Abstract

This study explores the legal protection received by undocumented Indonesian migrant workers, based on the 1990 UN Convention and the concept of state responsibility. The method used is a normative legal analysis with an approach to relevant laws and concepts. The research findings indicate that the 1990 UN Convention guarantees the fundamental rights of migrant workers through the principle of non-discrimination, but its protection remains quite limited due to weak law enforcement mechanisms and low levels of ratification by states. In addition, the protection provided by states faces challenges in the form of a lack of consular support and legal recognition in destination countries. Strengthening regulations at the national level, interstate diplomacy and increasing the effectiveness of consular.

Abstract

This study analyzes the role of the state in fulfilling gender-equal educational rights in Indonesia within the framework of the Sustainable Development Goals (SDGs), particularly the goals of quality education and gender equality. This research employs a normative juridical approach by examining statutory regulations, education policies and supporting empirical data related to educational access and protection. The novelty of this study lies in its analysis of the gap between formal legal guarantees and the achievement of substantive gender justice in education. The findings show that Indonesia has established an adequate legal foundation to guarantee the right to education without discrimination; however, its implementation remains ineffective in several aspects. Disparities are still evident in access to higher education, women’s participation in STEM fields, protection from gender-based violence in educational settings and educational accessibility for women in remote areas and vulnerable groups. The main barriers are not limited to regulatory issues but also include patriarchal culture, geographical inequality, economic constraints, limited gender-responsive curricula and weak institutional capacity. This study emphasizes that fulfilling gender-equal educational rights requires stronger legal enforcement, affirmative policies, preventive and repressive protection mechanisms and sustained social transformation to achieve the SDGs in a more inclusive and substantive manner

Abstract

Significant developments in legal protection for illegitimate children occurred following the issuance of Constitutional Court Decision No. 46/PUU-VIII/2010. This decision opened the way for the recognition of legal relations between illegitimate children and their biological fathers, provided that this can be proven through scientific and technological approaches and legally valid evidence. Using normative research methods with statutory, case-based and conceptual approaches, this study analyzes the implications of this decision on the inheritance rights of illegitimate children under the Civil Code. The results indicate that legal protection for children born out of wedlock in inheritance is realized through two main instruments: preventive legal protection and repressive legal protection. Although the Constitutional Court Decision opened access to civil relations between illegitimate children and their biological fathers, Article 863 of the Civil Code, which limits the inheritance portion of illegitimate children, has not been amended, thus structural discrimination persists.

Abstract

This research aims to determine the form of legal protection for women as victims of the dissemination of immoral content and to determine whether existing regulations are effective in restoring victims' conditions. This research uses a normative legal research method that focuses on reviewing and analyzing regulations related to the title. The results of this research reveal that existing regulations are still insufficient to provide protection and recovery for victims because they still focus on punishing perpetrators, ignoring the victims' interests. Therefore, regulatory updates are needed that focus on the interests of victims, so that protection in terms of victim recovery can be implemented effectively.

Abstract

Education is a fundamental right of children as guaranteed by the United Nations Convention on the Rights of the Child (CRC) of 1989 and various national regulations in both Indonesia and Thailand. Although both countries have established legal frameworks governing the protection of children's rights in the education sector, their implementation continues to face significant challenges. This study employs a socio-legal method with a comparative approach between Indonesia and Thailand, supported by literature review, field observations, and in-depth interviews. The data were analyzed qualitatively to identify the conformity between legal norms and the actual practices of child protection within educational environments. The findings reveal that both countries share a commitment to ensuring children's right to education; however, differences exist in the implementation of policies. Thailand demonstrates a more effective implementation through the provision of free education up to upper secondary level and a more integrated educational quality assurance system. In contrast, Indonesia continues to face challenges related to disparities in educational quality, limitations in supporting facilities, and suboptimal supervision of child protection within schools. The study concludes that the effectiveness of child rights protection in the education sector depends not only on the existence of legal regulations but also on the consistency of policy implementation, the quality of educational resources, and sustainable monitoring mechanisms. Therefore, strengthening institutional coordination, enhancing teacher capacity, and developing bilateral cooperation are necessary to support the fulfillment of children's rights to safe, inclusive, and quality education.

Abstract

The development of the electronic repair industry has raised legal issues regarding the use of refurbished spare parts containing original trademarks. This study analyzes trademark protection on refurbished spare parts through the case of Apple Inc. v. Henrik Huseby and its relation to the right to repair concept. The study finds that trademark protection is limited by the exhaustion of rights principle, yet the use of refurbished components may still constitute trademark infringement when it creates misleading impressions and consumer confusion. Therefore, trademark protection should be applied proportionally by considering consumer rights, transparency and sustainable repair practices.

Abstract

Dirty Vote, directed by Dandhy Dwi Laksono before the 2024 Indonesian election, became a significant alternative media phenomenon with millions of viewers within one day. This study examines representations of structural human rights violations in the documentary using constitutionalism, Thomas Pogge’s structural human rights theory and Habermas’s public sphere framework. The research applies qualitative methods through Fairclough’s critical discourse analysis, Pan and Kosicki’s framing model and Peirce’s semiotics. The findings reveal allegations of regulatory manipulation, bureaucratic politicization, misuse of social assistance funds and state apparatus mobilization that undermine popular sovereignty and simultaneously function as alternative public oversight mechanisms for democracy. These findings indicate that the film functions not only as a cultural product but also as an instrument of political criticism that expands public participation in monitoring the democratic process.

Abstract

This study aims to analyze criminal law enforcement against gambling practices in Sukoharjo Regency in accordance with the National Criminal Code. Gambling is a crime that is prevalent in society, both conventionally and digitally. The research was conducted empirically using a legislative and sociological approach. It utilized literature studies, laws and data on gambling handling at the Sukoharjo Police Department. The study's findings indicate that criminal law enforcement against gambling in Sukoharjo Regency is implemented through repressive and preventive measures, despite facing various obstacles such as low public legal awareness and inadequate oversight of technology-based gambling practices. This requires intensive enforcement operations, inter-agency coordination and community participation.

Abstract

Pancasila, as the state ideology, embodies the value of justice, which serves as the foundation for the formation and enforcement of law in Indonesia. However, its implementation still faces various problems, such as legal inequality, low integrity of officials, and weak protection of the poor. The method used is normative legal research with a philosophical and conceptual approach. The results show that Pancasila justice has a unique character because it integrates humanitarian values, balance between rights and obligations, social justice, and moral and spiritual dimensions. Analysis of the theories of justice of Aristotle and John Rawls shows that Pancasila justice is oriented not only toward the distribution of rights and protection of vulnerable groups, but also toward harmony between the interests of individuals and society. This research also found a gap between the values of Pancasila justice and law enforcement practices, which still face issues of unequal legal treatment, corruption, and limited access to justice.

Abstract

The escalation of the US-Iran conflict since February 2026 has made the Strait of Hormuz a center of international maritime law dispute. This normative legal research employs statute, case and conceptual approaches to analyze both states' violations of international law and the failure of enforcement mechanisms. The findings indicate that Iran's actions contravene UNCLOS norms—partially recognized as international customary law—including discriminatory navigation practices and restrictions on transit passage rights. Meanwhile, the United States violates Article 2(4) and Article 51 of the UN Charter through unilateral blockade without UN Security Council mandate and misuse of self-defense rights. International law enforcement fails due to ITLOS jurisdiction limitations and UN Security Council deadlock caused by the veto power. This condition creates a legal vacuum that places power above law in international dispute resolution.
