive qualitative approach, this study identifies deviations that often occur, such as fraud, sexual harassment, and behavior approaching adultery. Data were obtained through in-depth interviews and literature review. The results show that deviations in ta'aruf are often due to a lack of understanding of the principles of sharia, the influence of technology, as well as weak family supervision and mediators. The research also emphasizes the important role of the family and Islamic institutions in ensuring that the practice of ta'aruf is in accordance with Islamic teachings. Research recommendations include strengthening education on the concept of ta'aruf, stricter supervision of online practices, and the development of comprehensive shar'i guidelines to prevent abuse in this process

Abstract

Halal tourism has an important role in sustainable economic growth, especially in countries with a majority Muslim population. Indonesia, as the country with the largest Muslim population, shows rapid growth in the halal tourism industry. This research aims to explore and analyze the contribution of the halal tourism sector to a country's Gross Domestic Product (GDP) in the context of sustainable economic development. This research uses a literature study approach to obtain data from various literature sources, including books and previous research. Data collection techniques involve documentation, where information is obtained from various sources such as notes, books, journals, etc. After the data was collected, descriptive analysis was carried out to reach conclusions. The findings show that halal tourism is increasingly relevant based on Islamic sharia principles as the number of Muslim tourists increases globally. Indonesia is a pioneer in developing halal tourism in Southeast Asia, with a significant contribution to Gross Domestic Product (GDP), halal tourism increases competitiveness and economic growth in the future by implementing industry 4.0 with various digital platforms, halal tourism has a positive impact on the economy by creating new jobs to reduce poverty and improve community welfare.

Abstract

Lembaga Dakwah Islam Indonesia (LDII) Wonogiri Regency has different views regarding kafa'ah both in theory and implementation. theory and implementation. The type of research is qualitative, using a field study approach. Data collection techniques through observation, documentation, and interviews with primary and secondary sources. primary and secondary sources. Data analysis was carried out by means of reduction, presentation, and conclusion drawing. The results show that the practice of kafa'ah practice implemented by members of LDII Wonogiri Regency although it is not an absolute an obligation, but it remains the focus of attention that is always implemented by each member. Implemented by each of its members. A marriage will be easier to realise to be realised because they already understand each other's backgrounds so that in realising a harmonious family and avoiding conflicts that risk a split in the household.
