Abstract

Interfaith marriage in Islam and Article 16 of the Universal Declaration of Human Rights (UDHR) show significant differences in legal and ethical approaches. In Islamic law, interfaith marriage is strictly regulated, with permission for Muslim men to marry Ahl al-Kitab women (Jews and Christians), but prohibiting Muslim women from marrying non-Muslim men. This aims to maintain the sustainability of Islamic beliefs in the family. Meanwhile, the UDHR emphasizes the right of individuals to choose a life partner without discrimination of religion, race, or nationality. This study aims to find out how the law of interfaith marriage, according to Islamic Marriage law allows marriage between a Muslim man and a woman Ahl al-Kitab, there are certain conditions that must be met, including maintaining Islamic norms and respecting the rights of the couple Various opinions of scholars regarding interfaith marriage, especially related to the different views of madhhab, reflect the complexity and variation in the understanding of Islamic law on this topic. Article 16 of the UDHR, which affirms the freedom of individuals in marriage without discrimination, is contrary to the principles of Islamic law that further restrict interfaith marriage, describing the tension between human rights and religious teachings in the context of interfaith marriage.

Abstract

One biological parent may have their authority over one or more children revoked for a certain period of time by a court decision. Removing parental control over a child can be done for a number of reasons, such as abuse of authority, grave disregard of responsibilities, misbehavior, and being sentenced for a crime against their child based on a legally enforceable ruling. The Child Protection Law stipulates that parental authority may be revoked or supervision measures may be implemented, that a child may be separated from one parent, that contact between the child and the parent must be permitted, and that care that keeps the child in his family must be prioritized. If the government is given custody of the child, there must be a periodic review to make the separation as short as possible.

Abstract

The marriage ceremony of the Karo tribe is a sacred ritual that must be performed before couples can participate in other traditional ceremonies, with an exogamy system that requires marriage outside the clan (berimpal marriage) but creates complexity in terms of inheritance distribution and property arrangements. This empirical juridical research in Padang Mas Village, Kabanjahe District, Karo Regency analyzes the inheritance distribution mechanism in berimpal marriages and legal protection for heirs through literature study and interviews with descriptive analysis. The research findings show that the Karo inheritance system is patriarchal in nature, granting exclusive rights to male children according to traditional customs, however its legal protection depends on local government recognition and the Karo customary system does not have positive legal force as evidenced by the Supreme Court decision that recognizes the inheritance rights of female children, while inheritance dispute resolution can be conducted through two approaches namely civil law that guarantees legal certainty and kinship system that prioritizes social harmony and maintenance of kinship relationships.

Abstract

Unregistered marriages create legal uncertainty for Indonesian society, particularly regarding marital status and civil rights. This research analyzes the legal consequences of itsbat nikah (marriage validation) decisions on unregistered marriages in Aceh Singkil Regency using descriptive analytical methods and empirical juridical approaches. The research findings indicate that unregistered marriages are caused by local cultural factors, economic conditions, geographical factors, and weak administrative roles. The itsbat nikah process at Mahkamah Syar'iyah Singkil follows Religious Court Law provisions, resulting in declaratory decisions that provide legal basis for registration at KUA (Office of Religious Affairs), state administrative recognition, and civil rights guarantees, although the status of children born before itsbat requires separate determination. The research recommends improving marriage registration socialization, inter-institutional coordination, and public awareness to avoid legal problems.

Abstract

Abstract Child adoption is a practice that has long been carried out by Indonesian society, generally by married couples who do not yet have children, and is implemented in accordance with customs and laws and regulations. This normative legal research with descriptive analytical nature examines the legal system of child adoption, court validation, and the legal consequences arising using statutory, conceptual, and case approaches with qualitative analysis. The research results show fundamental differences between customary legal systems that sever blood relations between adopted children and biological parents, Islamic law and Law No. 35 of 2014 which do not sever such lineage relations. Child adoption requirements are regulated in Government Regulation No. 54 of 2007 and Social Affairs Minister Regulation No. 110/HUK/2009, where applications are submitted through social institutions then to the court to obtain a court decree if the specified requirements are met. The legal consequences of child adoption through court decisions show that adoptive parents only replace the role of biological parents in caring for, educating, and nurturing without severing blood relations, so that according to the Compilation of Islamic Law (KHI), adopted children are not included as heirs of adoptive parents but are entitled to obligatory bequests according to Article 209 paragraph (2), adoptive parents cannot become marriage guardians for adopted daughters and are not entitled to inherit from each other but may obtain obligatory bequests based on Article 209 paragraph (1), while adopted children still have blood relations with their biological parents and are entitled to inherit from each other according to the provisions of Articles 176-193 KHI.

Abstract

Child marriage is a form of coercion into adulthood that has a serious impact on the mental health, social, and legal development of children, especially women. Children who marry early often experience stress, depression, and anxiety disorders due to the pressure of adult roles that they are not ready to take on psychologically and socially. In addition, this marriage increases the risk of domestic violence, school dropout, and being trapped in an intergenerational cycle of poverty. In a legal context, a child who marries is automatically considered an adult and legally capable, even if emotionally and mentally unprepared, making it vulnerable to exploitation and legal harm. This study uses a normative method with a comparative approach to law, especially against the practice in the Netherlands and the Philippines, which have established an absolute ban on child marriage without a gap in legal dispensation. In contrast, Indonesia and Malaysia still provide dispensation spaces that are often used on the basis of culture or pregnancy outside of marriage. This discussion shows the importance of reforming national laws in favor of the protection of children as a whole, through the elimination of legal loopholes dispensation and strengthening social-based approaches to education and rehabilitation. Synergy between regulation, law enforcement, and changes in social norms is needed to end the practice of child marriage as a whole.

Abstract

This research examines the legal implications of the acknowledgment of illegitimate children within the context of the Indonesian legal system, focusing on the analysis of Decision Number 12/PDT.P/2023/PN.Wng. The background of this study arises from the phenomenon of illegitimate children who often do not receive equivalent legal status, resulting in discrimination within society. The purpose of this research is to understand the legal considerations of the judge in the petition for acknowledgment of the child and the legal consequences of such acknowledgment. This study employs a normative legal method with a descriptive-analytical approach to analyze primary and secondary legal materials. The findings indicate that the acknowledgment of an illegitimate child can change the child's status from illegitimate to recognized, although there are still social and legal challenges that must be addressed. This research underscores the importance of more comprehensive regulations regarding the acknowledgment of illegitimate children to protect their rights within the Indonesian legal system.

Abstract

Unresolved domestic problems often lead to divorce lawsuits, including due to domestic violence. This study analyzes Decision Number 126/Pdt.G/2024/PA.Sda which states that divorce lawsuits cannot be accepted even though there are strong indications of domestic violence. This study uses a normative legal method with a statute approach, conceptual approach, and case approach. The results of the study show that the panel of judges was incorrect in interpreting domestic violence only as physical violence, even though psychological violence has been proven to be real. This inappropriate decision creates injustice for victims of domestic violence who should receive legal protection.

Abstract

Incidents of unlawful transfer of inheritance rights still frequently occur in Indonesian societal practices. Although the inheritance law system has clearly regulated the mechanism for the transfer of inherited assets, in reality there are still many cases where certain parties attempt to control inheritance through illegal means. The method used in this writing is a normative juridical research method. Analysis of Supreme Court Decision Number 464 K/Pdt/2020 shows that the Panel of Judges was correct in qualifying the unilateral transfer of inheritance land certificates as unlawful acts based on Article 1365 of the Civil Code, but the decision still has weaknesses in providing clarity regarding proportional inheritance distribution mechanisms between adopted children and wives, and does not deeply consider the characteristics of the disputed inheritance property.

Abstract

Child adoption serves as an alternative for couples who have not been blessed with children; however, it raises legal issues, paticularly regarding the inheritance rights of adopted children. Under civil law, adopted children are entiled to inheritance rights equivalent to those of biological children,in contrast, islamic law does not grant adopted children direct inheritance rights;instead, they may recive inheritance through a wasiat wajibah (mandatory will). This disrepancy creates legal uncertaintly in juridical practice, as reflected in the palangkaraya Distric Court Decision No. 27/Pdt.G/2019/PN.PLK. This study employs a normative legal research method with descriptive analytical approach and Comparative legal. The findings reveal that although adopted children do not have automatic inheritance rights under either legal system, islamic law provides protection through the wasiat wajibah mechanism (up to one-third of the estate), while civil law relies on will and grants.
