Abstract

Developments in international law of the sea following the 2025 ICJ Advisory Opinion, the 2024 ITLOS Advisory Opinion and the 2023 BBNJ Agreement have prompted a fundamental shift in the concept of state sovereignty. This study examines the transformation of sovereignty in international law of the sea and its implications for Indonesia. Using a normative legal research method with treaty, conceptual and case approaches, the study finds that sovereignty is no longer understood as an exclusive right to exploit marine resources, but rather as a responsibility to protect the global environment through the implementation of stringent due diligence obligations, erga omnes commitments and collective governance mechanisms for areas beyond national jurisdiction. These developments necessitate the harmonization of Indonesia’s domestic legal framework following the ratification of the BBNJ Agreement through Presidential Regulation No. 67 of 2025.

Abstract

The development of information technology increases the risk of child grooming, which is the psychological manipulation of children for the purpose of sexual exploitation. This study analyzes the criminal law protection for child victims of child grooming and the legal certainty of this crime in Indonesia. The results show that legal protection for victims is regulated in the Child Protection Law, the TPKS Law, the ITE Law and the Criminal Code. However, the absence of specific regulations regarding child grooming makes it difficult to prove the element of psychological manipulation, multiple interpretations in the application of norms and less than optimal legal certainty for victims. Therefore, it is necessary to formulate child grooming as a special crime in the Child Protection Law to strengthen legal protection for children in cyberspace.

Abstract

The dualism of prosecution authority between the Attorney General's Office and the Military Oditurat creates a conflict of norms within the Indonesian criminal justice system. This normative legal research employs statutory and conceptual approaches to examine the construction of this conflict of norms and the urgency of the role of the Junior Attorney General for Military Crimes (Jampidmil). The findings indicate a contradiction between the single prosecution system principle adopted by the Law on the Attorney General's Office and the exclusive prosecution authority of the Oditurat based on the Law on Military Courts. This conflict impacts legal uncertainty and the fragmentation of law enforcement. Jampidmil serves as an instrument for coordination and harmonization; however, it has not been able to substantively eliminate the dualism of prosecution authority. Therefore, strengthening regulatory harmonization is required to ensure legal certainty in the prosecution practice of military criminal cases.

Abstract

The increasing involvement of states in international treaties creates tensions between international obligations and constitutional supremacy. Indonesia does not yet have a constitutional pre-ratification review mechanism, putting it at risk of both domestic unconstitutionality and international liability. In contrast, Hungary implements preventive review based on the 2011 Hungarian Constitution (Alaptörvény), supported by the 2011 CLI Law on the Constitutional Court, reflecting a fundamentally different constitutional design. Using normative legal research through comparative and conceptual approaches, this study finds that the existing ex post review model in Indonesia creates systemic vulnerabilities not present in Hungary's ex ante system. As a novelty, this study offers a three-tier adaptation model encompassing constitutional amendments, legislative revisions and progressive judicial interpretation to integrate constitutional pre-ratification review into the Indonesian legal system. The proposed model positions Pancasila as the staatsfundamentalnorm in the constitutional review of international treaties, an element not present in the Hungarian constitutional framework.

Abstract

The development of Artificial Intelligence (AI) has significantly enhanced the creation and dissemination of disinformation in international conflicts. The escalation of the 2026 Iran–U.S.–Israel conflict demonstrated the use of synthetic content, deepfakes and digital information manipulation as instruments of information warfare. This study aims to analyze the legal status of AI-based disinformation from the perspectives of cyber law and international criminal law. The research employs a normative legal method using statutory, conceptual and case approaches. The findings indicate that AI-based disinformation has not yet been recognized as a distinct criminal offense under international law. From a cyber law perspective, the use of AI to disseminate disinformation may be associated with cybercrime if it fulfills the elements of specific cyber offenses. Furthermore, international criminal law provides the possibility of liability when disinformation is used to support or facilitate the commission of international crimes within the jurisdiction of the Rome Statute.

Abstract

The crime of child molestation involving both perpetrators and victims raises issues regarding the balance of legal protection in the juvenile criminal justice system. This study aims to analyze the legal protection provisions for child perpetrators and victims in Indonesian positive law. The method used is normative legal research with a statutory and conceptual approach. The results of the study indicate that Law Number 11 of 2012 concerning the Juvenile Criminal Justice System places greater emphasis on protecting child perpetrators through diversion and guidance, while the provision of rehabilitation for child victims has not been comprehensively regulated. Therefore, it is necessary to strengthen the provisions for rehabilitation, psychological assistance and restitution for child victims, as well as the development of integrated implementation guidelines by law enforcement officials.

Abstract

Sexual crimes inflict prolonged physical, psychological and social impacts on victims. Indonesia's criminal law reform through the Law on Sexual Violence Crimes and the National Criminal Code (KUHP) demonstrates a paradigm shift toward victim protection through a victim-centered justice approach. This article analyzes the implementation of this paradigm in handling sexual crimes in Indonesia. The findings indicate that although the normative framework has accommodated the victims' interests and rights, judicial practices still face challenges in the form of secondary victimization. Furthermore, a gap remains between statutory regulations and their enforcement by law enforcement authorities in providing effective protection to victims. Therefore, it is necessary to formulate and implement standard operating procedures (SOPs) oriented toward victim protection and recovery at every stage of the criminal justice process.

Abstract

The Development Of Digital Technology Has Led To The Expansion Of Criminalization Through Law Number 1 Of 2024 Concerning The Second Amendment To Law Number 11 Of 2008 Concerning Electronic Information And Transactions (ITE Law). This Study Aims To Analyze The Potential For Overcriminalization In The Regulation Of Cybercrime Based On The Principle Of Ultimum Remedium. The Method Used Is Normative Legal Research With A Statutory And Conceptual Approach. The Results Indicate That Several Criminal Provisions In The ITE Law Have The Potential To Lead To Overcriminalization If Applied Broadly Without Clear Boundaries. Therefore, Law Enforcement Guidelines Are Needed That Prioritize A Non-Criminal Approach And Emphasize The Criteria For Proportional Criminalization.

Abstract

Analysis Of Judicial ' legal reasoning occurs between the Semarang Commercial Court Decision Number 5/Pdt.Sus-Pailit/2022/PN.Smg, which granted the bankruptcy petition against PT SM and the Supreme Court Decision Number 993K/Pdt.Sus-Pailit/2022, which annulled it on the grounds that no legally binding Industrial Relations Court (IRC) judgment had yet been issued. Using a normative-qualitative method, this study finds that the cassation decision creates legal uncertainty, as the Joint Agreement Number 01/PB-PT.SM/HRDGA/I/2022 had in fact satisfied the requirements for simple proof of debt under Article 2 paragraph (1) in conjunction with Article 8 paragraph (4) of the Bankruptcy Law, yet was deemed insufficient without the IRC prerequisite stipulated in SEMA 2/2019. This study recommends an amendment to the Bankruptcy Law that explicitly regulates bankruptcy proceedings against companies that fail to fulfill workers' rights.

Abstract

The Ministry of Finance issued Minister of Finance Regulation (PMK) Number 23 of 2026 which revises PMK Number 240 of 2016, and is effective from April 24, 2026.” The issuance of PMK Number 23 of 2026 as an amendment to the provisions for the management of state receivables shows the government's efforts to strengthen the effectiveness of the settlement of state receivables through the mechanism of “the State Receivables Affairs Committee (PUPN).” The focus of this research is the changes in PMK Number 23 of 2026. The research method used is normative juridical or legislative approach. The purpose of this study is to further analyze the legal changes in PMK Number 23 of 2026.
