Abstract

Rigid and non-flexible laws will lead to complex conflicts. So that a legal system is needed whose existence can be accepted by the community. This research focuses on how Islamic Law is positioned in the perspective of Indonesian national law as well as how the application of Islamic Law in Indonesia. This research uses normative juridical approach methods by conducting a comprehensive review of theories, concepts and laws and regulations to find answers to problems in research. Thus resulted in a conclusion that the position of Islamic Law in Indonesia has been in line with the philosophical-political, juridical, and sociological order. Although its implementation still finds obstacles, Islamic law has succeeded in contributing to the establishment of national law. This is evidenced by the formulation of Islamic Law into several products of Indonesian laws and regulations.

Abstract

The poisoning of Sergei Skripal in Britain by Russian military intelligence drew widespread condemnation from various countries in the world. This action violates state sovereignty and violates International Law because the assassination attempt uses chemical weapons, a nerve agent from the Soviet era named Novichok. Britain finally responded strongly by designating 23 Russian ambassadors as Persona Non-Grata, which was in accordance with the provisions of the 1961 Vienna Convention on Diplomatic Relations. Persona Non-Grata as the exclusive right of any State that can be used as a sanction if there is a violation of international law, although there may be arbitrary in its use because the Receiving State is not obliged to give a valid reason. Therefore, Persona Non-Grata in diplomatic law may be used as a warning or instrument of interruption for a diplomatic relationship that is considered incompatible. This paper will discuss the incident in the review of International Diplomatic and Consular Law.

Abstract

This case occurred between the United States (USA) and Nicaragua, where the problem between the two is a dispute that led to allegations of violations of international law, starting from the problems of domestic government that occurred in the Republic of Nicaragua. However, the United States is actively involved in these internal issues. Nicaragua considers that the interference by the United States further worsens the state of nicaragua's government and feels that the United States has committed actions contrary to the rules of international law. One of his interventions was when the U.S. took steps to stop economic aid to Nicaragua because nicaragua had previously fought El Salvador, where El Salvador was known to have good diplomatic relations with the United States. Knowing this, the U.S. also made some kind of attack by sending its military on Nicaraguan territory and planting mines in the sea and inland sea of Nicaragua, causing ships to be damaged and even destroyed. The U.S. also conducted corporate civilian and military facilities in Nicaragua. Of course, this is very disturbing to Nicaragua, because it did not make any efforts against the Americans but came under attack for its case with El Salvador. The case was then reported to the ICJ who mediated and considered that the actions taken by the United States were wrong, because it was too into matters that did not include its jurisdiction to participate in the case.

Abstract

Liberalism is a basic principle embraced by the United States in all its policies including trade policy. This principle is also carried out by U.S. President Donald Trump in the form of orientation to bilateral agreements. When viewed from the trade relationship between Indonesia and the United States, the Generalized System of Preference or GSP facility is the only bilateral relationship that Indonesia can run with the United States. GSP is the U.S. policy of waiging import duties on the import of certain goods from developing countries in which case Indonesia is one of them. But it turns out that there is a policy of evaluating the implementation of GSP against Indonesia looking at the trade balance and Indonesia's economic policies that have an impact on the United States. The evaluation has the potential to reduce Indonesia's Bargaining Position in GSP facilities. If it comes to unexpected conditions it can harm Indonesia because of the increase in tariffs imposed on the export sector. The author intends to review the reevaluation policy in terms of international law.

Abstract

Trade liberalization is the removal or reduction of restrictions or barriers to the free exchange of goods between countries. On the other hand, the United States' protectionist policy on Chinese products led to a trade war between the two countries. The impact of the U.S.-China trade war has an impact on fluctuations in the value of JCI in Indonesia, so protectionist policies are needed in accordance with national and international legal instruments to stabilize the national investment climate and capitalize on the conditions of the U.S.-China trade war. In this essay, the author uses a statutory approach, a conceptual approach, and a historical approach, so that this research is classified as normative juridical research or also called doctrinal legal research.

Abstract

The law of the sea is very instrumental in limiting the areas of sea, land, and waters of a country. The sea is a road that is very often used to connect one country with other countries for trade and even for the benefit of others. On the other hand, the existence of international sea law protects natural resources from being misused. The International Court of Justice resolves disputes between member states. It also provides opinions or advice to official bodies and specialized agencies established by the United Nations. In the performance of its duties, the International Court of Justice refers to international conventions to establish cases recognized by the states in dispute. The ICJ is also guided by international customs that are evidence of general practice.

Abstract

The right to work is an inseparable human right because every human being and everyone has the right to participate in, contribute and enjoy economic, social, cultural and political development, where all fundamental human rights and freedoms can be fully realized, as stated in the 1986 Un Declaration on the Right to Development. This provision also overshadows the interests of the Disabled. People with disabilities in Indonesia until now are still very difficult in finding a job and carrying out work. In this paper, the author seeks to analyze the employment standards for people with disabilities internationally in Indonesia's positive law and explain the conditions of application and supervision based on the phenomena that occur.

Abstract

The problem in the implementation of education is a serious problem, where errors that can be concluded in education problems will cause internal damage to the nation that can be monitored through HDI (Human Development Index). But the problem is the existence of an elderly society productive school but does not have a level of education or homelessness education. In this paper, the author initiated Legal Soft Skills Certification as a form of implementation of the Article 31 paragraph 2 and Article 28 C paragraph 1 of the Indonesia Constitution and its amendments. In order to emerge an alternative path for homeless people to regain their right to self-development through basic needs, get education and benefit from science and technology to improve their quality of life.

Abstract

A Code of ethics is needed in the world of the profession as an effort to realize the implementation of guidelines or behavioral guidance that can maintain the honor of a profession. The code of ethics of the profession can develop into a culture in society. In Indonesia, the professional code of ethics is bound by regulation in accordance with the profession itself, including one of which is the code of ethics and behavior of the Prosecutor contained in the Attorney General's Regulation of the Republic of Indonesia Number PER-014/A/JA/11/2012 concerning the Prosecutor's Code of Conduct. The Prosecutor's Code of Conduct is a set of norms of the description of the Prosecutor's Code of Ethics, as a guideline of priority that regulates the behavior of prosecutors both in carrying out their professional duties, maintaining the honor and dignity of their profession and in conducting community relations outside the ministry. Like the code of ethics in general, the prosecutorial profession's code of ethics aims to prevent the occurrence of office crimes. But on the ground level, efforts to realize the prosecutor's professional code of ethics experience several obstacles including cases related to crime or abuse of office by certain prosecutors. In addition to normatively, the position of the prosecutor is not strictly regulated in the constitution, also because the organizational structure of the Prosecutor of the Republic of Indonesia itself is within the government environment. So it is not surprising that it becomes a loophole for prosecutors to commit professional crimes such as corruption. Then the solution that can be offered is to establish a mechanism of supervision of the prosecutor's profession called the Prosecutor's Commission which has a role such as the Judicial Commission that oversees the profession of judges. Restructuring is needed for the performance of the Indonesian Prosecutor's Commission with the supervision of behavior and performance, in addition to providing rewards to outstanding Prosecutors.

Abstract

Corruption is a particular crime that provides losses, especially to the country's finances. Corruption itself can occur in various sectors both public and private. Due to the consequences of corruption that provide large scale, there is an urgency for the return of state finances from the results of corruption. In the public sector, it can be done to counter corruption by doing a reverse proof or what is referred to as Omkering van het Bewijslast or Reversal Burden of Proof because of the nature of corruption itself that is systematic and difficult to sniff by law enforcement. While in the private sector, one of the things that can be done is to utilize the institution Stolen Asset Recovery (StAR) which is the result of cooperation between the World Bank and UNODC with developing countries to prevent the laundering of corruption, with Mutual Legal Assistance as its upstream. In addition, private in the domestic sector can take advantage of the role of whistleblowers who will report on alleged criminal acts of corruption in the private sector. In general, to suppress or minimize the possibility of criminal acts of corruption can be used preventive-moralistic measures such as preparing a government order based on Good Governance. While further strengthened by repressive-proactive measures by optimizing the use of the Corruption Act and the Money Laundering Act as downstream from handling corruption in Indonesia.
